Minutes 12-16-80MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, DECEMBER 16, 1980 PRESENT Edward F. Harmening, Mayor Walter "Marty" Trauger, Vice Mayor Joe deLong, Councilman Marilyn Huckle, Councilmember Peter L. Cheney, City Manager Tereesa Padgett, City Clerk James Wolf, Asst. City Attorney Mayor Harmening welcomed everyone and Qalled the meeting to order at 7:30 P. M. He announced the Invocation tonight will be by Rev. Fred Sylvester, Pastor, Church of God of Boyn~on, to be followed immediately by the Pledge of Alle- giance to the Flag led by Councilman Joe deLong. He re- quested everyone to please rise. AGENDA APPROVAL Mr. Trauger stated after reading the Sun Sentinel today, he would like to delete Item 1 under Announcements to prevent any further embarrassment to the City Council. Under Administrative, he would like to add Item K - Re- moval of Political Signs and L - Request for Council Approval for Solicitation of Funds for Christmas by the Salvation Army. Mr. deLong referred to discussing Lolly the Trolley at the parade reviewing stand and asked if the Mayor wanted this on the agenda under New Business for discussion. Mayor Harmening agreed it could be discussed further. Mr. deLong stated that under New Business, he would also like to dis- cuss cutting through N. E. 22nd Avenue to High Ridge Road. He added this was all set to be cut through several years ago, but it was cast aside and he thinks it is about time that something is done. Mr. deLong moved 'to adopt the agenda with the additions and deletion, seconded by Mr. Trauger. No discussion. Motion carried 4-0. ANNOUNCEMENTS Mayor Harmening announced that City Hall will be closed on December 25 and 26, 1980 and January 1, 1981 in observance of Christmas and New Year's holidays. Mayor Harmening then presented service awards to the follow- ing City employees for ten years of service: Leonard Albury - Foreman in Building Maintenance Silas Clark - Equipment Operator in Sanitation Dept. Virginia Farace - Library Director Robert Frantz - Water Plant Operator J~ohn Gardner - Captain, Police Department Gus Hart - Supervisor, Parks Division Martha McArthur - Part-time Employee of the Library MINUTES - REGULAR CITY COUNCIL DECEMBER 16, 1980 BOYNTON BEACH, FLORIDA MINUTES Regular City Council Meeting of December 3, 1980 Mrs. Huckle referred to the spelling of Mr. Clinger's name and Mrs. Padgett advised this has been corrected. Mayor Harmening referred to Mr. Wright's reply in the last para- graph on page 2 and stated apparently this is not what Mr. Wright said or did not mean this and he suggests it be deleted. Mrs. Huckle stated she believes this is what Mr. Wright said and Mr. Trauger agreed. Mr. deLong suggested listening to the tape and Mayor Harmening suggested leaving it stand if that is what was said according to the tape. (The tape was listened to and the statements as recorded in the minutes are correct.) Mr. deLong moved adoption of the minutes, seconded by Mrs. Huckle. No discussion. Motion carried 4-0. PUBLIC AUDIENCE Mayor Harmening announced if anyone in the audience wanted to address the Council on any item not on the agenda, they may do so at this time. If anyone would like to speak on any item on the agenda, please give their name to the City Clerk and they will be allowed to do so when that item be- comes the regular order of business. Mr. Tom Plummer, 1314 S. W. 25th Place, stated he is the President of the Golfview Harbour Homeowners Association. He referred to asking for drainage corrections and told about the satisfactory response. They are now asking for support in the problem of clearing vacant lots. He wrote a letter on June 12 to the Codes Enforcement Board and some were cleared except for the 15 ft. right-of-way. These areas should be cleaned which would result in the probability that people will not dump rubbish there. Two problem lots are located in the area along 12th Street be- tween 25th Avenue and 25th Way and at the intersection of 25th Avenue and 10th Street. These are a disgrace to the neighborhood and City. The neighbors will not do it and they are fighting rats and snakes. He has gone through the proper channels to the department heads and has gotten a lot of conversations. If specifics are wanted, he will submit them later. The department heads are not responsive as they should be. After 2½ years, they have not done the first thing. He contacted Southern Bell and landscaping people and got it done. They have taken all the action they can. The City put up a "No Dumping" sign, but it doesn't do any good. The lots must be cleaned off and maintained. The lots should be maintained according to the~ordinance require- ments. He then thanked the Council for the results they have gotten in other matters. -2- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 Mayor Harmening asked what kind of rubbish or trash is being dumped there and Mr. Plummer replied that the lots are over- grown into the pavement and weeds are encroaching on the blacktop surface of the streets. The tree limbs hang out and scratch cars. They did get action on some lots through the Codes Enforcement Board. Mr. deLong suggested that this be turned over to the City Manager to be taken care of. Mr. Cheney advised that he agreed with Mr. Plummer on Friday to get together this week and go over this and see exactly what we can do. He will take a field trip with Mr. Plummer to see the lots. He then told about receiving a complaint from a resident in Golfview Harbour and cleaning off the lot and then finding the person who complained throwing trash on it the next day. They have tried to take care of this area. Mayor Harmening informed Mr. Plummer that this will be followed through. BIDS Construction of Water Main Extension - Congress Avenue/Miner Road, 16" Force Main (Utilities) Mr. Cheney informed the Council this is for the second stage of expanding the utility program on Congress Avenue from N.W. 2nd Avenue to Miner Road. He explained that it includes a water line on Congress Avenue to serve all the proposed development and water and sewer lines on Miner Road. This project will be paid for by a combination of E.P.A. Federal Funds and developers' funds with the water line being Paid for by the five developers. We will have all the checks from the local developers by the end of this week. If ap- proved,.this contract can be awarded before Christmas. It is recommended this bid be awarded to Southeast Underground Construction, which is $90,000 less than the cost estimate because this contractor has another job in this area. Mr. deLong moved to accept this recommendation and award this bid to Southeast Underground Construction for the water main extension. Mrs. Huckle seconded the motion. No discussion. Motion carried 4-0. One (1) Gas Chromatograph and Appurtenances (Water Plant) Mr. Cheney informed the Council this is for a gas chromato- graph and appurtenances for the water treatment plant. The lowest bid is from Hewlett-Packard and we recommend it be awarded. -3- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 Mr. deLong moved to accept this recommendation and award the bid to Hewlett-Packard for the sum of $17,516.50. Mrs. Huckle seconded the motion. No discussion. Motion carried 4-0. One (1) Water-Jacketed Incubator (Water Plant) Mr. Cheney informed the Council this is for an incubator for the water plant. Three bids were received and it is recom- mended this be awarded to Fisher Scientific Company in the amount of $1,887. Mr. deLong moved to accept this recommen- dation, seconded by Mrs. Huckle. No discussion. Motion carried 4-0. Demolition of Property - 924 North Federal Highway (Building Department) Mr. Cheney informed the Council this is for the demolition of an old building on North Federal Highway, which is re- ferred to sometimes as the pink building just south of the French restaurant. It is in conformance with our recently adopted demolition ordinance. If approved, it will be de- molished and the cost will be a lien against the property. Mr. deLong moved to approve this recommendation, seconded by Mr. Trauger. No discussion. Motion carried 4-0. Containers (Sanitation) Mr. Cheney informed the Council this is for a variety of sizes of dumpsters. It is recommended it be awarded to American Metal Containers, Inc. We will purchase a var- iety of sizes throughout the year within the $10,000 bud- geted in the account for this. We will buy sizes as needed. Mr. Walke went to Miami this week to see their operation and check them out in reference to construction. This is the low bid. Since we purchase more three and four yarders than six and eight yarders, it is recommended this bid be awarded to American Metal Containers. Mr~ deLong moved to accept this recommendation, seconded by Mrs. Huckle. Under discussion, Mr. Trauger commented that he showed the proposal blank to his college English class and they assumed we would get eight 8 cubic yard containers for the total sum of $458. Motion carried 4-0. SiTE DEVELOPMENT PLANS Applicant: Location: Use: Parkcrest Apartments, Lee Walker, Owner & Pres. N.E. 17th Avenue & N.E. 4th Street Construction of 44 two bedroom, two bath units in 8 buildings, plus meeting room and recrea- tion facilities -4- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 Mr. Cheney recommended this be continued to be on the table and Mrs. Padgett advised that the applicant's attorney is present. Mr. Cheney stated that he recommended tabling be- cause we wanted confirmation between his attorney and our attorney regarding the rights-of-way. He thinks it should be settled and understands it has not been done. Mr. Ben Cohn, attorney for the applicant, stated that he delivered all the materials to Mr. Vance's office today. Mr. Wolf stated that Mr. Vance is in Tallahassee and he doesn't know about this particular project or if those materials were delivered. Mr. Cheney