4 FLORIDA, APPROVING AND AUTHORIZING
5 EXECUTION OF A SECOND AMENDMENT TO
6 TEMPORARY CONSTRUCTION EASEMENT
7 8ETWEEN THE CITY OF BOYNTON BEACH AND
8 PALM BEACH COUNTY, IN SUPPORT OF THE CITY'S
9 CONSTRUCTION OF THE NEW REGIONAL FORCE
10 MAIN, AND PROVIDING FOR AN EFFECTIVE DATE.

13 WHEREAS, in 2007, the City issued task order U07-20-1 to the Wantman Group for
14 the new regional force main route selection, detail design, permitting and bidding phases of
15 the project; and
16 WHEREAS, in November, 2008, via Resolution 08-131, the City Commission
17 approved an Interlocal Agreement and Temporary Construction Easement between the City of
18 Boynton Beach' and Palm Beach County; and
19 i WHEREAS, a First Amendment to Temporary Construction Easement was approved
20 by the City Commission on December 15, 2009; and

21 i WHEREAS, this Second Amendment to the Temporary Construction Easement will

22 provide for continued access to the Temporary Construction Easement during the warranty
23 period for maintenance of the landscaping that was part of the original Utility Easement
24 Agreement; and

25 I WHEREAS, the City Commission upon recommendation of staff, deems it
I
26 appropriate to approve and authorize execution by the Mayor and City Clerk of the Second
27 Amendment to Temporary Construction Easement between the City of Boynton Beach and
28 Palm Beach County.
29 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF

1 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
2 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
3 being true and correct and are hereby made a specific part of this Resolution upon adoption
4 hereof.
5 Section 2. The City Commission of the City of Boynton Beach, Florida hereby
6 approves and authorizes the Mayor and City Clerk to execute a Second Amendment to
7 Temporary Construction Easement between the City of Boynton Beach and Palm Beach
8 County, a copy of which is attached hereto as Exhibit "A".
9 Section 3. This Resolution shall become effective immediately upon passage.

TEMPORARY CONSTRUCTION EASEMENT

EASEMENT ("Second Amendment") made JU 1 9 2 by and between PALM
BEACH COUNTY, a political subdivision of the State of Florida ("County") whose
mailing address is 301 North Olive Avenue, West Palm Beach, Florida 33401- 4791, and
CITY OF BOYNTON BEACH, a municipal corporation of the State of Florida, whose
mailing address is 100 East Boynton Beach Boulevard, Boynton Beach, Florida 33435-
7934 ("Grantee").
RECITALS
Whereas, County granted Grantee a Temporary Construction Easement on
January 13,2009 (R2009-0097) (the "Easement"), the termination date of which has been
extended; and
Whereas, County and Grantee wish to amend the Easement to further extend the
termination date.
WITNESSETH:
NOW, THEREFORE, for good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged by the parties, the parties hereto agree as
follows:
1. The foregoing recitals are true and correct and incorporated herein by
reference. Terms not defined herein shall have the same meaning as
ascribed to them in the Easement, as amended.
2. The Easement is hereby modified to provide that the rights granted
pursuant to the Easement shall expire and the Easement shall automatically
terminate upon the earlier of Grantee's completion of the Project or
December 1, 2012. Notwithstanding such automatic termination, Grantee
shall promptly deliver to County a Release of Easement, in a form
satisfactory to County, upon completion of the Project, if so requested by
County .

3. Except as modified by this Second Amendment, the Easement, as amended,
remains unmodified and in full force and effect and the parties hereby
ratify, confirm, and adopt the Easement, as amended, in accordance with
the terms thereof.
4. This Second Amendment is expressly contingent upon the approval of the
Palm Beach County Board of County Commissioners, and shall become
effective only when signed by all parties and approved by the Palm Beach
County Board of County Commissioners.

B. PROPOSED RESOLUTION NO. R11-054 - Authorize the Second Amendment to Temporary
Construction Easement (TCE) between Palm Beach County and the City of Boynton Beach in support
of the City's construction of the new regional force main.
C. PROPOSED RESOLUTION NO. R11-055 - Approve a contract extension for a second two year period
from June 20, 2011 through June 19, 2013 with DcR Engineering Services, Inc as permitted under
RFP #37-2821-07/CJD, "SCADA AND TELEMETRY SYSTEM GOODS AND SERVICES".
D. PROPOSED RESOLUTION NO. R11-056 - Designation of the Community Redevelopment Agency

E. Approve the 2010/2011 Recreation and Parks Strategic Plan.
F. Approve the full release of the surety and authorize return of the performance bond in the
amount of $205,700.00 to the developer for the project known as the Promenade.

A. PROPOSED RESOLUTION NO. R11-057 - Approve a contract with Thermal Concepts, Inc. of Davie,
FL for the replacement of the existing cooling towers at City Hall Complex, Bid No. #040-2510-
11 /CJD in the amount of $187,450 plus allow for a contingency of $15,000 if needed.
B. PROPOSED RESOLUTION NO. R11-058 - Approve the piggy-back of the Florida Sheriffs Association
joint purchasing contract #10-18-0907 for the purchase of (4) four replacement police pursuit
vehicles in the amount of $107,933
C. (1) Eliminate the re-advertisement of the Request for Qualifications (RFQ) for the scope of
services (A - E), "TWO YEAR CONTRACT FOR GENERAL CONSULTING AND ENGINEERING SERVICES FOR
THE CITY OF BOYNTON BEACH" ; and (2) authorize City staff to issue separate RFQs based upon the I
scope of services required for individual Capital Improvement Plan (CIP) projects. Passage of
motion authorizing staff to proceed as outlined herein.
