Minutes 01-17-84MINUTES OF THE REGULAR ~,~ETING OF THE CITY COUNCIL HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, JANUARY 17, 1984 PRESENT James R. Warnke, Mayor Carl Zimmerman, Vice Mayor Nick Cassandra, Councilman Joe deLong, Councilman Samuel L. Wright, Councilman Mayor Warnke welcomed everyone and called the meeting to order at 7:30 P. M. He announced the Invocation tonight will be given by Reverend Nathaniel Robinson, Church of God, followed by the Pledge of Allegiance to the Flag led by .Councilman Nick Cassandra. Peter L. Cheney, City Manager Betty S. Boroni, City Clerk William Doney, Asst. City Attorney AGENDA APPROVAL Councilman deLong stated he wants to put an item under Legal - Other and he does have an item on the agenda, D-l, which he would like to follow this additional item. Councilman Cassandra stated he would also like to add an item under Legal - Other. Mr. Cheney referred to distributing a blue folder with addi- tional items and read three additional bills to be added to Approval of Bills under the Consent Agenda~ Also, under the Consent Agenda, ratification of a decision by the South Central Regional Wastewater Treatment & Disposal Board. There is an additional resolution relative to Summit Investments and he would like two ordinances pertaining to Summit Investments deleted, Stems B-3 and B-4. Vice Mayor Zimmerman moved to adopt the agenda as amended, seconded by Councilman Wright. Motion carried 5-0. ANNOUNCEmeNTS Mayor Warnke acknowledged the presence in the audience of the immediate past Mayor Marry Trauger; the Director of the Chamber of Commerce, Owen Anderson; and ex-Mayor Ed Harmening. The ~yor read a Proclamation proclaiming the 4th day of February, 1984, as Black Awareness Day. REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 CITY MANAGER'S REPORT General Revenue Sharing Mr. Cheney referred to there being new regulations involved with general revenue sharing and advised we anticipate getting $400,000 of general revenue sharing funds, which is consistent with last year but has not been confirmed yet. There is special emphasis this year on our involvement with the handicapped. A notification was published in today's paper stating that we do employ the handicapped and he told about meeting other require- ments. At the end of the year, we must give a report on what we have done for the handicapped. Beach Project Construction Mr. Cheney announced that construction is anticipated to begin on the beach project next Monday morning. The contractor will move in a construction trailer. We have secured all the permits and will get the final building permit this week. The construc- tion will start from the north to the south. The exit will become a two way street in and out of the parking area. Parking will be restricted to the lower level at the south end. We will do our best to have safe access to the beach. Our lifeguards will still be there and the parking attendants will be there to assist. East Parking Lot of City Hall Councilman deLong questioned when work would begin on the east parking lot and Mr. Cheney replied that he didn't know as we don't have the money. He hopes as we work throughout the year, we will develop a funding mechanism in capital improvements for additions to the fire and police stations and it would make sense to postpone the parking lot changes until after that. Mr. deLong questioned the estimated cost for the parking lot improvements and Mr. Clark replied that it was estimated to be approximately $30,000 to $40,000. PUBLIC AUDIENCE Mayor Warnke announced that anyone who wishes to speak on any item not on the agenda tonight is welcome to come forward. He added if anyone wishes to sPeak on any item on the agenda to please fill out a slip and leave it with the City Clerk and they will be called upon at that time. Ms. Janet Folsum, First Church of Christ Scientist, respectfully requested a waiver of the $200 fee set forth in Chapter 5 re- garding the variance procedure for parking lot regulations. -2- REGULAR CITY COUNCIL MEETING BOYNTO~J BEA'C~, FLORIDA JANUARY 17, 1984 She added that they have a small congregation and would appre- ciate consideration of this request. She explained that it would cost $5,000 to $6,000 to have their gravel driveway black- topped. Mr. Cheney responded that he was sorry that he could not recommend waiving this fee as there are many small churches and businesses and the fee covers the administration cost of applications. The City Council must' make'a decision. Mr. Zimmerman questioned if this would come before the City Council or Board of Adjustment and Ms. Folsum replied that this has been in the process since last May and explained that the parking meets all codes, but the circular driveway is in question and the Community Appearance Board did not think the driveway should be required to be blacktopped. Mr. Cheney clarified that the issue is not whether they should get a waiver of the parking lot ordinance, but a question of the fee. Mr. Zimmerman ques- tioned if the Council had this authority and Mr. Doney replied