Minutes 07-21-81MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL HELD AT CITY HALL~ BOYNTON BEACH, FLORIDA, TUESDAY, JULY 21, 1981 PRESENT Edward F. Harmening, ~May0r Walter "Marty" Trauger, Vice Mayor Joe deLong, Councilman Patricia Woolley, Councilmember Samuel Lamar Wright, Councilman Peter L, Cheney, City Manager Tereesa Padgett, City Clerk James Vance, City Attorney Mayor Harmening welcomed everyone and called the meeting to order at 7:30 P. M. He announced the invocation would be by Vice Mayor Walter "Marty" Trauger, which would be followed immediately by the Pledge of Allegiance to the Flag, led by Councilman Samuel Lamar Wright. AGENDA APPROVAL Vice Mayor Trauger requested the addition under "Old Business" Df a report from the City Manager on the current status of the negotiations with the Union as #1 and the status of the Ordinance on water conservation as ~2. Under ~'New Business", Vice Mayor Trauger asked that "City Street Resurfacing" be added as the last item. Councilman Wright said he noted there were a few situations concern- ing the Police Department raised by a few citizens at the last meeting, which he wished Mr. Cheney to discuss under "Old Business" Mayor Harmening said Police Pensions should also be added to "Old Business". Mr. deLong moved the adoption of the Agenda as corrected, seconded by Vice Mayor Trauger. Motion carried 5-0. Councilman Wright said the Agenda should be corrected under "New Business" to read as follows: "a o Appointment of City Representative and Alternate to County Community Action Council Board - Requested by Councilman Samuel Lamar Wright." MINUTES Regular City Council Meeting of July 7, 1981 Vice Mayor Trauger moved for the adoption of the minutes as presented. No discussion. Motion carried 5-0. PUBLIC AUDIENCE Mayor Harmening introduced Charles Walker of the Palm Beach County Traffic Engineering Department. Mayor Harmening said Mr. Walker would discuss the pedestrian crossing and pedestrian controls on Sou-th Federal Highway, between S, W. 15th and S. W. 18thAvenue. City Manager Cheney said there had been a lot of discussions regarding South Federal Highway and he had asked Mr. Walker and his group to do some studies and discuss the traffic situation with the Council. Mr. Walker said his group made counts of the pedestrians crossing in the area of the shopping centers south of Woolbright during the heavy periods of from 12:00 Noon to 1:O0 p. M,, and it varied from forty to sixty people per hour who crossed at mid-block, where it had been discussed there should be a pedestrian signal. Mr. Walker said that City Manager Cheney stated that previously the State had authorized a pedestrian crossing signal in that location. He said the State has jurisdiction over U. S. 1 and, as Mr. Cheney said, the County would work with the City for an inStallation of that light if it was~theCi%y~s~ desire to go forward with the installation. He said the City could petition the County Commissioners to share in the cost of the light, and it would be their decision whether or not to grant the request. - 2 - MINUTES - REGULAR CITY COUNC!L'MEETIN~ BOYNTON BEACH, FLORIDA JULY 21, 1981 Mr. Walker said 18th Avenue is a very minor street. He said he was sure that the State Department of Transportation would not issue a permit for the installation of a signal at 18th Avenue at this time. Mr. Walker said it was his opinion, at this point and time, one is not required, necessary, or even desirable. Mayor Harmening asked Mr. Walker to recall %hat.the discussions were predicated on the establishment of another restaurant and anticipated problems. Mr. Walker Said. they did look at projected traffic and did not feel a light was necessary. Vice Mayor Trauger said he stood on the corner of Federal Highway and U, S. 1 and observed the lights. Mr. Trauger said he believed when the traffic can go on the right turn, people do not have enough time to cross, He said there is no right turn on U. S. 1 in Delray Beach. Vice Mayor Trauger said he thought as long as the pedestrian light was on, he did not think right turns should be allowed. Mr. Walker said you can make the signals do anything you design them to do. He said there had been no accidents there, according to his records, but the problem could not be solved by causing the intersection to become more congested. Vice Mayor Trauger asked Mr, Walker abo~t' ~h~ re~yc~ of tke__ lights at ~oolbright Avenue. Mr. Walker advised Mr. Trauger that Woolbright Avenue and the shopping center are so close together, you would not want a green on U, S. 1 