3 AN ORDINANCE OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, REGARDING THE
5 APPLICATION OF THE SCHOOL DISTRICT OF
6 PALM BEACH COUNTY, AMENDING
7 ORDINANCE 02-013 TO REZONE A PARCEL OF
8 LAND LOCATED WEST OF THE SOUTHERN
9 TERMINUS OF 31sT TERRACE SOUTH,
10 CONTIGUOUS TO THE NORTHERN BOUNDARY
11 OF THE CONGRESS MIDDLE SCHOOL AT 101
12 SOUTH CONGRESS A VENUE, AS MORE FULLY
13 DESCRIBED HEREIN, FROM PALM BEACH
14 COUNTY AGRICULTURAL RESIDENTIAL (AR)
15 TO PUBLIC USAGE (PU); PROVIDING FOR
16 CONFLICTS, SEVERABILITY, AND AN
17 EFFECTIVE DATE.

19 WHEREAS, the City Commission of the City of Boynton Beach, Florida has
20 adopted Ordinance No. 02-013, in which a Revised Zoning Map was adopted for said City;
21 and
22 WHEREAS, Michael C. Owens, on behalf of the School District of Palm Beach
23 County has filed a petition on behalf of the owner to rezoning a parcel of land more
24 particularly described hereinafter; and
25 WHEREAS, the City Commission, following required notice, conducted a public
26 hearing to consider the rezoning and heard testimony and received evidence which the
27 Commission finds supports a rezoning for the property hereinafter described; and
28 WHEREAS, the City Commission finds that the proposed rezoning is consistent with
29 the Land Use described in the City's Comprehensive Plan; and
30 WHEREAS, the City Commission deems it in the best interests of the inhabitants of
31 said City to amend the aforesaid Revised Zoning Map as hereinafter set forth.

1 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
2 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

Section 1.
The foregoing Whereas clauses are true and correct and incorporated
4 herein by this reference.
Section 2.
The following described land located at west of the southern terminus
5
6 of 31 sl Terrace South, contiguous to the northern boundary of the Congress Middle School at
7 101 South Congress A venue, as more fully described herein, is hereby rezoned from Palm
8 Beach County Agricultural Residential (AR) to Public Usage (PU):
9 LOT E, BLOCK 30, PALM BEACH FARMS CO. PLAT NO.8, ACCORDING TO
10 THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 5, PAGE 73, OF THE
11 PUBLIC RECORDS OF PALM BRACH COUNTY, FLORIDA.

13 A location map is attached hereto as Exhibit "A" and made a part of this Ordinance by
14 reference.
15 Section 3. That the Zoning Map of the City is amended to reflect this rezoning.

Section 4. All ordinances or parts of ordinances in conflict herewith are hereby
17 repealed.
18 Section 5. Should any section or provision of this Ordinance or any portion thereof
19 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect
20 the remainder of this Ordinance.
21 Section 6. This ordinance shall become effective immediately upon passage.
