Minutes 04-21-81MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, APRIL 21, 1981 PRESENT Edward F. Harmening, Mayor Walter "Marty" Trauger, Vice-Mayor Joe deLong, Councilman Patri cia_Woolley, Councilmember Samuel Lamar Wright, Councilman Peter L. Cheney, City Manager Tereesa Padgett, City Clerk James Vance, City Attorney Mayor Harmening called the meeting to order at 7:30 P.M. and welcomed a full house of visitors. Reverend Paul Dufford, St. John's United Methodist Church gave the invocation followed by the pledge of allegiance to the flag led by Mr. Cheney. AGENDA APPROVAL Vice-Mayor Trauger asked to add an announcement under E. 3 a in regard to the Water Supply. Mr. Cheney requested approval to delete Item IV-C - Long Term Disability Insurance and Group Life Insurance Bids.'and add one under X-H to dispose of all bid material prior to 1976. Mr. deLong asked to add under IX-C - Consider request of Community Relations Board. Mr. de Long moved to adopt the agenda with stated additions and deletions. Motion seconded by Vice-Mayor Trauger and carried 5-0. ANNOUNCEMENTS Mayor Harmening read the following proclamations: 1. Know Your City Government Day - May 14, 1981 2. American Business Womens' Scholarship Month - May, 1981 3. Habilitation Day for the Handicapped - May 17, 1981 Vice-Mayor Trauger stated he had received several calls in regard to the water supply in Boynton Beach because of all the publicity about Shortage of water in surrounding areas. He asked the City Manager for a report and praised prior Councils for their foresight in providing our City with an adequate water supply. Mr. Cheney stated we have a treatment capacity of 16 million gallons per day. The highest treatment any one day was in April, 1979 when we treated 12 .2 million gallons. The average for March, 1981 was 8 million gallons per day. He felt we were in good shape at this time. He anticipates plans to increase our plant in about 3 years. Mayor Harmening welcomed all the past Mayors in attendance and asked them all to come forward. Twelve of the nineteen past mayors were present. The meeting was recessed for approximately 30 minutes to allow the past mayors to visit with those in attendance and everyone to enjoy coffee and cookies. Mayor Harmening called the meeting back to order and Vice-Mayor Trauger introduced Jean Pipes, wife of former Mayor J.Willard Pipes. MINUTES Reqular city council Meeting of APril 7~ 1981 Councilman deLong moved for the adoption of the minutes as presented. Motion seconded by Vice-Mayor Trauger and carried 5-0. Special City Council Meeting of April 13, 1981 Councilman Wright moved for the adoption of the minutes as pre- sented. Motion seconded by Councilman deLong and carried 5-0. PUBLIC AUDIENCE Mayor Harmening announced if there was anyone in the audience who would like to address the Council on any item not on the agenda they may do so at this time. He added that if anyone would like to speak on any item on the agenda to please give their name to the City Clerk and they will be called when that item becomes the regular order of business. Jim Bolden, 437 N.E. 14th Avenue, came before the Council and requested the Citys' assistance in upgrading the median strips in his area. Mr. deLong felt the City had been amiss in not maintaining these strips over the past several years. Mr. Wright stated he lived on N. E. 15th and he too urged that the City improve 'this area and then moved that the City crews be sent to take care of this area and report back at the next meeting. Motion seconded by Mr. deLong and carried 5-0. -2- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA APRIL 21, 1981 Mrs. Victoria C~stello, 406 S. Seacrest Boulevard came forward. and asked for consideration on the beautification of Seacrest Boulevard. It was suggested that she contact the Community Appearance Board and also since Seacrest Boulevard was a County right-of-way, perhaps some assistance might be available from that source. PUBLI'C-HE~RING - 8:00 P.M. Applicant: Request: Terry L. Howison Abandonment of Utility Easement located in the East 6:00 feet of Lot 34 and the West 6:00 feet of Lot 35, Lake Worth Mariner Village (less the North 35:00 feet and the South 25 feet thereof). Terry Howison came forWard. The City Planner advised the Council that approximately 1 1/2 months ago there was an application for site plan approval to construct five (5) town homes on Rider Road extended at the northern terminus of N.Eo 7th Street. One of the provisos attached to that plan was the applicant to go forward