AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING CHAPTER 13-39(3) OF THE
CODIFIED ORDINANCES OF THE CITY OF BOYNTON
BEACH BY AMENDING SANITATION CHARGES,
PROVIDING FOR A SAVINGS CLAUSE, REPEALING
PROVISIONS, AN EFFECTIVE DATE, AND FOR
OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA AS FOLLOWS:
Section 1: That Chapter 13-39(3) of the Codified Ordinan-
ces of the City of Boynton Beach, Florida, concerning Sanitation
Charges be amended to read as follows:
(A) Commercial-Containerized Excluding Residential Units
(1)
Monthly commerical charge shall consist of a
total of the following five items:
(a)
Container Rental Charge - A monthly charge
to cover the a--~i%ua~~ cost of the container
(amortized over five years) as andu~lty
calculated and certified by the City
Count il.
The certified Container Rental Charge,
effective with the date of the adoption of
this Ordinance, will be as follows:
2 Cubic Yard Container - $4.33 per montt
3 Cubic Yard Container - $5.00 per mont
4 Cubic Yard Container - $5.92 per mont
6 Cubic Yard Container - $7.83 per montt
8 Cubic Yard Container ~ $8.83 per montl
(b)
Disposal Charge - A fixed charge per cubic
yard as charged by the County for disposal
of waste at the 18ndfill as annually
calculated and certified by the City
Counc il.
The amount certified as the Disposal Charge
on the date of the adoption of this
Ordinance will be $.25 per cubic yard per
pi~k up -(Un.compacted) .
(c)
Operating Charge - A fixed charge per pick
up to cover the operating cost less
disposal cost.
The certified Operating Charge on the date
of the adoption of this Ordinance will be
$11.69 per month per pick up.
(d)
Capital Equipment Reserve Charge - A fixed
charge per pick up to cover total capital
costs for vehicles as annually calculated
and certified by the City Council.
(1)
The certified Capital Equipment Reserve
Charge on the date of the adoption of this
Ordinance will be $4.57 per month per pick
up.
(e)
Overhead Charge - The Overheard Charge will
be as annually calculated and certified by
the City Council.
The Overhead Charge on the date of adoption
of. this Ordinance will be $.78 per cubic ~?.'
yard per pick up.
(2)
Partial monthly service will be charged on a pro
rated basis, as appropriate, based on the
guidelines in (1) above.
(3)
Removal charges for mechanically compressed
refuse shall be computed at three-to-one (3-1)
(containers furnished by the owners).
(4)
Two or more places of business using a single
container shall share equally the charges for
the container per pick up as outlined in (1)
above. Any joint use generating two cubic yards
or less per month shall be charged a minimum of
$35.00 per month to be shared equally.
(B) Non-Containerized Commercial Service
(1)
Refuse picked up from. bins shall be charged at a
rate of $15.00 per cubic yard (non-compacted
measure).
Small businesses generat&ng one cubic yard a
month or less shall be charged at the rate of
$15.00 per month.
(2)
Refuse picked up from residential type cans at
commercial establishments shall have their level
of service negotiated by the Public Works
Department, with an opportunity to appeal the
rate to the City Council.
(C) Residential Rates (Non-Containerized)
(1) $4.50 per month for single family dwelling.
(2)
$4.50 per month for each family unit duplex or
triplex.
(3)
$4.50 per month for each family unit for apart-
ments and condominiums.
(4) Trailer Parks - $4.50 per month per trailer.
(D) Residential Rates (Containerized)
(1)
$4.20 per month for each family unit for apart-
ments and condominiums that are served by high
volume containers. (Containerized) .
(2)
(E)
(2) $4.20 per month per trailer in trailer parks.
Special Pick Up -Unscheduled
The only Special Pick Up to be made will be in
connection with a family moving into or out of a
dwelling unit, or in connection with a health or
traSh violation.
Section 2: Ail Ordinances or parts of Ordinances in-con-
flict herewith are hereby repealed.
Section 3: Should any section or provision of this Ordin-
ance, or any portion thereof, be declared by a court of compedent
jurisdiction to be invalid, such decision shall not affect the
remainder of this Ordinance.
Section 4:
