Minutes 07-17-84MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, JULY 17, 1984 PRESENT Carl Zimmerman, Mayor Robert Ferrell, Vice Mayor Nick Cassandra, Councilman James R. Warnke, .Councilman Samuel L. Wright, Councilman Peter L. Cheney, City Manager Betty S. Boroni, City Clerk James W. Vance, City Attorney Mayor Zimmerman called the meeting to order at 7:30 P. M. He announced we are glad to have in the audience ex-Mayor Marty Trauger and Ms. Janet Olin, aide to Representative Messersmith. He added we will have the invocation given tonight by Rev. Ken Ferguson, Pastor of Ascension Lutheran Church, and to please remain standing for the pledge of allegiance to the flag. AGENDA APPROVAL Councilman Cassandra stated he would like to add under Administrative, Item E - Letters of Appreciation. Also, he thinks Item A under Development Plans should be deleted to review a pending request from Burdines. We have a procedure which must be followed. This height was considered and voted on. Therefore, if there is any further consideration by this Council, it must be by procedure with rescinding or amending the motion which was made and then going to the Technical Review Board if that is the Council's wish. This item is not proper and he moves to delete it. Councilman Wright stated he would like to add under New Business - Boynton Terrace Apartments. Mr. Cheney stated he would like to delete under the Consent Agenda, Item D, alcoholic beverage license approval and he would like to add one bill under Payment of Bills for Chapman Security in the amount of $11,244.00. Also, minutes of the Special City Council meeting of July 5 were distri- buted and approval of these minutes should be added. Vice Mayor Ferrell made a motion to approve the agenda as corrected with the additions and deletions, seconded by Councilman Cassandra. Motion carried 5-0. ANNOUNCEMENTS The City Manager announced that Council Budget Workshop meetings are scheduled next Monday, Tuesday and Wednesday at 7:30 P. M. in the Council Chambers. These are not Public - 1 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 hearings, but workshop meetings. The Council members will receive the budget possibly by Thursday and at the latest by Friday night. The purpose of the workshop meetings is to declare the maximum millage which must be advertised by August 15. This will be the tentative millage which cannot be increased, but can be reduced. These meetings will be held at 7:30 P. M. Joyce Waters - Librarian I in Library MINUTES Regular City Council Meeting Minutes of July 3, 1984 Councilman Cassandra moved to accept the minutes as pre- sented, seconded by Vice Mayor Ferrell. Motion carried 5-0. Special City Council MeetinG Minutes of July 5, 1984 Vice Mayor Ferrell made a motion to accept the minutes of this Special City Council meeting, seconded by Councilman Warnke. Motion carried 4-0 with Councilman Wright abstaining since he was not present. CITY MANAGER'S REPORT Beach Project Mr. Cheney announced the beach project is proceeding. They have scheduled completion around the first week in September because of rain days. He is a little concerned they may not be done by then, but that is provided for in the contract. The quality of the project is excellent. Golf Course The City Manager announced the golf course is proceeding very well. There has been regular attendance. The income is up and it seems we are operating a course people are satisfied and pleased with. In August, we will talk about the possibility of doing something with the restrooms and bar facilities, now that the main part of the golf course is functioning well, so these will be open in the fall when play picks up. Budget Mr. Cheney reported the budget is the main activity these days. He anticipates it will be out possibly on Thursday and definitely by Friday. REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 PUBLIC AUDIENCE Mayor Zimmerman announced if anyone has anything on the agenda they would like to speak on to please give their name to the City Clerk. Burdine's Mr. Kenrick Clifford, 4940 S.W. 83rd Street, Miami, stated he understands from Councilman Cassandra's motion that Burdine's has been taken off the agenda. Of course, he is disappointed. He referred to Burdine's selecting Boynton Beach because it is a great city and then told about working for Burdine's for 34 years. He told about the history of Burdine's increasing from 4 stores in 1950 to 28 stores in the State of Florida now. He told about their pledge to be a part of the community with citizen participation. He stressed that they are good corporate citizens. He thinks the design presented is one the city could live with and would not be an eyesore nor set a precedent. Councilman Warnke replied that their application would have been turned down because of the height limitation and urged their engineers to consider the consequences of a hurricane with high winds. Mr. Clifford replied that he obtained a written report from Mr. Annunziato stating anything built would be in accordance with code and meet hurricane protection. Councilman Wright apologized for what they have been put through and stated possibly there has been some miscom- munications. Personally, he likes the building as presented. Mr. Clifford clarified that he is not mad, but is kind of upset. They are aware of the ordinances on the books, but know there is a provision that the City Council has the right to approve a variance and the fact has been mentioned a facility was approved in the same shopping center which is exactly the same height. He feels they are being taken advantage of. He wants to make sure Burdine's has a store in Boynton Beach, because Boynton Beach deserves it. Councilman Cassandra clarified that the procedure was given to amend the plan and the motion made tonight concerned improper usage of the agenda. The people voted on a 45' height limitation by referendum. They came in exceeding the 45' height limit. He will research the statement about the Council having rights because he is positive the intent of the referendum was for exceptions for mechanical appurtenan- ces. - 4 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Councilman Wright stated the staff approved this and the Planning & Zoning Board recommended approval and it didn't come directly from Burdine's to the City Council. Councilman Cassandra replied that it should be investigated how it got to the City Council. The Planning Director, Planning & Zoning Board and Community Appearance Board did not have the right to approve, but only have the right to recommend. Councilman Warnke agreed that the 45' height limit is a policy of the City Council. Mayor zimmerman suggested they go through the Technical Review Board and Planning & Zoning Board with the revised plan. Mr. Cheney advised he made the mistake of putting this on the agenda. He was not present when it was first discussed and was under the impression the site plan was denied, but the height was given the opportunity to be revised. If they want to come back, they should submit a site plan amendment. The decision of the Council was stated at the last meeting. Mr. Ralph Marchese, 1901 Roma Way, stated some questions have come up within the last few weeks which are very per- tinent to the Council's duties. He doesn't think this Council or the city has to apologize to anyone because we are here. It has been questioned who makes certain laws and enforces codes. He sincerely trusts that this is done by the people of Boynton Beach through the elected City Council. He stressed that the Council should respect the wishes of the people of this area and the law is clear cut with stating 45'. Jaycees' Request Mr. Greg Smith, 321 DeCarie Street, Delray Beach, Chairman of the Board of the Jaycees, stated he came to speak about Bryant Orville Myers, Jr., who was recently