referred to request- ing this to be delivered after the last meeting and Mr. Cohn told about working on this over the weekend and how he had to hire an abstract company to do over 30 years of work. He would like to know if the Council is going to accept the recommendation of the City Attorney. Does he have to meet with Mr. Vance before the meeting or will it be discussed at the next meeting? Mayor Harmening replied that he would think if he and Mr. Vance can work out the details and problems, there should not be any problem. He doesn't believe the Council has any reservations or is seek- ing to cause any hardships. PUBLIC HEARING - 8:00 P. M. Request: Location: Use: Applicant: LAND USE AMENDMENT to Area 5 of Comprehensive Plan pertaining to securing vehicular access from Woolbright Road (15th Avenue) across the LWDD Lateral Canal 26 South Congress Avenue, adjacent to north side of L-26 Canal Property to remain Community Commercial without access restriction Nabil Hansen Ph.D., P.E., Agent for Robert B. Reed as Trustee Mayor Harmening announced this request has been withdrawn at the applicant's request. SITE DEVELOPMENT PLANS (CONTINUED) Applicant: Location: Use: John Pagliarulo S.E. 21st Avenue - Lots 8-13, Sunny Oaks Addition Construction of 8 two bedroom, two bath apartments, plus an accessory building Mr. Annunziato informed the Council this is an application to construct 8 units plus an accessory building on several lots in the Sunny Oaks Subdivision. This subdivision exists -5- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 with platted 50 ft. lots. It is located to the north of the western end of S. E. 21st Avenue. The applicant requests approval for eight units lying in a north/south direction parallel to the railroad tracks. The accessory building is to the north opposite the parking lot. Mr. Annunziato stated this application was reviewed by the Planning & Zoning Board and several interesting comments were made by the staff. Basically the comments were related to access and fire protection. The Building Department noted this application requires Board of Health approval. The Fire Department notes fire hydrants subject to code and at the time this was reviewed by the Technical Review Board, we did not have knowledge of the existing fire hydrants, but further information locates one at 21st Avenue and 3rd Street. The City Engineer noted that paving and drainage plans are required. Mr. Annunziato continued that the Utility Department noted to loop a 6" water line on S. E. 3rd Street between S. E. 21st Avenue and S. E. 20th Avenue and he explained this route. It is his understanding this would help to back feed the system and provide additional flow. The City Planner continued that the Police Department noted that parking lot security lighting is required, traffic signs in driveways are required, and they are in agreement with the City Planner's memo. The Public Works Department noted no underground garbage cans. Mr. Annunziato then read the following comments which he listed: That the developer utiliZe energy efficient light- ing such~ as sodium vapor lamp's for all required exterior lighting. That the developer construct S. E. 3rd Street and S. E. 20th Court from where S. E. 20th Court termi- nates to S. E. 21st Avenue with 22' pavement and two 4 ft. swales. He explained that S. E. 20th Court terminates within 50 ft. of the property line and a 30' platted right-of-way exists. He pointed out that 22' of pavement with 4' swales could~ be constructed. e That the developer dedicate a sidewalk easement to the City along the west side of S. E. 3rd Street and the north side of S. E. 20th Court and construct sidewalks in same. Sidewalk should also be con- structed on S. E. 21st Avenue in front of this -6- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 development. The reason for the easement is that it does not impact on setbacks. That the developer move his two parking lots five feet westward and connect the northern parking lot to S. E. 20th Court at S. E. 3rd Street. This will allow the developer to remove the north/south drive in front of his building and replace it with land- scaping. This is sort of a mutually beneficial recommendation. He feels circulation would be en- hanced and the Police Department agreed. Also, S. E. 3rd Street was addressed in the Comprehen- sive Plan procedure and it was found it had some advantage to relieve U. S. 1 to provide north/ south access. Mr. Annunziato stated this application was reviewed by the Planning & Zoning Board and unanimously recommended that it be approved subject to comments. It was also reviewed by the Community Appearance Board and comes forward with their positive recommendation. Mr. Trauger stated in reading the Planning & Zoning Board minutes, he cannot figure out where the pavement was left. Was the Planning & Zoning Board approval subject to the paving of the 300 feet and Mr. Annunziato informed him that