A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING AND DIRECTING THE MAYOR AND
CITY CLERK TO EXECUTE A SERVICE CONTRACT
BETWEEN THE CITY OF BOYNTON BEACH AND BLC
LAWN MAINTENANCE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Boynton Beach, Florida (City) has
previously entered into a contract with BLC Lawn Maintenance,
which contract is due to expire on November 2, 1994; and
WHEREAS, upon recommendation of staff, it is deemed to be
in the best interests of the citizens and residents of the
City by the City Commission to renew said contract for a one
year period.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

Beach, Florida, hereby approves authorizes and directs the
Mayor and City Clerk to enter into a Service Contract between
the City of Boynton Beach and BLC Lawn Maintenance for
landscape maintenance, which Contract is attached hereto as
Exhibi5 "A".

SERVICE CONTRACT
This agreement dated day of ,19
by and between the CITY OF BOYNTON BEACH, PALM BEACH COUNTY,
FLORIDA, hereinafter called the Owner, and
TARE LANDSCAPING (a corporation organized and existing under
the laws of the State of FLORIDA) and hereinafter called the
Contractor.
WITNK$$KTH: The Owner and the Contractor, for the
consideration stated herein, agree as follows:
ARTICLE I: SCOPK OF WOP4C
The Contractor shall perform all required work and shall
provide and furnish all labor, materials, necessary tools,
expendable equipment and all utility and transportation services
required for: ANN~AL CONTRACT FOR LANDSCAPE MAINTENANCE

contract.
all in strict accordance with the specifications, including any and
all Addenda, and in strict compliance with the Specification
documents hereinafter enumerated.
It is understood and agreed that said labor, materials, tools,
equipment and service shall be furnished and said work performed
and completed under the direction and supervision and subject to
the approval of the Owner or its authorized representative.
However, the Contractor shall retain his identity as an independent
contractor and no wise shall be considered an agent of the Owner.

A~TICLE II: CONTRACT PRICE
The Contractor shall pay the Owner as just compensation for
the ANN~AL CONTRACT FOR LANDSCAPE MAINTENANCE as provided in the
Specifications Documents for the following unit prices. The
Contract amount is One hundred and fourty-five thousand, fiv,':
hundred.and thirty nine dollars ($145,539.00) based upon unit lump
sum prices herein contained. The undersigned Bidder agrees that he
has carefully inspected the site and is thoroughly familiar with
all conditions therein.
The Bidder further agrees to commence on December 1, 1994.
IN WITNESS WHEREOF, The parties hereto have caused this
agreement to be executed as of the day and year first above-
written, in one (1) counterpart each of which shall for all
purposes be deemed an original.
