O01-02ORDINANCE NO. O1 - d~M' AN 'ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REGARDING THE APPLICATION OF KILDAY AND ASSOCIATES, INC.; AMENDING ORDINANCE 91-70 OF CITY BY REZONING A CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREIN, FROM PLANNED COMMERCIAL DEVELOPMENT TO PLANNED UNIT DEVELOPMENT AND AMEND THE PREVIOUSLY APPROVED PLANNED UNIT DEVELOPMENT MASTER PLAN; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted Ordinance No. 91-70, in which a Revised Zoning Map was adopted for said City; and WHEREAS, Kilday & Associates, Inc., as agents for the owner of the property more particularly described hereinafter, has heretofore filed a Petition, pursuant to Section 9 of Appendix A-Zoning, of the Code of Ordinances, City of Boynton Beach, Florida, for the purpose of rezoning a certain tract of land, said land being more particularly described hereinafter, from Planned Commercial Development to Planned Unit Development and to amend the previously approved Planned Unit Development Master Plan to allow for construction of multifamily dwellings on a 14.18 acres at a density of 10.8 DU/AC; and WHEREAS, the City Commission deems it in the best interests of the inhabitants of said City to amend the aforesaid Revised Zoning Map as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1: The following described land, located in the City of Boynton Beach, Florida as set forth as follows: See Attached Exhibit "A" ATTEST: (~orate Se~ s:ca\Ord\ Woolbrigh~l! e and the same is hereby rezoned from Planned Commercial Development to Planned Unit Development and to amend previously approved Planned Unit Development Master Plan to allow for construction of multifamily dwellings on a 14.18 acres at a density of 10.8 DU/AC. A location map is attached hereto as Exhibit "B" and made a part of this Ordinance by reference. Section 2: That the aforesaid Revised Zoning Map of the City shall be amended accordingly. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby :epealed. Section 4: Should any section or provision of this Ordinance or any portion :hereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance.