the recommendation is subject to staff comments which in- clude the construction of S. E. 3rd Street and S. E. 20th Court. Mr. Trauger clarified this would be at the expense of the developer and Mr. Annunziato agreed. Mr. John Pagliarulo, 3546 South Lake Drive, stated he has some comments in opposition to the City Planner's recommen- dations and comments listed. He is not a large developer, but is a small home builder. He owns these lots. They are lots which have been platted and he is not asking for any rezoning or change in usage. What appears to be happening here is that in order to get any use whatsoever from his property, it seems the burden is being put upon his should- ers to improve the rights-of-way which the City has taken the responsibility for awhile back, but never improved. In the initial meetings with the City Planner and City Engineer, no comments were ever made as to the disposition of the roadways or rights-of-way. It seems, in his opinion, that as long as he had proper ingress and egress to the property, there would be no problem. He proceeded at some expense and developed this plan for adequate use. Some of the comments he is in total agreement with such as the lights and provid- ing adequate fire protection. However, he feels the burden is being put upon one individual, himself, to improve quite -7- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 a bit of right-of-way, which he feels the City should parti- cipate with. To put in this roadway is a major expense. Mayor Harmening asked how many feet of paving was recommended and Mr. Annunziato replied that it is approximately less than 300 feet. Mr. Cheney added that the parking lot driveway should be deducted. Mr. Annunziato added that the paving could be replaced in front of the eight units. Mr. Trauger questioned the estimated cost and Mr. Annunziato replied that none was made. Mr. Pagliarulo continued that this property is zoned R-3. Would he be required to do this if he wanted to put a build- ing in the middle of the property and use it for a private residence for himself and Mayor Harmening replied negatively. Mr. Pagliarulo asked how he is to get to his property and Mayor Harmening replied that he has to build an access. Mr. Pagliarulo'clarified that the access would have to be a road which he has done. Since he is planning eight units, his major concern is to get the City to participate somewhat in the improvement of the road. In review of the site plan, there was discussion about a problem in the area with traf- fic flow, but this will exist whether this project is built or not. He is requesting that he and the City put their heads together and come up with mutual means to eliminate the problem. Mayor Harmening replied that his thoughts and comments are worthwhile and he can certainly agree to some extent; how- ever, it' has not been the policy of the City Council in quite some time to build any new streets. We have a hard time keeping up with the repaying of old streets. We only put $50,000 in the budget this .fiscal year for it which will not go very far. 300 feet is not a whole lot. Mrs. Huckle asked if he had gotten an estimate to construct the road since this was brought to his attention at the Planning & Zoning Board meeting and Mr. Pagliarulo replied negatively. Mayor Harmening referred to possibly $5,000 and Mr. Clark advised it would be $50 per foot. Mrs. Huckle added that the driveway can be subtracted and Mr. Pagliarulo stated that the relationship of constructing a road versus a driveway is probably a 3 to 1 increase due to the sub-base requirements, etc. Mr. Trauger referred to building the road on an assessment basis and asked if there was ownership on the other side to participate and Mr. Annunziato replied negatively. Mr. Pagliarulo explained this road would serve no purpose to the homes existing as their side yards are on this undeve- loped road. -8- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 Mr. Pagliarulo stated that his feeling is that he is re- stricted at the present time from the use of his property unless he does some improvements to City roads. Mayor Harmening stated improvements to City roads where there is no existing road has been done on a front foot basis. He doesn't recall the City putting any money into road construc- tion. Mr. Pagliarulo clarified that this is not agriculture property, but these are deeded lots and how can he use them and Mayor Harmening replied that a road must be built. Mr. Trauger stated he can see no other alternative than for the City Council to recommend to uphold the Planning & Zoning Board recommendations on this matter. If it is not paved, then it will be denied. Mr. Pagliarulo stated by burdening him with these extra costs, the project cannot go. It will not be feasible to proceed. The traffic problem will remain and the water for fire protection will not be improved. He will have to seek other sources to influence the