running into a red light at the pedestrian center. The red lights on U. S. t should come up together, so if you push the button, you may have to wait awhile until the light at Woolbright and U. S. t cycles to the red and gives the crosswalk indication. Councilman deLong asked whether there were funds available for a pedestrian light, City Manager Cheney said, "If you want to trans- fer it out of another account, yes." Mr. deL~ng moved to leave this matter on the table and proceed to the Public Hearing scheduled for 8:00 P, ~. W. 7th Street Construction of residential dwelling (R-2) duplex Robert Allan Constant, Agent for Antonio Valardo - 3 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 21, 1981 Carmen S. Annunziato, City Planner, showed the plat of Lake Boynton Estates. He calledattentionto~LOt 10, Block'2and s~idthe right-of-way for 1-95 took portions of Lots 1 through 9. Lots 1 through 8 and 18 through 11 were rezoned from C-2 to R-2 because access to these sites was limited to that of a residential zone. The request before the Council now is to take the Easterly 10 feet of Lot 10 and change the future land use desi-gnationand zoning to create a Lot of sufficient size to create a future duplex. Mayor 'Harmening asked if anyone in the audience wanted to speak in favor of this proposed rezoning and received no response. He asked if anyone in the audience wanted to speak in opposition to this proposed rezoning and received no response. Mayor Harmening noted the application was unanimously approved by the Planning and Zoning Board. Mr. deLong moved to accept the recommendation of the Planning and Zoning Board and approve the request for rezoning. The motion was seconded by Councilman Wright. No discussion. Motion carried 5-0. Vice Mayor Trauger moved to revert to the previous discussion on the Review of Pedestrian Crossing and Traffic Controls. The motion was seconded by Councilman deLong. The motion carried 5-0. PUBLIC AUDIENCE Review of Pedestrian Crossing and Traffic Controls - South Federal Highway, S. W. 15th Avenue ~Woolbright)~ and S. W, 18th Avenue Vice Mayor Trauger moved to appoint City Manager Cheney to find. the appropriate funds sufficient.to put~ in the traffie~light in the crossing on U. S. 1 between the Sunshine~and[~CauSeway-'Shopping Centers, and request Charles Walker, Palm Beach County Traffic Engineer, to determine if the traffic light at S. W. 15th Avenue and U. S, 1 can be rescheduled timewise so there is no right turn while the pedestrian crossing lights are activated. The determination would be for a six month trial while the City measures the impact, which would go into the tourist season. Councilman deLong seconded the motion, Mr. Walker stated there could be some problem~ accomplishing this due to the physical characteristics of. the street. Mr. Walker said he would like to put it in a report and come back. Councilmember Woolley asked'whether the pedestrian crosswalks could be more of a prOblem or a nuisance. Mr. Walker said it could set up a rear end collision situation and more vehicular accidents anytime you put up a signal in mid-block. Mr. Walker suggested they go ahead and put up the pedestrian signal and see if it resolves some of the problems the City is experiencing. MINUTES - REGULAR CITY COUNCIL MEETING B©YNTON BEACH~ FLORIDA JULY 21, 1981 .There being no further discussion, the motion carried 4-1, with Mayor Harmening dissenting. Valerie Brooks, who lives in the 400 block of N. W. First Avenue, ~appeared before the Board. She said she lives in a residential area. Mrs, Brooks and her neighbor said about 25 truck loads of sand had been dumped at the corner of N, W. First Avenue and Fourth Street on the street, right to the roadway, which ±s public property and not the property of the owner. There are a lot of cement blocks there and a cement mixer in the yard, Mrs. Brooks was told by the "lady in Codes Enforcement" that until they do something, nothing can be done about it. In the meantime, sand is blowing through the neighborhood. Councilman deLong moved to have the matter referred to City Manager Cheney. Water Meters - Utilities Councilmember Woolley moved to accept the Tabulation Committee's Report to accept the low bids in Items A through F inclusive. The motion was seconded by Councilman Wright. Councilman Wright noted that at the last Council Meeting, Mrs, Dee Zibell± raised some questions about needed improvements in the area. Mr. Wrightl asked if the Rolling Green Park Fencing would meet one of those concerns. The answer was it would~ Councilman deLong