Minutes 10-16-84MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEA"CH, FLORIDA, OCTOBER 16, 1984 PRESENT Carl Zimmerman, Mayor Robert Ferrell, Vice Mayor Nick Cassandra, Councilman James R. Warnke, Councilman Peter L. Cheney, City Manager Betty S. Boroni, City Clerk William Doney, Assistant City Attorney Mayor Zimmerman called the meeting to order at 7:30 P. M. He announced we will have the invocation given tonight by Rev. Nathaniel Sniffin, St. Joseph's Episcopal Church, and after that we will remain standing for the Pledge of Allegiance to the Flag led by Mr. Peter L. Cheney, City Manager. AGENDA APPROVAL Councilman Cassandra stated that he has two additions. Under Legal - Other, 9. Board of Adjustment. On Item G under Development Plans, he would like to discuss an item which was brought up by the Community Appearance Board. Mr. Cheney stated he would like to delete two items under Legal - Other, Items 1 and 2. Both of these had to do with the union contracts and both are being pulled from the agenda because both unions met last night and did not ratify the city's proposal. Councilman Cassandra moved to accept the agenda as corrected, seconded by Councilman Warnke. Motion carried 4-0. ANNOUNCEMENTS Mayor Zimmerman announced that the two story office building being proposed in the Publix Shopping Center is not on the agenda, but all those people present for this item are welcome to stay. Mr. Cheney added that this item has been postponed several times because this project has not received approval of the Community Appearance Board. Until receiving that approval, it will not be listed for con- sideration on the Council agenda. The applicants were con- tacted last week and they still were not prepared with the necessary information for the Community Appearance Board. They did arrive late last night for the Community Appearance Board meeting and it was reviewed by the Community Appearance Board, but it was not anticipated they would come. This will probably be on the agenda for the next City Council meeting on November 7. - 1 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Mayor Zimmerman announced the first City Council meeting in November will be on Wednesday, November 7, 1984, due to the General Election on Tuesday, November 6. Mayor Zimmerman read a proclamation proclaiming the week of October 21 through October 27, 1984, as Handicapped Awareness Week. The Mayor read a proclamation proclaiming the week of October 21-28, 1984, as Energy Awareness Week. Mayor Zimmerman read a proclamation proclaiming the week of November 12-17, 1984, as Boynton Woman's Club Diamond Jubilee Week. He then presented an original proclamation to Mrs. Zimmerman for the Woman's Club. Mr. Cheney announced the Boynton Beach American Association of Retired Persons (AARP) will sponsor a free Health Fair at the Boynton Beach Civic Center from 10:00 A.M. until 4:00 P.M. on Saturday, November 17, 1984. He told about this being a well attended and suffessful affair and added there is a lot of free and good advice. Mr. Cheney read a letter from the Town of Ocean Ridge dated October 3, 1984, complimenting on the splendid improvement made at the beachfront park and donating $500 for the purchase of a tree. Mayor Zimmerman replied that the Council will graciously accept this check and requested the City Clerk to send a letter of thanks. Mr. Frederick informed the Council that he spoke to the Mayor of Ocean Ridge and asked if he would like to have a specimen tree planted in the lower level parking lot at the beach. A Royal Poinciana Tree about 25 feet in height has been selected. With the Council's concurrence, he will proceed with that Planting. Councilman Warnke moved to send a letter of thank you to the Town of Ocean Ridge and possibly a small plaque can be put on the building stating that tree was donated. Also in the letter, possibly a remark can be included that we have had strife in the past, but are glad for this mutual cooperation and being good neighbors now. Councilman Cassandra seconded the motion and it carried 4-0. MINUTES Regular City Council Meeting Minutes of October 3, 1984 Vice Mayor Ferrell made a motion to accept these minutes as presented, seconded by Councilman Warnke. Motion carried 4-0. - 2 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Special City Council Meeting Minutes of October 9, 1984 Councilman Warnke moved to accept these minutes, seconded by Vice Mayor Ferrell. Motion carried 3-0 with Councilman Cassandra abstaining since he was not present. CITY MANAGER'S REPORT Agenda Preparation & Availability Mr. Cheney referred to the question about the item at the Leisureville Shopping Center being on the agenda and informed the audience by late Friday afternoon, the agenda is completed for the forthcoming City Council meeting. If people are concerned, they can call late Friday, Monday or Tuesday. Also, copies of the agenda are available to the public. Certificate of Conformance Awarded to Finance Dept. Mr. Cheney reported that the city through the Finance Department received an annual certificate of conformance relative to the financial report system in the city. He explained this means our financial reports meet nationwide standards and our reports have been found to be in compliance. It represents a tremendous amount of work and professional skill in the Finance Department. It does much for the reputation of the city and has a financial impact when in the market for bonds. Central Business District Ordinance & Guidelines Mr. Cheney referred to distributing a document from the Community Redevelopment Agency entitled the Central Business District Ordinance & Guidelines and explained how this would direct and be a