affirmatively. Mr. Cassandra referred to discussion several months ago about waiving the fee for setting up bleachers for churches and stated that fee concept was approved. Mayor Warnke asked if the Council wished to take any action on this and re- ceived no response. Mr. deLong suggested that the staff submit a recommendation and Mayor Warnke replied that Mr. Cheney did give a recommendation. Mrs. Dee Zibelli, 440 Ocean Parkway, requested clarification whether she could address the Council on an ordinance scheduled for first reading and Mayor Warnke replied affirmatively. Mr. deLong added that first reading is not open for public comments. Mr. Doney advised the Council could do whatever they want. Mayor Warnke stated that he feels any person wanting to speak on any item can come forward, but no action has to be taken. This will enable the Council to have background information for second reading. Mr. Zimmerman added that he believes the Council should honor the request if a slip is filed. Mr. deLong stated this would open first reading to public audience. Mr. Zimmerman agreed, but only if the intention is filed with a slip at the proper time. CONSENT AGENDA A. Bids Cleaning and Repainting of one (1) Eimco-Envirotech Potable Water Clarification Unit - Utilities The Tabulation Committee recommends awarding the bid to Brinkerhoff Sandblasting in the amount of $19,499. Sale of Surplus Laboratory Items - Utilities The Tabulation Committee recommends rejecting the sole bid received and donating the equipment to Lake Worth High School. -3- REGULAR CITY COUNCIL MEETING BOYNTONBEACH,.FLORiDA JANUARY 17, 1984 One (1) Type I Remount - Fire Department The Tabulation Committee recommends awarding the bid to E.V.F., Inc. in the amount of $23,665. One (1) ~wenty-Five Cubic Yard Compaction Collection Body and Chassis for 25-yard Rear Loadinq Compaction Body - Public Works The Tabulation Committee recommends awarding the bid to H. F. Mason in the amount of $66,798. Liquid AG Injection System - Sole Source Supplier - Golf Course It is recommended that the Liquid AG Injection System be awarded to Liquid AG Systems, Inc. in the amount of $-6,848. Clay Pipe & Fittinqs - Sole Source Supplier - Utilities It is recommended that this purchase be made from Dickey Company. Repair, Waterproof & Paint Exterior of City Hall The Tabulation Committee recommends awarding the bid to Griffin & Son Painting in the amount of $4,799.95. B. Budget Transfer Request - City Hall Repair, Waterproofing & ~ Painting This is requested to provide funds for the above bid. C. Approval of Encumbering Documents - Finance Department Twenty documents were submitted with a memo dated 1/4/84 from Mr. Grady Swann. D. Payment of Bills - December, 1983 See list submitted. E. Ratification of South Central Regional Wastewater Treatment & Disposal Board action of January 12, 1984 re: Authorizing Russell & Axon to prepare a study on ~he Clarifiers and DAF Units Councilman deLong moved adoption of the Consent Agenda with the additions, seconded by Councilman Wright. Under discussion, -4- REGULAR CITY COUNCIL ~ETING BOYNTON BE~CH, FLORIDA JANUARY 17, 1984 Mayor Warnke referred to the sale of surplus laboratory items and stated it was indicated not to sell them because of the small amount bid and Atlantic High School was not interested, so approval was requested to give them to Lake Worth High School. He asked if these items were offered to Santaluces High School and Mr. Cheney replied negatively as Santaluces is a brand new high school and they have everything. Mayor Warnke questioned what the encumbering documents are which are referred to and ~. Swann explained these cover funds which were set aside in 1982/83 and are unexpended and they prepare to spend them in 1983/84. Mr. Cheney added this is to keep the funds in reserve and not lose them. Councilman Cassandra referred to the terms and conditions submitted by Liquid AG Systems and read the one stating: "Customer acknowledges that no damage was done to storage tanks, pumps, piping or other property of the customer by Liquid Ag Systems, Inc., during delivery of product." He asked what happens if there is damage and a representative explained that if there is damage, it will be replaced. Mr. Cassandra stated that he wants to make sure we don't have to take damaged tanks and Mr. Cheney advised that we do not pay until everything is okay on everything. Motion carried 5-0. Mr. Cheney referred to approval being given for both the paint- ing of City Hall and the transfer of funds from contingency and explained that the building will be sand blasted, sealed, and painted. He added that letters will be put on the western wall and told about the process to preserve the letters. He clari- fied this money is just for painting and bids are still being received for the signs. He added that the bid for this paint- ing was low, but we are satisfied the contractor should be able to do the job. BIDS NONE PUBLIC HEARING Request for abandonment of a special purpose easement submitted by James Pollock - 520 Mission Hill Boulevard (description: 6 ft. easement along the southern boundary of Lots 1 and 2 and abutting easement along northern boundaries of Lots 5 and 6, Block 8, Mission Hill) Mr. Annunziato informed the Council this is a request for aban- donment of a special purpose easement located to the rear of -5- £ REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 520 Mission Hill Boulevard. The utility easemen~ is currently encumbered with power and utilities, but the applicant has made arrangements to relocate them. The Planning & Zoning Board recommended approval subject to the applicant submitting a unity of title to the property. Mayor Warnke asked if anyone wanted to speak in favor of this request. He asked if the applicant was present and Mr. James Pollock came before the Council. Mr. Pollock referred to being concerned about the unity of title and stated he approached the Building Department and asked if the City needed this protection. The abandonment of the easement was requested to build a pool and plant landscaping. As far as the Building Department is concerned, there is no need for a unity of title until he is committed to building. He approached Mr. Annunziato with this and was informed it would be no problem. Councilman deLong referred to the telephone company having concern and asked if that had been taken care of and Mr. Annunziato informed him the applicant will have to relocate the utilities at his expense. He explained how the unity of title concerns the rear yard setbacks, which is not an issue until building. It would not be inconsistent with the Planning & Zoning Board's recommendation to require a unity of title with a program of construction. Mayor Warnke ascertained nobody wished to speak in opposi- tion to this application and then declared the public hearing closed. The Mayor then recognized the presence of Ms. Janet Olin, Assistant to Representative Frank Messersmith. Councilman deLong moved to grant this request, seconded by Councilman Wright. No discussion. Motion carried 5-0. DEVELOPMENT PLANS Request for Master Plan Modifications - Boynton Lakes PUD Mr. Annunziato informed the Council this is a request for master plan modification submitted by Mr. Santiago Malavasi. He explained the location. The applicant is proposing the following three modifications: Change in unit types for the remainder of Phase II from single family attached to zero lot line single family detached units. - 6 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 A request to include as a permitted use in the Boynton Lakes PUD, a cable TV facility to include one 6.1 meter antenna, two 5 meter antennas and one free standing 60 ft. receiving tower. A request to be permitted to transfer to other por- tions of the PUD the difference in units between what was permitted and what is proposed. In this instance the number of units proposed is 168 and the number of units previously approved was 198. Mr. Annunziato continued that the process of a master plan modification leaves the determination with the Council as to whether or not the changes requested are substantial. The Technical Review Board met to review these requests and sub- mitted the following recommendations: that the City Council make a finding of no substan- tial change on the request to change the type of units proposed and that the Planning & Zoning Board approve this request. that the City Council make a finding of substantial change for the cable TV facility. It is the opinion of the Recreation & Parks Department that the site chosen seriously impairs the use of the existing recreation facility for recreation purposes; however, under any circumstances, the use of the cable TV facility would be limited to the homeowners in Boynton Lakes. If the cable facilities are expanded beyond the PUD, the use becomes commercial in nature and could not be considered for location in the PUD. He pointed out the location of the recreation building and proposed towers. that the City Council not address at this time the issue of transferring to other portions of the PUD units made surplus by this change in unit type. The Technical Review Board did offer for Council's con- sideration a procedure to address this issue in the future. Our recommendation is to allow the deve- loper to transfer his surplus units, but that the total unit count in any receiving development phase not be increased by more than 5%. With this in mind, it is suggested that the applicant submit an additional master plan modification showing how the surplus units would be distributed using this distribution as a guideline. Anything in addition to 5% could affect utilities, traffic configuration, etc. - 7 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 Mr. James Holland came before the Council representing the applicant and advised they have no particular problem with the recommendations of the Technical Review Board with respect to modification of the master plan. They did want to take exception to the recommendation of the Parks & Recreation Director regarding the cable TV facilities. They think