APPLICANT'S ADDRESS: 10 S.E. 1st Avenue, Delray Beach, FL DA TE OF HEARING: January 5, 2010 TYPE OF RELIEF SOUGHT: Appeal of Administrative PREMISES: Multi-structure warehouses 2951 S.W.I4thPlace Boynton Beach, Florida Site Plan attached as Exhibit "A" THIS MATTER came on to be heard before the City Commission of the City of Boynton Beach, Florida on the date of hearing on January 5, 2010. Applicant is appealing an administrative determination that a storage bay (a/k/a "unit") in the Premise shall not be used to manufacture, fabricate, or process goods in a self-storage facility bay in the M-l Zoning District in accordance with Chapter 2. Zoning, Section II.O.I.c The City Commission having considered the relief sought by the applicant and heard testimony from the applicant, members of city administrative staff and the public finds as follows: 1. The Applicant has owned and operated the Premises since approximately 1978. Applicant rents to the public, storage bays in the Premises. 2. By letter dated July 14, 2009 from attorney, Michael Weiner, an application for the relief sought was made by the Applicant in a manner consistent with the requirements of the City's Land Development Regulations; therefore, the City Commission has authority to enter an order on the appeal. 3. The Premises is zoned M -1, Light Industrial which permits a variety of uses notwithstanding that the City's supplemental zoning regulations only permit storage bays in structures designated storage/warehouse to be used for "dead storage of household goods, personal property or records of commercial businesses." 4. Although originally approved for use as storage/warehouse, on numerous occasions since 1978 the City of Boynton Beach has issued Business Tax Receipts (formerly referred to as Occupational Licenses) to businesses that store materials, equipment and merchandise as well as to those engaged in light manufacturing, processing and fabrication in bays in the Premises. 5. The Applicant has established that some storage bays have operated for uses other than dead storage and that such non-passive uses can be accommodated in the Premises provided life, health, and safety issues are addressed on a bay by bay case review and contingent upon meeting the other requirements stated herein. Based upon the foregoing findings it IS ORDERED that the Applicant's appeal is hereby granted subject to the following: A. Applicant may use or rent for use the 216 warehouse units, as identified on Exhibit "B", for any use authorized by the City's Land Development Regulations for M-l Industrial District zoning, excluding those businesses, aspects of business, or accessory components of businesses that involve customer traffic, whether in connection with sales, educational or service purposes, by way of example. When the distance separation requirements of Section 8.A.2 of the M-I Zoning Regulations are applicable to a proposed business, distance shall be measured to the nearest point of the bay of the proposed business. All activity conducted as part of the proposed business shall take place within the subject bay. No activity including vehicle or equipment parking (other than for the occupying business owner or operator) or storage shall occur within the interior aisles of the project, except for the temporary occurrence in connection with loading or unloading. B. As a condition precedent to a use other than passive storage of household goods, personal property, or records for commercial purposes, the tenant or occupant shall adhere to the conditions and procedures set forth in the City's Code of Ordinances for obtaining a Business Tax Receipt, including any required inspections and additional approvals. C. A tenant or occupant who desires to change the use of the unit from passive storage to any other permissible M-l use or a current tenant engaged in non-passive uses may be required to construct fire rated partition walls, change the required means of egress, handicap accessibility, fire protection, electrical upgrades, ventilation requirements, modification of plumbing facilities and exterior wall ratings as determined by the City's Fire Marshall and Chief Building Inspector following review on a case by case basis. Chemical and hazardous material storage used in conjunction with any manufacturing process shall be reviewed for exempt (maximum) quantities. D. Current tenants engaged in non-passive uses who have previously been granted a Business Tax receipt may be granted relief from bay upgrades if the Fire Marshall and Building Official determine that the continuation of the current use does not constitute a life, health and safety threat to adjacent tenants. E. Nothing shall prohibit the owner of the property from consolidating uses and tenants to specific portions of the Premises to reduce the need for modification of the structure to address fire, life safety, building, and accessibility regulations. F. The availability of parking spaces will be confirmed in conjunction with the review of individual requests for business approvals. A current site plan shall be maintained by the property owner and filed with each business tax receipt application showing the location and number of parking spaces to serve the subject business. Note: This requirement does not apply to those activities exempt from the Business Tax Receipt requirements as described above in item "B". G. Nothing herein shall limit application for code variances as provided by the City's Code. This Order shall take effect immediately upon issuance by the City Clerk.
