AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 3 (ALCOHOLIC BEVERAGES) OF THE
CODE OF THE CITY OF BOYNTON BEACH, FLORIDA,
AS AMENDED, BY ~MENDING SECTION 3.3 "HOURS
OF SALE--GENERALLY" TO LIMIT THOSE HOURS
IN WHICH ALCOHOLIC BEVERAGES MAY BE SOLD
IN SAID CITY; REPEALING ALL ~ORDINANCES
IN CONFLICT HEREWITH; PROVIDING A SAVINGS
CLAUSE; AUTHORITY TO CODIFY; AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS:
Section 1. Section 3.3 of Chapter 3 (.Alcoholic Beverage~
of the Code of Boynton Beach, Florida, is hereby amended to read
as follows:
Sec. 3-3. Hours of sale--Generally.
No person, firm or corporation licensed under the pro-
visions of this chapter shall sell, deliver or consume or permit
the sale, delivery, service or consumption on the premises where
such licensed business is conducted, of:
(a)
Alcoholic beverages of more than one percent of
alcohol by weight between the hours of 5,00
a=m= 2:00 o'clock a.m. and 12:00 o'clock noon
Sunday; it being the intent of this provision that
the sale, service and consumption of alcoholic
beverages shall be permitted between 12:00 o'clock
noon Sunday and ~,0~-eieteek-a~m~ 2:00 o'clock a.m
the succeeding Monday.
(b)
Alcoholic beverages of more than one percent of
alcohol by weight between the hours of
a=m= 2:00 o'clock a.m. and 8:00 o'clock a.m. on
all days except Sunday; it being the intent of this
provision that the sale, service and consumption
of alcoholic beverages shall be permitted between
the hours of 8:00 o'clock a.m.~and ~,~-e~eteek-a·
2:00 o'clock a.m. on the following day except as
modified hereinabove with reference to Sundays.
(c)
The above time limitations prohibiting sale, de-
livery or consumption of alcoholic beverages of
more than one per cent alcohol by weight, between
the hours of §,0~-e~etoek-a~m~ 2:00 o'clock a.m.
and 8:00 o"clock a.m. on all days except Sunday
shall not be applicable on January 1st of each
year, except in such years that January 1st falls
on a Sunday, in which event the regular closing
~'hours of §,~-e!etoe~-a,m= 2:00 o'clock a.m. to
12:00 o'clock noon shall apply.
(d)
Alcoholic beverages of more than one per cent of
alcohol by weight in sealed containers for con-
sumption off the premises between the hours of
§,~-~Zeteek-a=m~ 2:00 o'clock a.m. and 8:00 o'clo(
a.m. on all weekdays and Saturdays, and on Sundays
between the hours of ~,0~-eZeteek-a=m= 2:00 o'clock
a.m. and 12:00 o'clock noon.
Section 2. Ail ordinances or parts of ordinances in con-
fl±ct herewith be and the same are hereby repealed.
Section 3. Should any section or provision of this
ordinance or any portion hereof, any paragraph, sentence or word
be declared by court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder
hereof' as a whole or any part hereof other than the part declared
to be invalid.
Section 4. Specific authority is hereby granted to
codify this Ordinance.
Section 5. This Ordinance shall take effect on the 45 th
day after its final passage.