killed in an automobile accident in Georgia. They are requesting the city to accept a memorial they have built which lists the accomplishments Bryant has done throughout the state. They want him to be remembered as a Jaycee and resident of this area. Mr. Lyndon Smith, 221 S. E. 2nd Avenue, told about the help Bryant was in raising funds for various charities. They would like to place this memorial with a plaque at Jaycee Park. - 5 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Councilman Cassandra questioned the size and Mr. Smith illustrated. Mr. Cassandra asked if there was any policy on this and Mr. Cheney replied that he doesn't know of any and has been told there is a similar plaque in town. Mr. Greg Smith told about one being located in the center of Federal Highway. He further explained how this would be away from everything in Jaycee Park and would not cause maintenance problems. Vice Mayor FerreI1 made a motion for the Jaycees represen- tatives to meet with the appropriate members of staff and work this out, seconded by Councilman Wright. Under discussion, Mr. Cheney commented that only Council's appro- val was needed and Mayor Zimmerman added that it must be installed properly. Motion carried 5-0. At this time, Mayor zimmerman recognized the presence of ex-Mayor Vincent Gallo in the audience. CONSENT AGENDA A. Approval of Bills See list attached. Councilman Wright moved adoption, seconded by Vice Mayor Ferrell. Under discussion, Councilman Cassandra referred to Item A-2 and questioned if these supplies were combined with other cities to secure a bid and Mr. Sullivan informed him that we do this by ourselves and have discussed it several times, but have not done it with other cities. Mr. Cassandra asked if we also inspect the utilities prior to releasing a performance bond and Mr. Cessna replied affir- matively. Mayor Zimmerman clarified the motion is to accept the Consent Agenda deleting Item D and adding the additional bill. Motion carried 5-0. BIDS NONE PUBLIC HEARING Approve request for conditional use to construct a day care center to be known as Children's Center submitted by Barbara Alterman and Mavis Payne to be located at the corner of N. W. 8th Street and N. W. 1st Avenue Mr. Canon explained the location and told about the present zoning uses surrounding this property. He advised that a 3,800 sq. ft. building is planned which will accommodate 71 children. He showed the plan and pointed out the parking and entrance. The Planning Department submitted a memo and finds this conforms to all standards and recommends the site plan be approved subject to staff comments. The Planning & Zoning Board concurred and unanimously recommended this con- ditional use be approved. The landscaping plan was also approved by the Community Appearance Board. The only issue brought up was the location of the driveway on N. W. 1st Avenue and the Planning Department took this into con- sideration, but felt it would not be advisable to change the location to N. W; 8th Street because of increased traffic with it being a collector street. Councilman Warnke asked if the driveway conforms to setbacks from intersections and Mr. Cannon replied affirmatively as the requirement is to be set back 30 ft. from an intersec- tion and this will be back about 100 feet. - 8 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Ms. Barbara Alterman, 7554 Starling Circle, Boca Raton, explained that she will own and operate this proposed school and told about her experience. She and her partner feel they can provide quality day care. As far as there being 71 cars, they do encourage car pooling, which would reduce the number of cars. Also, the only traffic created would be early in the morning and late in the afternoon or early evening. Mayor Zimmerman asked if they would consider using N. W. 8th Street for the entrance into the property and Mrs. Alterman replied affirmatively, but when the architect researched this with the city staff, they found it would be a major thoroughfare and felt it would be more detrimental. Also, with exiting onto N. W. 1st Avenue, there is the option to go out onto 7th or 8th Street. Councilman Cassandra questioned the hours and Mrs. Alterman replied they are going to try to work with the merchants in the area and Motorola and will probably open at 7:30 A. M. and close at 5:30 to 6:00 P. M. Councilman Cassandra referred to meals and Mrs. Alterman replied they will not prepare food on the premises and the children must bring their own lunches. Councilman Wright clarified that they will accept children from all areas and not from just Motorola and Mrs. Alterman agreed. Councilman Cassandra questioned the number of employees at full capacity and Mrs. Alterman replied there will be approximately six teachers as Health Department standards must be met. Mr. Cassandra referred to the parking being reduced to 13 spaces then and explained how he thought there was a big safety hazard with cars getting out. He is con- cerned why the police did not comment about this. Mrs. Alterman explained that everyone would not be arriving and leaving at the same time and added there is also the possi- bility of having a turn-around with cars just dropping off children rather than parking. Mr. Cassandra questioned if a complete U-turn could be made in the parking area. Mrs. Alterman read a letter from M. M. O'Shea stating she lives directly across the street from Camino Gardens Preschool and does not find it to be noisy nor a nuisance. - 9 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Mr. John Schrey, 22666 S.W. 65th Circle, stated that his son has been going to Mrs. Alterman's school in Boca Raton for 13 months. He told how this school had been a benefit for his son. He also told about the care given at this school and at all times had found the premises clean. Mayor Zimmerman clarified that he didn't believe there were any objections to the school itself, but to the location of the entrance on 1st Avenue. Mr. Schrey advised there was no problem with traffic in Boca Raton because the parents come at different intervals as it is not like a public school where the bell rings and everyone has to be there. Mayor Zimmerman ascertained there were no other speakers in favor and asked those in opposition to come forward. Mr. John Martin, 736 N. W. 1st Avenue, stated he lives across the street from the proposed driveway to this school. He is not opposed to a school in any way. He told about 8th Street being a much wider street and 1st Avenue only being 20' wide. He told about children in this area walking to the school bus stop along this narrow street with no sidewalks. He is concerned about the number of parking spa- ces, but traffic is the biggest concern. Councilman Wright suggested possibly the plans could be revised to include a drive-thru right to the door. Councilman Cassandra referred to measuring this area and told how the street could not accommodate two large cars. He stated that personally he would like to see the entrance onto 8th Street. He also questions the location of the dumpster and access by the trash trucks. Mr. Cannon informed him the Public Works Director requested the dumpster location to be changed. Councilman Cassandra referred to there being no separation between this site and the gas station and 7-11 Store. Mayor Zimmerman informed him there has to be a fence. Mr. Cannon advised that shrubbery is required by code along the edge of a parking lot. Mayor Zimmerman referred to a fence being required by the Health Department and Mr. Cannon clarified that a fence is required around the play area. Mr. Cassandra again expressed his concern about the location of the driveway and stated he would like the applicant to consider moving the driveway onto 8th Street. Mr. Cheney - 10 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 commented that there will probably be increased traffic on 8th Street because it is wider than 7th Street. He also explained that when Old Boynton Road is re-aligned with a traffic light, it will meet 8th Street which will go through to Woolbright Road and be a major north/south street in that area. Possibly what is needed is to get onto the property at one spot and exit at another spot and have a driveway situation where you don't have to park. This may be an alternative. Councilman Cassandra stated that he has strong reservations on the safety factor considering the location of the driveway. He would also like to see the recommen- dation from the Public Works Dept. regarding the dumpster location. Mr. Norman Barker, 730 N. W. 1st Avenue, stated he lives directly across the street from this proposed day care center. In no way is he against this center. His main con- cern is the width of 1st Avenue. He told about it being difficult to get out of his driveway and being impossible to make a left hand turn from 7th Street onto Boynton Beach Blvd. He stressed that the full use of the street is needed to get out of a driveway onto 1st Avenue. He is also con- cerned about the children's safety as there are eight children living in the four houses across the street. Mr. Vincent Gallo, 3862 Edgar Avenue, informed the Council he is the realtor selling the property to Mrs. Alterman. This property is zoned commercial. A day care center hap- pens to be one of about four businesses in the zoning codes requiring conditional use by the City Council. Any other businesses under C-2 could apply for a building permit and build a business which would generate considerably more traffic than this day care center and could be open seven days a week, 24 hours per day. This is a quiet and clean business just open five days a week. As has been pointed out, 8th Street will eventually connect with Woolbright Road and will be a busy street. To enter that street near a busy intersection will create more of a problem. Also, two parking spaces will be lost. He thinks too much emphasis is being put on something which is not necessary when looking at the uses this property could be used for. Councilman Cassandra stated that general health, safety and welfare must be considered when reviewing a conditional use application. A day care center is wanted, but he is con- cerned about the safety. Mr. Gallo replied that pro- fessional people are being paid to submit recommendations - 11 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 and he thinks if there were other alternatives, they would have been presented. Mrs. Glorida Diana, 740 N. W. 1st Avenue, stated she agrees with her neighbors as it is a very narrow street, with the driveway location where it is proposed, it would cause problems. Mayor zimmerman ascertained there were no further speakers and declared the public hearing closed. vice Mayor Ferrell clarified that there isn't opposition to the day care center. He opposes the driveway at the pro- posed location. He lived at 740 N. W. 1st Avenue and told about the situation of the children walking along the street to the bus stop. As far as parking spaces, he has not seen a day care center have a problem with traffic backing up as the people coming are staggered. He thinks N. W. 8th Street will get the same amount of traffic whether it comes from a driveway on 1st Avenue or directly onto 8th Street. vice Mayor Ferrell made a motion to approve this conditional use with the change of relocating the driveway to 8th Street. councilman Wright questioned the shade trees recommended by the Community Appearance Board in the playground area and Mr. Cannon informed him the Community Appearance Board approved the landscaping plan which the applicant submitted. Mayor zimmerman added the landscaping was quite adequate; however, if this motion is approved, there will have to be some alterations in parking and landscaping- Mr. Cannon added that the Health & Rehabilitative Service guidelines require a certain amount of shade in the play area and he assumes the applicant designed the site plan to meet those regulations. vice Mayor Ferrell clarified that his motion was to approve this conditional use with the change of driveway exiting onto 8th Street rather than 1st Avenue. Mr. Cheney clarified that it would only be the relocation of the dri- veway and Mr. Ferrell agreed. Mr. Vance suggested that it might be practical to see if the applicant concurs with accepting this recommendation- Mr. Ferrell questioned the type of fence to be around the play area and Mrs. Alterman replied a chain link fence was - 12- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 planned, but the Community Appearance Board recommended a shadow box fence along the wall of the 7-11 Store. Mr. Ferrell agreed the fence should be the kind that the children could not see through as there is a problem along the wall with it being a public urinal. Mrs. Alterman com- mented that she understands the shadow box fence is a solid fence. Councilman Cassandra asked if she concurred with this recom- mendation or if she preferred it to be tabled, so she could work with the staff. Mrs. Alterman replied that she would like to have this tabled, so she can work with her pro- fessional staff. Councilman Cassandra clarified that we don't want to lose this day care center, but he has strong concern over the driveway location in regard to safety. Mr. Gallo advised that there are tons of criteria to be met with working with architects, Planning Department and Health Department. He explained there were requirements for square footage area, recreation area, parking, landscaping, etc. If things are moved around, they may lose square footage of the building, recreation area, etc. and run into problems. Vice Mayor Ferrell agreed that it wouldn't be that simple, but he thinks it would be better to have less square footage and a couple less children rather than someone getting killed in the street. Mr. Gallo responded that there are still other uses which could be put on this property which would create a greater hazard. He thinks the city is creating a hardship for this applicant. Councilman Wright stated he would like to see this tabled. It would be a serious problem if the number of children served would have to be decreased. He thinks it would be best to table it to see how it can be worked out. Mrs. Alterman concurred. Councilman Wright moved to table, seconded by Councilman Cassandra. Motion carried 5-0. Approve request for rezoning from REC to R-lA Single Family Residential for a 9.6 acre parcel located immediately east of LWDD E-4 Canal, south of Section 3, Palm Beach Leisureville, west of S.W. 8th Street, north of Woolbright Road. This request was submitted by Rick Rossi for B. D. Rawls as personal representative of the Estate of N. R. Field Mr. Cannon referred to a memo being submitted from the Planning Director outlining the reasons behind this rezoning - 13 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 and recommendation and explained the location of the pro- perty. He advised the reason this was zoned REC was at the time the Bass Creek Development was proposed, the developer was prevailed upon to dedicate parks and recreational land. This property was zoned REC to reflect the intended use. Bass Creek went under and the property has been transferred to several owners. There are no streets or utilities in this area. The Planning Department analyzed this request with respect to the impact to surrounding properties and the comprehensive plan. There would be no negative impacts on the surrounding properties. The lot size and house size are comparable and greater to that in Leisureville. It would be desirable to have recreational area at this location; however, the Planning Department finds it would be impossiible to require the developer