his determination was based upon a poor presentation of the site plan on their part and the cable TV consultants to the extent a small portion of the recreation area of Boynton Lakes was shown. He then showed a plan of the entire recreation area. He thinks the Council will agree the impact of the TV facilities upon the recreation tract is minimal. He explained what the proposed facilities would consist of and pointed out the location. This par- ticular site was determined after review of alternative sites in the PUD. They wanted to minimize the impact on all the residents of Boynton Lakes. He explained how the cable TV facilities would be buffered from the recreation facili- ties and residences. They request the modification of the PUD as submitted. Mayor Warnke referred to the dish being approximately 18 feet and Mr. Holland replied that it may be larger and explained the technical aspect involved regarding landscaping materials. Mr. Cheney explained how this was encumbering open recreation area and stated it is recommended this be deter- mined as a substantial modification and should come back through the whole review process. Mr. Holland replied that he didn't know if this would serve a useful purpose as the master plan for Boynton Lakes with the recreation facilities exceeds the requirements. Councilman deLong referred to a very thorough report being submitted by the City Planner and stated he believes the answers are appropriate. He believes we should uphold and accept the recommendations of the City Planner. Mr. Holland stated it was his understanding this is a recom- mendation of the Parks & Recreation Director, who sits as a member of the Technical Review Board. Mr. deLong asked if he had received a copy of the City Planner's memo and Mr. Holland replied negatively. Mr. Holland questioned if the recommendations were approved as submitted, what would be their next step and Mr. deLong informed him the next step would be to get in touch with the City Planner. - 8 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 Mr. deLong moved to accept the recommendations of the City Planner as noted in his memo of January 11, 1984. Mayor Warnke referred to this being an ordinance on first reading and announced a public hearing will be held on second reading. Two people have requested to speak on this subject. At the present time, the Council may or may not wish to take action on what they say. He asked if there is any precedent regarding public input on first reading and Mr. Doney replied there is not any legally binding format and it is a decision for the Council. Mayor Warnke asked if the Council members wished to have people speak on first reading on this important subject and Vice Mayor Zimmerman replied that if they have noted their intention on a slip and it is brought up at the proper time, he is willing to hear them. Mayor Warnke ascertained there were no objec- tions from the remainder of the Council. Mrs. Dee Zibelli, 440 Ocean Parkway, referred to the districting question being voted on in 1980 when the popula- tion was approximately 35,000 and stated at that time, the City was divided into five districts. The 1983 population is shown as 42,000 and according to projections, the popula- tion will be 71,000 by 1990. She asked if it seemed intelligent to decrease the number of districts with increased growth? The referendum passed overwhelming creating five districts and the five districts have worked well. Also, with the proposed election of a mayor at large, there will be double representation of one district. - 13 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 Mrs. Zibelli continued that she has no problem with the 60 day residency requirement or a Council person having to vacate his seat if moving from the district in which he was elected. Some people have concern about running for as many terms as wanted, but a person can be usurped if not per- forming. Mrs. Zibelli stated that she believes these issues should be voted on individually. Mrs. Zibelli then referred to the methods of choosing mayors and the powers of the mayor. Mrs. Zibelli asked the Council to consider maintaining the present five districts, keeping in mind the overwhelming passage of the referendum in 1981 and keeping in mind future growth. Let us not change for the sake of change! She requests that the five districts be kept intact and the people be allowed to vote on the other items individually. Col. Marty Trauger, 702 S.W. 28th Avenue, referred to districting and stated he feels we can say in Boynton Beach districting as now constituted has really served its purpose and now is no longer needed. It was set up originally solely for one purpose, to elect a black to the City Council to satisfy a need that had been going on for a long time. A black was elected, but he moved and it has shown a black can be elected from a district not having a total black popula- tion or majority. Why should the districts be changed? Why not recommend no districts and run at large. He knows of no fact that will support that districts and