3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, ANNEXING 0.95+/- ACRE OF LAND THAT IS
5 CONTIGUOUS TO THE CITY LIMITS WITHIN PALM BEACH
6 COUNTY AND THAT WILL, UPON ANNEXATION,
7 CONSTITUTE A REASONABLY COMPACT ADDITION TO THE
8 CITY BOUNDARIES; PROVIDING THAT THE PROPER LAND
9 USE DESIGNATION AND PROPER ZONING OF THE
10 PROPERTY SHALL BE REFLECTED IN SEPARATE
11 ORDINANCES TO BE PASSED SIMUL T ANEOUSL Y
12 HEREWITH; PROVIDING FOR CONFLICTS, SEVERABILITY,
13 AND AN EFFECTIVE DATE; PROVIDING THAT THIS
14 ORDINANCE SHALL BE FILED WITH THE CLERK OF THE
15 CIRCUIT COURT OF PALM BEACH COUNTY, FLORIDA, UPON
16 ADOPTION.

18 WHEREAS, the Comprehensive Plan for the City of Boynton Beach requires the
19 development of an Annexation Program; ,md
20 WHEREAS, The School District of Palm Beach County, owner, by and through its
21 agent, Michael C. Owens, of the property more particularly described hereinafter, have
22 heretofore filed a Petition, pursuant to Section 9 of Appendix A-Zoning, of the Code of
23 Ordinances, City of Boynton Beach, Florida, for the purpose of annexing a certain tract of
24 land consisting of approximately 0.95 +/- acre; and
25 WHEREAS, the City of Boynton Beach hereby exercises its option to annex the
26 following tract of land as hereinafter described, in accordance with Article I, Section 7 (32)
27 fthe Charter ofthe City and Section 171.044, and 171.062(2), Florida Statutes; and
28 WHEREAS, said tract of land lying and being within Palm Beach County is
29 ontiguous to the existing city limits of the City of Boynton Beach, and will, upon its
30 nexation, constitute a reasonably rompcJ:t addition to the City boundary.
31 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION

1 OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
2 Section I. That each and every Whereas clause is true and correct.
3 Section 2. Pursuant to Article I, Section 7 (32) of the Charter of the City of
4 Boynton Beach, Florida and Section 171.044, Florida Statutes the following described
5 unincorporated and contiguous tract of land situated and lying and being in the County of
6 Palm Beach, Florida, to wit:
7 LOT E, BLOCK 30, PALM BEACH FARMS CO. PLAT NO.8, ACCORDING TO
8 THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 5, PAGE 73, OF THE
9 PUBLIC RECORDS OF PALM BRACH COUNTY, FLORIDA.

11 SAID LANDS SITUATE, LYING AND BEING IN THE CITY
12 OF BOYNTON BEACH, PALM BEACH COUNTY, FLORIDAat

15 is hereby annexed to the City of Boynton Beach, Florida, and such land so annexed shall be
16 and become part of the City with the same force and effect as though the same had been
17 originally incorporated in the territorial boundaries thereof.
18 Section3 : That Section 6 and 6(a) of the Charter of the City of Boynton Beach,
19 Florida, is hereby amended to reflect the annexation of said tract of land more particularly
20 described in Section 2 of this Ordinance.
21 Section 4: That by Ordinances adopted simultaneously herewith, the proper City
22 zoning designation and Land Use category is being determined as contemplated in Section
23 171.162(2), Florida Statutes.
24 Section 5. All ordinances or parts of ordinances in conflict herewith are hereby
25 repealed.
26 Section 6: Should any section or provision of this Ordinance or any portion thereof
27 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect

2 Section 7: This Ordinance shall not be passed until the same has been advertised
3 for two (2) consecutive weeks in a newspaper of general circulation in the City of Boynton
4 Beach, Florida, as required by the City Charter and Section 171.044, Florida Statutes.
5: Section 8. This ordinance shall become effective immediately upon passage.
6 Section 9. This ordinance, after adoption, shall be filed with the Clerk of the
7 Circuit Court of Palm Beach County, Florida.
