7 OCEAN AVENUE AND SW 1ST A VENUE,
8 EXTENDING TO SEACREST BOULEV ARD FROM
9 SW 2ND STREET, SUBJECT TO STAFF COMMENTS;
10 AUTHORIZING THE CITY MANAGER TO
11 EXECUTE A DISCLAIMER, WHICH SHALL BE
12 RECORDED WITH THIS ORDINANCE IN THE
13 PUBLIC RECORDS OF PALM BEACH COUNTY,
14 FLORIDA; AND PROVIDING AN EFFECTIVE DATE.

17 WHEREAS, staff is requesting that the City abandon an 18.2 foot wide unimproved
18 alley between West Ocean Avenue and Southwest 1 sl Avenue, extending to Seacrest Boulevard
19 from Southwest 2nd Street, subject to staff comments; and
20
21 WHEREAS, comments have been solicited from the appropriate City Departments,
22 and public hearings have been held before the City's Planning & Development Board, and the
23 City Commission on the proposed abandonment; and
24
25 WHEREAS, staff finds that the alley no longer serves a public purpose, and the City
26 Commission adopts that finding.

28 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
29 THE CITY OF BOYNTON BEACH, FLORIDA THAT:

31 Section 1. The foregoing Whereas clauses are true and correct and incorporated
32 herein by this reference.

34 Section 2. The City Commission of the City of Boynton Beach, Florida, does
35 hereby abandon a an 18.2 foot wide unimproved alley between West Ocean Avenue and
36 Southwest 1 sl A venue, subject to staff comments. The property being abandoned is more
37 particularly described as follows:

39 All of the 18.2-foot alley as shown on Blocks 11 and 12, Plat of BOYNTON HEIGHTS,
40 as recorded in Plat Book 10, Page 64, according to the Public Records of Palm Beach
41 County, Florida,

43 LESS that part of the alley between Lot 22 and 23 of said Block 12 that was previously
44 abandoned per Resolution No. 75-WWW by the City Council of the City of Boynton
45 Beach, Florida, dated November 18, 1975, and

KNOW ALL MEN BY THESE PRESENTS that the City Commission of the City of
Boynton Beach, Florida, does hereby abandon an 18.2 foot wide unimproved alley between
West Ocean A venue and Southwest 1 st A venue, subject to staff comments. The property being
abandoned is more particularly described as follows:
All of the 18.2-foot alley as shown on Blocks 11 and 12, Plat of BOYNTON HEIGHTS,
as recorded in Plat Book 10, Page 64, according to the Public Records of Palm Beach
County, Florida,
LESS that part of the alley between Lot 22 and 23 of said Block 12 that was previously
abandoned per Resolution No, 75-WWW by the City Council of the City of Boynton
Beach, Florida, dated November 18, 1975, and
LESS that portion of the alley lying northerly of and adjacent to Lots 35 and 36 of said
Block 12 as noted in Ordinance No. 99-04 of the City Commission of the City of
Boynton Beach, Florida, dated February 2, 1999.