Council truly sup- port that district with a neglect of others. All the pre- sent Council has given support to the entire city. If a person runs from a district and was elected from a district, that is a different story. During the last seven to eight elections when candidates ran at large, they came from the entire city and we always had ten to fourteen candidates in the primary. Since districting, there has only been two and in one case only one candidate. As our city is growing, qualified candidates are needed who live within the city limits. Qualified candidates are needed, but that doesn't come around each time to every district. Look at the people elected within the last ten years. We really haven't had a majority of the truly outstanding leaders in the major walks of life and not too many years ago, we elected to this Council, who by today's standards, would probably be classified as functional illiterates. The best qualified educationally and experienced people are needed to sit on this City Council. With the western area growing, we see - 14 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 businessmen and qualified citizens moving to that area away from the corporate part of the city. In a few years, the boundaries will have to be adjusted again. Why not now, just eliminate the districts? Col. Trauger then referred to the office of mayor and stated he does not feel the way for electing a mayor should be abandoned. Looking back ten to fifteen years, there was not any mayor who could have done as good a job as he did without first serving as vice mayor. Perhaps, Councilman Joe deLong would be the exception because he had experience as mayor of Boca Raton. In looking at other cities and how they chose mayors, either from the Council or serving as vice mayor first, we have found relatively stable govern- ments. However, where mayors are elected separately, cities have had problems. People could run for mayor who have never attended a meeting or served as a councilman. The population is just stirred up by campaign promises. Col. Trauger then referred to consecutive terms of the City Council and stated the two term and staying out a term has served very well. It is easier for an incumbent to get elected. With continuing terms, he feels we will get an entrenched Council. He then read a newspaper article citing this example from Boca Raton. He stressed that our present terms of office keep the councilmembers on their toes and they must be active or they go out. He believes that con- secutive terms are so great a rule with the current Council, if they believe in that, should put in a restriction that no member can serve as a starter. Col. Trauger referred to a vast portion of the people not having spoken in reference to these changes either in objec- tion or in concurrence, but stated the people will believe what the candidates campaign on. He asks why the election machine should be overhauled now? Col. Trauger added that when he returned from Virginia after Christmas, he drove from U. S. 1 to Seacrest Blvd. and almost fainted to see how beautiful 23rd Avenue has been completed and also Gulfstream Boulevard. Councilman deLong stated that he believes the ex-Mayor was in error when he said we formed the districts in order to elect a black. Under no circumstances was he involved in anything like that. He went along with districts because three or four people who served on the Council came from the one district. Also, he thinks Councilman Wright was elected before there were any districts. He clarified that - 15 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 Councilman Wright was elected on his own because the people throughout the city supported him. Col. Trauger agreed that may be an error, but the sole point in districting was to get a black on the City Council. Councilman deLong referred to the question of continuing in office after serving two terms and stated he never heard of any legislative body to restrict it to two terms. This is only done in the executive branch and explained. Why is the feeling to restrict any member of Council to serve two terms? This is very expensive. He told about plans made while he was in office, which were not carried out after he went off the Council and the expense involved to carry out these projects today which are still needed. Mayor Warnke referred to this just being the first reading of the ordinance and stated a public hearing will be held at the second reading. Councilman deLong suggested seeing what the people want and the candidates can campaign when this is put on the ballot. Councilman Wright stated that he would like to comment that he was instrumental in fighting for districting, but not particularly to get a black elected to the City Council. Black people are elected like white people to serve people and he has tried to do that. There was a coalition of whi- tes and blacks together in support of districting. They were tired of everyone coming from Chapel Hill. Many people don't travel North Seacrest Blvd. or 10th Avenue daily and they felt