Ii 2 3 A RESOLUTION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, APPROVING AND AUTHORIZING 5 THE CITY MANAGER TO EXECUTE A FIRST 6 AMENDMENT TO INTERLOCAL AGREEMENT 7 BETWEEN THE CITY OF BOYNTON BEACH AND 8 PALM BEACH COUNTY TO CONTINUE 9 IMPLEMENT A TION OF THE YOUTH VIOLENCE 10 PREVENTION PROJECT UNTIL DECEMBER 31,2010; 11 AND PROVIDING AN EFFECTIVE DATE. 12 13 14 WHEREAS, the Palm Beach County Board of County Commissioners directed the 15 Criminal Justice Commission to develop a Youth Violence Prevention Program which 16 would address the increase in violent firearms crimes; and 17 WHEREAS, the Criminal Justice Commission was able to secure funding through 18 the Edward Byrne Memorial Justice Assistance grant which funded the YVPP program 19 through September 30, 2010; and 2 WHEREAS, due to the change in funding source and the transition of the program from the Police Department to the Recreation & Parks Department caused a slight delay in 2 the implementation of the program which allows the City to continue to offer the program 2 through the end of December, 2010; and WHEREAS, the City Commission of the City of Boynton Beach upon recommendation of staff, deems it to be in the best interest of the citizens of the City of Boynton Beach to approve and authorize the City Manager to execute a First Amendment to the Interlocal Agreement with Palm Beach County to continue implementation of the Youth V iolence Prevention Program in the City of Boynton Beach through December 31, 2010. 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: S:\CA\RESOlAgreements\Reso -First Amendment ILA with PSC for YVPP 09-10,doc II I I 1 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 2 being true and correct and are hereby made a specific part of this Resolution upon adoption 3 hereof. 4 Section 2. Upon recommendation of staff, this Commission does hereby 5 authorize execution of a First Amendment to the Interlocal Agreement between the City of 6 Boynton Beach and Palm Beach County to continue implementation of the Youth Violence 7 Prevention Program in the City of Boynton Beach through December 31, 20 10, a copy of 8 said First Amendment is attached hereto and made a part hereof as Exhibit "A". 9 Section 3. Y 2 2 2 ATTEST: Commissioner - Steven 2 3 31 3 3 3 3 3 eso -first Amendment ILA with PSC for YVPP 09-10,doc RJO-I&Y FIRST AMENDMENT TO INTERLOCAL AGREEMENT BETWEEN THE BOARD OF COUNTY COMMISSIONERS, PALM BEACH COUNTY, FLORIDA, AND THE CITY OF BOYNTON BEACH, FLORIDA This First Amendment is made the fourteenth day of September, 2010 to the Agreement of April 6, 2010 R2010-0531 between the Board of County Commissioners, Palm Beach County, a political subdivision of the State of Florida (herein referred to as the COUNTY), and the City of Boynton Beach, a municipality located in Palm Beach County, Florida (herein referred to as the CITY), each one constituting a public agency as defined in Part I of Chapter 163, Florida Statutes. WIT N E SSE T H: WHEREAS, Section 163.01 of the Florida Statutes, known as the Florida Interlocal Cooperation Act of 1969, authorizes local governmental units to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will harmonize geographic, economic, population and other factors influencing the needs and development of local communities; and WHEREAS, Part I of Chapter 163 of the Florida Statutes permits public agencies as defined therein to enter into Interlocal Agreements with each other to exercise jointly any power, privilege, or authority which such agencies share in common and which each might exercise separately; and WHEREAS, The Criminal Justice Commission (CJC), upon direction from the Board of County Commissioners (BCC), continues the development of a Youth Violence Prevention Project which addresses the increase in violent firearms crimes; and WHEREAS, the Criminal Justice Commission has recommended the use of Federal Edward Byrne Memorial Justice Assistance Grant funds to support the partnership by providing funds for the CITY to participate; and WHEREAS, the COUNTY agreed to reimburse the CITY for expenses, up to the amount of $279,900 from October 1, 2009 through September 30, 2010 for the Youth Violence Prevention Project; and WHEREAS, the parties mutually desire to extend the Interlocal Agreement until December 31,2010. NOW THEREFORE, in consideration of the mutual representations, terms, and covenants hereinafter set forth, the parties hereby agree as follows: 1. The Term of the Interlocal Agreement is amended to provide that the Interlocal Agreement shall continue until December 31,2010. Pursuant to Ordinance No. 2009-049, Palm Beach County has established the Office of the 1 In accordance with Palm Beach County Code, Chapter 2, Article III, Section 2.51, this First Amendment shall not take effect until executed by the CITY and the COUNTY.
