AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, A24ENDING OPdPINANCE NO. 79-24 OF
SAID CITY, BY A}fENDING LAND USE ELEMENT
OF THE COMPREHENSIVE PLAN OF THE CITY BY
CHANGING THE LAND USE OF CERTAIN PROPERTY
MORE PARTICULARLY DESCRIBED HEREINAFTER
FROM OFFICE C0~4ERCIAL TO MODERATE DENSITY
RESIDENTIAL, PROVIDING FOR A SAVINGS CLAUSE,
REPEALING PROVISION, AN EFFECTIVE DATE AND
FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Boynton Beach,
Florida, has adopted a Comprehensive Land Use Plan and as part of
said Plan a land use element by Ordinance No. 79-24 in accordance
with the Local Government Comprehensive Planning Act; and
I~HEREAS, the procedure for amendment of a Land Use Element
of Comprehensive Plan as set forth in Florida Statutes 163.3184
has been followed; and
I~EREAS, after public hearings and study, the City Council
deems it to be in the best interest of the inhabitants of said
City to amend the aforesaid Land Use Element of the Comprehensive
Plan as adopted by the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That Ordinance No. 79-24 of the City is hereby
amended to reflect the following. That the land use of the
following described land located in the City of Boynton Beach,
Florida, shall heretofore be Moderate Density Residential rather
than Office Commercial. Said land is more particularly described
as follows:
Parcel C, Plat of Tenth Section, Palm
Beach Leisureville, as recorded in
Plat Book 30 Pages 129 thru 141,
Public Records of Palm Beach County,
Florida: less the following
described property:
Beginning at the Northwest corner of said
Parcel C thence North 69° 11' 14" East along
the North line of said Parcel C, a distance
of 58.74 feet; thence South 20° 48' 46" East,
a distance of 143~02 feet to a point on the
north line of S.W. 15th Avenue (Woolbright
Road); thence westerly along the north right-
of-way line of Woolbright Road to the south-
west corner of said ParceliC; thence North
1° 59' O8" West along the said west line of
Parcel C, a distance of 151.10 feet to the
point of beginning.
Section 2. That any maos adopted in accordance with the
Land Use Element of said Comprehensive Plan shall be amended
accordingly.
Section 3. That should any section or provision of this
Ordinance or any portion~ thereof be declared by a court of compe-
tent jurisdiction to be invalid, such decision shall not affect
the remainder of this Ordinancem
Section 4. Ail ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section 5. This Ordinance shall become effective immediately
upon its passage.