representation was needed from all communities. He believes the Sun Sentinel was far-fetched in regard to their editorial and commends Councilman deLong on his response. If you look at the black population in Boynton Beach, there is no way the black community could elect a black person on the City Council. The support of the white com- munity is needed as well. He is thankful our former Councilwoman Lyn Huckle said the people should decide on what they wanted with districting. The vote for this was overwhelming. Had they wanted districting to get a black elected to the City Council, probably Mayor Warnke would not be sitting here today because he represents a district with approximately 75% black people. Councilman Cassandra stated since May 1983, he has been pushing for this change in election law and he would like to ask former Mayor Trauger where he has been during the last eight meetings when this was being discussed instead of coming now? Also, why did Mrs. Zibelli also wait? He has - 16 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 received no communication until tonight on pros or cons of this and there have been eight meetings° Vice Mayor Zimmerman stated the idea of putting these various items on the ballot separately isn't going to work very well. We could have a combination of several things that won't fit together as a package. We took the direction of trying to work up a package and he thinks that is the way we are going to have to go. Mr. Doney informed the Council that the districts must be approved and numbers assigned before approval of the pro- posed ordinance. Councilman Cassandra advised that he put together an overhead to show what he has been advocating. He showed this proposal and referred to taking all the concerns of the incumbents as much as possible, continuity of experience and tried to get together the basic 2/3 concept we have now. He suggests the numbering to start with 1 at the bottom of the proposed graph, District 3 next, District 2 next and District 4 at the top portion of Boynton Beach. He looked at the transition points and problems which may come about. He explained how the forthcoming elections would affect the proposed districts. He recommends Districts 1, 3, 2 and 4 as shown on the graph. Mr. Zimmerman questioned what proposed map these were being applied to and Mr. Cassandra replied that Proposal ~3 is more acceptable as presented by the Planning Director. Councilman Cassandra moved to accept the proposed districts according to voting district Proposal 93 as outlined: Yellow to be District 1 Blue to be District 3 Red to be District 2 Green to be District 4 Councilman deLong seconded the motion. Under discussion, Mr. Wright commented that he expressed dissatisfaction with Proposal #1. He felt the black community should not be split based on previous court cases. When he votes to sup- port this ordinance, it is only to go to public hearing and he is not sure of his last decision. He wants to hear further from the public at the hearing on February 7. Mr. Zimmerman commented that Mr. Annunziato did a good job. He understands the appli- cant is willing to accept this recommended zoning. This ordinance acknowledges the recommendation. It is in order to approve this ordinance on first reading. Motion carried 5-0. - 21 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 Report from City Attorney - Occupational License to Sell Jewelry Mr. Doney referred to a memo being submitted and advised it is their opinion this use could be regulated by prohibiting sales from hotel and motel rooms. Mr. deLong moved that the City Attorney be instructed to amend the ordinance to make this a prohibited use in the zoning ordinance. Mr. Zimmerman asked if this would come under the review of the Planning & Zoning Board first and Mr. Cheney replied affirmatively. Mr. Cassandra seconded the motion. Under discussion, Mayor Warnke commented that he thinks this is a good idea. Motion carried 5-0. Utility Bond Refinancing Mr. Cheney read his attached memo dated January 17, 1984, addressing the refinancing question for utility bonds. Mayor Warnke commented that this is an excellent report on the status of the financial advisors at the present time. He added that he has received numerous phone calls from financial institutions. Councilman deLong referred to re- affirming the agreement and Mayor Warnke agreed we had, butl the company has changed hands. Mr. Cheney added that the changes identified in his memo have taken place and we were not aware of some agreements until yesterday. This needs to be explored further. He doesn't think we should move ahead right now. We should meet with the principals involved. Councilman Wright stated he wants to make sure we are working with firms and not individuals in firms. Councilman deLong added that it must be considered that we have had firms here for a long period which have been outstanding and reputable. Mr. Cheney told about satisfactory rela- tionships with key representatives during the past thirty years and stated as long as the individuals