MINUTES OF THE CITY COMMISSION MEETING HELD IN THE
COMMISSION CHAMBERS, CITY HALL, BOYNTON BEACH, FLORIDA,
AT 6:30 P.M., ON TUESDAY, FEBRUARY 15, 2011

In the absence of Mayor Rodriguez, Vice Mayor Ross called the meeting to order at
6:01 p.m. It was explained the Commission would be participating in a closed-door
executive session.
Attorney Cherof advised the closed-door executive session was for the purpose of
discussing pending litigation in the 4th District Court, between the City of Boynton Beach
and Ralph and Rosie's, Inc., Case No. 09029016. Only the Commission members, City
Manager and City Attorney would be present during the session. It was anticipated to
last approximately 20 to 25 minutes after which the regular Commission meeting would
follow.
Vice Mayor Ross recessed the meeting at 6:02 p.m.
Mayor Rodriguez reconvened the meeting at 6:46 p.m.

Item 6.C for discussion. Attorney Cherof noted Item 9.B should be tabled to the second

Vice Mayor Ross moved to approve. Commissioner Hay seconded the motion. The

2. OTHER
A. Informational Items by Members of the City Commission
Commissioner Hay had the opportunity to attend the ground breaking for the Barrier
Free Park that would be located across from the Slomin Family Center and would entice
people to the area when completed. There was also a luncheon following the ceremony
at Hunter's Run. He also noted the Heritage Festival would be held on the weekend
and invited everyone to join in the activities scheduled for Friday and Saturday.
Commissioner Orlove had attended the Pancake Breakfast hosted by the Firefighters.
Besides attending the ground breaking for the Barrier Free Park, he had attended the
ribbon cutting ceremony for Oceanfront Park and the new boardwalk including the art
work. Commissioner Orlove had also been to Forest Park Elementary and spoke to the
third grade class regarding civics and local government. He reminded the community
the Commission would be having a joint workshop with the Community Redevelopment
Agency on Thursday starting at 6 p.m.
Vice Mayor Ross announced the Boynton Beach Fire Rescue held an awards ceremony
and Nichole Roberts was named the Paramedic of the Year and Roxanne Girardi was
the Employee of the Year. She had attended the Pancake Breakfast and the Oceanfront
Park ceremony.
Mayor Rodriguez indicated he had also attended all the events mentioned.
3. ANNOUNCEMENTS, COMMUNITY & SPECIAL EVENTS & PRESENTATIONS
A. Presentation of Certificates of Appreciation to Park Vista High School Band
Members, the Town of Ocean Ridge and City of Boynton Beach Employees
who have donated their time and service to support our adopted military unit,
the Delta Demons of the 101st Airborne Division. With Special Thanks to the
SandSifters, Ms. Latham's 2nd grade class at Poinciana Elementary, the
Boynton Beach Republican Club and the AfterSchool Students at the Art
Center.
Mayor Rodriguez read the names of those receiving certificates for their participation
and assistance with the Delta Demons program. Ken Kaleel, Mayor of Ocean Ridge,