to keep it under the REC category. The owner owns this parcel with 70 other lots. The recommendation is this zoning request be approved. The Planning & Zoning Board unanimously concurred with the recommendations and recommended approval. Mr. Wade Riley, 1300 West Lantana Road, Lantana, explained the plan for 14 lots with lakes to the north and south. Mayor Zimmerman asked if they would construct 8th Street all the way through from Ocean Drive to Woolbright Avenue and Mr. Riley replied that they basically go up to Ocean Avenue and if they are first, they will construct it. Councilman Cassandra asked if it could be maintained as REC and Mr. Cheney explained that three separate ownerships came together under Bass Creek and the overall plan was developed with this recreational area. The land has now reverted to the three original owners. The REC zoning made sense when it was a large planned development, but does not with three separate developers. Mr. Riley added that he owns about 17 acres or 75 lots and this would be too large a recreational area for that amount of land. Mr. Cannon added that this land is now unplatted acreage and explained when platted, recreational area will be required to be dedicated. Mayor Zimmerman asked who would maintain the lakes and Mr. Riley replied there would be an association formed for the 75 lots. Mr. Cheney added this will be addressed in the subdivision apPlication. NEW BUSINESS Consider Establishment of Tree Memorial Fund Mr. Cheney referred to a report being submitted and explained that it formalizes a tree program in memorial form and establishes a tree memorial fund. There is the poSsibi- lity citizens, businessmen, organizations, etc. will put money into a memorial fund for trees and a proCedure has. been proposed where the money will be spent. Mr. Spence is present and made the recommendation and is willing to work with the program. Mr. Robert Spence, 22 Colonial Club Drive, told about an acquaintance asking about the existence of a tree memorial fund in Boynton Beach and how he had checked into it. It is hoped a tree memorial fund will be established to receive contributions from people who want to contribute in memory of persons. He explained how the fund would accumulate until recommendations are made for planting trees. No spe- cific plaques would be put on the trees. A memory book should be kept at City Hall with a duplicate copy in the archives with the City Clerk. This would enable people of this city to make contributions in memory of people and those contributions when accrued would provide for some additional beauty with trees on public lands of the city. If this is approved, he would like to have the privilege on behalf of his friend in making the first contribution in the amount of $500. He thinks this fund would be useful. He requests the Council's approval. - 15 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Councilman Cassandra stated he attended the Parks & Recreation Board meeting when this was proposed. He did voice a concern, but it will be taken care of. Mr. Cassandra moved to recommend that we approve the establishment of a Tree Memorial Fund as proposed by the Recreation & Parks Board. Councilman Warnke seconded the motion. No discussion. Motion carried 5-0. Mr. Warnke moved to revert to the regular order of business and Mayor zimmerman informed him this was not necessary as it was included in the original motion. PUBLIC HEARING (Continued) Approve request for a variance from Appendix C, Subdivision and Platting Regulations, Article X, Section 10 of the Code of Ordinances, in reference to street right-of-way width of 60' with swales. This request was submitted by Mr. Burlison A. Gentry, Agent for Swinton Development Corporation, for 50' street rights-of-way in the Rollingwood Development located between Seacrest Boulevard and Swinton Avenue Mr. Cannon referred to a memo being submitted and explained the location of the property. He advised the applicant is requesting the right-of-way for the street winding through the subdivision be reduced from a 60'right-of-way, which has been the policy of the city, to a 50' right-of-way with curb and gutter. The applicant has provided a letter to the City Engineer stating the justification for this variance. He explained their reasons were to configure the lots without disturbing the existing topography. The staff reviewed this request and their opinion was the applicant could design the subdivision to meet the subdivision requirements and the application should be denied. Councilman Cassandra requested the city Engineer to comment and asked if this would create any runoff problem. Mr. Clark clarified that this request is to be allowed to use a 50' right-of-way with swale construction. The ordinance provides for 50' right-of-way with curbs and gutters. The Water Management District does not like curb and gutter construction and most likely would require an overflow into the canal system. The question before the City Council is the question of swales or 50' right-of-way, which is not provided for by the subdivision ordinance, as opposed to what is required by the subdivision ordinance, which is a 60' right-of-way with swales. He explained the policy. - 16 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Councilman Warnke asked if with the 60' right-of-way, would it decrease the number of lots and Mr. Clark replied that a 60' right-of-way would take away from the area of the lots and they undoubtedly would lose lots. It also may affect the layout and require a different layout. However, he is sure there are many layouts which could be planned providing a 610' right-of-way and meet the ordinance requirements. Mr. Burlison Gentry came before the Council and stated he submitted a letter making an application for this variance. He explained how they were trying to utilize this area from swinton Avenue to Seacrest Boulevard with a viable layout. The same layout could be configured with a 60' right-of-way, but the problem is the lots would be 99 feet deep. During the annexation hearing, the neighbors were concerned about building homes comparable in value and size to t!hose in the area and the developer stated at that time, the ilots would be in excess of 100 feet deep. Models have been prepared in the market range from $200,000 to $300,0!00. If the lot size was decreased to 99 feet, it would make the size not com- parable. He explained how it was felt the retention areas indicated would be adequate with 50' rights-of-way. With this lot and street configuration proposed, they are trying to preserve the elevations existing on this property. He told about the elevations being, a unique feature in this area. Also, with maintaining the existing grades, they would be able to preserve the existing trees in the area. In reference to drainage, he told about a number of develop- ments in this area having french drains and this type of sewer with experiencing no problems with regard to flooding. He feels the developer has complied with the recommen- dations. They request consideration so the development can proceed. Mayor Zimmerman asked if he b~ought these facts out to the Technical Review Board and Mr. Gentry replied that he was not able to attend that meeting. Mayor Zimmerman questioned the legality of this and Mr. Vance replied that he gathers the request is for a variance from 60' to 50' swales and he feels that would be in viola- tion of the code. Mr. Cheney added that with a 60' right- of-way, there is the area to h~ndle the water in swales, but to go to 50' would be a tight situation. It has been found that swales are a better way to handle drainage and he explained that french drains have been used, but must be cleaned out. - 17 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Councilman Cassandra referred to the current D.E.R. drainage