special zoning ordinance for the downtown area. This is consistent with the understandinq the Community Redevelopment Agency and the city hav~ had in reference to development guidelines. All the procedures will have to be reviewed like an amendment to the zoning ordinance. He suggests that the Council review this prior to forwarding to the Planning & Zoning Board. In reference to the staff, Mr. Annunziato has worked with Urban Design Studios in preparing this, but the staff has not reviewed nor commented on it. Turnpike Interchange Mr. Cheney stated that tomorrow night at 5:00 P. M., the Chamber of Commerce will be holding a press conference at - 3 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 the Holiday Inn in reference to the receipt of a report from the engineers concerning an interchange on the Florida Turnpike at Boynton Beach Boulevard. $20,000 was contri- buted by the county and $17,500 from the business community for studying whether it is feasible and cost effective to have an interchange. The report has been received and the results will be announced tomorrow at the press conference. PUBLIC AUDIENCE Proposed Two Story Office Building in Publix Shopping Center Mr. Ron Reeves thanked the Mayor for bringing up this item at the beginning of the meeting and requested those people in opposition to stand. He stated he hopes to have the same show at the next meeting. Councilman Cassandra suggested that he call the City Clerk or obtain an agenda. Mr. Reeves advised that he was called about it not being on the agenda, but was not able to notify everybody. Proposed Rezoning at Congress & 23rd Avenues Mr. Peter Mooij, Golfview Harbour, referred to the Milnor Corporation withdrawing their application for rezoning at Congress & 23rd Avenues at the last Planning & Zoning Board meeting and stated they were very pleased about that. However, a lot of people did a lot of work and stated he wants to take this opportunity to publicly thank everyone in the city as well as the petitioners. Over 400 homeowners representing Leisureville, Estates of Silver Lake and Golfview Harbour have signed petitions in opposition to this rezoning. He would like to submit these petitions as a matter of record, so it is on record that a group was pre- pared to oppose this rezoning. Mayor Zimmerman replied that he didn't believe it was necessary since the item was withdrawn. He congratulated them for having an actively participating group in that area of the city. Councilman Cassandra suggested accepting the petition just on the supposition it may be put back on the agenda two weeks from now, so it is on record. Councilman Cassandra asked if there was any time duration on requests of rezoning and Mr. Cheney replied this was withdrawn, so there is no limit. Mr. Annunziato advised there is a one year limit to re-applying stated in the code. - 4 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Chambers Sound System Mr. Lowell Bennett, Leisureville, stated every time he has attended a City Council meeting, the sound system is deplorable. He suggests that the system either be repaired or replaced, so those who have enough civic interest and show up can hear. Mayor Zimmerman apologized for the system not operating properly. Councilman Warnke commented that the system picks up CB transmissions and has static and he thinks a long look should be taken at this sound system and it should either be repaired or replaced. He hopes the Council agrees to have the City Manager look into this matter. Councilman Cassandra suggested that it be checked two hours before a meeting and Mr. Cheney advised that it worked at 4:30 P. M. this afternoon when he tested it. Unpleasant Beach Situation Mr. Patrick Stafford, Colonial Club, told about a disturbing experience at the oceanfront park with young adults climbing on the rail, falling into the seaoats, shouting obscenities, etc. at the north end on Sunday evening. Mayor Zimmerman informed him that Ocean Ridge Police Department is right across the street and this is in their jurisdiction. CONSENT AGENDA A. Bids Golf Course Clubhouse Furniture - Golf Course Mr. Cheney submitted a summary and analysis of the clubhouse furniture bid and advised this is the equipment we are planning to buy for $22,336. We anticipate spending another $4,000 to $5,000 on interior decorations. B. Resolutions NONE Approve request from Palm Beach Lei~ureville Community Association, Inc. to erect six temporary signs for their Annual Bazaar This request was outlined in a letter dated October 3, 1984, from the Palm Beach Leisureville Community Association. D. List of Payments - Month of September, 1984 See list attached. - 5 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Eo Approve request from Mr. Glenn Rogers, W. E. Rogers & Son, Inc., for permission to place an office and storage trailer on their property located at 301 S.E. 4th Street in conjunction with the construction of the Halsey & Griffith project In accordance with Chapter 25, Section 25.7 of the City of Boynton Beach Codes of Ordinance, the Building Department recommends approval. Approve request for refund on Cemetery Lots 644A & B and 645A, Block N Mildred Brann and Eugene Schlatt submitted this request. Ratification of the contract between South Central Regional Wastewater Treatment & Disposal Board and Certified Welding Engineers, Inc. The contract book was submitted for review and ratification. Approve request for zoning approval for alcoholic bever- age licenses: Blossom Shoppe Florist, Inc. 211 N. Seacrest Blvd. Boynton Beach, FL Marilyn's 2610 N. Federal Hwy Boynton Beach, FL The Deputy Building Official noted zoning for the above addresses permits the sale of beer, wine and liquor for con- sumption off premises. Approve request from Mr. Jeffrey Cathcart, Project Engineer for the Cherry Hills road improvement project, representing Campanella Corporation, for permission to place an office trailer on Parcels 7, 8, and 9 on S.W. 13th Avenue In accordance with Chapter 25, Section 25.7 of the City of Boynton Beach Codes of Ordinance, the Building Department recommends approval. J. Approval of Bills See list attached. Councilman Cassandra moved to accept Items A, B, C, D, E, F, G, H, I, and J. Councilman Warnke seconded the motion. - 6 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Under discussion, Mayor Zimmerman referred to the signatures not appearing on Item J and Mr. Cheney replied that neither he nor Mr. Swann were here on Friday, but these have been reviewed and will be signed. Motion carried 4-0. BIDS NONE PUBLIC HEARING NONE DEVELOPMENT PLANS Consider request for Annexation, Land Use Element Amendment and Rezoning - Edward I. Singer Mr. Cheney recommended this item be postponed until the next meeting because the attorney representing the applicant could not be present. Approve request by Alan Ciklin for Great Universal Development - Florida, Inc. to modify the preliminary plat for Quail Lake West by changing S.W. 26th Street from a public street to a private street. Quail Lake West is located west of Congress Avenue between Woolbright Road and Golf Road Mr. Cheney recommended this be postponed until the next meeting because the applicant has indicated he would like to have more time to respond to the Planning & Zoning Board's action which recommended denial. Approve request for preliminary plat approval for Northwoods at Hunters Run, Addition 91, located at Tract E - Hunters Run Golf & Racquet Club. This request provides for infrastructure improvements related to the construction of 18 single family detached homes on 9.79 acres consistent with a previously approved master plan and was submitted by Charles Gilbert for Summit Associates, Ltd. Mr. Annunziato explained the location. He advised this plat went to the Planning & Zoning Board with a positive recom- mendation subject to staff comments. The Planning & Zoning Board unanimously recommended approval of this request sub- ject to staff comments. Councilman Warnke moved to approve this request for prelimi- nary plat approval for Northwoods at Hunters Run, Addition - 7 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 #1, located at Tract E - Hunters Run Golf & Racquet Club. Vice Mayor Ferrell seconded the motion. No discussion. Motion carried 4-0. Approve request for site plan approval for Northwoods at Hunters Run, Addition 1, to construct 18 single family detached dwelling units on 9.79 acres at Tract E of Hunters Run Golf & Racquet Club. This request was submitted by Charles Gilbert for Summit Associates, Ltd. Mr. Annunziato showed the site plan and explained it was to construct the 18 units approved in the preliminary plat. The request went to the Planning & Zoning Board with a posi- tive recommendation subject to staff comments. The Planning & Zoning Board recommended approval with the comments. It was also reviewed by the Community Appearance Board and approved. Councilman Warnke moved approval of the site plan for Northwoods at Hunters Run, Addition 1. Vice Mayor Ferrell seconded the motion. No discussion. Motion carried 4-0. Approve request to modify the site plan for LaNotte Restaurant at 2280 N. Federal Highway by bringing the building into compliance with the code requirements and to make improvements to the east side of the building. This request was submitted by Regis Moreau for PL&G Enterprises Mr. Annunziato pointed out the changes proposed by the new operator. He stated they also plan to bring the site into conformance with zoning regulations and all the code violations have been corrected or removed. This went to the Planning & Zoning Board with a positive recommendation from the staff subject to comments. The Planning & Zoning Board recommended approval, including the addition of a satellite dish antenna, which he understands has been removed. It was subsequently approved by the Community Appearance Board. Mr. William Osborn, Architect representing The Shooters stated as Mr. Annunziato mentioned, all violations have been taken care of with the exception of the storage building, which is being demolished now. They have no connection with the previous owners. Councilman Warnke asked if they planned to have outside amplified music and Mr. Osborn replied he could not answer that. Mr. Cheney stated he believes they do plan to have outside music, but believes they plan to build a barrier to contain it. - 8 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Mr. Cheney referred to receiving some suggestions that the operators of The Shooters were in some way tied in with the operators of LaNotte or one in the same. He addressed this to the operators of The Shooters and has a letter on file indicating that in no way in the past or future will The Shooters be involved with the exception of leasing and purchasing this property. Also, he told about the represen- tatives from The Shooters correcting the violations. He thinks they plan to put the satellite dish antenna back up after obtaining a permit. Vice Mayor Ferrell made a motion to approve this site plan for LaNotte Restaurant. Councilman Cassandra seconded the motion. No discussion. Motion carried 4-0. Approve request to modify the St. Mark's Catholic Church site plan by paving the area immediately in front of the church entry at 733 N.E. 4th Avenue. This request was sub- mitted by Richard SanGiovanni for Archbishop Edward McCarthy Mr. Annunziato explained the