commented the Town was proud to have helped in the endeavor and is very grateful to
the men and women of the Armed Forces. All recipients were congratulated.
B. General Election Proclamation - March 8, 2011 - presented by Mayor Jose
Rodriguez
Mayor Rodriguez read the Proclamation relating to the March 8, 2011 General Election
and noted two incumbents were candidates in two districts.
4. PUBLIC AUDIENCE
INDIVIDUAL SPEAKERS WILL BE LIMITED TO 3 MINUTE PRESENTATIONS
(at the discretion of the Chair, this 3-minute allowance may need to be
adjusted depending on the level of business coming before the City
Commission)
Buck Buchanan, 807 Ocean Inlet Drive, requested all those candidates for the
independent CRA Board be notified and understand their presence is needed at the
joint workshop with the Commission and CRA. Mr. Buchanan understood Commissioner
Holzman's position on not wanting to listen to the presentation. Since it will occur, Mr.
Buchanan contended Commissioner Holzman's knowledge and input would be
appreciated.
Arthur Deruve, 105 Live Oak Lane, appeared after being asked to sign a petition to
rescind the permission to build strip clubs in the City. He could not understand why four
of the Commissioners approved the establishment of strip clubs in District 4. Generally,
a City could not restrict clubs from anywhere in the City. He would vote against the
measure even if legal counsel had to be hired to dispute the law requiring cities to allow
the clubs. Mr. Deruve applauded the Mayor for voting against the measure.
Lisa Bright, 501 NE 53rd Street, Boca Raton, FI, placed a letter into public record a
copy of which is available in the City Clerk's office. She read the letter from the State
Attorney General's office addressed to Chief Matthew Immler regarding the
investigation of Boynton Beach CRA Director, Lisa Bright. "Dear Chief Immler: The
Public Integrity Unit has completed the investigation of the above referenced matter.
After a thorough investigation, we have not found credible evidence that Mrs. Bright
benefited financially as CRA Director from her relationship with Joseph Ferrer. Based
on this investigation, we will be closing this matter without further action."
Ms. Bright contended the letter represented irrefutable evidence that Boynton Beach
City officials conspired with the Palm Beach Post to orchestrate false allegations against
her to defame her character and slander her reputation. The claims were based on
hearsay, conjecture and innuendo and no evidence to support wrongdoing. There were
only personal opinions of impropriety resulting in nine articles in 62 days published by
the Palm Beach Post resulting in the loss of her job. A search of Ms. Bright on the

internet would yield the negative articles first. The allegations cost the City of Boynton
Beach, Palm Beach County and the State of Florida in excess of $100,000. Buying out
her contract would have cost less than $50,000. Ms. Bright claimed she, her family and
friends were followed to various locations in an attempt to humiliate and intimidate.
Monies were paid to confiscate her personal garbage on two occasions to be analyzed,
catalogued and photographed at considerable expense. A list of the contents was
provided to the newspaper.
Ms. Bright thanked Commissioner Hay for being the voice of reason during a disgraceful
period for the City of Boynton Beach.
Chelsea Collins and another student from Boynton Beach High were present to
announce a fundraising activity that the sophomore class council had initiated for the
Academic Incentive Program. They sought assistance to motivate the students to pass
the FCA T tests and be productive citizens in the work place or attend college. The
class had teamed with Applebee's to benefit the students and the consumers. A
pancake breakfast would be held on February 26th from 8 a.m. to 10 a.m. Tickets would
be $8.
Victor Norfus, 261 N. Palm Drive, spoke on behalf of the Heart of Boynton Community
Association and congratulated all those who volunteered with the Delta Demons and
asked everyone to support the veterans. The Heritage Celebration would be held
February 18th with the Night of Joy from 6 to 9 p.m. at the Ezell Hester Center. On
Saturday from 11 a.m. to 6 p.m. a celebration would be held at the Carolyn Sims Center
with speakers and entertainment. The mission is to improve the social, physical and
economic health in the Heart of Boynton community by sharing information, facilitating
training and education, providing resources and encouraging communication and
participation among neighborhoods; government, education institutions and other
participants. Mr. Norfus also announced the Community Relations Board held meetings
the 2nd Wednesday of each month and they would listen to any concerns.
No one else coming forward, Mayor Rodriguez closed the public audience.
5. ADMINISTRATIVE
A. Appoint eligible members of the community to serve in vacant positions on City
advisory boards
Motion
Commissioner Orlove moved to appoint Terry Lonergan as a regular member of the
Financial Advisory Committee. Vice Mayor Ross seconded the motion. The motion
passed.