with the request to have abandoned an existing utility easement that was encumbered by a water line that crosses the canal to serve Lake Worth Mariner Village. This application has been reviewed by the staff and the public utilities. Our recommendation to the Planning and Zoning Board was that the easement be abandoned subject to applicant dedicating a new easement and relocating the water line at his expense under the auspices of the Utility Department. NO ~other utilities were affected. The public hearing was held by the Planning & Zoning Board and they forward the same recommendation to you by unanimous vote. The Mayor called for anyone in the audience who wished to speak in favor of this abandonment. No one came forward. He then called for anyone who wished to speak in Oppo= sition and no one spoke. Councilman deLong moved to adopt the recommendation of the Planning & Zoning Board and approve this abandonment and the memos dated March 10, 1981 from the City Plannerl "The Planning Department offers no objection to the requested abandonment subject to the relocation of the existing'water line ahd the dedication of a new utility easement" and the City?~Enqimeer~ "I recommend that the easement abandonment be approved subject to the relocation of the City water line in the new easement. Letters from Utility Companies are being forwarded to the City Planner for the Planning and Zoning Board. "The new easement description looks O.K." and the Utilities Director dated March 20, 1981 _~'This easement can be abandoned with the proviso that they furnish the new.proposed easement and re-locate the water line under our supervision, ~at their expense~. be made part of the record. Also that the City Attorney draw up the proper resolution for the next meeting. Mr. deLong moved to revert to regular order of business. seconded by Mr. Wright and carried 5-0. Motion BIDS Seven (7) Drop Lift Files for Utilies Department. Mr. Cheney stated that the tabulation committee recommends accep- tance of bid from Florida Level and Transit Company, Inc. at a cost of $1~190.00, 30 days delivery. Mr. deLong moved to accept the recommendation of the tabulating committee. Motion seconded by Mrs. Woolley and carried 5-0. One (1) 25 Cubic Yard Rear Load Packer Alt'ernate Bid - One (1) 20 Cubic Yard Rear Load Packer Mr. Cheney stated the key matters concerned in the proposed purchase are: 1. Conversion to diesel trucks from gasoline 2. Conversion to high capacity packers, which will result in fewer trips 3. Conversion to automatic five-speed transmission instead of manual transmission 4. Convert to trucks with a tandem axle so that we will not violate highway maximum weight restrictions He further stated this should reduce the number of trips to the landfill and make the combination of garbage and trash pick up more effective. He recommends the purchase of three (3) Ford rear loaders, 25 CUbic yard Packers from H.F. Mason at $55,698.00 each. Mr. de Long moved to accept the recommendation based on the City Manager's memo dated April 20, 1981 and the memorandum of the Director of Public Works dated April 17, 1981 and award the bid to H.F. Mason. Motion seconded by Vice-Mayor Trauger and carried 5-0. -4- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA APRIL 21, 1981 SITE DEVELOPMENT pLANs Applicant: Location: Use: Burger King Corporation, submitted by Ramon Cue, Agent Southwest corner of S.E. 18th Avenue and U.S.1 Construct a 93 seat Burger King Restaurant with Drive-thru facilities Mr. Annunziato advised that this item was tabled by the Community Appearance Board Monday evening because the applicant did not receive the agenda in time to attend the meeting. He also stated that at the present time the site in question is encumbered by the parking lot of the Centumy Bank. Access to the site is proposed to be from U.S. #1 with an ingress and egress separated by a minor median and three (3) entrances and exits are pro- vided on S. E. 18th Avenue.t two of which would also serve the Bank. The main thrust of the conversation at the Planning & Zoning' Board meeting seemed to concern access to the site, turning movements at the median and the report prepared by the applicant concerning traffic. The Planning & Zoning Board recommended to the Council that the application be denied owing to the fact that the traffic which would result ~from the proposal will .