Minutes 03-20-81MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, MARCH 20, 1981 PRESENT Edward F. Harmening, Mayor Walter "Marty" Trauger, Vice Mayor Joe de Long, Councilman Patricia Woolley, Councilmember Peter Cheney, City Manager Tereesa Padgett, City clerk Mayor Harmening called the meeting to order at 6:00 P. M. and announced it is a special meeting called in accordance with Section 56 of the City Charter of the City of Boynton Beach to consider: 1. Amending Ordinance No. 81-1. Proposed Ordinance No.81-11 Re: Amending Ordinance No.81-1 Charitable Solicitations. Mayor Harmening read proposed Ordinance No,81-11 by title on first reading: AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO.81-1 CHARITABLE SOL- ICITATIONS, SECTION 20-26 RESTRICTIONS ON BEHAVIOR, BY PROVIDING FOR CITY COUNCIL WAIVER; REPEALING PROVISIONS; PROVIDING A SAVINGS CLAUSE; AUTHORITY TO CODIFY; AN EFFECTIVE DATE; AND FOR OTHER PROVISIONS. Mr. Cheney read a portion of Section 25 - Emergency measures from the City Charter. All ordinances or ~esolutions passed by the City Council shall become effective as otherwise pro- vided therein. Two-thirds (2/3) of the member- ship of the City Council shall be required to enact an emergency ordinance. Any emergency measure shall be defined as an ordinance providing for the immediate preservation of public peace, property, health or safety, or for the daily operation of a municipal department; in any case, the emergency shall be set forth and defined in a preamble thereto. Mr. Cheney referred to having a discussion with Mr. Vance, City Attorney, as to whether or not this proposed ordinance could be considered as an emergency ordinance. After further discussion it was determined that Proposed Ordin= ance No.81-11 could not be classified as an emergency. Mr. de Long moved to ~take no a~ion on-a~y item on the agenda b£ this ~eeting. Motion seconded by Vice MayorlTr~uger and carried 4-0. Ad.journment Vice-Mayor Trauger moved to adjourn, seconded by Mrs. Woolley. Motion carried 4-0 and the meeting was properly adjourned at 6:22 P.M.