6. CONSENT AGENDA
Matters in this section of the Agenda are proposed and recommended by the
City Manager for "Consent Agenda" approval of the action indicated in each
item, with all of the accompanying material to become a part of the Public
Record and subject to staff comments.
A. Approve the Minutes from the City Commission meeting held on February 1,
2011.
B. PROPOSED RESOLUTION NO. R11-015 - Approve an Agreement with
SageView Advisory Group, Inc. to provide a review of the Nationwide and
ICMA 457(b) deferred compensation plans that the City offers to employees for
their personal retirement savings plans at no cost to the City of Boynton Beach.
C. PROPOSED RESOLUTION NO. R11-027 - Approve an Agreement for Water
Service Outside of the City Limits with OK Seahorse LLLP, for the property
located at 4001 N. Ocean Blvd., Delray Beach, FL 33483
Commissioner Holzman had pulled Item 6.C for discussion. A letter had been received
approximately a year ago, from the Town of Gulfstream, requesting to annex the same
property. Mr. Bressner understood the matter was on a referendum to be considered
on March 8, 2011. The existing Interlocal Agreement with the Town of Gulfstream
includes the parcel, but the agreement would become moot if it were to be annexed.
Motion
Commissioner Holzman moved to approve. Commissioner Hay seconded the motion.
The motion passed.
D. PROPOSED RESOLUTION NO. R11-028 - Approve the Second Amendment
to the Interlocal Agreement (ILA) between the City and the Board of County
Commissioners that authorized the City to receive funding as a partner in the
continued planning and implementation of the Youth Violence Prevention
Program (YVPP) through December 31,2010, extending the term to March 31,
2011
E. PROPOSED RESOLUTION NO. R11-029 - Adopt the City of Boynton Beach's
Community Development Block Grant (CDBG) Substantial Plan Amendment to
facilitate acceptance of NSP-3 Funding.
Commissioner Orlove had pulled Item 6.E to get an update on the Block Grant Program.
Octavia Sherrod, Community Development Manager, reported 15 properties had been
purchased with 12 under contract or being rehabilitated. Three properties are complete

and there are five under contract for purchase through the NSP-1 program. This is a
continuation of the funding.
Commissioner Holzman requested clarification on the boundaries of the expanded area
where the monies could be spent. Ms. Sherrod gave a general description as the two
tracks being south of City Hall beginning on Ocean Avenue to SE 23rd Avenue bordered
on the west by 1-95 and to the east by FEC tracks. Housing and Urban Development
(HUD) has to approve the application. The $200,000 would be used for the single
family homes at the old Boynton Terrace location. It is a financing mechanism for the
purchasers. The CRA had requested funding to buy down the cost of the housing as
needed. Vivian Brooks, Interim CRA Director, advised a down payment assistance
program for the buyers had been discussed.
Mayor Rodriguez recognized the program was to refurbish foreclosed homes. Ms.
Sherrod acknowledged that was one of the eligible uses. The down payment
assistance would also be an eligible use. Commissioner Holzman agreed with the
Mayor that the money should be spent to refurbish foreclosed homes rather than assist
with new homes.
Commissioner Orlove inquired about the timeline to use the money. Ms. Sherrod
replied 50% had to be spent within two years and the remainder used within three
years. Ms. Brooks added the CRA had issued an RFP and responses could be 60 days
and the permit for site development is a 90 day process. The amount for the assistance
would be minimal to assist with closing cost. A 3% down payment would be required.
Commissioner Orlove was in total agreement with moving forward with homes that are
blighted and if money remains toward the end of the cycle it could be used for down
payment assistance. He thought the monies should be earmarked for the Heart of
Boynton. Mayor Rodriguez noted all the funds were being expended in the northeast
and northwest sections of the City.
Ms. Sherrod clarified HUD had directed the funds be concentrated where the biggest
gain can be made. Commissioner Hay recalled the project had been ongoing for some
time. He felt the CRA and Community Development Department had devised a plan to
use the funds efficiently and would satisfy the need to see some development in the
area.
Commissioner Holzman indicated the funds are now available for the Forest Park area
and would be a significant improvement to a blighted area with many foreclosures. The
program should now grow to other neighborhoods that deserve the attention of the
Commission. The current funds should be focused on other parts of the City. The
Ocean Breeze West project status is still tentative at best.
Commissioner Orlove understood his District would not be getting any of the monies. If
the money were concentrated in the areas mentioned by Commissioner Holzman and