asked why there was no report from the Tabulation Committee concerning Chemical Feed Systems Modifications. City Manager Cheney said normally the recommendations come through Russell & Axon, Engineers, and then to him, because the review process is complicated and technical, Vice Mayor Trauger asked City Manager Cheney to give a report on how many trucks and cars were purchased this 'year and how many the City owns. He said he would like to know the status of the vehicles as the new budget is coming up. The motion to accept the low bids-on the above items'carried 5-0, - 5 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 21, .1981 DEVELOPMENT PLANS Plats Final Plat Approval - Tract "N" (~Hunters Run} of the Summit, Plat No. 1 (~est side of South Congress Avenue}. Mayor Harmening said there was a letter from'Tom Clark, City Engineer, recommending approval of the final plan. Councilman delong moved to approve the final plat and 'make the letter from Tom Clark, City Engineer, dated July 14, 1981, a matter of public record. The motion was seconded by Vice Mayor Trauger, No discussion. Motion carried 5-0. Preliminary Plat Approval - Dos Lagos (East side of Congress Avenue between Lake Worth Drainage 'Canals 20 & 2t) Carmen Annunziato, City Planner, said the Planning and Zoning Board unanimously recommended approval of the plat. Councilman deLong moved to accept the recommendation of the Planning and Zoning Board and approve the preliminary plat' of Dos Lagos, subject to-staff recommendations. The motion was seconded by Council- member Woolley. Motion carried 5-0. Preliminary Plat Approval - Boynton Beach Industrial Park North (West of 1-95, North of Industrial Avenue and South of the Boynton Canal) Councilman deLong asked whether the question of the sidewalks had been resolved. Mr. Annunziato advised there are two questions to be resolved. He said the applicant was relUctant to conform with the recommenda- tion of the City Planner with relation to the buffer wall to be constructed to separate the residential property to the west and the induskrial property to ~e east, the nature and the place where the wall would sit. Also, the applicant wants to get a feeling of the Council of whether there is a need for sidewalks on both sides of the street. There will be no access to the sidewalk on the west side of the street. The plat was recommended for approval by the Planning and Zoning Board but to include the comments of the staff. Any counter-recommendations were to be submitted last week and Mr. Annunziato received nothing from the applicant regarding the wall. Councilman deLong asked if the Ordinance called for sidewalks on both sides. Mr. Annunziato said the procedure requires the appli- cant submit an application for variance to the City Engineer. After a public hearing, the Council can then make a determination. - 6 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 21, 1981 Mr. Marvin Klepps, 1119 N. W. 8th Court, Boynton Beach, President of Laurel Hills Homeowners Association, appeared before the Council and said the Association was concerned about the traffic problem that will be generated from Industrial Avenue onto N. W. Second Avenue. They were before the Council about a year ago on another matter concerning the traffic from 7th Street onto N. W. Second Avenue. As a result of their appearance last year, their group submitted a plan to the City Manager for a controlled traffic light on N. W. 8th Street. The plan would be to make entrance from Industrial Avenue and N. W. 7th Street onto N. W. Second Avenue less hazardous. Mr. Kleppsalso asked whether the City had a noise ordinance and whether it was enforceable. Laurel Hills Homeowners Association understands the industrial park will have a dressmaking plant on the northend of the building, which they feel is a noisy type of manufacturing, City Manager Cheney said the City has a noise ordinance that affects the hours from 10:00 or 11:00 P. M. until 8:00 A. M, if there is a nuisance. If Laurel Hills does not hear the noise, there will be no problem. Mr. Cheney said the ordinance has been used quite successfully. On the traffic situation, City Manager'Cheney advised it is very serious and the City ~has begun to have conversations with the County. The City has asked Palm Beach County Traffic Engineer Charles Walker and his staff to lOok at the long term situation on N, W. Second Avenue and how it relates to 1-95, the Boynton Mall, and perhaps Motorola. Tom Sheehan~ Attorney for the developer of Boynton Industrial Park Associates, came forward. He stated