O80-09ORDINANCE NO. 80- ~ AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, EXTENDING TPIE MUNICIPAL TERRITORIAL LIMITS OF SAID CITY BY THE ANNEXATION OF A CERTAIN UNINCORPORATED TRACT OF LAND LYING CONTIGUOUS THERETO AND WITHIN PALM BEACH COUNTY, FLORIDA, TO WIT: A PARCEL OF LAND LOCATED IN SECTION 4, TOWNSHIP 46~,~SOUTH, RANGE 43 EAST, PALM' BEACH COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED HEREIN- AFTER; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LAND; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR AUTHORITY TO CODIFY, SAVINGS CLAUSE, AN EFFEETIVE DATE AND FOR OTHER PURPOSES. WHEREAS, the owners of the property more particularly ~escribed hereinafter has heretofore petitioned the City Council of the City of Boynton Beach, Florida, requesting .the annexation of certain property lying adjacent and contiguous to the terri- torial limits of said municipality and within the same County to the municipal territorial limits of said City; and WtTEREAS, the City Council of the City of Boynton Beach, Florida, has determined that said petitions bear the signatures of all owners of property in the area to he annexed and that such property meets the criteria of Section 171.043 Florida Statutes (1974) relative to the character of the area to be annexed; and WHEREAS, ~he City Council of the City of Boynton Beach, Florida, deems the annexation of said land to be beneficial to and in the best interests of the said City, and the owners of said land that said land be annexed and included within the municipal territorial limits of said City; and WHEREAS, all requirements of the Charter of the City of Boynton Beach, Florida, and of the laws of the State of Florida relative to voluntary annexation of contiguous territory have been complied with; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BO¥1qTON BEACH, FLORIDA: -1- Section 1: That the City Council of the City of Boynton i~Beach, Florida, hereby annexes the tract of land more particularly i described in the attached Exhibit A, which is hereby made a part .~ereof, to the municipal territorial limits of the City of Boynton Beach, Flor ida. Section 2: That upon annexation'~ subject property shall oe zoned Zone C-3 (Community Commer~-ial). Section 3: That the territorial boundaries of the City of Boynton Beach, Florida, are hereby redefined so as to include the ~bove-described property. Section 4: Repealing Provision: All ordinances or parts Df ordinances in conflict herewith are hereby repealed. Section 5: Separability: Each of the provisions of this )rdinance is separable, including word, clause, phrase or sentence, ~nd if any portion thereof shall be declared invalid, the remaining ~ortion shall not be affected but shall remain in full force and ,~f fect. Section 6: Effective Date: This ordinance shall become -=ffective in the manner and at the time provided by law.
