O80-35ORDINANCE NO. 80- AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, A-MENDING ORDINANCE NO. 79-24 OF SAID CITY, BY AMENDING LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY BY CHANGING THE LAND USE OF CERTAIN PROPERTY MORE PARTICULARLY DESCRIBED HEREINAFTER FROM LOCAL RETAIL CO~iMERCIAL TO GENERAL COMMERCIAL, PROVIDING FOR A SAVINGS CLAUSE, RE-PEALING PROVISION, AN EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Boynton Beach, Florida, has adopted a Comprehensive Land Use Plan and as part of said Plan a land use element by Ordinance No. 79-24 in accordance with the Local Government Comprehensive Planning Act; and WHEREAS, the proposed amendment to the Comprehensive Plan has been referred to the Planning and Zoning Board of the City of Boynton Beach, the Local Land Planning Agency; and WHEREAS, said Board has recommended the proposed change to the Land Use Plan; and I~HEREAS, after public hearings and study, the City Council deems it to be in the best interest of the inhabitants of said City to amend the aforesaid Land Use Element of the Comprehensive 'Plan as adopted by the City. NOW, THEREFORE, BE IT ORDAINED BY THE ~CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. That Ordinance No. 79-24 of the City is hereby amended to reflect the following. That the land use of the following described land located in the City of Boynton Beach, Florida, shall heretofore be General Commercial rather than Local Retail Commercial. Said land is more particularly described as follows: Block 3, Robert Addition to Town of Boynton Subdivision and the east 10 feet of the abandoned alley lying to the west of and adjacent thereto and the north 12.5 feet of the abandoned road lying south of the south lot line and the east 10 feet of the abandoned alley lying west of and adjacent to. Above described property including the 12.5 feet of abandoned road right-of-way~ Lots 1 thru 3 inclusive, Block 6, Robert Addition to Town of Bovnton Subdivision and the south 12.5 feet of abandoned road adjacent to north line of Lot 1 and east 10 feet of abandoned alley lying west of and adjacent to. Above described property including the 12.5 feet of abandoned road right-of-way, as recorded in Plat Book 1, Page 51, Public Records of Palm Beach County, Florida. Section 2. That any maps adopted in accordance with the Land Use Element of said Comprehensive Plan shall be amended accordingly. Section 3. That should any section or provision of this Ordinance or any portion thereof be declared by a court of compe- tent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 4~ Ail ordinances or parts of ordinances in conflict herewith are hereby repealed_. Section 5. upon its passage. 1980.