Council. Mr. Trauger moved to uphold the recommendations of the Plan- ning & Zoning Board as submitted. He added this means with the staff comments and this applicant either has to pave the road or this is denied. Mayor Harmening clarified that it would be denied if he does not agree to the staff comments. Mr. deLong clarified that the motion is to approve the recom- mendation of the Planning & Zoning Board in accordance with staff recommendations. We are not denying this request, but are approving it with compliance with staff recommendations. If the applicant does not comply, he will not be able to go forward. Mrs. Huckle seconded the motion. Mr. Louis Lichtenstein referred to operating the food con- cession at the beach and told about talking to people from all over the world who visit Boynton Beach. He referred to being tourists in different areas of the world and stated that nowhere is there a $10 per day charge to park. There are only a few days during the year when it has been diffi- cult to park and usually this is only for a short period of time. It is a shame to increase the residents' fees. In- creasing the fee will drive people to Lake Worth or Lantana. With the price of gas, one of the cheapest things is to come to the beach with children. He does not think the Council should approve this recommendation. He does not think this increase would be fair to anyone, both non-residents and residents. Mrs. Huckle moved to adopt Ordinance No. 80-47 on second reading, seconded by Mr. Trauger. No discussion. Mrs. Padgett took a roll call vote on the motion as follows: Councilman deLong - No - his objection is that he does not think it is necessary to raise the fee on local people. He has met with Mr. Howell and Mr. Annunziato and drafted everything. It is presently being typed and should be ready for the next meeting. Mayor Harmening announced this would be left on the table. OLD BUSINESS Municipal Golf Course Agreement/Progress Report (Tabled) Mayor Harmening asked if there was any report and Mr. Cheney replied he could make one more comment. Mr..deLong moved to take this from the table, seconded by Mr. Trauger. Motion carried 4-0. Mr. Cheney reported they are continuing to negotiate and dis- cuss this matter. He has been told by the attorney for the developer of the adjacent property that they will be drafting a letter and making a commitment to make a road available when the City needs access to the property. He was told we would receive this letter next week to be reviewed by the City At- torney. If it is a commitment, he will have something to report at the meeting in January. He understands the Commis- sioner is arranging another meeting on this matter. He d6es anticipate a letter of commitment to meet our time table. Review of New Proposed Employee Classification Plan and Imple- mentation Manual (Tabled) Mr. deLong referred to this being held for the full Council and MaYor Harmening announced it would be left on the table. NEW BUSINESS Discussion of Inter-City Bus Service Mr. deLong suggested turning this over to the City Manager fOr a feasibility study to be made. Mr. Trauger questioned -14- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 the route and Mr. deLong replied this would be up to the City Manager to ascertain. The staff and City Manager can work this out. Discussion of Extending High Ridge Road Mr. deLong referred to High Ridge Road being a County road and stated they have jurisdiction within the City limits. He told about this only being extended southward from 22nd Avenue because a previous Commissioner had some friends living in the area who did not want it extended further. He thinks we should be able to get some action now. This City is progressing and should not~ have within the confines of the City an unfinished road leading to an industrial area. Mayor Harmening agreed. Mr. deLong suggested having Mr. Cheney pursue this and see what can be done with the County. Mr. Trauger referred to the High Ridge Road resi- dents opposing it about one or two years ago and Mayor Harmening agreed and added they also opposed it in 1973. Mro deLong stated if it requires a resolution to the County Commission, let's get cracking on it and Mr. Trauger agreed it should be pursued. ADMINISTRATIVE Report on Firing Range (Tabled) Mr. deLong referred to this having been hanging fire for quite awhile and stated a lot of inquiries have been made and he would like to know what we can do about this? He thinks there is a necessity for a firing range in the City. He believes Mr. Cheney was attempting to work out an agreement with the F.O.P. Mr. Cheney requested this to remain on the table, but advised that the Council's last instruction~ in response to a F.©.P. letter, was possibly the City should purchase the F.O.P. in- terests in the current piece of land. This would give them funds for a separate clubhouse. They have not gotten to this yet. Mr. deLong asked if a report could be given at the next meeting and Mr. Cheney replied there will be a meeting with the President of the F.O.P. sometime in January. Mr. deLong asked if there was any possibility of installing a firing range like the one in Ocean Ridge and Mr. Cheney replied that is what we have to do, but we have to clarify the multi-ownership of the building. Also, some funds will be required for this and possibly we may need a bond issue. Mr. deLong commented that he doesn't think it will be expen- sive and Mr. Cheney replied that it depends on the F.O.P.'s interest. -15- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 Consider Acceptance of Utilities and Streets - Ridgewood Estates (Tabled) Mr. deLong moved to remove this from the table, seconded by Mr. Trauger. Motion carried 4-0. Mr. Cheney stated the question on the Ridgewood Subdivision has been one of requiring the developer to finish a variety of small items. One of those items is to redo some of the drainage swales i~ accordance with the plans presented and the current standards. A petition has been submitted from property owners in the area asking that we not require the developer to put in drainage swales. They make the point there is positive drainage in the area, but we don't think that will necessarily solve the problems. He thinks we will have to go throughout this section of the City to install swales to sot~ the drainage problems. There is the question raised of going onto property at City expense to install swales when at the same time letting new development be ap- proved without swales. He has not talked to the people there. He suspects they may have the feeling it will be a more disastrous situation than it will be. The question is are we going to require swales there and in all new developments? Mayor Harmening referred to the developer being aware of the swale requirements and Mr. Cheney replied that he was and they were included on the plans. Mr. Trauger stated that he talked to some people and they thought a ditch was going to be built. Mayor Harmening re- ferred to how the developer would describe it and Mr. Cheney stated if the Council supports going in this direction, he will meet with the people and explain this to them. Mr. Trauger moved that we continue with the City Manager pursuing this and require the Ridgewood Subdivision to install swales. He added we must require this from new developers to correct drainage in the City. Mr. deLong seconded the motion. No discussion. Motion carried 4-0. Mr. Trauger referred to discussing drainage and stated he thought swales were going to be put in along North Seacrest Boulevard where the water lines ar9 being installed. Mr. Cheney informed him we are going tQ put in swales and will be doing that very soon on the first five lots from 19th Avenue.~ We could not r'equire the Contractor to do it on the rest of the lots. The first fkve lots is where the drainage problem was. We have a c~mmitment from the deve- loper that he will be sure grass i~ growing on the lots north of the first five, since we ~re putting in swales. -16- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 Consider Landscaping Plan for East End of New Royal Palm Clubhouse Mr. Cheney referred to Mr. deLong inquiring about possibly eliminating the wall on the east side of the clubhouse and landscaping that area so it looks better and stated he felt they should not knock down the wall without discussing it. Mr. deLong stated the wall does distract from the new build- ing. He has had many inquiries about what we are going to do with the wall and suggestions that we get rid of it because it is unsightly. It certainly would add to the attraction of the building to have it landscaped. Mr. deLong moved to take the wall down and landscape the area, seconded by Mr. Trauger. No discussion. Motion car- ried 4-0. Mr. Cheney reported that the clubhouse is progressing and the tile is being installed in the bathrooms. Mr. Trauger asked what color it will be painted and Mr. Cheney informed him the lower half will be panelled and the top painted a light gold. Mr. deLong commented that it is attractive both inside and outside. City Manager Report on MICA Studies: 1. Solid Waste Management Study and Decision Making Guide 2. Analysis and Recommendation of the Equipment Main- tenance Division Mr. Cheney stated he presented these to the Council because this Council authorized these in the beginning. He wants to come back at the first of the year on both of these re- ports and itemize in detail the recommendations and indicate the ones we support, ones which make sense at a later time, etc. An implementation schedule will also be developed and he will comment. He wanted to let the Council members read these reports. Mr. deLong moved to place both questio~ on the table. He added that he read the reports and is concerned and thinks it is a move in the proper direction and is long overdue. Mr.. Trauger seconded the