MINUTES OF THE SPECIAL CITY COMMISSION MEETING HELD IN THE
COMMISSION CHAMBERS, CITY HALL, BOYNTON BEACH, FLORIDA,
AT 6:30 P.M., ON TUESDAY, SEPTEMBER 27, 2010
PRESENT:

Mayor Rodriguez called the meeting to order at 6:31 p.m. Vice Mayor Ross offered the
invocation followed by the Pledge of Allegiance to the Flag led by Commissioner Hay.
Mayor Rodriguez recessed the meeting at 6:33 p.m. to hold a special Community
Redevelopment Agency Board meeting.
Mayor Rodriguez reconvened the City Commission meeting at 7:24 p.m.

Proposed Resolution No. R10-139
FY2010/11
RE: Ratifying CRA budget for
Attorney Cherof read Proposed Resolution No. R1 0-139 by title only.
Motion
Commissioner Orlove moved to approve. Commissioner Hay seconded the motion.
There was no public comment.
The motion passed 4-1. Commissioner Holzman dissented on voting to ratify the CRA
budget; however, Mayor Rodriguez explained the purpose of the motion was allowing
the Commission to have final approval of the CRA budget. Based on the explanation,
Commissioner Holzman voted to approve Proposed Resolution No. R10-139. The
motion passed unanimously.
2. Proposed Resolution No. R10-140 RE: Approval of Memorandum of
Understanding between the City of Boynton Beach and the Boynton Beach
Firefighters and Paramedics, IAFF, Local 1891.

Attorney Cherof summarized the intent of Proposed Resolution No. R 10-140 shortened
the term of the contract by one year and continued the freeze on wage increases
required under the agreement.
Motion
Commissioner Hay moved to approve. Commissioner Orlove seconded the motion.
The motion passed unanimously.
3. Proposed Resolution No. R10-141 RE: Ratifying the collective bargaining
agreement between the City of Boynton Beach and the Boynton Beach
Firefighters and Paramedics, IAFF, Local 1891
Proposed Resolution No. R10-141 ratified a new collective bargaining agreement now
covering a term of October 1, 2010 thru September 30, 2013 providing for a wage
freeze the first year and the opportunity for a re-opener on issues regarding
compensation in the following years of the contract.
Motion
Vice Mayor Ross moved to approve Resolution R 10-141. Commissioner Hay seconded
the motion. The motion passed.
4. Proposed Resolution No. R10-142 RE: Approval of Memorandum of
Understanding between the City of Boynton Beach and Palm Beach County
Police Benevolent Association, Inc. for Police Officers and Detective

Understanding between the City of Boynton Beach and Palm Beach County
Police Benevolent Association, Inc. for Sergeants
6. Proposed Resolution No. R10-144 RE: Approval of Memorandum of
Understanding between the City of Boynton Beach and Palm Beach County
Police Benevolent Association, Inc. for Lieutenants
These resolutions relate to the agreements with the Police Benevolent Association for
the three bargaining units within the Police Department. The agreements modify the
contract that ran from October 1, 2007 to September 30, 2010 to extend it for two years
and extend the pay freeze.

Commissioner Hay moved to approve R10-142. Vice Mayor Ross seconded the motion.
The motion passed unanimously.

motion. The motion passed unanimously.

Vice Mayor Ross moved to approve R10-144. Commissioners Orlove and Hay
seconded the motion. The motion passed unanimously.
7. Conducting the 2nd Budget Public Hearing for discussion of the Fiscal Year
2010/11 Millage and Budget:
Attorney Cherof explained it would be the public's second and final opportunity to ask
questions or comment on the budget.
a. Proposed Resolution No. R10-145 RE: Adopting the final millage rate
for fiscal year 2010/11
Attorney Cherof read Proposed Resolution No. R10-145 by title only, adopting a millage
rate of 6.7626 mills for the General Fund.
Mayor Rodriguez opened the issue for public hearing.
Mark Karageorge, 240A Main Boulevard, thanked the Commission for maintaining the
millage rate at the same level as last year.
No one else coming forward, Mayor Rodriguez closed the public hearing.

Vice Mayor Ross moved to approve Proposed Resolution R10-145. Commissioner Hay
seconded the motion. The motion passed 5-0.

Attorney Cherof read Proposed Resolution No. R10-146 by title only, adopting the final
budget.
Mayor Rodriguez noted the last worksheet received reflected a deficit of $68,000 and
the budget had to be balanced. Commissioner Orlove suggested the Shopper Hopper
program in relation to the trolley system, should be consolidated for savings.
Commissioner Holzman asserted the argument should have been for the CRA because
this is the City budget. Commissioner Orlove viewed the monies as being strictly from
the City budget on the Shopper Hopper.
Mayor Rodriguez recalled the decision had already been made to evaluate the two
systems and possible options over the next four months before any services were
diminished. Mayor Rodriguez pointed out the Shopper Hopper had not been targeted
for elimination in the budget at this stage, so the public would not be aware this
discussion would be held at the meeting. Vice Mayor Ross added it would be an
immediate, negative impact to the users of the Shopper Hopper without notice. She
suggested furloughs be discussed to balance the budget deficit. Commissioner Orlove
was not in favor of furloughs because it would not be effectuated through all
departments. He was in favor of a 7.0 millage rate which would not put the budget in a
deficit situation, but the majority had ruled for a lower millage rate. He would not
support furloughs. There was no consensus to reduce the Shopper Hopper budget or
the use of furlough days to balance the budget. At the request of Mayor Rodriguez,
Major Frank Briganti, Police Department, advised there were no vacant positions within
the records division. Lori LaVerriere, Assistant City Manager, pointed out two vacant
positions had been eliminated from the budget.
Mayor Rodriguez suggested the $68,000 could be taken out of the emergency reserves.
Commissioner Holzman asked if it would affect the bond rating of the City or take the
emergency balance below the ordinance requirement. He emphasized hard decisions
had to be made. Commissioner Orlove reiterated there was a significant shift when the
millage rate was reduced from 7.0 to the current rate. Commissioner Holzman argued
two more positions had been added after there was agreement to lower the millage rate
adding $100,000 to the budget.
Mayor Rodriguez reviewed the budget process and indicated with the 7.0 millage rate
many cuts were restored. At the 6.76 millage rate there still remained a $100,000
surplus and more headcount was added back into the budget resulting in the current
$68,000 deficit. Mr. Atwood felt confident the current budget year fund balance to be
carried over would cover the $68,000. Ms. LaVerriere advised the actual amount would
be reduced by $7,338 and $2,572 in adjustments.

Commissioner Hay moved to use monies from reserves up to $50,000 to balance the
budget. Vice Mayor Ross seconded the motion. The motion passed 4-1
(Commissioner Holzman dissenting).
Motion
Commissioner Hay moved to adopt the final budget for fiscal year 2010/2011.
Commissioner Orlove seconded the motion.
Mayor Rodriguez opened the issue for public hearing. No one came forward. Mayor
Rodriguez closed the public audience.
The motion passed 4-1 (Commissioner Holzman dissenting).
8. Adjournment
There being no further business to come before the Commission, Mayor Rodriguez
properly adjourned the meeting at 7:45 p.m.
