Permits 06-6196, 07-3189, 07-3190,07-3256,09-3364 and 10-782., Meeting Minutes Building Board of Adjustments and Appeals Boynton Beach, Fl ' February 3, 2011 Andrew Mack, Interim Building Official, explained the application and the fact that a time extension was granted to the applicant in the past. The City is in favor of this request for a time extension of one year. The Recording Secretary administered the oath to all those intending to testify. William David Poist, Sr., ,President of C 1 Construction and Director of Development for Compson, said this was the second' request for a time extension. He appreciated the Board's cooperation since this is a very difficult economy. He is hopeful they will be able to move forward with Compson Place Apartments within the next 90 days when the firm letter from HUD is received. With regard to the parcels on the opposite side of the canal, Sembler sold their portion and one parcel will probably move forWard within the year. There is no market for the other parcel at this time. In response to Ms. Agee, Mr. Poist explained a "firm letter". HUD goes through site planning, site analysis and a recommen<;lation based on appraisal and income flow. The numbers are then agreed upon and the application goes forward'from Jacksonville to Miami and onto Washington, D.C. for the issuance of a "fir!'n letter" which is a commitment to develop and fund. This will be an affordable housing project including some retail on the ground flo.or with space for ADA and handicapped. It is a different type of use. Mr. Rurey referred to the permit, numbers and inquired if the permits were six years old. Mr. Mack responded affirmatively. ., Motion Ms. Agee moved to approve. The motion was seconded. Cross Fit Boynton Beach was fined $9,413.67 for commencing a build out at 975 Gateway Boulevard, Suite 106 after building permit was applied for but before it was granted. The timeline is as follows: . 11/01/10 . 11/17/10 . 12/02/10 . 12/07/10 . 01/13/11 . 01/19/11 . 01/19/11 Applied for Building Permit Red Tagged Building Permit Approved $9,413.67 Fine Paid CO Obtained Permit Penalty Fee Waiver application submitted Permit Penalty Fee Waiver application denied The reasons for which the appeal is taken and a definite and detailed statement of relief sought from the Building Board of Adjustment and Appeals is as follows: Cross Fit Boynton Beach hired Polo Construction to build out a new Cross Fit gym at Quantum Village, the Publix strip mall at Gateway and 1-95. Unfortunately, Polo Construction began the build out after applying for the building permit but before obtaining the permit. As spon as the premises was red tagged, all construction immediately stopped and the fine was paid promptly and in fulL Construction was completed without further issues, a CO was obtained, the gym is now open, and it is a beautiful gym that is an asset to the City of Boynton Beach. John Kay of Polo Construction submitted a Permit Penalty Fee Waiver to the Building Department. Upon his recommendation, he met privately with Andrew Mack, Interim Department Head, to argue our petition. It was denied. Quantum Viilage strip mall is in receivership. Much of the mall is unoccupied. In the building where CrossFit Boynton Beach is locat~d, both bays on either side of the gym are vacant and not built out. CrossFit Boynton Beach is bringing valuable business to a mall that is in financial distress and to a location that needs tenants. A fine of nearly $10,000 severely threatens Cross Fit Boynton Beach's ability to survive by consuming a substantial amount of the business' working capital and marketing budget. It is potentially bankrupting during the critical early months of the new " business, when the fine monies could instead be used to market, grow, and establish , Cross Fit Boynton Beach in the community. Please consider some of the intangibles that Cross Fit Boynton Beach brings to Boynton., The gym is an active member of the Chamber of Commerce. The gym ,offers a 33% discount to all police, fire fighters, and first responders (and have many members from those communities. In fact, one of our coaches is a Boynton police officer, soon to be detective). CrossFit Boynton Beach has built a state of the art fitness facility that strives to help Boynton citizens improve their health and fitness. Enclosed please find a picture of the exterior and the interior of Cross Fit Boynton Beach. The City can be proud of this beautiful, new facility. Cross Fit is a global phenomena. In 2007 there were approximately a dozen Cross Fit gyms in the US. There are now over 2,000 in the US alone and many others throughout the world. This explosive growth has occurred because Cross Fit is an exceptional training regimen thatis fun and that works. It works because it is high- intensity, short-duration training. It's fun because the work outs change every day and because it is practiced in coach led classes, and it's simply more fun to work out in a group than alone. Cross Fit is transformational for many of it's practitioners. Crossfitters tend to become truly fit and very devoted. In fact, most crossfitters seek out