A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH,
FLORIDA, RATIFYING THE ACTION TAKEN
BY THE SOUTH CENTRAL REGIONAL
WASTEWATER TREATMENT AND DISPOSAL
BOARD ON JANUARY 19, 1995, AS SET
FORTH IN EXHIBIT "A" ATTACHED
HERETO; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, The South Central Regional Wastewater Treatment
& Disposal Board (SCRWTDB) requests ratification of the action
taken by the Board on January 19, 1995, as set forth in
Exhibit "A" attached hereto and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY 0F BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton
Beach, Florida, does hereby ratify the actions taken by the
South Central Regional Wastewater Treatment & Disposal Board
on January 19, 1995, as set forth in Exhibit "A" attached
hereto and made a part hereof.

the Surplus Funds to conduct study on condition of Outfall
line;
9. Approved an expenditure of $14,050 from the
Operational Contingency Fund to pay the fine assessed by the
DEP for the Ferric Chloride Spill.

Pursuant to the Board's instruc=ion, we have reviewed ~he issue of
whether the City of Delray had restrictions on the utilization of
their share of the Board's surplus ~unds accumulated for engaging
in ooean outfall repair and maintenance feasibility study. We met
with. Messrs. Safford and Greenwood on January 25, 1995 and it was
dete~ned that there were no restrictions on the utilization of
those funds upon approval b~ the Board, which has been done, and
ratification by the Cities, which is still required.
It is my understanding that for the future what you will bring to
the next board meeting, is a proposal to return the balance of the
surplus funds less the $100,000.00 you are going to use for the
feasibility study and less one month's working capital with such
funds to be-returned to t'he Cities as part of their sinking fund
accounts. The outcome of the feasibility study will then dete=mlne
the actual repairs needed to be made to the outfall, as well as a
cost com~=~ be included ~n your sinking fund formulas as part