motion. No discussion. Motion carried 4-0. Mr. Cheney stated he would like to take this opportunity, because Mr. Walke is present, to indicate to the Council that we are making some major improvements and progress in the Public Works Department. We are building on the resources we have there, but do have a long way to go. -17- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 Mr. deLong added that he happened to be responsible for mak- ing the recommendation for a new General Services complex. After reading this report, he can see what stubborness does on the part of the City Council. He made the recommendation to make the building twice the size when it was built and we had the money; but since the recommendation came from his direction, it was scuttled. He is happy and pleased with this report. Mayor Harmening added that he has been harping on *the maintenance of equipment and any improvements will be worthwhile. *Correct~on - seeminutes~/5/81 Mr. Trauger complimented MICA for these beautifully prepared studies. He added that he believes we are going to have throughout the next year a progressive series of reports to improve City operations. Approve Encumbrance Documents Mr. Cheney read the following encumbering documents: Reserve for Wilson Park - $35,000 Reserve for Ordinance Codification - $5,000 Reserve for Bicycle Path - $3,103.75 Reserve for City Property Improvements - $25,000 Reserve for Gym & Recreation Equipment - $1,954.75 Reserve for Fire Vehicle - $20,000 Reserve for Professional Services - $16,800 Reserve for Library Books - $2r068.85 Reserve for Mango Heights Drainage - $11,978.50 Mr. Cheney added these are all projects in the mill. Mr. deLong moved approval of the encumbrance documents as recorded, seconded by Mr. Trauger. Under discussion, Mrs. Huckle questioned what the reserve was for professional ser- vices and Mr. Cheney informed her in last year's budget, we appropriated this money in order to have funds for profes- sional services. We anticipated it would be for the job classification study and that is what this is for. He will propose spending it for the MICA study done. Some will also be used for further payment to MICA. Consider Request from Howard Riley - Re: Utility Service to Land on Congress Avenue Outside the City Mr. Cheney read a letter from Mr. Rick Rossi representing the Field's interests in a pi~e of land owned by Riteco Development Corporation on the west side of Congress Avenue north and south of 22nd Avenue, requesting a letter from the City indicating they will provide the required water and sewer service for this project. He advised that over the -18- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 years, a letter of this nature has been relatively standard when projects are within the City or within the utility ser- vice areas. However, because of discussions with Delray Beach at the Regional Board meeting, we have had some addi- tional discussions about this project and other projects. He has told the developer he would not feel comfortable signing a letter confirming the availability of water and sewer without discussing it with the City Council because of the current question with the wastewater plant. We are doing many things to be sure we can serve these areas, but he doesn't want to give false security. He has indicated Boynton Beach was the leader in the Regional Board bringing about studies to expand the plant. Both Delray Beach and Boynton Beach are attempting to increase the capacity of the plant. We even discussed in the past the possibility of preserving in mothballs part of the old City plant to have capacity available if needed. At the same time, we have received another request to confirm the availability of water and sewer for the Knollwood Orange Groves. He is concerned with the current City commitments in the City and service areas. Mr. Cheney continued that there also appears to be an addi- tional complication relative to increase in density. There was some assumption there would be five units per acre, but it now appears to be eleven units per acre according to the County Comprehensive Plan. He is not suggesting that we can't serve those areas, but we must be sure and let the people know possibly there are some problems in the short run. He realizes it is our responsibility to serve this area and doesn't want to mislead the people that we won't do it; however, he doesn't feel comfortable making this commitment now. The developers are involved and cannot proceed with rezoning before the Board of County Co~mis- sioners without this letter of confirmation. The question is whether the Council wants to give it to them at this time. Mayor Harmening stated that the points raised are pretty valid and he feels we should see where we stand with the regional plant before making long term commitments. Mr. Jori Moyle, attorney from West Palm Beach representing Riteco, came before the Council. He stated the City Mana- ger