O80-24ORDINANCE NO. 80- ~ AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING THE CHARTER OF SAID CITY SECTION 72.9 PERSONNEL RULES BY ALLOWING THE CITY COUNCIL TO INITIATE AN AMENDMENT TO THE PERSONNEL RULES OF SAID CITY; PRO- VIDING FOR A SAVINGS CLAUSE; REPEALING PROVISION; AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 72.9 "Personnel Rules" of the Charter of the City of Boynton Beach, Florida, be amended to read as follows: Sec. 72.9 Personnel rules. Immediately after the taking effect of this act [article] the personnel officer shall prepare personnel rules to govern the merit system and carry out the provisions of this act [article]-. The city manager shall approve them with or without modification. When approved by him they shall be submitted to the city council and shall become effective immediately after the city council by resolution adopts them, with or without amend- ment. Thereupon, the rules and regulations of the board of civil service passed on the 27th day of October, 1954, shall be auto- matically repealed and superseded by the rules herein provided for. Amendments to said personnel rules may be enacted by follow- ing the identical procedure set forth-hereinabove for adopting the original rules, and may also be amended by city council initiative. The per,sonnel rules shall provide for: (1) (2) (3) (4) (5) (6) (7) The classification of city positions, which classification shall be based on the duties, authority and responsibility of each position; A pay plan for all city positions embodying the principle, equal pay for equal work, which plan shall become effective when the city council by resolution adopts it with or without amendment; The method of holding competitive tests for fairly determining the merit and fitness of candidates for appointment and promotion; The establishment, maintenance and certificati, of eligible lists for filling vacancies; The order and manner in which layoffs may be effected; Hours of work, attendance, regulations and provisions for sick and vacation leave; The procedure governing provisional or-pro- bationary appointments; (8)- (9) (10) Provide rules for the procedures and grounds fo~ suspension, demotion, dismissal and transfer of employees within the classified service; Other practices and procedures necessary for effect{ye administration of the merit system under the provisions of this'Charter. To make rules and regulations for the selection of a grievance committee by members in the classified service. Section 2. Should any section or provision of this Ordinance or any portion hereof be declared by court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 3.. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. That this Ordinance shall become effective immediately upon its passage.
