AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
REGARDING THE APPLICATION OF VINCENT
BARRERA (A 0.41 ACRE PARCEL LOCATED AT
3025 N. FEDERAL HIGHWAY, OPPOSITE THE
NORTHEAST CORNER OF THE GULFSTREAM
MALL); AMENDING ORDINANCE 91-70 OF SAID
CITY BY REZONING A CERTAIN TRACT OF LAND
MORE PARTICULARLY DESCRIBED HEREIN,
FROM CG (GENERAL COMMERCIAL IN PALM
BEACH COUNTY) TO C-3 (COMMUNITY
COMMERCIAL); PROVIDING FOR CONFLICTS,
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach, Florida
has adopted Ordinance No. 91-70, in which a Revised Zoning Map was
adopted for said City; and
WHEREAS, Vincent Barrera, as owner of the property more
particularly described hereinafter, has heretofore filed a Petition, pursuant to
Section 9 of Appendix A-Zoning, of the Code of Ordinances, City of Boynton
Beach, Florida, for the purpose of rezoning a certain tract of land consisting
of 0.41 acres, said land being more particularly described hereinafter, from
CG (General Commercial in Palm Beach County) to C-3 (Community
Commercial) ; and
WHEREAS, the City Commission deems it in the best interests of the
inhabitants of said City to amend the aforesaid Revised ?oning Map as
hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY

NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The following described land, located in the City of
Boynton Beach, Florida as set forth as follows:
The South 50 feet of the northeast V4 of the
southwest V4 and the northeast V4 of Section 4, ,
Township 46, Range. 43, Palm Beach County,
Florida, lying east of US No. 1 less and except that
portion conveyed to the State of Florida in Book
138, Page 223.
be and the same is hereby rezoned from CG (General Commercial in Palm Beach
County) to C-3 (Community Commercial). A location map is attached hereto as
Exhibit "A" and made a part of this Ordinance by reference. Attached as Exhibit
"B" is a copy of the conditions/requirements for this rezoning, which are
incorporated herein.
Section 2: That the aforesaid Revised Zoning Map of the City shall be
amended accordingly.
Section 3: All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
Section 4: Should any section or provision of this Ordinance or any
portion thereof be declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the remainder of this Ordinance.
Section 5: This ordinance shall become effective immediately upon