there was a provision in the master wall for a buffer wall, and the developer was not contesting that, He pointed out there will be landscaping, a street, a 50 foot setback for drainage easement, a buffer space and a buffer wall. He said the wall will be' a louvered cement wall and passed pictures around to the Council so they could see how it would look. Mr. Sheehan stated that Mr. Annunziato had raised an objection to the wall, and they had revised their plans to bring the wall out- side of the right-of-way, moving the right-of-way two feet over to provide space for the wall, Mr. Sheehan said they would be coming back to the CounCil for~a variance on the s±dew~lk. Mr. Annunziato said the questions relating to the wall were what is it and what does it look like. Also, how do you build the wall and how do you maintain it. The Zoning Code defines a buffer wall as a six foot decorative masonry wall. Mr. Annunziato said approxi- mately two dozen property owners will be affected by the wall. - 7 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 21, 19 81 Mr. Annunziato asked how the wall would be constrUcted on the two feet proposed, how it would be maintained, and how they would seek permission from the property owners to obtain access to the west side of the wall. Mr. Annunziato said his recommendation was that the wall be put in a five foot strip of priuate ownership, Mr. Annunziato further said he also thought there might be some liability issues as a result of the location of the wall on a public right-of-way. He said he thought the wall should be put on private property. Attorney Sheehan said the maintenance responsibility would be up to the Property Owners Association and the wall could be maintained with access to only~one side. They would not have to go on the residential area to maintain it. Mayor Harmening disagreed with Mr. Sheehan that the wall could be maintained from one side. City Attorney Vance said it appeared the applicant desired to obtain a variance for the sidewalk on the west side of the street. He determined it would take a month or five weeks. He said ~he felt the question was of maintenance and the ability of the property owner. Mr. Vance asked the Council if the applicant should go ahead and file for the variance and get back with the City Planner and work with him. Mr. Vance said the applicant should then come back to the Regular City Council Meeting and sit at a public hearing, in four weeks, while the variance was in process. John W. Ewseychik, Jr., Engineer for Satter Companies, Inc., said the original plans reflected a 1~5 foot strip and the plans had been approved. Mr. Ewseychik said when he made past approvals and put his name on them, he lived by that. The documents had already been approved by the City. City Manager Cheney told Mr, Ewseychik he (Mr. Ewseychik) knew he had to go through preliminary plat approval and that was not a final approval he received. Mr. Ewseychik said one reason they gave so much detail was not to run into a problem later on. The plans had been approved, so now it is a shock 'to hear, "we changed our minds? Mr. Annunziato said a plan is always subject to review. Mr. Sheehan said they had a wall that can'be maintained from one side; the plans had been changed, as requested by,the'City Planner; the street was moved over, and the plans changed to accommodate the requests. Thewall will not be on a right-of-way. They are ready to bond the sidewalk. He asked for a preliminary approval of the wall with a two foot strip. Councilman deLong said the staff had made recommendations, and he felt the Council should comply with the staff comments, Councilman Wright said he thought they should get back with the City Planner. - 8 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 21, 1981 Mr. Ewseychik said they complied with the requests initially but these requests are new and above and beyond what was originally contemplated under the original master plan approval. That type of detail was reflected originally and approved originally. Mr. Vance told the Council Mr. Annunziato said if the Council felt this type of wall could be accepted, it was possible it may b~ab~i~to'~b~ maintained in the future. Mr~ Annunziato said it can stop at the final plat if the applicant cannot prove it can be maintained. Councilman Wright asked Mr. EwseYchik a~d,Mr. Sheehan if they would be willing to come back to the~next meeting, which would be August 4. Councilman deLong moved to table the issue until the next meeting. Councilman Wright seconded the motion, and the motion