as things progressed there could flexibility to continue to expand the program. Vice
Mayor Ross added several homes in District 4 received funding too.
Quintus Greene, Development Director, clarified HUD has criteria that has to be applied
to the expenditure of the funds. The criteria had been reviewed and two census tracts,
south of Ocean Avenue meet HUD's criteria. There is an understanding with the CRA
regarding eligibility of funds to provide assistance to home owners. The objective was
to spend the money within the required timeframe.
Mayor Rodriguez summarized the $1 million plus originally awarded for the
Neighborhood Stabilization Program primarily intended for municipalities to buy
foreclosed houses, renovate and sell them. Houses were bought in Districts 4 and 2.
There are other tracts available in District 3. Commissioner Orlove advised there were
no houses in District 1 that met HUD standards. Mayor Rodriguez felt the funding
should support another neighborhood. There are many foreclosures in the Forest Park
neighborhood and towards the Bethesda Hospital area.
Vice Mayor Ross clarified any decision would have no impact on the Ocean Breeze
funding. Commissioner Hay looked forward to not seeing the blighted area within the
City. At this time it was obvious where monies needed to be spent and it was in District
2 that is suffering the most. Continuing in the same direction would be the best use of
the funds rather than the monies going elsewhere.
Commissioner Orlove pointed out there was indecision on what was to be included in
the Ocean Breeze project and concentrating on District 3. Near the end of the three-
year timeframe, spending more money for the Ocean Breese project with more
community input could be possible. Commissioner Hay applauded Commissioner
Orlove's thinking, but he could not support the proposal. A heated discussion ensued
on the use of the monies already expended and the fact it was all in one area.
Mr. Greene suggested the financing of units for the Ocean Breeze project be
considered and the $200,000 be devoted to the three census tracts that have been
determined to be eligible. Two are south of Ocean Avenue. It would give staff the
opportunity to work in all three of the census tracts.
Motion
Commissioner Holzman moved to spend the $1.168 million in the new tracts and hold
out $200,000 for a period of one year to assess the Ocean Breeze project progress.
Commissioner Orlove seconded the motion.
Commissioner Hay inquired if staff had comments regarding the proposed plan. Ms.
Sherrod responded a plan had to be submitted and it would have to be amended at a
later time.

The motion passed 4-1 (Commissioner Hay dissenting).
The changed directive would be for no activity in tract 6100. Mayor Rodriguez indicated
the activity would be in tract 6201 or 6203 being south of Ocean Avenue. The $200,000
would stay in the plan and be submitted to HUD to be used in year two of the program.
Mr. Greene cautioned the decision remained with HUD. Mr. Bressner noted a status
report on the funding would be presented after the response from HUD would be
received.
F. Accept the written report to the Commission for purchases over $10,000 for the
month of January 2011.
7. BIDS AND PURCHASES OVER $100,000
A. PROPOSED RESOLUTION NO. R11-030 - Approve the piggy-back of the
Sheriff's Contract for the purchase of new and replacement vehicles as
approved in the FY 2010/11 Budget in the amount of $536,630 from various
vendors
Commissioner Holzman inquired if the vehicles being replaced were included in the plan
to extend the life cycles. Jeff Livergood, Director of Public Works and Engineering,
replied the vehicles were in the revised plan. The new plan eliminates some of the fleet,
reduces the size of the vehicles and reduces the life of the vehicles. The oldest cars
are ten and eleven years old, non-police vehicles. Some heavy equipment may last
longer. The newest cars are 2009. Mr. Bressner noted it varies with the use of the
vehicles. There had been a full-blown cost analysis on the maintenance schedule. Mr.
Livergood noted the analysis was done every year with fleet budgeting. There will be
salvage value