are capable and give the right advice, he prefers working with an individual rather than working with a large company and not knowing who will be your advisor day to day. Mr. deLong told about having an outstanding relationship with Mr. A1 Shepard. After discussion, Mr. Zimmerman moved to accept the report, seconded by Mr. Cassandra. Mayor Warnke clarified that it was moved and seconded to accept this report with a followup report to be submitted at a later date. Under discussion, Mr. Wright requested when the City Manager gets information, he would like to have it in advance if possible, so we can study it. Motion carried 5-0. - 22- REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 Amendment of Ordinance No. 83-41 to Include Stipulations' Councilman deLong moved to place the stipulations which he presented and were made a matter of public record to amend Ordinance No. 83-41 to include those stipulations as they were given. We are dealing with an autonomous body and he wants to be sure we are going in the right direction. The City Attorney said not to put these in the ordinance, but he thinks they should be in there. Councilman Cassandra clarified these stipulations regarded height and wet lands. Mr. Cassandra then seconded the motion. Mayor Warnke clarified that it had been moved and seconded th amend Ordinance No. 83-41 to include the stipulation regarding the height limitation and protection of the mangroves. Mr. deLong clarified that he wanted the stipula- tions he submitted and made a matter of public record included. Under discussion, Mr. Wright referred to hearing about the plan from the Community Redevelopment Agency regarding erecting a facility in the downtown zone. He doesn't want us to take that negatively. They were commissioned to do a job and we should not say to the designers or the Community Redevelopment Agency that the plan should reflect totally what is in the ordinances or charter. It is incumbent upon the Planning & Zoning Board and City Council to decide we have a 45 ft. height limitation. He feels there is a pur- pose for downtown redevelopment. Motion carried 5-0. Consider Rescinding Last City Council Action Concerning Community Redevelopment Funds - Requested by Joe deLonq Councilman deLong referred to having money invested and stated if nothing else occurs except upgrading the area, he thinks the taxpayers will be getting their money's worth. He moves to rescind the previous action taken in so far as the budget was concerned. Mr. Wright seconded the motion. Under discussion, Mr. deLong stated he wants to make it spe- cifically clear this is the body which approves and rejects. We are not guided by the desires of any board in the city. 10% of federal revenue sharing goes to the Community Relations Board and they come to the City Council to allo- cate funds. Motion carried 4-1 with Mayor Warnke dissenting. Vice Mayor Zimmerman moved to appropriate $15,000 to the Community Redevelopment Agency at this time. Councilman - 23 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 Cassandra seconded the motion. Under discussion, Mr. Cheney referred to this being an open ended allocation and Mr. deLong agreed this is not the total amount of money we are going to give them. He believes we are setting aside the amount of $40,000. Mr. Zimmerman added that he believes we should wait and see if this plan is approved or not. He is sure there will be changes made to the plan. When the plan is approved, he is sure they will need money; but if not approved, he doesn't think they should have more. Mr. deLong clarified that he will go along with additional funds if needed if the plan is approved and Mr. Zimmerman agreed. Mr. deLong suggested that a certain amount of money should be set aside. Mr. Wright stated that he is still opposed to this whole process. He wants to see the Community Redevelopment Agency continue what they have started and the City continue what we have started. He thinks we should support this request for $15,000. Mr. deLong agreed that he was not in favor of stopping the project after all the money which has been put into it, but many people have the oppo- site feeling. After discussion, Mayor Warnke clarified the motion is to allocate $15,000 from the general revenue sharing funds to the Community Redevelopment Agency at the present time. As requested, Mrs. Boroni took a roll call vote on the motion: Mayor Warnke - Nay Vice Mayor Zimmerman - Aye Councilman Cassandra - Aye Councilman deLong - Aye Councilman Wright - Aye Motion carried 4-1. Residency of Board Members Councilman Cassandra referred to the question being raised in May that there were some board members not residing in the City of Boynton Beach. The intent of his recommendation was that if any board member moved that he would have to resign because it was in conflict with the ordinance. He referred to the possibility of a four year appointment being made and a person could live out of town for three years after being appointed. He told about the clauses in the ordinances not being written the same in reference