carried 5-0. Preliminary Plat Approval - Fi'sherman's Landing (Eastern terminus of both Las Palmas Blvd. and Lakeside Harbour DriVe) Mr. Annunziato said the Council had seen this several times in the past as a rezoning application, The application was for approval of a preliminary plat fOr ten single family lots, The Planning and Zoning Board unanimously recommended that it be approved subject to technical comments. Mr. Annunziato commented that the Planning and Zoning Board had requested an interpretation as to the land value per acre and the property was sold on the same date as the Planning and Zoning Board meeting, The land value was approximately $140,000.00 per acre. Councilman deLong moved, seconded'by Vice Mayor Trauger, to approve the preliminary plat. Motion carried 5-0. Site Plans Site Development Plans - Summit Associates, Ltd., submitted by Charles Gilbert, Agent (Construction of a new model home and sales center in the southerly pOrtion of Tract "J", Summit, Plat #1) Mr. Annunziato showed the plans for a new sales center in the southerly portion of Tract "J". The Planning and Zoning Board unanimously recommended that the plan be approved. Councilman deLong moved, seconded by Councilmember Woolley, to approve the site development plans. No discussion. OLD BUSINESS Discussion Of Beach Renovat£on'PrOject' City Manager Cheney suggested the City begin negotiations with the architect to develop a contract'. Mayor Harmen±ng asked what the time span would be, and Mr. Cheney said[he did not know but it seemed to him the City could save some time by going ahead, Mr, Cheney said they were talking about app~oximate!y $100,000.00. Councilman deLong said the City has the revenue issue, the golf course, and now the beach. City Manager Ch~ney said the City can beassured that the dune line at the beach ~ili continue to dis- appear and if the City would negotiate a co~t~act with the ~ architect, plans and construction drawings ~f what 'has to be done could be prepared. If the City goes with the bond issue next March, at the regular election, and it is approved, and there is no design work, then probably no design work would be .started until a year hence, Councilman deLong'asked if it would take that long for the architect to draft plans, City Manager Cheney said if the City does not negotiate with the architect until after the bond issue, when the contracts have been negotiated and approved and then the designs begin, it would be the following winter season before the City could be in a construc- tion period. He said he would think the City would want to begin major construction in May or June, not during the season. Vice Mayor Trauger asked what source could the City use for the architect's fee, and City Manager Cheney said the recreation fund, and Vice Mayor Trauger said that was commit%ed to ~the 30~acre park. City Manager Cheney said the City continues to get money into that fund and will continue to get money into that fund regularly. Mr. Cheney stated if they do not begin the negotiations, they will just keep postponing them, and there is approximately $150,000.00 in the fund now. Mr. Cheney said there is a desire to move ahead with the beach and, obviously, it is going to cost money. Mr. Cheney asked the CounCil if the City was ready to spend some money or not. Councilman deLong expressed concern that there were too many things on the board a't once. Mayor Harmening suggested since the City would soon be going into the budget, there would still be time to pursue this issue, and the City is not really pressed to get something going immediately. Councilman Wright moved to strike the issue from the Agenda. motion Was seconded by Councilman deLong and carried 5-0, The It was decided that Mr. Cheney could bring the matter up again during the budget process, Report on Residential Development - Lake Boynton Estates - S. W. 7t'h Street City Manager Cheney informed the Council he had nothing else to add to the report they had before them. Mr, 'Cheney said he had talked to A1 Pollock and the attorney for A1 Pollock. Mayor Harmening requested Mr. Cheney to notify the residents of Lake Boynton Estates that the City is concerned with their welfare and advise them of the matters in the report. CoUncilman deLong asked whether the issuance of permits had been stopped. Mr. Cheney advised no permits were being issued for the moment. - 13 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 21, 1981 Discussion of City Council/Citizens Revitalization Council of Boynton Beach, Inc. workshop City Manager Cheney advised the