regulations and Mr. Cheney informed him that D.E.R. requires the water to be maintained on site. Mr. Vance clarified that if they were applying for a 50' road with curb and gutter, it could be considered, but this is not even contemplated by the code. Mr. Clark clarified that the drainage is the consideration and the recommen- dation was based on the ordinance requirement which has other considerations besides drainage. A 60' right-of-way is required by ordinance and they are requesting a variance to have a 50' right-of-way. Mayor Zimmerman ascertained nobody else desired to speak in reference to this public hearing. DEVELOPMENT PLANS Review pending request from Burdines DELETED Proposed amendments to Section 4F of the Zoning Code and consistency with the Comprehensive Plan - Recommendation from Planning & Zoning Board Mr. Cannon stated the Planning & Zoning Board unanimously found these proposed amendments to be consistent with the Comprehensive Plan based upon the Planning Director's recom- mendation which was submitted. Councilman Cassandra moved to direct the City Attorney to prepare the appropriate ordinance, seconded by Vice Mayor Ferrell. No discussion. Motion carried 5-0. Councilman Cassandra informed the audience this would remove the 65' tower and bring it down to 45'. Any increase over 45' would come to the City Council for approval. - 18 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Approve request to construct 288 multi-family rental dwelling units on 29.78 acres on the west side of Congress Avenue, immediately south of Congress Middle School, to be known as Banyan Creek. This request was submitted by Ned Marks for Banyan Creek Associates, Ltd. Mr. Cannon showed the site plan and explained the location of this multi-family area. He pointed out the access roads and advised that paving, drainage and utilities have been approved. He explained the type of units proposed and recreational facilities. He advised this site plan was reviewed by the Planning & Zoning Board and comes with a positive unanimous recommendation subject to staff comments. It was also approved by the Community Appearance Board. Councilman Wright moved to approve this request to construct 288 multi-family rental dwelling units on 29.78 acres on the west side of Congress Avenue, subject to staff comments. Councilman Warnke seconded the motion. No discussion. Motion carried 5-0. Approve request to construct optional screen enclosures at Boynton Lakes located on the east side of Congress Avenue, south of Hypoluxo Road. This request was submitted by Donald Elliott for Lennar Homes, Inc. Mr. Cannon informed the Council this would allow the option of constructing a screen enclosure on any of the approved units on the Boynton Lakes PUD. It is just a minor modifi- cation with no staff comments. The Planning & Zoning Board gave a positive recommendation. Vice Mayor Ferrell made a motion to approve this request, seconded by Councilman Cassandra. Under discussion, Mr. Cassandra stated he thinks it is ocassionally nice to recognize a person who gives without asking for money. He referred to Mr. Jeff Hopper being present and stated at the Community Appearance Board meeting, there was a need for landscaping at the Boynton Child Care Center and Mr. Hopper volunteered six to nine trees delivered and planted. He expressed appreciation for this donation. Motion carried 5-0. Approve request to construct a 14,800 square foot showroom and warehouse on 1.234 acres to be known as L&J Boynton Showroom. This request was submitted by Joseph Friedes and will be located on the S.E. corner of Congress Avenue and S.W. 30th Avenue in Lawson Industrial Park Mr. Cannon explained the site plan and location. He told about the intended uses and design of the building. He - 19 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 advised in accordance with the revised Mi regulations, the staff has approved automobile repairs for all of the building. There is a stipulation that no garage doors be visable from Congress Avenue. The Planning & Zoning Board reviewed this plan and gave a unanimous positive recommen- dation subject to staff comments. Mr. Cheney asked if this would be for automobile repairs and Mr. Cannon replied affirmatively, which has been approved by staff. Mr. Cheney stated there will be showrooms in the front with no parking in the landscaped areas. He added along Congress Avenue, there will be no parking of vehicles in need of repair. Mr. Cannon replied there was no discussion regarding that and the application for the use of the building stated there would be no body work in the building, but there was no stipulation regarding parking. Mr. Cheney stated he would like statements from the appli- cant for the record as there is concern from the residents on the other side of Congress Avenue. Mr. Joe Friedes came forward and stated he has a specific stipulation in all his leases that no inoperative vehicles can be parked outside a building. He is in agreement with the staff comments. Councilman Cassandra moved to accept the Planning & Zoning Board's unanimous recommendation for the construction of this showroom and warehouse with staff comments and the last stipulation about non-operable vehicles. Vice Mayor Ferrell seconded the motion. No discussion. Motion carried 5-0. Approve request to construct a 96,300 square foot shopping center on 9.627 acres on the S.W. corner of Hypoluxo Road and Congress Avenue to be known as Meadows Square Shopping Center. This request was submitted by Gerald Higier for Turks & Caicos Corporation, B.V. Mr. -qannon explained the location of this major shopping cen~. He showed the site plan and told about the proposed stor~H,S_~andr~\ out parcels. He explained the access to the site and the additional driveway requested. He told about the parking and landscaping discussions. There was reference to curb stop problems and the Planning Department recommended landscaped strips with a continuous concrete curb, which is still an issue which the applicant Will respond to. The Planning & Zoning Board did concur with all the staff com- ments including the provision of the landscaped strip. The applicant may want a clarification regarding the screening of the loading areas in the rear of the stores with the - 20 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 residential zoning adjoining, but there will be a buffer wall along the south and west boundaries. The site plan was also approved by the Community Appearance Board. Mayor Zimmerman asked if the screening was to be in the form of a wall or landscaping around the loading areas and Mr. Cannon replied a wall was suggested to screen the trucks in the area where they back in and unload, which would have to be about 15' high. Councilman Cassandra asked if there would be curb stops with the landscaping in the parking area and Mr. Cannon replied the landscaping would be in lieu of curb stops. Mr. Kiernan Kilday referred to the major tenant being Publix Markets and told about this shopping center being similar to the one recently constructed at Military Trail and Woolbright Road. In reference to screening the truck unloading area, he suggests that this area be enclosed with a screened wall with a barrier trailer high as approved by the Technical Review Board. He explained how the wall would be 8' high with 16' trees to provide the screening effect. They will work with the staff to come to an acceptable solu- tion. They will provide that screening. Mr. Kilday stated they would like ~2 deleted in its entirety. They are aware of the staff's desire to redesign the parking. He told about Publix having requirements for a proper parking configuration with concern being placed on safety and visability. With landscaping, there is a question of meeting the required number of spaces and at this point, the amount of