4 A RESOLUTION OF THE CITY OF BOYNTON
5 BEACH, FLORIDA, AUTHORIZING AN ADDITIONAL
6 EXTENSION OF THE "NOTICE OF INTENT"
7 APPROVED BY RESOLUTION NO. 10-021; AND
8 PROVIDING AN EFFECTIVE DATE.

10 WHEREAS, the City Commission approved a Notice of Intent (NOI #2010-2) by
11 Resolution R10-021 on February 2, 2010; and
12 WHEREAS, the Notice of Intent was to be in effect from the date of adoption and
13 thereafter for a maximum period of 180 days, unless otherwise extended by the City
14 Commission by subsequent Resolution following public hearing; and;
15 WHEREAS, on July 6,2010, the City Commission approved a sixty (60) day extension
16 ofthe Notice ofIntent and moratorium to September 29, 2010; and
17 WHEREAS, on September 21, 2010, the City Commission approved a second sixty (60)
18 day extension of the Notice ofIntent and moratorium to November 28, 2010; and
19 WHEREAS, staff has recommended the temporary moratorium be extended for an
20 additional sixteen (16) days thereby extending the time period from November 28, 2010 to
21 December 14, 2010 to allow final processing of ordinances following the study of impacts and
22 regulations related to adult entertainment uses.
23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
24 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
25 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
2 being true and correct and are hereby made a specific part of this Resolution upon adoption
2 hereof

1 Section 2. The City Commission of the City of Boynton Beach, Florida does hereby
2 extend the Notice of Intent #2010-2, originally approved by Resolution No. R10-021, for an
3 additional sixteen (16) days, to expire on December 14, 2010.
4 Section 3. That this Resolution shall become effective immediately upon passage.
