X THIS MATTER came before the City Commission of the City of Boynton Beach, Florida appearing on the Consent Agenda on the date above. The City Commission hereby adopts the findings and recommendation of the Planning and Development Board, which Board found as follows: OR THIS MATTER came on to be heard before the City Commission of the City of Boynton Beach, Florida on the date of hearing stated above. The City Commission having considered the relief sought by the applicant and heard testimony from the applicant, members of city administrative staff and the public finds as follows: 1. Application for the relief sought was made by the Applicant in a manner consistent with the requirements of the City's Land Development Regulations. 2. The Applicant JHAS HAS NOT established by substantial competent evidence a basis for the relief requested. 3. The conditions for development requested by the Applicant, administrative staff, or suggested by the public and supported by substantial competent evidence are as set forth on Exhibit "D" with notation "Included". 4. The Applic;ant's application for relief is hereby ~ GRANTED subject to the conditions referenced in paragraph 3 hereof. DENIED 5. Please note that changes or revisions to these plans may generate X additional comments. Acceptance of these plans during the TART (Technical Application Review Team) process does not ensure that additional comments may not be generated by the Commission and at permit review. 2. Indicate within the site data the type of construction of the existing X building as defined in 2007 FBC, Chapter 6. 3. Indicate within the site data the occupancy type of the structure as X defined in 2007 FBC, Chapter 3. See Section 312 of the FBC. 4. Buildings, structures and parts thereof shall be designed to withstand X the minimum wind loads of 140 mph. Wind forces on every building or structure shall be determined by the provisions of ASCE 7, Chapter 6, and the provisions of 2007 FBC, Section 1609 (Wind Loads). Calculations that are signed and sealed by a design professional registered in the state of Florida shall be submitted for review at the time of oermit application. 5. Every building and structure shall be of sufficient strength to support X the loads and forces encountered per the 2007 FBC, Section 1607 and Table 1607.1. Indicate the live load (pst) on the plans for the added structures. 6. At time of permit review, submit signed and sealed working drawings X of the proposed construction. 7. Add a general note to the site plan that all plans submitted for X permitting shall meet the City's codes and the applicable building codes in affect at the time of permit application. Conditions of Approval Paae 2 I DEPARTMENTS I INCLUDE I REJECT I 8. Pursuant to approval by the City Commission and all other outside X agencies, the plans for this project must be submitted to the Building Division for review at the time of permit application submittal. The plans must incorporate all the conditions of approval as listed in the development order and approved by the City Commission. 9. The existing roof structure and building structure shall be evaluated by X a professional engineer to ensure the roof and structure is capable of withstanding additional imposed loads as mandte by Section 707.1 - 707.4.1 of the Florida Existing Building Code and Table 1607.1 of the FBC. A detailed engineering analysis shall be permitted at the time of the building permit application submittal. 10. Guards are required on the equipment platform per the Florida X Existing Building Code Section 703.5. 11. The construction of the rooftop equipment enclosure shall be of non- X combustible construction, and the support shall be of non-combustible materials per FBC 1509.5.1. 12. Indicate the dimensions (L x W) of the enclosure on the plan. X PARKS AND RECREATION Comments: None X FORESTER/ENVIRONMENTALIST Comments: None X PLANNING AND ZONING Comments: 13. To ensure consistency, all four (4) proposed stealth facilities shall be X required to be constructed at one time per the dimensions and designs of the approved plans. 14. Revise plans at time of permitting to include details of small warning X signs to be located at each roof access point. 15. If future technological advances result in the proposed stealth X facilities no longer being needed, the applicant agrees to abandon the facilities and be responsible for the removal of all telecommunications enclosures and equipment, leaving the area consistent with the rooftop conditions that existed prior to construction of the stealth facilities. . DEPARTMENTS INCLUDE REJECT 16. No continuous outdoor lighting shall be installed on the rooftops to X serve the stealth facilities. Any temporary lighting required during an emergency shall be directed toward the stealth facilities and away from adjacent properties. 17. The antenna enclosures must be repainted as necessary to ensure X the continued mitigation of the visual impact of the facilities. ADDITIONAL PLANNING & DEVELOPMENT BOARD CONDITIONS Comments: 18. Condition #13 is rejected and replaced with the following wording, to X allow phasing of two of the enclosures: To ensure consistency, all four (4) proposed stealth facilities shall be required to be constructed with the same building materials per the dimensions and designs of the approved plans. Enclosures 1-2 located on the easternmost portion of the roof shall be required to be constructed at the same time. Enclosures 3-4 (located west of enclosures 1-2) shall be required to be constructed at the same time, after leases have been secured for future carriers.
