RI0-12i2. 2 3 A RESOLUTION OF THE CITY COMMISSION OF 4 THE CITY OF BOYNTON BEACH, FLORIDA, 5 APPROVING THE THREE (3) YEAR EXTENSION OF 6 AN AGREEMENT BETWEEN THE CITY OF 7 BOYNTON BEACH AND PHILLIPS AND JORDAN, 8 INCORPORATED, FOR DEBRIS COLLECTION AND 9 DISPOSAL BEGINNING THE 2010 HURRICANE 10 SEASON; AUTHORIZING THE CITY MANAGER TO 11 EXECUTE THE NECESSARY DOCUMENTS WITH 12 PHILLIPS AND JORDAN, INCORPORATED; 13 PROVIDING AN EFFECTIVE DATE. 14 15 WHEREAS, on July 3, 2007, the City Commission approved the piggy-back of a 16 three-year contract between Solid Waste Authority of Palm beach County and Phillips and 17 Jordan, Incorporated (alk/a Phillips & Jordan, Inc.) of Robbinsville, North Carolina for 18 debris collection and disposal; and 19 WHEREAS, pursuant to paragraph 2B of the Agreement dated August 7, 2007, 20 between the City of Boynton Beach and Phillips & Jordan, Inc., the City has an option to 21 extend the Agreement for one additional three-year term from June 14, 2010 through June 22 13, 2013; and 23 WHEREAS, due to the critical nature of this service, it is imperative to have a 24 contract in place in order to avoid delays should there be a hurricane/disaster/emergency 25 situation; and 26 WHEREAS, upon staff s recommendation, the City Commission deems it to be in 27 the best interest of the citizens and residents of the City of Boynton Beach to exercise its 28 option to extend the Agreement with Phillips & Jordan, Inc., for one three-year period to be 29 utilized as an insurance policy on an "as needed basis". 30 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF 31 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: S:\CA\RESO\Agreements\Reso -Phillips & Jordan Debris removal Extension (2010).doc 11 1 1 1 1 1 1 1 1 2 21 2 2 2 2 2 2 2 ATTEST: 2 3 31 3 3 3 3 3 3 3 I' 1 Section 1. Each Whereas clause set forth above IS true and correct and 2 incorporated herein by this reference. 3 Section 2. The City Commission of the City of Boynton Beach, Florida, hereby 4 exercises its option to extend the Agreement with Phillips & Jordan, Inc. of Robbinsville, 5 North Carolina, for one three-year period ending on June 13,2013 which shall be utilized as 6 an insurance policy on an "as needed basis for debris collection and disposal. 7 Section 3. The City Manager is authorized to execute the necessary documents to advise Phillips & Jordan, Inc., of the City's decision to extend the Agreement. Section 4. A copy of Amendment #2 stating such is attached for your records. Part 1-20 (Agreements With Other Governmental Entities) of RFP No. 07-224/JMD states: All PROPOSERS submitting a response to this RFP agree that such response also constitutes a response to all State Agencies and Political Subdivisions of the State of Florida under the same terms and conditions, for the same prices and for the same effective period as specified in this RFP; should the successful PROPOSER(S) deem it in the best interest of their business to do so. The agreement resulting from this RFP in no way restricts or interferes with any State Agency or Political Subdivision of the State of Florida from re-solicitation for any or all items specified in this RFP. I would like to extend the offer to the City of Boynton Beach, Florida to enter into an exclusive agreement with P&J as allowed under the aforementioned Part 1-20 of said RFP. This offer is made at the same terms and conditions stated in the referenced Contract. The term of the agreement between our firms is effective beginning the date of acceptance (below) through June 13, 2013. Additionally, the attached information sheet is to ensure that P&J has the most recent information for the City of Boynton Beach on file.