square footage to space is exact. They do feel the layout meets the codes and would like approval of the plan as submitted. Mayor Zimmerman asked how many spaces they would be short with using angle parking and Mr. Kilday replied that he believed they would lose 27 parking spaces. Councilman Wright asked if the buffer wall would be straight and Mr. Kilday replied that a landscaped treatment has been suggested, but it is shown as a straight wall now. Councilman Cassandra questioned how the additional requests could be enforced if this plan was meeting the code. Mr. Cheney replied there are several ways to meet the code requirements. Parking can be with individual curb strips or a continuous curb. We have had complaints about individual - 21 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 curb stops. The question is which way to meet code when either way meets the code. Mr. Cassandra asked if a landscape barrier was included in the code and Mr. Cheney replied it is consistent with the code. Mr. Dan Lovett suggested that one solution would be to eli- minate the curb strips entirely. The problem with linear planting islands is it does create a loss of leasable space. The way it is laid out now is exactly the way the city ordi- nances allow. If they could get a variance to eliminate the curb stops, they would, but would want the layout to remain the same. Mr. Vance clarified that in light of the question asked, curb stops are a permitted approach authorized by the code and while another method may also meet the code, he doesn't know that one can deny an applicant because he doesn't like the method used to meet the cOde. Mr. Cheney clarified that the suggestion is not to deny the applicant, but raise an alternative way of doing it and see if the developer agrees, but this developer is not in agreement. There is an oppor- tunity to do the alternative, but it could reduce the size of the shopping center. It does meet the standards as pro- posed and the alternate was just suggested. Mr. Cheney asked if the sketch shown on the screening by the loading docks was consistent with what the Technical Review Board was talking about and Mr. Cannon replied affir- matively. Mr. Cheney suggested this could be approved with the idea they are going back to the Technical Review Board to work this out. Mr. Cassandra stated he wanted to make sure they will come back if there is disagreement. Mr. Vance clarified that the sketch shown by Mr. Kilday was substantially in compliance for screening and if not agreeable with the Technical Review Board, they could come back again. Mr. Kilday agreed. Councilman Wright suggested that they look again at the landscaped area and Mr. Kilday replied they have spent a lot of time considering that. Mr. Vance suggested that the code could be amended and Mr. Cassandra agreed this is the next thing which should be done with going to landscaping and getting rid of curb stops. Mr. Simon Ryder, Chairman of the Planning & Zoning Board, explained that curb stops were included because they provide direction for parking. Councilman Cassandra moved to approve this plan with the Planning Department's second request pertaining to - 22 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 landscaping not having to be complied with, but to comply with the curb stops and all other staff comments with the intent as stated for screening in the minutes. Councilman Warnke seconded the motion. Mayor Zimmerman clarified the motion was to approve subject to the screening meeting approval of the Technical Review Board and the Planning Department and also the landscaping being amended to show curb stops. Under discussion, Councilman Wright asked if this parking lot would look like the one at Woolbright Road and Military Trail and Mr. Kilday replied the layout is identical, but the curb stops are not installed. Motion carried 5-0. Approve request to construct a 2,585 square foot convenience store (Seven Eleven) on a .5409 acre parcel on the N.W. corner of Woolbright Avenue and Seacrest Boulevard. This request was submitted by Jiminez & Associates for Southland CorDoration Mr. Cannon referred to there being an existing 7-11 Store on this site and explained how the applicant plans to redevelop the site entirely with relocating the store, improving drainage and landscaping, etc. The Planning & Zoning Board reviewed the plan and forwarded it with a positive unanimous recommendation subject to staff comments. The site plan has been reviewed and approved by the Community Appearance Board. Councilman Cassandra referred to there being a variance granted for the driveways not to be 180' and Mr. Cannon informed him it would be impossible on this site to meet that requirement. He added there was an extensive discussion about the proper location and it resulted in this configuration. Mr. Cheney added that there is not enough room for the driveways on either side and even though it will not meet all standards, it will be better than what is there. Also, the whole corner will be landscaped and grassed. Mr. Cassandra asked if the parking lot variance was granted and Mr. Cannon replied affirmatively, to place the driveways within 180' of the intersection. Councilman Warnke referred to there being a lot of excava- tion going on at this site already and Mr. Cheney informed him that it is on the lot next door. Mr. Jose Jimenez came before the Council and verified that the excavation is on the lot next door. Councilman Wright - 23- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 questioned how close this would be to Woolbright Road and Mr. Jimenez replied about 39 feet. Mayor Zimmerman asked how much additional land was being added'to the north and Mr. Cheney replied there was none as the additional land is to the west. Councilman Wright questioned if this building would line up with the salon on Woolbright Road and Mr. Jimenez replied that he had no idea, but Mr. Cheney guessed it would be further back or about the same. There was further discussion about the landscaping, loading area, stucco treatment of the building, etc. Mr. Jimenez then told about plans to put in gas pumps. Mr. Cheney advised that such plans would have to come back to the City Council in the future for approval. He clarified that this plan does not guarantee them gas pumps, but lays it out so they could have gas pumps in the future with the layout of the parking. Mr. Simon Ryder pointed out that what will be corrected is presently there is a drop curb all along the street frontage and this improves that condition by limiting access. Mr. Vance clarified that the City Council is considering the site plan as submitted tonight by itself without any gas pumps, Vice Mayor Ferrell made a motion to approve this request, seconded by Councilman Wright. Motion carried 5-0. Approve request to construct entrance way walls and signs at Sky Lake Plat I, to be located on the N.E. and N.W. corner of N.W. llth Street and Old Boynton Road. This request was submitted by David DeBoard for Oriole Homes Corporation Mr. Cannon informed the Council that the sign for Sky Lake is already up and this is an after fact approval. Both the Planning & Zoning Board and Community Appearance Board approved and there are no staff comments. Councilman Wright moved approval of this, seconded by Councilman Cassandra. Motion carried 5-0. - 24- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Approve request to construct a 53,400 square foot office building on 6.16 acres, plus landscaping and parking, and a request for a height exception of 9 feet for mechanical equipment. This request was submitted by Donald Stiller for Woolbright Associates to be located on 1901 S. Congress Ave. Mr. Cannon informed the Council this is a request for modi- fication of Phase II of Woolbright Corporate Center. This is the second building on the site plan