~ to an already dangerous intersection and that the curb cut on U.S. #1 will cause an additional hazard to traffic. Carmen Annunziato showed an overlay of the area and reviewed the many traffic problems and turning movements that seem to exist while considering the joint application of. Century Bank and Burger King. Century Bank proposes a curb cut just 20 feet ~ ~outh of the exit lane of Burger King on U.S. #1. He read the memo from Bert Keehr dated December 29, 1980 into the records Be ad~±sed of %he following list of items concerning this site-plan, and which do not meet, or are question- able pertinent to zoning requirements. Prior to approval of this plan, a submittal for the relocation of the parking area for the bank must be made and approved. This would require twenty-two (22) parking spaces, and a Department of Transportation turn-out permit would be required. completion of this parking lot would have to be completed prior to the commencement of "Burger King". This plan requires Board of Health approval, as well as Hotel and Restaurant approval. Parking is adequate for a ninety-three (93) seat capacity, indicated on plan. Plan shows thirty- seven (37) approved parking spaces 4. Restrooms do not meet the handicapped code. 5. Plan does not indicate handicapped sign placements -5- MINUTES = REGULAR CITY COUNCIL BOYNTON BEACH, ~FLORIDA APRIL 21, 1981 Also the memo from the City Engineer Tom Clark under date of April 6: Reference is made to the following letters regarding Burger King, revised plans 1. Letter from Charles Walker dated 3/19/81 2. Letter from John Wilson, D.O.T. 3/19/81 3. Letter from Paul White, D.O.T. 3/31/81 I discussed this project with John Wilson, the Traffic Engineer in the D.O.T. Permitting Section and he voiced the opinion that most of the southbound diners would go to Burger King by way of S.E. 18th Avenue rather than by the proposed ingress and egress on U.S. #1. Based on the above information Layout I, Figure 4 of the revised Traffic Study is acceptable although in my opinion not a requisite to serve the property. I recommend that a commitment be made by Burger King and the Bank to 'share on a pro-rata basis the cost for a traffic signal when warranted at U.S. #1 and S. E. 18th Avenue as determined by D.O.T. Paving and drainage plans are satisfactory. The City Planner requested an off street loading space 12' x 35' x 14' to serve the restaurant. The members of Council discussed the subject briefly and Council- man deLong read excerpts from the letter dated March 19 from John Wilson, District Traffic Services'~Engineer, D.O.T. Gene Moore~ attorney representing the applicant spoke and pointed out the fact that Burger King was a reputable firm and would be an asset to the community. They would employ approxima~ely 50 young persons in the area and he submitted a brochure for the record. He ~oted that the location under consideration is prop- erly zoned and the staff has recommended approval of this partic- ular site plan along with the traffic program as prepared by their traffic impact engineer. He agreed that his client was in agree- ment to accept the full responsibility of the cost of the traffic signalization when deemed necessary and approved by D.O.T. He had no knowledge of anyone else having to submit a traffic study in this area. Subject plan has been approved by D.O.T. and Palm Beach County. He felt it would be unfair to deny the applicant the requested use of this location. If the Council feel's Burger King and Century Bank will have to bear the cost of signalization at 'S.E.18th Avenue & U.S. ~1, then they are willing to do so. It is totally unfair for them to bear the whole burden beCause 'they are not the only ones that have created the traffic problems at this intersection. -6- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA APRIL 21, 19 81 Vice-Mayor Trauger asked Mr. Moore if they had any figures about what the approximate tax return would be to the City in a year or what the economic volume returned t° the City would be from a normal year's business. He stated the biggest problem here is the traffic in-put. Fast Foods like to congregate around an area where there,s a winner, which happens to be right now, MacDonalds. What I am concerned about, as these come in, the others in their highly competitive mood, are going to be knock- ing out some of the others and we're going to have the chicken place or somebody else l~ft high and dry much as we suffered when Howard Johnsons went out with a bad deal, but besides that, economically, with Woolbright and where we've been proposing to put a traffic light there at the Shopping Center, then a light here, we're going to have a row of traffic lights, one