applicant is requesting to be allowed to construct in front of the church a dropoff area which will connect the parking areas in front of the church. This was reviewed by the Technical Review Board with the recommendation to approve as submitted. The Planning & Zoning Board forwarded the same recommendation. There are no questions regarding the moratorium variances as no addi- tional permits are required for this construction. Councilman Cassandra moved to accept the unanimous recommen- dation of the Planning & Zoning Board for St. Mark's Catholic Church site plan modification. Vice Mayor Ferrell seconded and the motion carried 4-0. Approve request to modify the site plan for Buildings D, E and F at the Boynton Commercenter, 1600-2200 Corporate Drive. This request was submitted by Fred Popper for Boynton Commerce Center. Mr. Annunziato read the four changes noted by the applicant and explained. This went to the Planning & Zoning Board subject to a list of comments. It is recommended by the Planning & Zoning Board for approval with the comments. The Community Appearance Board reviewed this and there was some discussion regarding the landscaping and buffer strip to the east of the E-4 canal, but they did approve. Councilman Cassandra stated his concern is for the Leisureville people who raised the question last night - 9 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 regarding the landscaping berm of the area and the screening effect that they were kind of promised in 1978. A new owner is not responsible for what a previous owner said. This raises a strong concern as far as residents around any construction to make sure sands and dirt of residue of construction are not a burden to the residents. He referred to problems in other areas and stated he thinks Boynton Commercenter should make a strong effort to satisfy people along the E-4 Canal so they get 75% screening that they thought they were going to get from the original owner. Also, the berm should be cleaned up. There is no reason why landscaping cannot be done while construction is underway. He thinks the developer should be told to take care of this. Councilman Warnke referred to the last item of putting in a loading dock with a depression and pointed out there was a staff comment because a well is within 100 feet of this area, there may be danger of pollution and a DER permit should be obtained. He cannot see voting for an item con- tingent upon a D~ER permit. He would rather see them come back after securing a DER permit. Mr. Annunziato replied that he doesn't believe a DER permit is required for this construction. He believes it was the feeling of the Technical Review Board there may be concern and it should be addressed by DER to see if there is jurisdiction. It is not located within the easement set aside when the wells were developed. Councilman Warnke asked how we protected our well site from possible pollution and Mr. Annunziato replied that the drainage plans prepared for that dock show storm water will not be directed anywhere near the wells. After a lengthy discussion regarding the possible problem of pollu- tion to the well site and corrective action, Mr. Fred Popper advised that it came to his attention today that this item is to be removed from the list; the dock will not be done. Councilman ~assandra referred to the concern regarding lack of landscaping and stated he would like to see screening and a berm area created quickly to satisfy the concerns of Leisureville residents. Mr. Popper replied that he spoke with the developer today and they are going to proceed with the landscap~ drawing for approval. Mayor Zimmerman questioned the time element and Mr. Popper replied he would like at least a month. Mr. Cheney explained that the landscaping plan in effect has been approved by the Community Appearance Board and could be followed for compliance. Mr. Popper continued with stating the landscaping has not been done in the buffer zone because the paving has not been done on that piece of property. As soon as the paving is completed, they will finish the landscaping. Councilman - 10 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Cassandra again referred to expediting the planting and Mr. Popper stated the paving will start at the end of this week. Councilman Warnke moved to approve the proposed changes to Boynton Commercenter for Buildings D, E and F, and delete Item 4 with the depressed loading driveway to the loading dock. Vice Mayor Ferrell seconded the motion. No discussion. Motion carried 4-0. Approve request for determination of no substantial change resulting from the addition of a child care center to the list of permitted uses at the Boynton Lakes Planned Unit Development. Mr. Annunziato stated this item came to the City Council approximately two months ago, but was subsequently withdrawn by the applicant. This is a request for a finding of no substantial change in connection with a day care center at Boynton Lakes. The comments previously concerned the matter of use and whether this is a business. The applicant has resubmitted with a different understanding. He is willing to accept the T.R.B. recommendation that preference be given to the residents of this PUD. They think in a short period of time, the use will be serving almost exclusively the pro- ject residents since this will consist of over 1,000 units. He pointed out the location of this center. The technical staff recommends finding of no substantial change be made as long as preference is given to residents of the PUD. Councilman Cassandra referred to having voted on this and denying it and stated the applicant did not withdraw. Mr. Annunziato clarified that it was withdrawn by letter after the meeting. The Council made a finding of no substantial change with the proviso that the use be exclusively for the residents of the PUD. Before the Planning & Zoning Board was able to act upon this request, the application was withdrawn. Councilman Cassandra stated this just seems to be the change of the word exclusively to preference and he sees no change. It is true it is internal, but it is the same location. Attorney Roger Saberson, representing the applicant, clarified that the company does have every intention of serving the people in the development to the intent that there is a demand for that service. He feels eventually they will be serving the people in the development. If the Council feels this is an appropriate use, he respectfully requests that it be done in the nature of preference. There is no child care company who will put in a building to serve just this one area. - 11 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Vice Mayor Ferrell stated he feels there is a difference when having a child care center in a development and opening it to outside people. He would look at this as a substan- tial change. Mr. Saberson replied that depends upon the judgment the Council would make to what extent and how many people in the development will be served. It is contained within the development and designed to serve the people in the development. Even with 1,000 units, it is likely some slots may go to outside the development. Mayor Zimmerman questioned if the deed restrictions covered this and Mr. Doney replied that he had not reviewed these lately. Vice Mayor Ferrell asked if this is a conditional use and Mr. Annunziato replied negatively and Mayor Zimmerman added that it is a permitted use with our appro- val. Mr. Saberson referred to commercial uses being approved in PUD zoning and stated none had the requirement to exclusi- vely serve the people in that development. Councilman Cassandra told about expressing concern with commercial use in the PUD on Hypoluxo Road. Mr. Saberson pointed out this would be located within the interior of the development, but requested that the imposition not be made to serve people only from that development. Councilman Cassandra asked if construction would be completed before the PUD development is completed and Mr. Saberson informed him they intend to build before all the units in the development are occupied. There was discussion about the number of residences built andMr. Saberson explained how applications would be taken from the residents and slots in the school allotted on an annual basis. Councilman Cassandra stated he is not very receptive to this request. He thinks it is a substantial change and he is not conducive to the word preference. After further discussion, Councilman Warnke made a motion to make a determination of no substantial change. The Mayor ascertained there was no second to this motion. Vice Mayor Ferrell made a motion to find this is a substan- tial change. Mr. Annunziato clarified that with finding of a substantial change, the applicant can come back with a rezoning application or not pursue further. Councilman Cassandra seconded the motion and it carried 4-0. Vice Mayor Ferrell referred to a gentleman being present from the V.F.W. and having attended several times for this - 12- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 purpose and made a motion to change the order of business to consider their item. Councilman Warnke seconded and the motion carried 4-0. ADMINISTRATIVE Consider request from Veterans of Foreign Wars Post 5335 dated July 2, 1984 (Tabled) Councilman Cassandra moved to remove from the table, seconded by Vice Mayor Ferrell. Motion carried 4-0. Mr. Gerald Mitchell, Post Commander of Boynton/Lantana Post 5335 and Chaplain of the Third District of V.F.W., stated it is the desire of the Post to place this bronze plaque as a tribute to a retired City Council member in the Boynton Beach Bicentennial Park. He told about this member's record, beliefs, etc. and stated they would be grateful if the Council would bestow upon them the opportunity to place this plaque in the Bicentennial Park on Federal Highway in honor of our public servant, Joe deLong. Councilman Warnke moved to approve this request on the con- dition that we are invited to the dedication. Commander Mitchell replied that for all the Council has done for them, they will send invitations embossed with gold. Vice Mayor Ferrell then seconded the motion. Under discussion, Councilman Cassandra questioned the location and Mr. Mitchell replied they wanted the Council to allocate the spot in the park and they will go forth and build the foun- dation for it and meet with the approval of whomever is responsible. Councilman Cassandra referred to meeting the ordinance requirements and Mr. Cheney replied this is a pla- que being mounted on a base. He added he would like the Council to make suggestions for the location of this plaque in the park. Councilman Cassandra questioned if this park would be relocated and Mr. Cheney replied that this park is permanent. Mayor Zimmerman stated this could be decided at a later date. He added it would have been nice if former Mayor deLong could have been here and Mr. Mitchell advised him that it was impossible for Mr. deLong to be here and they are waiting until he is able to be present for the unveiling of this plaque. Motion carried 4-0. Councilman Cassandra moved to revert back to the regular order of business, seconded by Councilman Warnke. Resolutions Proposed Resolution No. 84-ZZZ - Re: Adopting 1984/85 Pay Plan Mr. Doney read proposed Resolution No. 84-ZZZ by title: A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, ADOPTING