O98-07ORDINANCE NO. 098-07 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 4 OF ORDINANCE 097-37, TO AMEND THE BALLOT LANGUAGE AND THE EXPLANATORY STATEMENT; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, on August 5, 1997, the City Commission adopted Ordinance 097-37, submitting to referendum an amendment to Section 50 of the City Charter entitled ~ Terms of Elecmed Offices,H allowing unlimited two year terms for all elective offices; and WHEREAS, Section 4 of Ordinance 097-37 provides for the form of the ballot question to be presented at the referendum election; and WHEREAS, the City Commission of the City of Boynton Beach, Florida has determined that it is in the best interests of the citizens of the City to amend Section 4 of Ordinance 097-37 to revise the explanatory statement setting forth the substance of the proposed amendment to Section 50 of the City Charter. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section. The foregoing whereas clauses are true and correct and are now ratified and confirmed by the City Commission. Section 2. Tha5 Section 4 of Ordinance 097-37, adopted August 5, 1997, is hereby amended to read as follows: ca~ord\charter - amend 97-37 1/9/98 Page 1 Section 3. The title of the ballot and explanatory statement setting forth the substance of the proposed Charter Amendment shall appear on the ballot and shall read as follows: AN AMENDMENT TO CITY CHARTER SECTION 50, TERMS OF ELECTIVE OFFICES CURRENTLY AN ELECTED OFFICIAL IS LIMITED TO TWO, TWO-YEAR TERMS. THIS AMENDMENT OF THE CITY CHARTER WOULD ELIMINATE THE CURRENT TWO- TERM LIMIT ON HOLDING ELECTED OFFICE. THE NUMBER OF TERMS AN ELECTED OFFICER COULD HOLD WOULD NOT BE LIMITED. THE LENGTH OF EACH TERM WOULD REMAIN THE SAME, TWO (2) YEARS. SHOULD SECTION 50 OF THE CHARTER BE AMENDED AS PROPOSED? YES NO Section 4. Ail Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith shall and the same are hereby repealed to the exuenu of such conflict only upon passage of the referendum. Section 5. If any clause, section or other part of this Ordinance shall be held by any court of competent 3urisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be considered as eliminated and nou effecting the validity of the remaining portions of the Ordinance and its application shall remain in full force and effect.
