AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING THAT PARAGRAPH OF SECTION
1, (DEFINITION OF TERMS) OF THE CITY ZONING
REGULATIONS DEFINING THE 'TERM "FAMILY" BY
INCLUDING WITHIN SAID DEFINITION, HOUSEHOLDS
LICENSED BY THE STATE OF FLORIDA, WITH FOSTER
CHILDREN, UP TO FIVE CHILDREN (INCLUDING BOTH
NATURAL AND FOSTER CHILDREN IN THIS TOTAL);
PROVIDING A REPEALER CLAUSE; PROVIDING A
SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE
AND FOR OTHER PURPO~SES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH,
FLORIDA:
Section 1. The paragraph defining the term "Family" in
Section 1 of Appendix A, Zoning Regulations, of the codified
Ordinances of the City of Boynton Beach, Florida, is hereby
amended by including within said definition households, licensed
by the State of Florida, with foster children up to a total
of five children (both natural and foster), and said paragraph
is therefore amended to read as follows:
Family. A single person occupying a dwelling unit
and maintaining a household, including two (2) or
more persons related by blood, marriage, or adoption
occupying a dwelling, living together and maintain-
ing a common household. Foster children duly placed
in foster homes licensed by the State of Florida,
up to a ~3aal of five children (both natural and
foster) in the household, are expressly included
within this term. A common household shall be deemed
to exist if all members thereof have access to all
parts of the dwelling.
Section 2. All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.
Section 3. That should any section or provision of this
Ordinance, or any portion thereof, be declared by a Court of
competent jurisdiction to be invalid, such decision shall not
effect the remainder of this Ordinance~
Section 4. This Ordinance shall become effective immediately
upon its passage.
