11-002 II 1 ORDINANCE NO. 11- 00 a. 2 3 4 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY 5 OF BOYNTON BEACH, FLORIDA AMENDING THE LAND 6 DEVELOPMENT REGULATIONS CREATING THE OCEAN 7 A VENUE OVERLAY ZONE BY AMENDING CHAPTER 1" 8 ARTICLE II, DEFINITIONS; AMENDING CHAPTER 2, 9 ARTICLE I, OVERVIEW; AMENDING CHAPTER 2, ARTICLE 10 II, PLANNING & ZONING DIVISION SERVICES; AMENDING II CHAPTER 3, ARTICLE III, ZONING DISTRICTS AND 12 OVERLAY ZONES; AMENDING CHAPTER 3, ARTICLE IV, USE 13 REGULATION; AMENDING CHAPTER 4, ARTICLE II, LAND 14 USE DESIGN AND BUFFERING STANDARDS; AMENDING 15 CHAPTER 4, ARTICLE III, EXTERIOR BUILDING AND SITE 16 DESIGN STANDARDS; AMENDING CHAPTER 4, ARTICLE V, 17 MINIMUM OFF ~STREET PARKING REQUIREMENTS; 18 PROVIDING FOR CONFLICTS, SEVERABILITY, 19 CODIFICATION AND AN EFFECTIVE DATE. 20 2J 22 23 WHEREAS, staff is proposing amendment to the Land Development Regulations 24 (LDR) involving the creation of a zoning overlay zone for Ocean A venue to further the 25 vision contained within the Downtown Master Plan and support the current CRA 26 initiatives; and 27 WHEREAS, the City Commission of the City of Boynton beach deems it to be in 28 the best interest of the citizens and residents of the City to amend the Land Development 29 Regulations to create the Ocean A venue Overlay Zone and further the goals of the 30 Downtown Master Plan. 31 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION 32 OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 33 Section 1. In instances where a build-to 13 line is required, the space between the building and property line is typically ]4 referred to as the "reduced building setback" area. Waiver (Ocean Avenue Overlay Zone). 7 8 1. General. 9 10 !: Purpose and Intent. The purpose of this II subsection is to provide an efficient relief process to 12 allow for deviations from certain requirements and 13 standards of Chapter 3 and Chapter 4 as they pertain 14 to the Ocean A venue Overlay Zone (OAOZ). The 15 intent of this application is not to provide a means ]6 for circumventing any such requirement or standard 17 but to allow for a departure from the code upon 18 demonstration that the subiect request satisfies the ]9 intent of the review criteria contained herein. 20 21 b. Applicability . For property located within 22 the OAOZ, the waiver process shall be available for 23 deviations from any development and design 24 standards of Chapter 3, Article III, Section 8.D. 25 26 2. Submittal Requirements. The applicant shall 27 submit a letter that addresses the review criteria of Section 28 3.E.3 below, in addition to submitting any plans and 29 exhibits required by the accompanying site plan, whenever 30 applicable. 3 ] 32 3. Review Criteria. The applicant shall justify 33 each waiver request as part of the application for site plan 34 or site plan modification. The applicant shall document the 35 nature of the request, the extent of its departure from the 36 standard regulation, and the basis for the request. The City 37 may request additional information and documentation from 38 the applicant, such as a shared-parking study, or other type 39 of performance related analysis that further iustifies the 40 waiver request. Approval Process. A Walver request may be 4 approved by staff if the subiect request is reviewed 5 concurrently with a mmor site plan modification 6 application, and such application requires administrative 7 review pursuant to the review criteria of Section 2.F above. 8 Otherwise, the waiver application requires review by the 9 City Commission and shall be processed in accordance with 10 Chapter 2, Article I. Section 3. I I ]2 5. Denial. Upon the denial of an application for 13 relief hereunder, in whole or in part, a period of one ( I) year 14 must elapse prior to the filing of the same or similar 15 application affecting the same property or any portion 16 thereof; however, this restriction shall not apply to 17 applications which further the City's economIC 18 development, workforce housing, or green building 19 programs. 20 2] 6. Expiration. A waiver shall remain valid as long 22 as the corresponding site plan or site plan modification 23 approval remams m effect, or unless there IS any 24 amendment to the original waiver. Any amendment to the 25 original approval shall require application for, and approval 26 of, a new waiver. 27 28 Section 5. Chapter 3, Article III, Zoning Districts and Overlay Zones, of the 29 Land Development Regulations, is hereby amended by adding the words and figures in 30 underlined type, as follows: 31 Chapter 3, Article III, Section 8.D 32 33 D. OCEAN A VENUE OVERLAY ZONE (OAOZ). 