on top of another. But some place along here, there~has to be one between 23rd and Woolbright with this traffic generation in. What I'd like to see now is a recommendation, particularly from Mr. Walker's office as to where the light should be. Either here at this point for Burger King-MacDonald; the other light either up there where Walgreen's is (to cross there) plus the light we now have at Woolbright. To get this whole problem controlled, I would be willing to go along with this proposition and think it is.good if we can get a committment from the people you represent, that if warranted by the State, that Burger King will pay for a light; because I don't believe the City of ~ Boynton Beach should eventually pick this economic impact up when Burger King is taking off the money. Mr. Vance then asked Mr. Moore if Burger King would agree to pay for new signalization at 18th and Mr. Moore replied that they Would pay when and if warranted, although, as he has stated before, that it is grossly unfair to make the last guy pay because they certainly aren't the one that required it. They would pay when signalization is authorized by D.O.T. and when warranted at 18th Avenue. Discussion followed on signals and traffic controls. Mr. Ryder, Chairman of Planning and Zoning was asked for his comments and recommendations. He stated that he did make recom- mendations as .they-appeared in-b(~ardmin~utes. He suggested the two curbcuts on U. S. #1 should be used for ingress only and exit by way of 18th Avenue. He felt a traffic light would be necessary at this intersection Mr. Daniel Murray, Traffic Engineer Consultant, explained his interpretation of traffic impact access to Burger King and stated he had discussed this with several professional people and ~hat he feels that it provides the best overall safety and would recommend it. He stressed the importance of the radius of the curbcuts. Mr. Trauger recommended site development approval subject to staff recommendations and comments. A motion was then made to approve -7- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA APRIL 21, 1981 this subject if Mr. Moore, as the applicant's representative, was in agreement. Mr. Moore agreed with staff comments and would send letter in regard to signalization. Mr. Trauger made the motion to approve the plan subject to Staff comments, the Community Appearance Board approval, and receipt of letter from applicant agreeing to pay for the sig- nalization at such time as the City can get approval from D.O.T. and subject to' the.approval of parking site plan for the bank. Mrs. Woolley seconded the motion.* Motion carried 5-0. *Mr. de Long stated he was dubious aboutthec~b cuts on Federal Highway.(SeeMin. 5/5/81) Mr. Trauger stated that in connection with this motion that we have just accepted on Burger King, he would like to now have the City Manager and the City Engineer get in contact with Mr. charles Walker in regard to the~e three potential lights and see how one relates to the other and get his recommendation. Site Development Plans Continued Applicant: Location: Use: Lazarus Salamon Intersection of N.E. 5th Avenue and Railroad Ave. Construct Warehouse Mr. Annunziato informed the Council that this is a request to construct a 6,204 sq. ft. warehouse on Railroad Ave. at the intersection of N. E. 5th Ave. He explained the site plan to the Council and stated that 'it went before the Planning and Zoning Board and the Technical Review Board with positive rec- ommendation subject to Staff recommendations: Building Department: Sidewalks required on N.E. 5th Ave. Police Department: Security lighting required Public Works Dept.: Co'ordinate with Public Works Dept. before pouring dumpster slabs Energy Coordinator: Recommend energy efficient sodium- vapor lighting. Community Appearance Board also approved this plan. Mr. Salamon agreed to conform to all staff comments. Mr. deLong moved to accept the recommendation of the Planning & Zoning Board and approve subject site plan to construct rental warehouses subject to staff comments. Motion seconded by Mr. Wright and carried 5-0. Applicant: Location: Use: Antonio Velardo, submitted, by John Pagliarulo, Agent N. E. 15th Place and U.S. #1 (N.E. corner) Construct 18 stores and 18 offices Mr. Annunziato informed the Council that this appllcation and request was to construct 18 stores and 18 offices at N.E. 15th Place and U. S. #1 (N.E. Corner of the intersection). Basically the plan has one remaining problem and that concerns the intersection of 15th Ave. with the median and the location of the entrance to the site. The key to this was the shaping of the median as it -8- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA APRIL 21, 1981 currently exists with an acceleration lane to allow northbound to turn left at N. E. 15th Ave. The dangerous part of this is the-southbound traffic stopping in a thru traffic lane to turn right into this project. He read the City Engineer's ~omments from ~'his~memo d~ed~Aprit 7, 1981 as follows: 1. Drainage calculations are required. A cross-section of the French drain should be added showing membrane over and around rock. The additiona~ ingress and egress onto U.S.