PAY PLAN FOR FISCAL YEAR 1984/85 AND ESTABLISHING JOB DESCRIPTIONS FOR CERTAIN MUNICIPAL POSTS Councilman Cassandra stated he believes discussion is in order since this was just received. Mr. Cheney agreed the package is big, but mostly covers job descriptions which we discussed. There have been some job descriptions changed, grade changes and some new descriptions, which were all part of the budget. The main part of this resolution addresses the employees' benefits in the city as they are recommended - 17 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 to be amended for the coming year. of the resolution: He then read section 1 "That the municipal employees' Pay Plans A and B attached hereto are hereby adopted, ratified and approved for all City employees with the exception of the bargaining members of the Police and Fire Departments. Plan A is an approximate 4% increase over the present pay plan and will be effective retroactive to October 4, 1984, and Plan B, an additional 2% increase over Plan A, will be effective June 6, 1985. Pay Plans A and B include a L-6 Step as an addition to previous pay plans." Mr. Cheney stated this is his proposal for adjustment to the city pay plan for the coming year. It was also under discussion for employees for this coming year as benefits to have an additional holiday in January known as Martin Luther King, Jr. Day and second, the addition of a dental plan for city employees, which we hope would be in effect around January 1985. That particular plan calls for obtaining pro- posals from many insurance companies. The proposal is the city would pay the total cost of the employees' share of the dental plan and $7 of the family portion of the dental plan for those who desire to join. The dental plan has been talked about for many years and is becoming more prevalent. He explained how it is an incentive to employees for taking care of their teeth. These proposals are funded within the approved budget. Mr. Cheney continued that as he indicated earlier this evening, he deleted from the agenda the two matters of pay adjustments for the Police and Fire Departments. Both of those departments have been negotiating with him for some time. Both departments had a meeting last evening and rejected his proposal for a contract settlement for the coming year. They continue to work under the present contract extended. He assumes they will want to meet again. The indication is they will be asking to meet again and we will continue to negotiate to see if we can find a resolu- tion for the current situation where we can get together with the union in some way. He did have a counter offer from the Police Department today and he indicated he could not accept nor recommend, but would tell the Council what it was. Their counter offer was somewhat different than their offer yesterday, which was to receive 4% adjustment effec- tive this month and an additional 3% adjustment effective in June; he previously offered 2%. Today, the counter offer was they would like a 10% adjustment for the coming year. - 18- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 He suggested that was not particularly responsive to what we had been talking about and would not recommend it this year because the money is not available. Councilman Cassandra moved to accept Resolution No. 84-ZZZ adopting the 1984/85 pay plan for city employees excluding the union police and fire members. Councilman Warnke seconded the motion. Other Ratification of Police Union Contract DELETED Ratification of Fire Union Contract DELETED Approve contract for Beach Cleaning Services with Universal Beach Services Corp. Mr. Cheney informed the Council the scope of services are well defined and are expanded from our original agreement with the company. Our original 1984-85 budget proposal allowed for six cleanings per month at a cost of $6,178. This contract calls for two cleanings per week at an annual cost of $7,800. The budget will require an additional $1,622. Please note that the cost per cleaning has been reduced from $85.80 to $75.00. With the near completion of our renovation project, the increased service Is recom- mended. We have found Universal Beach Services Corp. to be competent and reliable and recommend approval of the contract. We will take additional funds by re-allocating funds in the Recreation Department. He thinks this makes sense and will probably come back to the Council about cleaning the rest rooms more frequently. Mayor Zimmerman referred to receiving a lot of requests on this particular item and stated for the small additional cost, he thinks it is a worthy project. - 19 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Councilman Warnke moved to approve the contract with Universal Beach Services Corp. as presented, seconded by Councilman Cassandra. Under discussion, Mr. Doney referred to section 9-B on page 3 and pointed out that something seemed to be missing and advised he proposes to make the addition to give either party the right to cancel with thirty days notice. That would be added subject to their approval and if not approved, it would come back to the Council. Councilman Warnke amended his motion to include these stipulations, seconded by Councilman Cassandra. Motion carried 4-0. Renew contract with Joyce Environmental - Aquatic Weed Program Mr. Cheney informed the Council this was previously done once per month, but was reduced last year to ten times per year. He is now recommending going back to twelve months. He is also recommending continuing for another month or two with the treatment of the couple canals which we discussed putting on a special assessment project which is being discussed. He recommends