local' Cross Fit gyms when they travel, and having a Cross Fit in Boynton will support tourism from the growing ranks of crossfitters. Additionally, Cross Fit gyms traditionally perform charity events. Cross Fit Delray Beach, for example, holds charity events to benefit the Milagro Center. We plan to hold similar charity events as well. To Qualify for the ownerlbuilder exemption in Florida Statute 489.103 (7) (b), an owner must personally appear and shm the buildinl! permit application. State law requires construction to be done by licensed contractors. You have applied for a permit under an exemption to that law. The exemption allows you, as the owner of your propeny, to act as your own contractor with certain restrictions even though you do not have a license. You must provide direct, onsite supervision of the construction yourself. You may build or improve a one- family or two- family residence or a farm outbuilding. You may also build or improve a commercial building, provided your costs do not exceed $75,000. The building or residence must be for your own useor occupancy, It may not be built or substantially improved for sale or lease. If you sell or lease a building you have built or substantially improved yourself within] year after the construction is complete, the law will presume that you built or substantially improved it for sale or lease, which is a violation of this exemption. You may not hire an unlicensed person to act as your contractor or to supervise people working on your building. It is your responsibility to make sure that people employed by you have licenses required by state law and by county or municipal licensing 'ordinances. You may not delegate the responsibility for supervising work to a licensed contractor who is not licensed to perform the work being done. Please note that on page I of Exhibit E that line item "H" is not part of this document and was hand written by the applicant. Andrew Mack politely advised that he does not qualify for penalty relief based on the information provided and it was denied, One thing should be acknowledged is that the penalty fee is a result of the contractor's negligence by commencing work without first obtaining the required permits, clearly a violation of the law. The contractor, not the tenant is responsible for such penalty fees. This a violation of City Ordinance No. 09- 016 and subject to the penalties imposed as prescribed in the Boynton Beach Administrative Amendments to the 2007 Florida Building Code Section 108,5, This department felt that this issue was resolved when the contractor made his apologies, fees were paid and pennit was issued, The contractor Mr. Kay is aware that I had the option but withheld reporting this to the Department of Business and Professional Regulation who would impose additional fines, discipline the contractor and leaving record on his professional license, In closing, based on the information provided and in my opinion on behalf ofthe Building Division, the only reason that the business owner paid for the penalty fees is because this was a result of their business arrangement which is clearly in violation ofthe law, In the contractor's own words, he made a bad business decision and this should be resolved between the contractor and his customer. CrossFit Boynton Beach was fined $9,413.67 for commencing a build out at 975 Gateway Boulevard, Suite 106 after building permit was applied for but before it was granted. Unfortunately, Polo Construction began the build out after applying for the building permit but before obtaining the permit. As soon as the premises was red tagged, all construction immediately stopped and the fine was paid promptly and in full. Construction was completed without further issues, a CO was obtained, the gym is now open, and it is a beautiful gym that is an asset to the City of Boynton Beach. John Kay of Polo Construction submitted a Permit Penalty Fee Waiver to the Building Department. Upon his recommendation, he met privately with Andrew Mack, Interim Department Head, to argue our petition. It was denied. Quantum Village strip mall is in receivership. Much of the mall is unoccupied. In the building where Cross Fit Boynton Beach is located, both bays on either side of the gym are vacant and not built out. Cross Fit Boynton Beach is bringing valuable business to a mall that is in financial distress and to a location that needs tenants. A fine of nearly $10,000 severely threatens Cross Fit Boynton Beach's ability to survive by consuming a substantial amount of the business' working capital and marketing budget. It is potentially bankrupting during the critical early months of the new business, when the fine monies could instead be used to market, grow, and establish CrossFit Boynton Beach in the community. Please consider some of the intangibles that Cross Fit Boynton Beach brings to Boynton. The gym is an active member ofthe Chamber of Commerce. The gym offers a 33% discount to all police, fire fighters, and first responders (and have many members from those communities. In fact, one of our coaches is a Boynton police officer, soon to be detective).