Council they took in formal expression of opinion that they would be willing to move ahead to pass the appropriate Resolutions to bring about a Community Develop- ment Agency. Mr. Cheney said sample Resolutions had been received from Tallahassee but they had not been reviewed by the City Attorney and him. Mr. Cheney and the City Attorney did not have time to meet with Carmen Annuziato, the City Planner, or to have the Resolutions rewritten. Mr. Cheney explained the matter was put on the Agenda so that the Council could confirm the direction taken at the workshop. Vice Mayor Trauger moved to inform't.he Chamber of Commerce that the City Council accepted the downtown revitalization recommendation contained in the concept and the City 'Attorney will draw up the inecessary agreement papers. Councilman deLong seconded the motion. Motion carried 5-0. Current Status~of Union Negotiations - requested by Vice Mayor Trauger City Manager Cheney gave a memorandum, dated July 21, to members of the Council. He stated there was a meeting on WSd~esda~ July 15, and he made an offer at the end of the day. On Friday night, July 17, 1981, the.Union voted unanimously to reject what was talked about at the W~esday meet~ing~.~ Mr. Cheney said he anticipated hearing from them again soon. City Attorney Vance will make a report. Water Conservation - requested by Vice Mayor Trauger Mr. Perry A. Cessna, Director of Utilities, said the City is coming close to tapping into wells used only for emergency purposes. He stated drawing water from those wells increases the danger of their being destroyed by salt water intrusion. Mr. Cessna further stated South Florida is in a very, very critical situation. Vice Mayor Trauger moved, seconded by Councilman deLong, to request City Attorney Vance to prepare an Emergency Ordinance. The motion carried 4~1, with Councilman Wright dissenting. There was a brief recess while City Attorney Vance prepared the Ordinance. Mr. Vance read Proposed Emergency Ordinance No. 81-24 'i~n~its entirety~ "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTIONS 3A 1, a and b OF ORDINANCE NO. 81-15, CHANGING THE HOURS IN WHICH SPRINKLING/ WATERING OR IRRIGATION OF SHRUBBERY, TREES, AND LAWNS IS PERMITTED, AND MODIFYING THE LOCATION OF SUCH SPRINKLING AND THE DAYS ON WHICH SUCH SPRINKLING ~AY BE DONE, TO PROVIDE AN EFFECTIVE DAY FOR THOSE PURPOSES." Section 3 A, 1 of Ordinance No, 81-15 is amended as follows: 1. The sprinkling, watering or irrigating of shrubbery, trees, lawns, grass, ground covers, plants, vines and gardens shall be limited to the hours of 12:00 Midnight to 9:00 A. M. with no more than thirty (30) minutes of watering for any one area during this period. Further, such uses of water shall be authorized: a) For property North of Woolbright Road, only on Wednesdays and Saturdays. b) For property South of Woolbright Road, only on Thursdays and Sundays. Section 2. The remaining provisions of Ordinance No, 81-15 are ratified and reaffirmed. Section 3. This Ordinance, being an emergency measure, shall take effect immediately upon passage." Report on Police Matters - Requested by Councilman Wright Councilman Wright said he wanted a report on the matters presented to the Council at the last meeting by Mr. and Mrs. Bob Shores, 151 Miner Road. City Manager Cheney said they met with Captain Hillery of the Police Department, and it was explained to them that their call came in when shifts were changing, As it was not an emergency case, there was a delay in response to their call. Mr. Cheney said he believed they understood. - 15 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 21, 1981 City Manager Cheney informed the Council that Mr. and Mrs. Shores also raised questions about the street lights, and he contacted Florida Power and Light Company to give a recommendation on all of Miner Road, so the City can go ahead and get two lights for Miner Road. Police Pensions Mayor Harmening told the Coun~cil that the Police Department, at their last meeting, seemed to be in favor of a provision in their pension for retirement eligibility after twenty years of service. The deduction for the pension went to 8%, Mayor Harmening said the Police Department feels this woUld be an excellent tool for recruiting. Vice Mayor Trauger asked if they would be retiring at the full pension after twenty years, the same as if they went thirty or forty years. Mayor Harmening said the~deductions from their pay would be increased to 8%. Councilman deLong stated the Cost to the City would be about $3,000.00. .M~,. ~heney~ advised he