3 AN ORDINANCE OF THE CITY COMMISSION OF THE
4 CITY OF BOYNTON BEACH, FLORIDA, AMENDING
5 THE PERSONNEL POLICY MANUAL OF THE CITY OF
6 BOYNTON BEACH; PROVIDING FOR CONFLICTS,
7 SEVERABILITY, AND AN EFFECTIVE DATE.

1~ I WHEREAS, on February 2, 1998, by Ordinance 098-06, the City Commission of the
City of Boynton Beach, adopted a Personnel Policy Manual for the City of Boynton Beach,
11 which document was further amended by Ordinance No. 098-34 dated September 3, 1998,
12 Ordinance 098-44, dated December I, 1998; Ordinance 02-031, dated August 6, 2002,
13 Ordinance 03-047, dated September 2, 2003, Ordinance 03-049, dated September 16, 2003,
14 Ordinance 05-048, dated September 6, 2005 and Ordinance 09-018, dated April 7, 2009; and

16 WHEREAS, the Human Resources Director is charged with the responsibility of
17 reviewing the document on a continual basis and making recommendations for amendments to
18 the policies from time to time, to correctly reflect the intent and purposes of the City's personnel
19 program;

21 WHEREAS, the Human Resource Director with the assistance of administrative staff
22 has undertaken a comprehensive review of the PPM and has recommended numerous changes.

24 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
25 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

27 Section 1. The foregoing "WHEREAS" clauses are hereby certified as being true
28 and correct and are incorporated herein by this reference.

30 Section 2. That the Personnel Policy Manual (PPM) is hereby amended to
31 incorporate all of the amendments as reflected in the PPM which is attached hereto as Exhibit
32 "A" and made a part hereof.

34 Section 3. Should any section or provision of this ordinance or portion hereof, any
35 paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid,
36 such decision snaIl not affect the remainder of this ordinance.

38 Section 4. All Ordinances or parts of Ordinances, Resolutions or parts of
39 Resolutions in conflict herewith be and the same are hereby repealed to the extent of such
40 conflict.

1 Section 5. This Ordinance and the amendments to the Policy and Procedures
2 Manual adopted thereby shall become effective on passage. The amendments to the PPM
3 which constitute mandatory subjects of bargaining, if any, shall take effect when implemented
4 through collective bargaining or waiver of bargaining.