Commissioner Holzman moved to approve. Vice Mayor Ross seconded the motion.
The motion passed.
B. PROPOSED RESOLUTION NO. R11-031 - Accept a FEMA Fire Act Grant
award in the amount of $138,880.00 for grant #EMW-2010-FO-06789 with a
required city match of $34,720.00 and authorizing the expenditure of the entire
program amount of $173,600.00 for the purchase of Firefighter Safety and
Survival Equipment (RIT Packs) and the purchase and installation of "Direct
Capture" diesel filtering equipment for 18 diesel powered apparatus in the
current fire department fleet as described in the grant application and award
notification.
Commissioner Holzman asked how the fire assessments funds could be utilized.
Deputy Chief Carter noted the grant required a 20% match and part of the monies

would come from the fire assessment. The approved expenditure is for fire fighting
equipment. Mr. Bressner commented no funds from the assessment are used for fire
suppression activities. Commissioner Holzman noted $22,500 would be needed
annually to maintain the equipment. Deputy Chief Carter explained the life span of the
diesel filters is only two to three years depending on use. Newer vehicles will have
filters that last the entire life of the vehicle. The current vehicles have no filters and the
grant would be utilized to clean the diesel exhaust. Commissioner Holzman expressed
concern that spending had to be tightened to meet the new budget constraints.
Commissioner Orlove confirmed that FEMA would be paying 80% of the cost while the
City would pay 20%.
Motion
Commissioner Orlove moved to approve. Vice Mayor Ross seconded the motion. The
motion passed.
8. CODE COMPLIANCE & LEGAL SETTLEMENTS

9. PUBLIC HEARING
7 P.M. OR AS SOON THEREAFTER AS THE AGENDA PERMITS
The City Commission will conduct these public hearings in its dual capacity
as Local Planning Agency and City Commission.
A. PROPOSED ORDINANCE NO. 11-002 - FIRST READING - Approve the
establishment of a zoning overlay (CDRV 11-001) for the general vicinity of
Ocean Avenue, between the F.E.C. Railroad and Seacrest Boulevard,
modifying the Land Development Regulations by establishing revised
development standards and uses consistent with, and implementing the vision
contained within the Downtown Master Plan. Applicant: City initiated
Attorney Cherof read Proposed Ordinance No. 11-002 by title only on first reading.
Ed Breese, Principal Planner, reported staff had been working to change the regulations
to assist in implementing the Downtown Master Plan as well as four CRA initiatives.
The concept would be to create a public art and cultural corridor between the Marina
and go west along Ocean Avenue. There would be adaptive reuse of existing buildings
and relocation of historic structure onto vacant parcels along Ocean Avenue. A sense
of place would be created with small shops and restaurants for a pedestrian-friendly
area. The current zoning was not adequate to implement the perceived changes for the
area. The long-range plan would not accommodate the small lots along Ocean Avenue,

but rather the assembling of lots for large projects. Tenants for two CRA owned lots
were being sought for the adaptive reuse of residential structures.
The overlay district was designed with the FEC corridor as the east boundary, Seacrest
Boulevard as the west boundary and SE 1st Avenue as the south boundary and NE 1st
Avenue with the exception of an alley north of NE 1st Avenue. No existing building or
structures would be non-conforming. The regulations are sensitive to the historic
properties in the zone currently or in the future. Staff recommended approval of the
Ocean Avenue overlay zone.
Vice Mayor Ross asked what CRA staff members had been involved.

B. PROPOSED ORDINANCE NO. 11-008 - FIRST READING - Approve the
abandonment of 18.2-foot wide unimproved alley located between West Ocean
Avenue and SW 1 st Avenue, extending to Seacrest Boulevard from SW 2nd
Street. Applicant: City initiated. STAFF RECOMMENDS ITEM BE TABLED TO
THE MARCH 15TH MEETING to allow time to further discuss and resolve
issues raised at the Board hearing and/or recently identified involving
alternative access, access easements, property maintenance and liability. Date
certain tabling will ensure that the required legal ads/public notices are
preserved.