approval of this contract. There is a 9% increase in the rate over last year. The monthly rate is $995 compared to $915. He suspects it was increased because of chemical costs. This is a good company and used by most people. Even with the increased price, it is still recommended and he believes it is worthwhile. Councilman Cassandra moved to accept the City Manager's recommendation for this new contract with Joyce Environmental for the aquatic weed program. Councilman Warnke seconded the motion. Accept & File Negotiated Sale Disclosure Statement Mr. Cheney referred to this coming up last week at the spe- cial meeting regarding reselling of the bonds for the golf course and stated it has now been prepared. It is simply a matter of accepting, so officially it is in the records to make the sale of the bonds complete. In the first line, it should be 1984A. Vice Mayor Ferrell made a motion to accept this negotiated sale disclosure statement, seconded by Councilman Warnke. No discussion. Motion carried 4-0. Consider land development regulations - Civic land dedica- tion for referral to Planning & Zoning Board - 20 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Mr. Cheney referred to the Melear tract annexation dedi- cating property for public use and explained how this was based on that to have everyone participate in the same way. He added this is similar to our current ordinance for recreation land, but this is for non-recreation land. He explained how this recognizes that we have other needs and the current facilities must be expanded. If the Council is in favor, it should be referred to the Planning & zoning Board for review and then will come back to the City Council. Councilman Warnke questioned the maintenance of this dedi- cated property and Mr. Cheney replied that with dedicating it to the city, the city would own it and maintain it. We would have the choice of accepting land or money. Councilman Warnke stated he was uncomfortable with Paragraph F on Page 4 and questioned why we should commit ourselves at the time of development. Mr. Annunziato explained how this would give the applicant a guarantee and would be part of the mechanism of the procedure. Mr. Doney added there is the same identical provision in the recreation ordinance. Mr. Cheney suggested it could be changed to read shall be commenced and/or built. Mr. Doney referred to this ordi- nance being challenged and stated to support such a taking of property or money, we must tell the people what we are going to do with it. Councilman Warnke moved to refer the Civic Land Dedication/ Development Ordinance to the Planning & Zoning Board for their consideration. Vice Mayor Ferrell seconded the motion and it carried 4-0. Approve Project Agreement for State Aquatic Plant Control Funds Mr. Frederick informed the Council this is a D.N.R. grant project which makes funds available to municipalities to receive money from the state. The state will reimburse the city 18% of our expenditures. We just have to submit invoices showing we spend money for chemicals. Vice Mayor Ferrell made a motion to approve this agreement, seconded by Councilman Warnke. Motion carried 4-0. Consider Ordinance "Definition of Family" for referral to Planninq & Zoning Board Mayor Zimmerman asked if this meant a family could not have more than five children and Mr. Doney clarified that it is - 21 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 saying there cannot be more than five unrelated. Mr. Doney advised the current family definition would not be enfor- ceable. It prohibits certain people from living together which cannot be prohibited. Mr. Doney then read the old and new definitions for family. Councilman Cassandra clarified that if they are related by blood or marriage, there could be 25 people living in a house; but if not related by blood or marriage, they could not have more than five. Mrs. Wilda Searcy came forward and asked if this would apply to people living in apartments and Mr. Doney replied an apartment would be one unit and allow one family. Mrs. Searcy asked if only one bathroom per house would be allowed and Mr. Doney replied that is covered by the building code. He clarified that this prohibits more than five people unre- lated from living together. Mrs. Searcy referred to enfor- cement and Councilman Cassandra replied that it would be done by Code Enforcement Officers. He told about a complaint of eleven to twelve people living in a single family house instigating this. Mrs. Searcy asked if this covers the entire city and Councilman Cassandra replied affir- matively. At this time, Councilman Warnke announced that he would like the audience to know that Mrs. Searcy took matters into her own hands and made a playground for children in her neigh- borhood. Councilman Cassandra moved to pass this onto the Planning & Zoning Board for their review, seconded by Vice Mayor Ferrell. Motion carried 4-0. Board of Adjustment Councilman Cassandra referred to a recent applicant to the Board of Adjustment re-applying because the code does not include a one year requirement and moved to request the City Attorney to write an ordinance to put a one year requirement on re-applying for an application to the Board of Adjustment. Motion carried 4-0. - 22- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 OLD BUSINESS Response to previous City Council requests for information: Consider request to close Ocean Drive between Leisure- ville and Lake Boynton Estates Mr. Cheney reported the City Attorney's office has been reviewing the law and various court cases on this matter. They have asked for some information, study and engineering opinions as to the nature of this street regarding the