BOYNTON BEACH, FLORIDA, AMENDING SECTION 6.C.1.
OF APPENDIX A TO THE ORDINANCES OF Th~ CITY OF
BOYNTON BEACH, FLORIDA, ZON~qG REGULATIONS, BY
PROVIDING THAT LUMBER YARDS BE A CONDITIONAL
USE LN THE C-3 ZONING DISTRILT, REPEALING ALL
ORDINAiqCES Ill COI~FLICT, PROVIDING FOR A SAVI~S
CLAUSE, PROVIDING AN EFFECTIVE DATE, AND FOR
OTHER PURPOSES.
WHEREAS~ certain lumber yards currently exist as legal non-conforming
uses in the C-3 Zoning Districts of the City of Boynton Beach, Florida, which
lumber yards badk prior to the revision to the City Zoning Ordinance pursuant
to Ordinance No~ 75-19, been permitted uses under the City Zoning Regulations
in effect prior to said revision; and
WHEtW~S, the Planning and Zoning Board of the City of Boynton Beach,
Florida, has unanimously reconmended that lumber yards be included as con-
ditional uses in the C-3 Zoning Distric~ of the City of Boynton Beach,
Florida; and
WHEREAS, the City Council of the City of Boynton Beach, Florida, deems
it to be in the best interests of the residents of said City to include
lumber yards as conditional uses in the C-3 Zoning Districts of the City;
NOW, THEREFORE, BE IT ORI~I_NED BY THE CITY COUNCIL OF %HE CITY OF BOYNTON
BEACH, FLORIDA, AS FOLLOWS:
Section 1: %17at lumber yards be included as conditional uses in the
C-3 Zoning Districts of the City of Boynton Beach, Florida, and tbmt Section
6.C.1. of Appendix A to the Ordinances of the City of Boynton Beach, Florida,
Zoning Regulations, be amended to read as follows:
1. USES PERMIt. Within any C-3 conmtmity commercial district,
no building, structure, land or water shall be used except for one or more of
the following uses:

Any use permitted in C-1 or C-2 districts.
Antique and ceramic stores.
Appliance stores (sales and service).
Art and music stores.
Bars, cocktail lounges and package stroes.
Delicatessen.
g. Department stores.

Florists, greenhouses, nurseries and other
horticultural uses~
Hotels, motels, apartment hotels, and
apartment motels ~
Laundromat and dry-cleaning (on premises).
Lumber Yards.*
Multifamily residential dwellings are aut~r~ed as
a special Use in said district, subject tO the
building and site regulations set forth in section
5 (G) (2) (a) of AppendiX A of this Code.
Private clubs, lodges and fraternal organizations.
~Public utilities if adequately screened to exterior
view.
Recreational facilities, including bowling lanes,
gymn siums and health centers.
Restaurants, including drive-ins.
Service stations without mjor repairs, but in-
cluding car wash (see definitions, '~ajor
Repairs") erected in accordance with supplemental
regulations, section ii-L.
Shopping centers.
Sundries and variety stores°
Theatres, excluding drive-ins.
New boat sales agencies.*
Section 2: Ail Ordinances or parts of Ordin~ces in conflict here-
with are hereby repealed.
Section 3: That should any section or provision of this Ordinance,
or any portion thereof, be declared by a Court of competent jurisdiction to
be invalid~ such .decision shall not effect the remainder of this Ordinance.
Section 4:
