A RESOLUTION OF THE CITY COMMISSION,OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A PURCHASE AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH, FLORIDA AND CPT OF SOUTH FLORIDA, INC., FOR THE. PURCHASE AND INSTALLATION, OF COMPUTER HARDWARE AND SOFTWARE TO INSTALL A NOVELL NETWORK IN THE POLICE DEPARTMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida has previously approved the concept of and the negotiation for the purchase and installation of software and hardware for the installation of a Novell Network in the Police Department, to be paid for by the utilization of the Law Enforcement Trust Fund; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1, The City Commission of the City of Boynton Beach, Florida hereby authorizes and directs the Mayor and City Clerk to execute a Purchase and Installation Agreement between the City of Boynton Beach, Florida and CPT of South Florida, inc., a copy of said Agreement being attached hereto as Exhibit "A". ~ This Resolution shall become effective immediately upon passage. The purchase price of this Asreement shall-include all costs ot' equipment, c~elivery ano instaliation including all cabling, cable, ends arid related hardware needed for installation, all trainintt a~ specified herein, and all maintenance as specified herein. 7. A payment Of 50% of the Unit Price will be made upon completion of the installation. The balance shall be :)aid after (15) days of completion of the installation. 8, All equipment, software and installations si-ell be warranted/'or a minimum period of one (1) year from the date of final acceptance except for Compaq brand PrOducts which must include Compaq's standard 3-year limited wazranty. Warranty shall include on- site service and shall cover all parts and labor except consumables. 9. CONTRACTOR shall be deemed to be an inde~ndent contractor and not an agem or employee of the CITY. SUPPLIER represents that it carries the proper worker's compensation insurance as required by the laws of the 5tare of Florida. 10. This is a personal service Agreement whereby the CITY has expressly retained SUPPLIER. This Agreement is not as$isnable or transferable in whole or in pal without the prior expressed written consent of the CITY which consent can be arbitrarily withheld. 1 !. SUPPLIER warrants for one (1) year from delivery and acceptance by CITY thai all items supplied shall be of $ood quality,, free from faults and defects, fit for the purpose in:ended and in conformity with the soedfications set forth in the Invitation to Bid. t .3. SUPPLIER shall provide a minimum period of one (1) year warranty from the date of final installation of said equipment. The warranty shall include on.4ke ~ervice and shal! cover all parts and labor except co~,sumables. 16. SUPPLIER guarantees a f'our (4) hour response time for ser,,'ice during the hours of 9:00 A,M. and ,~:00 P.M., Monday throu~h Friday. 17. If SUPPLIER shall be adjudged bankrupt, or if it should make a general ass~gnrr, en! for the benefit of creditors, or ii' a receiver should be appointed due to SUPPLIER's insolvency, or if it should persi~ently disregard laws or ordinances, or is othel~vis~ suilty ot~ an.v substantial violation of any provision of the Agreement, the CITY may [ermlnate this Asrecment without prejudice to any other right or remedy of the CITY. 20. This Agreement is entered into subject to the provisions of the Charter and Code of Ordinances of the City of' Bo3mton Beach and applicable Federal, State and County laws, at[ of which are incorporated hereir~ by reference. Any disputes under thls asreement shall be sett!ed accordlnlt to the laws of the State of Flor!da and venue shall be in Palm Bea¢i~ Count)', Florida. 21. Should SUPPLIER fail to perform any provisions set forth herein, said breach shall constitute a deirault under this A,~H-een-rent. 22. Twenh'-three (2.3) 3' P, J45 to RJ45 IBM Level 5 Patch Cables will be run from the Patch Panel to the three S-Port Concentrators supplied by CPT. The three 8-Port concentrators w~il siva a total or' 24 ports, which will be connected by a separate upllnk coaxial connection. At the wa!l, twenty-three (23) 14' RJ45 to RJ45 IBM Level 5 stranded cables will be included. Each recessed IBM Level 5 modular wall iacks wilt be color coded, ~o that the user will not mistake the jack for a telephone or other type 6' data iack. All cables will be terminated in accordance to IBM Level 5 wirin8 standard $68b. At the conclusion of the cable in~allation, the entire cable system will be tested in accordance with such standards. In the event that Iocation~ permit the utilization ot' dual outlets, or even quad outlets, CPT will supply them instead of the single RJ45 recessed jacks at no additional charge. These dual or quad outlets will be co!or coded for the user. This will be on an as.needed basis, and will be determined at a lc, cat;on.by, location decision by the City of Boynton Beach Police Department personnel. This will provide the nearest installation, in that tn many of the locations the re-punching of hole~ in the wails will not be required. The present wall outlet area, as indicated to us, is usable in some locations. City of Bo,/nton Beach has indicated to us that certain data jacks now being used for the AS/400 terminals will notbe needed at these locations, ~nd therefore can be replaced with an :BM Level $ jack and te;ephone jack. ,'n addition, CPT will re-terminate the existin§ I[)11 line at that jack location. CPT has observed that ',here is a conduit In place between the Police Departmen~ and City Hall. In the event that such conduit is not accessible or ~ot practical r.o utilize, CPT has received information from the City of Boynton Seach .k, tlS Department that theme are availab!e pair runs between the Police Department and City Hall, where the Gateway will be located. CPT has observed these cable runs; :hey can be u'dllzed to bring the cabling for the Gateway to the Punchdown area. It should be noted, however, thai the available cable runs that are already in place are Level 3. Therefore, 1his connection will be Level 3 instead of Level $. This, however, will not impact the performance of the Gate, ray in any way. In Ihe event that lhe City chose to have Level 5, CFT will ins,all such Level $ provided that the conduit is accessible and without obstructions or any other Im'oblems that might prohibit the use of such conduit.
