AS, the City Council deems it to be in the best interests of the residents of said City to amend the said revised Zoning Map as hereiomfter set forth; NOW, THEREFORE, BE IT OPJIkII{ED BY ~TdE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIEA, AS FOLLOWS: Section 1: The following described property located in the City of Boynton Beach, Palm Beach County, Florida, be and the sam~ is hereby rezoned as indicated: Parcel 1 - %kacts 37, 38, 39, 58, 59 and 60; Tracts 40 and 57, less the west 25 feet thereof and less the south 25 feet of tracts 57, 58, 59 and 60; Tracts 69, 70 and the east 260 feet of tract 71 less the north 60 feet thereof, all tracts being a portion of Palm Beach Farms Company Plat Number 8 recorded in Plat Book 5, page 73, Public Records of Palm Beach County, FlOrida, are hereby rezoned frcm Zone R-3 to Zone R-2. Parcel 2 - Lots 66, 67 and 68, less the north 60 feet thereof, Palm Beach Farms Company Plat Number 8 as recorded in Plat Book 5, pa~e 73, Public Records of Palm Beach County, Florida, are hereby rezoned fr~n Zone C-3 to Zone R-2. Section 2. The rezoning provided for by Section 1 of this Ordinance is subject to the compliance with the following conditions by the applicant for the said rezoning and the owner of the property that is the subject .of the rezoning, Hugh Culverhouse, Trustee: a~ That the applicant comply with all Ordinances of the City of Boynton Beach, Florida; b. That the properties rezoned tie into the water system of the City of Boynton Beach at two points on State Road 804 and Congress Avenue with a sixteen inch (16") water line; c. That sewage collection from the northerly part of the above desCribed' property be by gravity flow to the regional pumping station and that the southerly portion of the property be served by a gravity collection system pumping into the northerly portion of the property; d. That the applicant Plat limited access easements on all collector and arterial streets; e. That of the acreage required by the City Ordinmnces to be dedicated as public recreation and open space, a minimum of 4 acres of this amount be in the form of land, with the balance to be paid by the applicant to the' City as a fee pursuant to Section 8 (B)(5) of Article IX of the City Subdivision and Platting Regulations; f~ That applicant agrees to pay the school impact~ fee requried by the SchOol Board of Palm Beach County; g~ That applicant agrees to pay the traffic ~mpact fee required by Palm Beach. County. Section 3. The said revised Zoning }~p of the City of Boynton Beach, Florida, shall be ammnded accordingly. Section 4. Ail Ordinances or parts of Ordinm~ces in conflict herewith are hereby repealed. Section 5. That should any section or provision of this ordinance or any portion thereof be declared by a Court of competent jurisdiction to be invalid, such decision shall not effect the remainder of this Ordinance.