located in the southwest corner of the property. The applicant is asking to rotate the orientation of the building 90 degrees counter-clockwise and also include drive-thru teller win- dows. Also included is the reconfiguration of the parking lot for more efficient traffic flow. The Planning & Zoning Board recommended approval subject to staff comments and approval of the height exception. The Community Appearance Board also approved. Councilman Warnke asked if a 9' exception had been given on the first building for the height and Mr. Donald Stiller replied affirmatively and added this will be identical to the building there, but they have turned this building for better parking in front. Councilman Cassandra referred to a Planning & Zoning Board member commenting about arrows in the parking area and Mr. Stiller agreed these would be put in. Councilman Wright moved to approve, including the height exception. Councilman Warnke seconded the motion. No discussion. Motion carried 5-0. Mr. Ben Uleck, 1507 S.W. 17th Avenue, came forward and referred to the residents of Boynton Beach voting for a 45' height limitation and questioned the size of this mechanical room and Mr. Stiller informed him it is identical to what is on the other building. Mr. Uleck stated that the mechanical room is part of the structure of the building and there should be no variance. Mayor Zimmerman commented that this is not noticeable from the ground. Mr. Uleck asked if there is a limit how long and how wide a mechanical room should be on a building and Councilman Wright replied negatively as this is left to the Council's discretion. Mr. Vance read the considerations from the code for clarification. Mr. Uleck stated the people were not aware of these exceptions and voted on the limit of 45'. Mr. Cheney informed him it was discussed at City Council meetings on several occasions and the language was very specific. There has been no change in the issue voted on. The exception for mechanical equipment was always included. - 25 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 After further comments between Mr. Uleck and the Council regarding the height limitation, Mayor zi~erman asked if this new building should conform to the other building or the first building be torn down and Mr. Uleck replied that he has not noticed it on the first building and the second one cannot be refused. Councilman Wright remarked that this has been allowed since the referendum was passed. Mr. Ralph Marchese came forward and stated the people voted on not exceeding 45 feet and Councilman Wright replied that no building has been built in excess of four stories. After further discussion about height, Vice Mayor Ferrell clarified that this is a functional necessity in this case. Approve request to construct a 1,140 square foot addition to the previously approved site plan for the existing bank located at 2250 S.W. 15th Avenue submitted by George C. Davis for Sun Bank - Palm Beach County Mr. Cannon showed the site plan and explained the location and addition proposed. He also pointed out the additional landscaping and curbing for landscaped islands. The only staff comment was in reference to the lighting. The site plan was approved by both the Planning & Zoning Board and Community Appearance Board. Councilman Wright moved to approve this request to construct a 1,140 square foot addition to Sun Bank subject to staff comments. Councilman Cassandra seconded the motion. No discussion. Motion carried 5-0. Approve Planned Industrial Development/Proposed Uses in Boynton Commercenter (PID) Mr. Cannon stated this is a requirement of the PID section of the code. A memo was submitted from the Planning Director which refers to a memo from the Utilities Director specifying the types of manufacturing uses to be allowed with others listed to be approved on an individual basis. Mr. Cassandra asked if the manufacturing of wood could include trusses and Mr. Cessna replied that his recommen- dations were based on the consideration of pollutants coming from the business which should be reviewed by the committee to be sure nothing would affect our wells. Councilman Cassandra stated that we met with three qualified people and he believes either one would do an adequate job for the city. He thought Post, Buckley, Schuh & Jernigan had more experience in Florida. This was the edge that put them in first place and CH2M Hill in second place. Councilman Cassandra made a motion that the landfill project be given to Post, Buckley, Schuh & Jernigan. Councilman Wright seconded the motion. Under discussion, Councilman Wright commented that the staff ratings were very similar. He thinks in terms of experience in the State of Florida, we would be remiss in not considering Post, Buckley, Schuh & Jernigan. In looking at expertise of personnel, he feels they rate very high on what we have here in Palm Beach County. He supports them for this job. Vice Mayor Ferrell referred to being out of town when the interviews were given, but advised that he did read the recommendations. The only one concerned enough to get in touch with him to make him aware of their points was Post, Buckley, Schuh & Jernigan and he thinks that shows concern on their part. Motion carried 3-2 with Mayor Zimmerman and Councilman Warnke dissenting. Mr. Cheney clarified this is instructing him to attempt to negotiate a contract to bring back to the City Council. If a contract agreement cannot be reached, he will go on. NEW BUSINESS Consider report concerning the retention of technical advice relative to Reverse Osmosis Treatment of Drinking Water - 28 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Mr. Cheney referred to a report being submitted and advised Mr. Cessna is present to answer any questions. If the tech- nical report is accepted, it means we think this process deserves attention. He thinks it is time to make an invest- ment in technical and analytical advice. We need someone to put time in on a professional basis. He is not suggesting not continuing along the conventional route at the same time, but taking the two parallel for a couple months to see what happens. Environmentally, it seems if Mr. Cessna's suggestion works, it means sense not to take as much water out of the aquifer. Mr. Cessna informed the Council that the master plan went with conventional treatment because in years past, reverse osmosis and/or ultrafiltration has been an intensive and expensive process. When the gentleman came before the Council a few months ago and suggested taking water out of the canal and using for sprinkling, this started him thinking about other ways and finding out. He has done some investigating and submitted a report. He thinks the fastest way would be to have a subcontract through Russell & Axon, so we can make a comparison. He wants to know whatever comes out both parties agree it is included in both sets of figures to compare capital costs, operating costs, as well as environmental impact. Also, when taking water out of the canal, it should be explored with the South Florida Water Management District. If they disapprove, then we are looking at the conventional treatment we have now or taking wells and treating them. He wants to be involved when doing this, so we don't get sold a bill of goods. Councilman Cassandra stated his concern is $25,000 to $35,000 for Russell & Axon for this particular project. Mr. Cessna replied that it should be a joint thing with allo- cating money and explained the detail involved to do this with different agencies. Councilman Cassandra clarified the request is for $25,.000 to $35,000 to investigate this proce- dure, which means in doing this research, he wants to coor- dinate with Russell & Axon because they are doing our water plant research also. Mr. Cheney informed him that we have not talked to Russell & Axon about any kind of joint opera- tion. We would like both studies compared. The idea with having both segments represented in this joint operation is when we get done, we will have two people agreeing, so we don't end up with this professional engineer and our pro- fessional engineer refusing to agree. Councilman Cassandra clarified that Russell & Axon has done the research and - 29 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 development for the conventional treatment. The recommen- dation is like an 80/20 type of relationship. Councilman Cassandra referred to the 126 priority pollutants and asked if removing them would be feasible and Mr. Cessna replied affirmatively. Mayor Zimmerman asked if the idea for the future was to try to convert all water processing over to a better system or operate two different systems at the same time and Mr. Cessna replied to operate two different systems at the same time to get the water quality wanted. He added the study will point out if it is more viable to change treatment. He feels both should be involved to come up with figures that are comparable. Councilman Warnke told about researching this and disco- vering all the major canals discharging into the ocean from Palm Beach and Broward Counties put out more water than the state uses in one day. Councilman Cassandra asked if we have $35,000 and Mr. Cheney replied affirmatively as a couple years ago, we raised the capital facility charge substantially in an attempt to be prepared for this. Councilman Wright asked if Mr. Conlon is still the con- sultant and Mr. Cessna replied affirmatively, for Post, Buckley, Schuh & Jernigan. Mr. Wright clarified that he will be getting some of this money and Mr. Cessna agreed. Mr. Cheney advised that a contract will be negotiated and brought back to the Council. Councilman Cassandra questioned the time needed to negotiate a contract and Mr. Cheney replied he would hope the contract could be nego- tiated and ready for Council's review in a month and he would hope a couple months later, pending on the availabi- lity of the time of the people involved, we would have some idea where we stand. Mr. Cassandra stated his concern is $35,000 for the finished conclusion with no additional needed and Mr. Cheney replied that he proposed for everything to be answered in the contract. Mr. Jim Suddarth, Russell & Axon, stated they would be happy to work with anybody that Mr. Cessna feels comfortable with. They agree this should be looked into. Mr. Cassandra agreed this should be investigated. - 30 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Councilman Cassandra moved to authorize the City Manager to start negotiations with the appropriate people on this reverse osmosis project. Councilman Warnke seconded the motion. Mayor zimmerman requested a report to be submitted as quickly as possible. Motion carried 5-0. Consider request from Hunters Run relative to landscaping maintenance on Congress Avenue Mr. Paul Hykel informed the Council they would like to curb the median strip in front of Hunters Run, plant it and put in a sprinkler system with a pump on the back of the 30 acres owned by the city. They would like the city to main- tain the landscaping. They will also put in fill for a berm in the city's 30 acre parcel. Councilman Warnke asked if there would be any costs involved over the long run and Mr. Cheney replied just maintenance costs. He added if we do this, it will improve Congress Avenue. He referred to having this in the north end and pointed out that Mr. Hykel is offering to put in curbs, irrigation system, grass and trees. Our only cost from now on would be to maintain the median, pump and irrigation system. Mr. Hykel clarified that they will be curbing from their little building, but the acreage in front of the city park will not have curbs. Mr. Cheney stated we will request the county to curb that, but their current widening of Congress Avenue does not include curbing, but we are hoping to have that included later on. Councilman Wright moved to approve, seconded by Vice Mayor Ferrell. No discussion. Motion carried 5-0. Consider request for Community Relations Board to consider development of Neighborhood Assistance Program - Requested by Councilman Nick Cassandra Councilman Cassandra stated he spent time at the Community Relations Board meeting and submitted a proposal to help beautify the city and help areas of concern. The Board would like Council's approval in concept to go along and proceed with his recommendation. It would be a work force to clean up areas, etc. The total cost would be about $10,000 for three months. He would like Council approval to go ahead with the concept. It will not be done this year. Vice Mayor Ferrell made a motion to have them go ahead and look into this; seconded by Councilman Wright. Under - 31 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 discussion, Mr. Wright commented that anything which is a community program should be investigated. Motion carried 5-0. Mr. Cheney added that he will write to the Board to make this formal. Boynton Terrace Apartments Councilman Wright referred to visiting these apartments and stated he would like the City Council to express to Mr. Seaman to do what they can to make living conditions pleasing for the residents. He would like Mr. Seaman to work with the residents when there are concerns. There is a roof falling in and he told about other problems. Mayor Zimmerman questioned what the Council could do and Councilman Wright suggested that a letter be sent to Mr. Seaman. Communication should be established with us to get these problems resolved. The City Manager should follow through advising this is a concern of the City Council. Mr. Cheney told about the Housing Authority having a forum for people to listen and speak. Councilman Wright added that he did go to Congressman Mica's office to check on this also and was told it would be followed up. ADMINISTRATIVE Consider Youth Advisory Council (Tabled) Councilman Wright stated he would like to wait on this as it is too late. Board Appointments (Tabled) Councilman Cassandra moved to remove from the table, seconded by Vice Mayor Ferrell. Motion carried 5-0. Two Alternate Members to Community Relations Board (Councilman Nick Cassandra & Mayor Carl Zimmerman) Mayor Zimmerman nominated Donna Sanchez, 271 Miner Road. Councilman Cassandra moved to accept these appointments of alternate members for the Community Relations Board, seconded by Councilman Wright. Motion carried 5-0. One Alternate Member to Codes Enforcement Board (Councilman James Warnke) - 32 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 17, 1984 Councilman Warnke stated that he has two names, but did not get their permission. He moved to table this appointment, seconded by Mr. Cassandra. Motion carried 5-0. Accept Resignation from Edgar D. Hurford, Chairman, Cemetery Board Vice Mayor Ferrell made a motion to accept this resignation and send a letter to Mr. Rurford thanking him for his long service. Councilman Wright seconded the motion. Under discussion, Mr. Wright questioned how many years Mr. Hurford has served and Mrs. Boroni replied about twenty. Mr. Wright commented that more than just a letter should be sent. Councilman Warnke agreed and stated he has known Mr. Hurford and he has served for 25 years and was extremely dedicated. We do have a plaque downstairs honoring Mr. deLong for his service and he thinks it would be appropriate to have the best volunteers we have had be honored in a similar fashion with a plaque. He agrees Mr. Hurford should get more than a letter. Councilman Wright suggested a resolution of commen- dation and having it framed. Councilman Warnke suggested not making a decision now, but giving it consideration. Mayor Zimmerman suggested possibly the city staff can think of something appropriate. Motion carried 5-0.
