3 AN ORDINANCE OF THE CITY COMMISSION OF THE
4 CITY OF BOYNTON BEACH, FLORIDA, RESCINDING
5 ORDINANCE NO. 09-030 WHICH CREATED A SEVEN
6 MEMBER CRA BOARD AND DELETING IN ITS
7 ENTIRETY SECTION 2-13.2 OF THE CODE OF
8 ORDINANCES; AMENDING CHAPTER 2.
9 ADMINISTRATION TO ADD A NEW SECTION 2-13.2
10 PROVIDING FOR A COMMUNITY REDEVELOPMENT
11 BOARD COMPRISED OF THE MEMBERS OF THE CITY
12 COMMISSION PLUS TWO (2) ADDITIONAL MEMBERS
13 APPOINTED BY THE CITY COMMISSION; PROVIDING
14 FOR CONFLICTS, SEVERABILITY, CODIFICATION
15 AND AN EFFECTIVE DATE.

17 WHEREAS, the City of Boynton Beach has determined that it is in the best interests of
18 the citizens and residents of the City to add establish a Community Redevelopment Agency
19 Board comprised of the members of the City Commission plus two additional members to the
20 Community Redevelopment Agency, as permitted by Chapter 163.357(1 )(c); and

22 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
,~ THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

25 Section 1. That Chapter 2. Administration, Section 2-13.2 shall be amended by
26 adding the words and figures in underlined type, as follows:

28 I Sec. 2-13.2. Governing body of community redevelopment agency.

30 (a) The Community Redevelopment Agency Board shall consist of
31 the five members of the City Commission plus two additional members
~7 appointed by the City Commission.

34 (b) The terms of office of the additional Board members shall be for
35 4 years, except that the first person appointed shall initially serve a term
36 of 2 years.

38 (c) Any person may be appointed as Board Member if he or she
39 resides or is engaged in business, which means owning a business,
40 practicing a profession, or performing a service for compensation, or
41 serving as an officer or director of a corporation or other business entity
42 so engaged, within the area of operation of the agency, which shall be
43 coterminous with the area of operation of the City of Boynton Beach.

2 (d) A certificate of the appointment or reappointment of any Board
3 Member shall be filed with the City Clerk, and such certificate is
4 conclusive evidence of the due and proper appointment of such Board
5 Member.

7 Section 2. All ordinances or parts of ordinances in conflict herewith be and the
8 same are hereby repealed.

10 Section 3. Should any section or provision of this ordinance or portion hereof, any
11 paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such
12 decision shall not affect the remainder of this ordinance.

14 Section 4. Authority is hereby granted to codify said ordinance.

16 Section 5. This ordinance shall become effective immediately upon passage.
