12.01.23 - Seat Belt Use CITY OF BOYNTON BEACH, FLORIDA ADMINISTRATIVE POLICY MANUAL CHAPTER: 12 Risk Management Policy No. 12.01.23 SECTION: 01 Standard Operating Guideline Page: 1 of 2 SUBJECT: 23 Seatbelt Use PURPOSE: To promote higher level of safety through seatbelt use by all employees at all times, monitor the usage, and provide guidance for disciplinary actions. PROCEDURE: 1. Safety belts will be worn at all times by all occupants of City vehicles. 2. All department heads, supervisors and managers will monitor their employees operating City vehicles, or personal vehicles used for City business. Employees that do not adhere to this requirement will be subject to the following progressive discipline applicable throughout the term of employment: First Offense Written Reprimand Second Offense Suspension Third Offense Termination 3. Employees who are involved in a motor vehicle accident and file a Workers' Compensation claim, will have a 25% decrease in wage replacement benefits if it is determined they were not wearing their seatbelt at the time of the accident. (Note: This does not affect the medical payments.) 4. Exceptions. a. A City Employee who is certified by a physician as having a medical condition that causes the use of a safety belt to be inappropriate or dangerous. (Florida Statute 316.614, 6a) b. A City Employee working on residential solid waste or recyclable collection services, who is required to frequently exit the vehicle to perform manual operations, while in the course of employment collecting solid waste or recyclables on a designated route.
