3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA
4 AMENDING LAND DEVELOPMENT REGULATIONS, CHAPTER
5 4, ARTICLE IV, SECTION l.e.t, "WALL SIGN (AFFIXED TO
6 BUILDINGS)" TO CLARIFY THE METHODOLOGY USED TO
7 CALCULATE THE MAXIMUM WALL SIGNAGE ALLOWED FOR
8 ANY GIVEN BUILDING OR TENANT SPACE; PROVIDING FOR
9 CONFLICTS, SEVERABILITY, CODIFICATION AND AN
10 EFFECTIVE DATE.

12 WHEREAS, prior to the Land Development Regulations rewrite, the sign code was
13 more explicit with respect to the methodology used in determining the maximum allowable
14 wall sign area; and
15 WHEREAS, the maximum area was based on the linear building frontage and
16 therefore, sign area is logically intended to be a factor of length of building frontage and
17 presence along the principal roadway, rather than a factor of building depth or perimeter; and
18 WHEREAS, the term frontage was inadvertently excluded from the new code when the
19 written standard was rearranged into tabular format which omission potentially changes the
20 meaning or interpretation of this standard and would allow signs that are excessive in size and
21 inconsistent with the intent of the City's sign regulations; and
22 WHEREAS, the City Commission has considered the recommendations and has
23 determined and finds that the changes to clarify the methodology used to calculate the
24 maximum wall signage allowed for any given building or tenant space is consistent to meet the
25 intent of the original sign code in the Land Development Regulations.
26 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
27 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
28 Section 1. The foregoing whereas clauses are true and correct and are now ratified

1 and confirmed by the City Commission.
2 Section 2. Chapter 4, Article IV, Section l.C.1. "Wall Sign (Affixed to Building)"
3 of the Land Development Regulations of the City of Boynton Beach Code of Ordinances is
4 hereby amended as follows:

6 b. Maximum Sie:n Area (Table 4-13). The maximum allowable wall sign
7 area is a factor of the zoning district within which a building is located and the
8 length of such building. Specifically, it shall be based on the ratio of wall and to
9 ach linear foot of building frontage or tenant space frontage. The maximum
10 allo';/able area for '.yall signs is a factor of the zoniag district and length of the
11 building viall. '.Vall signs shall be allowed in accordance with the following

15 1 Wall signs are allowed for nonresidential developments within the following:
16 1) single-family residential districts; 2) the R-2 and PUD districts; and 3) all
17 developments containing multiple-family residential uses (in excess of 10 dwelling
18 units). The cumulative signa?:e area shall not exceed 32 square feet. The top of the
19 sign( s) shall not exceed the height of 10 feet. 'Nail sigHs are allov.ed for nonresideHtial

25 2 Wall signs are allowed within all developments containing multi-family
26 residential or nonresidential uses.

28 3 Pursuant to Section 5.C.2 below, the maximum wall sign area may be
29 increased by 10% to allow for additional signage on rear facades of multiple-tenant

1 buildings within nonresidential developments.

3 4 For a multiple-tenant building designed as an indoor shopping mall, the
4 maximum allowable wall sign area may be increased, provided the total signage area
5 (per wall of a major department store or center store containing an exterior customer
6 entrance) does not exceed 10% of the area for each faryade.

9 Section 3. Each and every other provision of the Land Development Regulations
10 not herein specifically amended, shall remain in full force and effect as originally adopted.
11 Section 4. All laws and ordinances applying to the City of Boynton Beach in
12 conflict with any provisions of this ordinance are hereby repealed.
13 Section 5. Should any section or provision of this Ordinance or any portion thereof
14 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the
15 remainder of this Ordinance.
16 Section 6. Authority is hereby given to codify this Ordinance.
17 Section 7. This Ordinance shall become effective immediately.