13. LEGAL
A. PROPOSED ORDINANCE NO. 11-003 - SECOND READING - Approve
revision of Chapter 15-8 titled "Noise Control" (Exhibit "A")
Attorney Cherof read Proposed Ordinance No. 11-003 by title only on second reading.
Scott Blasie, Code Compliance Administrator, corrected the data that the plainly audible
levels and decibel levels had been set back one hour. It is joint project involving CRA
staff members, Planning and Zoning and Development staff members also. It is
separate from the live entertainment permit provisions. Both items had been initiated by
staff. The changes to the Noise Ordinance involved changing the definition of weekend
from Saturday Sunday to Friday Saturday. The decibel levels are consistent with other
cities. The hours for decibel level compliance were extended one hour to benefit the
businesses. The plainly audible standard is 100 feet away, if you can hear the music, it
would be a violation of the Code if it was not within the time parameters. The level has
to be significantly higher than the ambient noise level. Citations can be issued by police
officers for violations. The first visit would include a request to turn the noise down. If it
becomes repetitive, a citation would be issued.
There was discussion relating to businesses having to cease their entertainment at 10
p.m. on weekdays. They can continue if they keep the decibel level under the threshold.
Mayor Rodriguez inquired about the data used to select the hour of 11 p.m. Mr. Blasie
responded it was a consensus of staff. The data relating to other municipalities had
been reviewed. Commissioner Holzman inquired if consideration was given to setting
Thursday, Friday and Saturday as the weekend. Mr. Blasie replied business owners
and residents agreed that Friday and Saturday should be considered the weekend.
Input was garnered from many business owners and neighboring residents.
Mayor Rodriguez had received concerns that the 11 p.m. time limit on week days
seemed to be late and suggested 10 p.m. may be more appropriate. Commissioner
Holzman and Vice Mayor Ross wanted to include Thursday in the definition of weekend.
Mr. Blasie added holidays were added to the regulations for holiday hours.
Motion
Commissioner Holzman moved to approve the Ordinance changing the time period from
7 a.m. to 10 p.m. and changing the definition of weekday to Sunday thru Wednesday.
Commissioner Orlove offered a substitute motion that Sunday through Thursday be 10
p.m. and Friday and Saturday and holidays would be midnight. Commissioner Hay
seconded the motion.
Mayor Rodriguez opened the issue for public hearing.

Ginny and Bob Foot, 760 East Ocean Avenue, Coastal Towers, had worked with staff
since 1983 on the definitions in the ordinances. Businesses were consulted, yet condos
owners had to wait until second readying of the ordinance to make comments.
Modifying the ordinance may have value. The underlying complaint is flaunting the
existing ordinances by the Banana Boat and the prospect of limited enforcement of any
noise law. They asked for police action on 140 situations over the years and many after
a cease and desist order had been issued in 2006. The violations have been both
minor and extreme. Mr. Foot suggested the limits be extended for certain holidays to 1
a.m. for New Years Eve. He did not understand the need for 13 holidays in addition to
every Friday and Saturday. He presented signatures from many residents protesting
the lack enforcement of the current code and loosening of the law. Mr. Foot asked that
the time be maintained at 10 p.m. on week days and urged the Commission to give the
police the ability to enforce the law that is approved.
Steve Skaggs, 728 Casa Loma Boulevard, with Two George's Restaurant and a
business owner in Boynton Beach for 14 years felt he did try to cooperate with the
neighbors. A reasonable noise ordinance is necessary for both the business owners
and the residents. However, business owners do need to provide the customers with
entertainment when possible. Boynton Beach is a seasonal town with many visitors that
do not maintain the same schedule as the year-around residents. Mr. Skaggs
requested the noise ordinance be extended to 11 p.m. during the week to generate
business and encourage visitors and residents to the area. Being business friendly
would assist in generating extra tax dollars. He suggested only a few residents were
making many calls to complain. The police have visited the site on many occasions and
generally a request to turn the music down solves the problem. Mr. Skaggs requested
the hours be until 11 o'clock Sunday through Thursday and midnight Friday and
Saturday.
Peter Armour, at Marina Village, 700 E. Boynton Beach Blvd., spoke on behalf of a
woman in Marina Village who had to wear ear plugs on weekends when her door is
open due to the outside noise. He was also speaking for the Delta pilot who gets up at
4:30 a.m. without a good night's sleep. Even with his hurricane impact doors and
windows closed, the music is still audible from the Banana Boat especially on Sunday
nights. Two George's have been good neighbors. Mr. Armour did not advocate for less
music on the weekends.
Mike Minia, lived at Marina Village, echoed the concerns of other residents. The music
was loud and did go longer than allowed. There are nights when the noise goes on until
one or two a.m. in the parking lot. The music has continued until 11 p.m. on many
occasions.
Phil Kayco, Marina Village resident, commended Two Georges, but indicated the noise
level at Banana Boat is beyond reason and very loud. He asked the ordinance be
enforced, especially the decibelleve!. There is loitering occurring after hours.