whole transportation network. The reports will be submitted and the City Attorney will make a judgment. He told about the County Engineering Department and Police Department taking counts and advised this information will be submitted with additional staff comments relative to the traffic and deve- lopment situation in this area. A report will be compiled as soon as possible so the Council wiil have the complete information and legal opinion regarding the action to take. Mr. Doney added that generally roads can be vacated or closed, but typically it is alleyways or roads which have no use in the scheme of the overall city plan. He needs to do more research on this. Another factor which did come in is the impact on emergency vehicles. Mr. Cheney agreed that it is a complicated situation and there is also the question of where to close it. Councilman Cassandra asked if Mrs. Mills was satisfied with the report given by the City Manager and Mrs. Mills replied affirmatively. Mr. A1 Polak, 645 West Ocean Avenue, representing the Lake Boynton Estates Property Owners Association, stated they are not in favor of closing Ocean Drive. He told how the closing of this street would result in it being dangerous for the children walking to school and delay of emergency vehicle services. The Police Dept. does an efficient job and has even ticketed Leisureville residents for speeding in that area° Councilman Warnke referred to this possibly being.subject to a public hearing and Mr. Cheney agreed that would be required. Mayor Zimmerman stated the Council will await the further report. Information covering landscaping requirements for single family homes Mr. Cheney reported that we do not have requirements for landscaping individual single family homes. It is very seldom a.problem and he explained. He doesn't recommend taking this on and developing standards. Mayor Zimmerman added that he believes the Community Appearance Board is working on a revision of the ordinance for landscaping and they are including something concerning single family homes. - 23- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 Mrs. Wilda Searcy questioned what was going to be done about the new house in her area which does not have any landscaping and Mayor Zimmerman replied that without an ordinance or anything in the code, we cannot do anything about it except possibly have the weeds removed by the owner. Information concerning complaint of Mrs. Elizabeth Jenkins Mr. Cheney read his report dated October 16, 1984. Mrs. Elizabeth Jenkins came forward and advised that Mrs. Moore has gotten in touch with her and some work has been done. She has been assured this will be taken care of by the Housing Authority. She was told that she was in violation with having a car parked in her yard, but there has been a car sitting on the street without a tag which was overlooked by Mrs. Moore. She told about things being cleaned up and plans to improve her property. NEW BUSINESS Special Assessment District - Canal Maintenance (Tabled) Mr. Cheney requested this to be left on the table. ADMINISTRATIVE Consider funds for proposed appraisal at Wastewater Treatment Plant (Tabled) Councilman Warnke moved to take this off the table, seconded by Vice Mayor Ferrell. Motion carried 4-0. Mr. Cheney distributed a report received this afternoon. He thinks this package includes the proposed agreement to be signed by the two cities with Shell Oil Company. The pro- posed agreement calls for an exchange of land. The suggestion is if Shell Oil Company agrees with this contract and the terms of it, we would then have an appraisal made which would not exceed $3,000 to be sure the land being swapped is equal in value. This was prepared after the last South Central Board meeting where it was agreed that a land swap would be the way to go. Councilman Cassandra stated at the board meeting, we had an appraisal for a piece of land to buy. We decided a second appraisal was in order to make sure the price was proper. Then, at the last Council meeting, Delray Beach had pledged - 24 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA OCTOBER 16, 1984 additional money for an appraisal which he disagreed with by doing something without the board's discussion. He questioned if the recommendation was now to go along with this appraisal? Mr. Cheney informed him at the last board meeting, the matter was approved that would call for the two cities taking ownership of the strip in front of the board's pro- perty and would give up ownership of an appropriate amount of land at the south end of the currently owned board pro- perty. The idea is the board would own the frontage and do what they want with it and Shell Oil Co. would own the land to the south of the current property tied into land which they already own south of there. Councilman Cassandra questioned the purpose of this $3,000 and Mr. Cheney informed him this $3,000 is to look at the land in front and compare with the land already appraised at the south ~nd to make sure it is equal. Councilman Warnke clarified that our cost would be $1,500 and it is recom- mended that the appraisal not be performed until Shell Oil Company has accepted the contract. Mr. Cheney agreed this would give Mr. Federspiel the authorization to go ahead if Shell accepts the offer and another board meeting would not be required. The Council still has to give final approval of this agreement because we own half the property. Councilman Warnke made a motion that the City Council of Boynton Beach go on record approving the concept of using $1,500 in conjunction with $1,500 from Delray Beach and authorize Mr. Federspiel to negotiate and expedite, but not get an appraisal ahead of time.