#i is not desirable and will require D.O.T. approval. A re- alignment of N.E. 15th Ave. would split the property but simplify the traffic control problem here. Having an exit only at the north end of the property would be a viable alternate. and then a memo from Captain Hillery, also dated April 7, 1981 "I agree with the City Engineer, Tom Clark. I share in his suggesting an exit only at the north end of the property as a viable alternative to the one planned. Even if the exit/entrance were moved slightly south to allow southbound u.s. I traffic to make a left turn into the entrance, there would be a hazard'created as there is no stacking lane available' The Building Department had required an elevator and the Fire Department noting compliance to the Utility Department memo which speaks to it not being necessary to have the 6" water main as indicated on Mr. Martin'~s drawing, but the installation of two fire hydrants would be necessary per memo from the Utility DePartment under date of April 17, 1981. The prime concern of the Planning~& Zoning Board seemed to be the median. Mr. Pagliarulo brought to the BoardS attention that he had met with Mr. White of D.O.T. who had indicated that D~O.T. would. ~ermit reconstrUCtion-~'of~.~he'median ~emoving the accelera{ion aspect fo~"N~r~h'turni~ ~raffic on 15th Avenue and constructing a more tFpical type of median allowing for a stack-~ lng potential~in the median to allow'left turns. This comes to the Council with unanimous recommendation for approval and also approval by the Community Appearance Board. Mr. Pagliarulo stated he was familiar with all the requirements of the staff and D.O.T. and agreed to meet them. His only question was the requirement of an elevator. He had not been able to find this requirement in the City Code. The City Manager assumed it was in the Handicapped Code. Mr. Pagliarulo stated he was willing to put an elevator in if this was a firm code requirement. Mr. deLong moved to table this item until this requirement was clarified. Motion seconded by Mr. Trauger and carried 5-0. -9- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA APRIL' 21, 1981 Plats Final Plat: Location: Use: Lawson Industrial Park S.W. 30th Ave., East of Congress Avenue InduStrial Mr. Clark, City Engineer, informed the Council that this was a final plat that he was recommending for approval subject to Posting a performance bond in the amount of $224,370 for the City maintained improvements. e A surety bond in an amount to be determined by the County Traffic Engineer for the pro rata cost of the traffic signal at the intersection of Congress and S.W. 30th Ave. Developer being required to commit himself to a traffic impact fee. Mr. deLong moved for approval,subject to Mr. Clark's memo dated April 16, 1981 that the performance bond be in appropriate form and approved by the City Attorney,and the applicant to have 60 days in which~to post bond and to accomplish all the other criteria Setforth in memo. Motion seconded by Mr. Trauger and carried 4-0. Mayor Harmening stated that Councilman Wright had stepped down. Preliminary Plat: Location: Use: Congress High Point of Boynton, submitted by Nabil Hansen Congress Ave. and S.W. Congress Blvd. Construct 556 Units, two Recreation Areas and two lakes. Mr. Annunziato stated that this plan h~.d been before the Planning and Zoning Board several times as a pre-application and master plan but this is the first time to come before the Council. This is a multi-family development of four plex units in dondominium form.. The Planner reviewed the proposed preliminary plat in detail including roadway, water lines, etc. as he pointed them out on the drawing. He stated that Congress Blvd. would be extended as a public right-of-way of 80' which would eventually tie into Knuth Road. He further stated that the applicant has agreed to construct Congress from northward of the intersection