to this. He feels that any person who is on a board presently and does not reside in Boynton Beach where the code contains a residency requirement, they should be asked at the end of today's Council meeting to resign with the proper letter of thanks. - 24 - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JANUARY 17, 1984 Councilman deLong stated anyone on any board can be removed for just cause. It can be stated that moving out of the city is just cause. Councilman Wright stated that people who have been appointed could stay until the end of their term and Councilman Cassandra replied this was not his intent since some boards have longer than one year terms. Councilman Wright stated with a one year term they should be able to remain. Mr. Cassandra stated it should be con- sistent. After further discussion, Mr. Doney advised that he will look at each ordinance again and can insert this additional provision. Mr. Cassandra moved to draft an ordinance covering the resignation of any board member, other than those covered by State Statute, who move out of town to relinquish their position on the board. Mr. deLong seconded and the motion carried 5-0. The matter of selling Bonds for new m~ney for new projects is, at the moment, a secondary issue. Because of information and statements that have been made to City Personnel on Monday and Tuesday, January 16 and January 17, 1984, it is currently recommended that the City Council take no action relative to refunding of the Municipal Utility Bonds at this time. Within the last two days, suggestions have been made that Financial Advisory and Underwriting Companies have entered into agreements concerning the City's financial services; agreements about which the City was not aware. It has not been possible up to this point to determine the validity and accuracy of these possible agreements or to determine what liability the City might have if it were to make a decision concerning Bond Underwriting nderwr riOr to further investigations of the current and past relationships between iting Firms. The City has had, in the past, a continuing relationship with particular persons and experts and these persons have had affiliations with companies that have changed from time to time as they saw fit, or as circumstances required. These relationships for the past few years have been as follows: 1. A1 Shepard with the William R. Hough & Co. with A1 being the Primary Representative. Al Shepard with his own ccmpany, Florida Municipal Securities, Inc., with Al as his own Principal, ~joined by George Bland and Arnold Schneider. e Florida Municipal Securities, Inc. and Henderson, Few & Co. with George Bland and Arnold Schneider being the Principle Representatives. This change took place after Al Shepard's death. e An expectation of George Bland and Arnold Schneider joined in an association with another firm, possible Matthews & Wright. This change took place when Henderson, Few & Co. took steps to discontinue the operations of Florida Municipal Securities, Inc. The Division with which George Bland and Arnold Schneider have been associated. ~ Prior to the develotmnents of the last two days, it has been expected that two options would beput before the City Council for consideration for the refunding operation. These options would be: 1. Continuation with George Bland and Arnold Schneider in association withMatthews & Wright, under certain con- ditions. 2. Opening the issue of Financial Advisor and Underwriting two other firms for consideration by the City Council. The conditions that would have been suggested: Option No. 1 (Above): George Bland and ArnoldSchneider enter into an Agreement with Matthews & Wright relative to their services with Matthews & Wright. B. Matthews & Wright and the City enter in to an Agreement or Contract for services. George Bland andArnold Schneider obtaining the appropriate and necessary releases from Henderson, Few & Co. (releases that would hold the City harmless from any claims by Henderson, Few& CO. or other Firms. If Option No. 1 did not materialize satisfactorily in regard to the three con- ditions, a r~dation to the City council to consider Option No. 2 would call for the issuance of a request for proposals from Underwriting and Financial Advisory Firms for Underwriting and Financial Advisory services for the refunding issue, with a limitation that the firms indicating an interest would be required to have reasOnable and significant representation in the South Florida area (West Palm Beach to Fort Lauderdale area). After proposals are received, the selection processes would include Staff screening, City council review of several applicants, City council selection of one applicant and the execution of an Agreement followed bytheexecution of the Refunding Issue. The proposals for selling additional bonds for newconstruction would then be a separate issue to consider after the refunding. In sumnary, it is currently felt that no action can be taken at this time and that the outstanding questions mst be further investigated, identified and answer.