34 35 L Purpose and Intent. The Ocean Avenue Overlay 36 Zone (OAOZ) IS comprised of multiple properties 37 containing varymg Future Land Use Map (FLUM) 38 classifications and zoning districts. As such, the densities 39 of developments shall correspond with the respective 40 FLUM classifications. For new developments however, the 41 maximum allowable density shall be II dwelling units per 42 acre for proiects on properties with single lot depth. The purpose and intent of the OAOZ 5 are as follows: 6 7 !: Provide for a mix of selected commercial. 8 residential, office, and entertainment activities, with 9 an emphasis on arts and cultural ventures that will 10 encourage the adaptive re-use of existing buildings, 11 restoration of historic structures, and maintain and 12 further enhance the pedestrian and historic scale of 13 the area; ]4 15 b. Encourage the location of specialty retail, 16 artist related uses and entertainment establishments ]7 in concentrations that will enable and encourage 18 pedestrian movements between businesses, and ]9 between the marina ! waterfront attractions to the 20 east and the cultural! civic activities to the west; 2] 22 c. Initiate implementation of vanous 23 recommendations contained within approved 24 redevelopment plans; 25 26 d. Stimulate greater awareness and pride in the 27 City's architectural, historical, and cultural heritage; 28 and 29 30 e. Improve overall livability of the general area 3] and stabilize and improve property values. 32 33 2. Defined. The Ocean A venue Overlay Zone 34 (OAOZ) shall be bounded on the east by the Florida East 35 Coast Railroad (F.E.C.), on the west by Seacrest Boulevard, 36 on the south by Southeast I sl A venue, and on the north by 37 Northeast I sl A venue, except between Northeast I sl Street 38 and Northeast 3rd Street, the north boundary shall be the 39 alley between Northeast 1 sl A venue and Boynton Beach 40 Boulevard. 4] 42 3. Conflict. In the event of any conflict between 43 the provisions of the Ocean A venue Overlay Zone and any 44 other sections of the Land Development Regulations, the 45 provisions of this section shall prevail. Uses Allowed. See "Use Matrix Table 3-28" 5 in Chapter 3, Article IV, Section 3.D. Additionally, no 6 existing use shall be deemed non-conforming. 7 8 5. See "Single-Lot Depth" above for all proposed exnansions or additions to existing structures. In these instances, the required setback shall be 10 9 feet. 10 I II 1 The minimum side interior setback shall be five (5) 12 feet for lots with 50 feet of frontage (but less than 75 feet). 13 14 2 Not to exceed three (3) stories. 15 ]6 6. Accessory Structures. 17 18 a. Fences along the front of the property are 19 discouraged. Any fence that is proposed however, 20 shall be decorative in nature, opaque, and not exceed 21 three (3) feet in height. Walls, chain link, board on 22 board, shadowbox, and similar types of fences are 23 expressly prohibited. 24 25 b. All parking, mechanical equipment, trash 26 containers, and miscellaneous equipment shall be 27 landscaped to be screened from view. 28 29 7. Parkin!!. 30 3] a. Minimum Number of Required Spaces. 32 The minimum number of required off-street 33 parking spaces shall be calculated in accordance 34 with Chapter 4, Article V, Section 2 above; 35 however, the total number of required spaces may be 36 reduced by up to 50% for all new developments, 37 excluding multi-family residential projects. When 38 two (2) or more adiacent property owners combine 39 their off-street parking in accordance with the code 40 and construct a shared parking facility with common 41 access drives, the total number of required off-street 42 parking spaces may be reduced by an additional 43 10%. 44 45 46 S.ICAIOrdinancesILDR ChangeslOrdinance - Ocean Avenue Overlay. doc - 7 - II I I b. Allowable Location of Off-Street Spaces. 2 ill The intent of the OAOZ is to screen 3 off-street parking areas from abutting rights- 4 of-way and locate buildings along front and 5 side corner property lines. It is therefore, a 6 requirement to locate off-street parking areas 7 within rear and side interior yards for all new 8 projects and those in which parking areas 9 would be altered to accommodate a proposed 10 building renovation or expansion. Only ] ] existing parking areas for existing 12 developments may remain if the spaces are 13 unaltered as part of any building renovation ]4 or expansion. In these instances, the existing 15 off-street parking area shall be substantially 16 screened from off-premises by a hedge, ]7 decorative fencing, or a combination thereof, 18 provided that such hedge and I or fencing 19 would be compliant with the intent of the 20 OAOZ, and to the standards of the urban 2] landscape code to the maximum extent 22 possible. Any deviation from the above 23 standards would require the approval of a 24 waiver in accordance with Chapter 2, Article 25 II, Section 4.E. 26 27 m If 100% of the required off-street 28 parking spaces cannot be provided on-site, 29 they may be provided at an off-site location 30 provided the following conditions are met: 3] I) the proposed location is not farther than 32 500 feet from the subiect property as 33 measured by a straight line from a point on 34 the boundary of the property to the closest 35 boundary line of the property to be leased; 36 and 2) the off-site location is owned or 37 leased by the owner or operator of the 38 subject business or property owner. Any 39 lease agreement must be approved by the 40 City Commission. The parent business 41 property shall be posted with slgnage 42 indicating the location of the off-site parking 43 spaces. See 9 Chapter 4, Article II, Section 4.B.5 for additional 10 regulations regarding required landscaping and streetscape II ! design. 12 13 9. Buildine: Desie:n. 14 ]5 a. New Buildine:s. All new buildings 16 used for non-residential purposes shall be designed 17 to be residential in character. The building design is ]8 encouraged to utilize sloped roofs, gables, porches, ]9 residential style windows and other elements 20 normally associated with the typical frame 2] vernacular buildings found m the City and 22 throughout South Florida, and those of historic 23 structures anticipated to be relocated to the area. 24 New structures shall be constructed with the 25 building entry oriented towards the street and shall 26 be sensitive to the scale, massing and design 27 envisioned in the Downtown Master Plan. 28 29 b. Additions to Existine: Buildine:s and 30 Structures. All building additions shall be 31 sensitive to the original building design relative to 32 the architectural style, building 33 materials! components and treatments, and 34 proportions. Original materials and details, as well 35 as distinctive form and scale features, which 36 contribute to the character of the building and/or 37 surroundings, shall be preserved to the maximum 38 extent feasible. Rehabilitation work shall not 39 destroy the distinguishing quality or character of the 40 property or its environment. 41 42 For historic structures, any new additions, exterior 43 alterations, or related new construction shall not 44 destroy historic materials that characterize the 45 structure. New additions and adjacent or related 4 new construction shall be undertaken in such a 5 manner that if removed in the future, the essential 6 form and integrity of the historic structure and its 7 environment would be unimpaired. 8 9 10. Sh~na1!e and Exterior Li1!htin1! Standards. ]0 11 !: Signs allowed within the Ocean A venue 12 Overlay Zone shall be externally illuminated only, 13 and consist of the prototypical monument sign 14 designed for the area, wall mounted, and / or a 15 projecting sign. 16 17 b. The size of wall mounted signs shall be 18 calculated at one-half (0.5) square foot of sign area 19 per one ( I) lineal foot of building frontage measured 20 along the main building entrance. 21 22 c. Proiecting signs and mounting brackets shall 23 be decorative in nature, and the sign face shall not 24 exceed six (6) square feet in size. 25 26 d. General lighting of the site shall harmonize 27 with and blend into residential/mixed use 28 environment. Ground lighting and up lighting of the 29 building and landscaping is encouraged. However, 30 when the use of pole lighting is necessary, the 3] fixture height shall not exceed 15 feet, be decorative 32 In nature and compatible with the color and 33 architecture of the building. 34 35 36 Section 6. For existing structures within the 3 Central Business District (CBD) or subsequent zoning 3 districts established to supplement or replace the CBD, and 3 any parcel or parcels of land assembled by unity of title 3 located within the Ocean Avenue Overlay Zone (OAOZ) 3 that front on that segment of Ocean Ayenue extending west 3 from the CBD to 8eacrest Boulevard, no additional parking 3 shall be required where: 4 41 a. The capacity of the structure is increased by 4 adding dwelling units, floor area, or seats; or 5 6 c. The use of a structure is changed. 7 8 2. Inelie:ible Uses Exemptions. The following 9 uses ore exempt from the pro'"isions of this subsection and 10 shall be otherwise required to satisfy the parking I ] requirements of this article: The prOVISIOns of this 12 subsection do not apply to the following uses: 13 ]4 a. Multi-family residential uses and structures. 15 16 b. Churches, temples and other places or 17 worship. ]8 ] c. Theaters, auditoriums, meeting halls, and 2 other places of assembly. 2] 22 d. Clubs, lodges and fraternal organizations. 23 2 Section 10. Should any section or provision of this Ordinance or any portion 2 thereof be declared by a court of competent jurisdiction to be invalid, such decision shall 2 not affect the remainder of this Ordinance. 2 Section 11.
