RIO _ o!J- A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING THE MAYOR TO EXECUTE A SPECIAL WARRANTY DEED TRANSFERRING FIVE (5) PARCELS OF LAND TO THE PALM BEACH COUNTY SCHOOL BOARD IN ACCORDANCE WITH A 1993 SITE EXPANSION INTERLOCAL AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND THE SCHOOL BOARD OF PALM BEACH COUNTY FOR THE EXPANSION OF THE POINCIANA ELEMENTARY SCHOOL SITE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in July, 1993 the City of Boynton Beach entered into an Interlocal Agreement with the Palm Beach County School Board wherein both the City and the School Board agreed to pursue the acquisition of adjacent parcels of properties around the campus of Poinciana Elementary School to allow for the expansion of the school; and WHEREAS, as part of the Interlocal Agreement, the City was to transfer five (5) parcels of property which are now part of the Poinciana Elementary School campus, but which were never formally transferred to the School Board of Palm Beach County; and WHEREAS, staff is recommending completing the transfer of the five (5) parcels pursuant to the 1993 Site Expansion Interlocal Agreement by authorizing the Mayor to execute the Special Warranty Deed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The foregoing "WHEREAS" clauses are true and correct and 28 hereby ratified and confirmed by the City Commission. 29 Section 2. The City Commission of the City of Boynton Beach hereby authorizes 30 the Mayor to execute a Special Warranty Deed, a copy of which is attached hereto as Exhibit S:\CA\RESO\Reso - Poinciana Elementary Land Transfer.doc - I - II "A", transferring five (5) parcels of land to the Palm Beach County School Board in 2 accordance with a 1993 Site Expansion Interlocal Agreement between the City of Boynton 3 Beach and the School Board of Palm Beach County for the expansion of the Poinciana 4 Elementary School site. 5 Section 3.