of Congress Blvd. extended southward to the intersection of Woolbright and has also agreed to a pro-rata share of the cost of the traffic signal with the Congress Professional Office Building Complex to signalize the intersection of Congress Avenue and Congress Boulevard. The City Planner read the memo of April 7, 1981 from Captain Hillery to the City Planner pointing out an existing City sub- division known as High Point. To etiminate~con~usion it was suggested to Dr'~ H~nsen. that the subdivision have a word pre- c$~i~h~ Migh P6int. Mr. Annu~ziato then read the seven points -10- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA APRIL 21, 1981 enclosed in a memo from the City Engineer dated April 7, 1981 Off-site plans for improvements to Congress and Wootbright Road are subject to County approval. 2. The land value will be determined by the Planning and Zoning Board for Parks and Recreation commitments. e To eliminate confusion during emergencies the name of this'project must be changed. A name preceding the High Point designation would be acceptable. o The Recreation Director will accept a payment in lieu of land dedication for Parks and Recreation. The cost estimate for off-site road improvements must be approved by the county. e The cost estimate for on-site public and private streets is not identified and must be included. o A copy of the Water Management District construction permit is requested. The City only has staff recom- mendations at this time. Said memo referred to a copy of a letter-dated April 3, 1981 to Perry Cessna. Mr. Annunziato stated that the Planning & Zoning Board unanimously recommended that the preliminary plat of Congress High Point be approved subject to staff cotangents. The P & Z Board recommended to Council that a professional appraisal by a qualified individual as provided in the Subdivision Regulations be done. The P & Z Board reCom~nended that subject plat be approved' subject to staff comments and subject to the land value being established at $30, 000 'per acre. Vice Mayor Trauger then suggested that an appraiser be asked to establish the value of subject land. ~r. Nabil Hansen then asked to be recognized and proceeded to explain his-qualifications and the fact that the developers had paid $16,000 an acre one year ago. He also pointed out the fact that land directly north of this project is on the market for $30,000 an acre. He went on to say that the developer has been cooperating with the Planning and Zoning Board and the County byfour~laning Congress Avenue~ building a bridge and also building a 6" water main. He said that in regard to the,valua- tion of the land that any figure between $16,000 and $30,000 per ac~e would be acceptable. He also said that they did not want to get an appraisal only to find weeks later that it would not be acceptable. Mayor Harmening then asked if the City Planner was familiar with the developer's appraisal. Mr. Annunziato replied that he was and that the appraisal was by a Real Estate Broker, not a Real Estate Appraiser. He also said that because of the sensitivity of the subject that he and the Board would be more comfortable with a professional opinion that -11- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA APRIL 21, 1981 Would stand up in court. Mr. Vance stated that our code provides for an MAI appraisal and that the City Planner should provide the developer with three names of qualified appraisers. It was then moved by Mr. deLong and seconded by Mrs. Woolley to table this matter until such appraisal is made. Motion carried 5-0. SUSPENSION OF REGULAR ORDER OF BUSINESS Mr. deLong then made a motion to ~suspend the regular order of business mn order to move to New Business "B" Request to Abandon N.E. 3rd CoUrt. This was seconded by Mr. Wright and carried 5-0. Mr. Cheney explained that by petition from the Homeowners of the Four Suns Condominium they have requested the City to take steps to accept N.E. 3rd Court - that portion between South Circle Drive and N.E. 17th Ave. as a City street. Mr. Cheney said there was no question about the balance of N.E. 3rd Court but all City records and the condominium document indicated this area between South Circle Drive and N.E. 17th Ave. to be a private street. The question is does the Council want to accept this portion of N.E. 3rd Court and secondly how do we go about bringing this street into some sort of public posture. The current problem at hand is the maintenance of this area now in its present condition. Mr. Vance stated that he has not had an