planned'to put the dollars for the plan into the City Budget and adopt the appropriate ordinances to make it a part of next year's budget. He said it would be more than $3,000.00. Deputy Chief William H~ilto~' said 2~1/2% of an average salary is credited for each year of service. Therefore, if a man went for 20 years, he would get 5~%, if he went 30 years, he would get 75%. Presently, a man has to be sixty years of age to draw a pension. With this plan, after twenty years of service, a man would be eligible for retirement, Deputy Ch±ef Hamilton said the cost would be just over $3,000.00 per year, according to the actuary. Councilman deLong expressed that it~woutd be~advantageous to the City because they would be able to get men to stay with the City, Now the changeover is costing the City money. Councilman deLong moved, seconded by Vice Mayor Trauger, that the City Manager be instructed to make the necessary provisions in the Upcoming City budget for the police pensions. The motion was unanimously passed 5-0. The motion carried 5-0. - 16 - MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA JULY 21, 1981 Appointment of City Representative to County Community Action Council Board - Requested by Councilman Samuel Lamar Wriqht Councilman deLong moved that nominations be opened, seconded by Councilman Wright. The motion carried 5-0. Councilman Wright said he delivered a letter from the Community Action Council on July 20. Boynton Beach has not been represented for one or two years. Mr. Wright said the program evolved from the Kennedy and Johnson administrations and involves services for poor people. Councilman Wright recommended Cornell C. Johnson, Casualty Claim Manager, Allstate, a resident of Boynton Beach, as the member, and Mrs. Gloria Skinner, Realtor, Boynton Beach, as an alternate, to the Board of Directors, Councilman deLong said the resumes were impressive, and moved the nominations be closed and Mr. Johnson and Mrs. Skinner be appointed. Councilmember Wo011ey seconded the motion. Motion carried 5-0. Street Resurfacing Requested by Vice Mayor Walter "Marty" Trauger Vice Mayor Trauger referred back to the City Council's memo of April 20, 1981, which gave a street resurfacing priority, which was prepared by the City Engineer and City Manager Cheney, The Council appropriated $50,000'.00 to this year's budget for street resurfacing and elected that they take top priorities in resurfacing the streets. Mr. Trauger said he would like to have another list with top priorities established for this year's bUdget consideration in two amounts, one $100,000.00, and one $150,000.00, and if not enOugh, establish an amount. He said if something is not done, Boynton Beach will be "pot hole city". Vice Mayor Trauger moved that the.City Council instruct City Manager Cheney and the City Engineer to prepare a street resurfacing program for the next fiscal year, based on their memorandum-'of April 20, 1981, which gave a priority of streets to be resurfaced, for the next budget meeting. Vice Mayor Trauger said the City Manaqer and City Enqineer shoUld delete the streets that had been resurfaced or planned to resurface this year with the $35,000,00 that is in the budqet, then add the streets which have the qreatest Drioritv for resurfacing, in their view, with amounts terminatinq at $100,000,00, $150,.000~,00, and $200,000.00. The motion was seconded by Councilman deLonq. Motion carried 5-0. ADMINISTRATIVE Review of Phase II of Municipal Golf Course City Manager Cheney said the golf'course~.plans were sitting on the table for review. The construction plans are almost complete and some additional plans for the greens. The City should have some- thing from them within two weeks also, Discuss Elimination of Use of Whistle at Train Crossings - Requested by CoUncilman Joe deLong Councilman deLong said the' whistle bothered some people who live near the railroad. Councilman Wright said some people should decide whether they wanted life or not. Mayor Harmening said they knew the railroad was there when they bought. Councilman Wright said people will be killed if they do not hear the whistle. City Attorney Vance said with the ex±sting legislation, Florida Statute 359, it is mandatory and requires that the trains blow their whistles. He said the City would be laying itself to considerable exposure and liability, It would be a very dangerous procedure not to have the whistles. Vice Mayor Trauger said people call him and say there are too many train whistles, but Flagter.put the railroad down long before any of the people got here.