Charles Alt, 1625 Renaissance Commons Boulevard, indicated the area is very noisy
with amplified entertainment and loud crowds. When buying the property, the promise
of upscale restaurants did not envision outdoor bars and entertainers. The crowds
linger after the music stops. The noise is very audible and should be controlled. Mr. Alt
did not feel Boynton Beach should become another West Palm Beach with its
associated crime and party atmosphere.
Victor Norfus, 261 N. Palm Drive, contended the noise ordinance should be on a 3/4
week and adjust the hours accordingly. The acoustics could contribute to the noise
level for certain areas. The placement of speakers should also be regulated to reduce
the sound impact. He thoughtThursday should be included in the weekend definition.
Luke Therien with Banana Boat, 739 E. Ocean Avenue, advised it was a family-owned
business since 1978 and worked with the Police Department to be within the law and
regulations. The two restaurants had worked to build the tourist industry downtown
along with the fishing village. It is an attractive area. He favored the proposed Code
rules. The business is located in the business district and an area of tourism. Both
establishments were built before the condos. Live music has been the same for the
past five or six years with one saxophone player or other solo performers. A
management team tries to strictly enforce rules and shuts down at 10 p.m. Most of the
complaints filed have not been valid and involved only one person complaining. The
issue should be if the complaint is real and should be addressed. On Friday, Saturday
and Sunday nights the music is all outside. Any complaints are dealt with an immediate
response to shut down the noise. The Banana Boat does have music an hour later than
Two Georges' but it is not illegal. The Proposed Ordinance is fair, but strict and he
stood ready to embrace the regulations.
Craig Gurlac, 100 NE 6th Street in Marina Village, indicated noise is not a problem. He
faced the restaurants directly and like all cities with high rise buildings, they attract a lot
of noise. The business owners do turn the music down at a reasonable hour and move
the outside entertainment indoors.
Chief Immler reported from October 21,2010 to 8:30 p.m., February 15th, 98 calls for
noise disturbances were received. Three were for noise at Banana Boat or Two
George's and three for noise at Renaissance Commons. The remaining 92 calls were
from private residences. There were no summons issued or arrests and no fines levied.
Commissioner Holzman questioned the impact of the ordinance on the future
development of downtown and Renaissance Commons and the ability to attract
businesses to Boynton Beach. Mr. Greene thought the Ordinance as proposed was
reasonable and recommended adoption. If attracting tourism is the goal, the City
should adopt policy to encourage tourism. A key element is the comfort level of tourists
to dine and be entertained. Banana Boat has been in existence for over 30 years and
Renaissance Commons was developed as a mixed-use area. The Ordinance balances