opportun- ity to review the condominium~ doCuments but will render an opmnion after he reviews all facts invOlved. The City Clerk ~dvised the chair that Mrs. Marjorie Devine had requested to speak on this subject. Mrs. Devine, President of Four Sea Suns Condominium, Inc, Stated that the City had taken care of the pot holes in N[E. 3rd Court in 1980 but had not done so in-1981. It is now mn a dangerous condition and the homeowners requested the Citys assistance in getting this matter resolved. The members in the audience were recognized. Mr. Cheney recommended that the Council accept the easement and authorize him to enter into contract with Orton Construction Company to remove the fill at a cost of $4,400.00 to be paid out of the utility funds. Motion seconded by Mr. Wright and carried 5-0. -BUS I~NE S S Discuss Pedestrian crossinq on U.S. #1, South of Woolbriqht Mr. Cheney advised that he had been in touch with our County Commissioner. and he feels that possibly the County may be able to fund this signal if it is deemed necessary. Vice-Mayor Trauger felt this subject should be pursued for the safety of the citizens. Further discussion was held and all members felt the study should continue in regard to this light and the one at 18th Avenue, discussed earlier in the meeting. Mr. Cheney was instructed to locate the funds for signalization of a pedestrian crossing south of 15th Avenue on U.S. #1 between Sunshine Square and Causeway Shopping Center. Mr de Long moved to table this item until the funds are made available. Motion seconded by Mrs. Woolley and carried 5-0. Mr. Cheney advised Council that the sidewalks they had previously requested on the north side of Woolbright, east of U.S. #1, to accommodate the pedestrians from Gulfstream Apartments could be built for approximately $2,000. Discuss Land Transfer - Westside Baptist Church The City Manager reported that the City Attorney had determined that an.appraisal would be necessary prior to transfer of this piece of property. Motion Mr. Cheney discussed the list of 23 drainage problem areas that he had submitted with his agenda memorandum, and reviewed a map showing the areas that swales had been properly graded for drainage. He pointed out three catagories of drainage problems: 1. Places where homes get water into them. 2. Places where poor drainage cause traffic problems. 3. Other poorly drained areas. The Mayor stated that there was only $50,000 in the budget for drainage and Street resurfacing. The drainage projects submitted totaled $201,689.00. Discussion followed as to a possible bond issue to cover the complete job. After a lengthy discussion of the 23 areas listed, Mr. Trauger moved to allot $15~000 to drainage improvement at Seacrest and North 19th Avenue. Motion seconded by Mr. deLong. Motion carried 5-0. Review Street Resurfacin~q Pro~ects The City Manager submitted a proposed resurfacing list indicating five (5) priority listings with a total of 8.5 miles at an approximate cost of $304,283.00 He further explained to Council they could do approximately one mile with the $35,000 budgeted. The list submitted by the City Engineer as "first priority" entails ~pproximately 9,050 lineal feet which is far more than can be done in this budget. Review Status of Current Solid Waste Planninq Mr. Cheney gave an update report and suggested Boynton Beach follow the major cities efforts to cOntrol this problem of solid wastes. One .site being considered at this time is in West Palm Beach adjacent to Century Village which is envir- omentally approved~ He feels this is the most viable piece of land that is being considered and urged the Council to support this choice. Mr. deLong asked Mr. Cheney if he would continue to represent the City onofficially. Mr. Cheney said he would. Authorize Expenditure of Additional Funds for Water Meters The City Manager recommended the expenditure of up to $60,000 from the Utility Fund for meters and parts. Mr. Wright asked the City Planner whether Community Development had plans to expand the Day Care Centers. Mr. Annunziato replied the staff for the Community Development has prepared its budget that went to the Review Board last Thursday. In that budget some $457,000 was set aside in next year's budget for the reconstruction of 10th Ave. They did not address the issue of funds for Day Care Center Expansion. Mayor Harmening brought out the fact that Riviera has been allotted more than Boynton Beach. Mr. Cheney advised that steps were being taken toward selection of engineers for the work on 10th Avenue.