the various interests of the parties. Ms. Brooks agreed that attracting business and
particularly restaurants is critical to attracting tourists and the businesses cannot be
restricted to the point they cannot succeed. Several of the new businesses coming into
the area have expressed the desire to have live music. An energized downtown has to
have energized City regulations to entice visitors and residents to remain in the City.
She felt the ordinance as written was fair. Any City has a level of ambient noise and it
has to be accepted. It is a tool to attract businesses. Younger people eat out a lot and
have the expendable income to do so. They do dine later in the evening. Mayor
Rodriguez emphasized the ordinance does not close the businesses at 10 p.m. or 11
p.m., it simple turns the music or entertainment lower.
Mayor Rodriguez sought input from Chief Immler on any enforcement issues. The Chief
advised Code Enforcement has the trained personnel to measure the decibel levels and
not the officers. The plainly audible standard is used by the officers for all noise
complaints and it applies even to private residences. If it is a persistent issue, the
matter would be referred to Mr. Blasie for the decibel measurements. Chief Immler
advised the goal is to be equitable and it is not a problem for the Police Department.
Mayor Rodriguez closed public comments.
Motion
Commissioner Orlove amended his motion to go with staffs recommendation on the
time limits Sunday through Thursday 11 p.m. and midnight on Friday, Saturday and
holidays. Commissioner Hay seconded the motion.
Commissioner Orlove explained the City needed to be more helpful with its businesses
and create an environment to attract businesses and respect the residents. Controlling
the noise within a timeframe can be appreciated by everyone. In season the time
should be expanded rather than restricted.
Vice Mayor Ross recognized residents from District 4 were present and had met with
her and she appreciated their concern for the noise levels. The business owners had
also spoken with her and voiced their concerns. She hoped the owners of Banana Boat
could attempt to monitor and control the noise in the parking lot after hours if possible.
All restaurant owners should keep that in mind.
Mayor Rodriguez proposed a compromise of 10:30 p.m. Sunday through Thursday.
Vice Mayor Ross added the issue should be revisited in a year as plans and projects
move forward. Commissioner Hay understood the concerns, but thought Mr. Greene's
perspective was more appropriate to grow the area and agreed with staff's
recommendation. There have not been that many complaints and it is a mixed-use
project.

Commissioner Orlove suggested some type of signage may be helpful to inform the
public. Mr. Bressner expressed concern that the reaction to such signage could be
problematic. There would have to cooperation with the property owners to place the

would be possible. Garbage collection schedules have been altered to accommodate
residents and noise concerns. The Live Entertainment ordinance would give staff a
chance to view the layouts and may alleviate some of the concerns of the residents.

establishing a Historic Preservation Property Tax Exemption Program for the
City of Boynton Beach

Commissioner Holzman asked how the tax abatement would be enforced and the
determination of the increased value that would be exempt. Mike Rumpf, Director of
Planning and Zoning, explained the exemption would be based on the appraisal system
and comparables. It could be much less than the cost of the renovations.
Commissioner Orlove understood the exemption would be based on 100% of the
increase in assessed value based on renovations or rehabilitation. The property
appraiser would make the determination of the historic preservation value and the
owner would have the right to appeal. Commissioner Holzman confirmed the onus

would be on the property owner. There would be an interlocal agreement between the
City and the County. The City's portion of the ad valorem tax is approximately 50% of
the total ad valorem tax bill.

Commissioner Holzman moved to approve with Mr. Buchanan having a two-year term
and Mr. Karageorge having a four-year term. Commissioner Orlove seconded the
motion.
Mayor Rodriguez pointed out Mr. Cairo was a candidate who had private development
experience and had attended many of the meetings. It might be appropriate to add him
to the Board to have the benefit of his expertise in the industry. Commissioner Orlove
noted there was one other candidate that had a similar background and had been
attending the meetings. There was a unanimous understanding to bring the two
designated candidates to groom them to eventually have the Commission step out of
the equation. Commissioner Orlove hoped Mr. Cairo and others would continue to be
involved and be part of the independent board when the transition was finalized.
Vice Mayor Ross agreed there were two other candidates she would have seriously
considered, but there are only two positions at this time.