correctly stated that Palm Beach County requires some type of indication in the nature of reasonable assurance that water and sewer will be available when going for re- zoning. Without this letter, they will not be able to sat- isfy that requirement and cannot go ahead with the rezoning. In listening to the City Manager, he would have thought this letter would have been a commitment on the part of the City and that is not the case. The letter is merely an indication that they are within the service area and the capacity -19- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 is there and it is the intent of the City Commission to pro- vide water and sewer service when the project comes into being. If the capacity is not there when it is time to enter the water and sewer agreement, then it is no~ done. They must provide the County Commission with reasonable assurance of water and sewer. Mayor Harmening informed him that we will be glad to have the consulting engineers in conjunction with the Utility Director see where we stand in regard to sewer capacity and when we get the answer to this, we could give you a definite answer. Mr. Moyle replied that he would appreciate an indication from the City Council tonight if the capacity is there. If the City Council can give guidance if the capacity is there, a letter should be forthcoming. Mayor Harmening informed him that there was a meeting of the Regional Board last night and there is a problem if we don't make the April cutoff date, it is questionable whether we can start with expansion. We are not sure exactly where we stand. Mr. Moyle stated he thought the plant had a 12 mgd capacity now which is split between the municipalities and Boynton Beach is now operating at 4 mgd now. Mayor Harmening agreed this is correct, but Delray Beach is operating over 6 mgd now. Mr. Moyle clarified that expansion is planned and this could be stated in the letter that it is being applied for and in the event it is approved, then services can be provided to this development. This area was included under the EPA ap- plication. As the regional agent, there is a certain respon- sibility when the developer comes in in good faith and asks for this type of letter. They have deadlines to meet with making applications. They are looking at an interest rate which went to 21% today. They do not think it is fair to have an indefinite delay. Mr. Cheney stated that Mr. Moyle made 'the point that this is not a commitment, but is a statement. We are concerned about making a statement and having the rezoning take place based on the statement, especially when the density is being doubled. We do only have about 4 mgd going into the plant, but already have commitments from five major developers on Congress Avenue. We must be concerned with these on our limitation. We al- ready have commitments. He suspects throughout Palm Beach County there are many utility service areas that will haunt jurisdictions because commitments are made and they will not have the capacitY. We want to be sure to be able to meet the obligation. We cannot expand the wastewater plant without -20- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 DER and EPA approval. We do acknowledge our service area, but there are other agencies to be considered. We must be sure of existing commitments. We started earlier this year doing a three times per year survey of just what the commit- ments are to our system and over the next five years to see what we anticipate the construction will be by service areas in the City and County year by year. This will help us now with more confidence whether we can make a realistic state- ment. Confirming the letter must be more than the fact that they are in the service area. Mro Moyle stated that the Land Use Plan requires reasonable assurance that water and sewer will be available at the site. This is not a commitment on the part of Boynton Beach. As the regional agent, they are indicating if there is the capa- city when this development takes place, it is their intent to service it. The City can say if the EPA grant is turned down, they will not have the capacity and the County Commission can consider that. He assumes water is no problem. If the City doesn't want to give this letter, just give a letter confirm- ing the water and they will provide a letter to the County assuring them they will do a package plant. He does not think this request is unreasonable. They are in the area to be pro- vided water and sewer and the City intends to serve them if they have the capacity when they come on line. Mayor Harmening stated perhaps the quarterly update could be moving along within the next month to have a more definitive answer, so we are not misleading anyone. Mr. Moyle questioned how this letter would mislead anyone? They are presently in the service area and the capacity is there presently and it is the City's intent, in the event they have the capacity when this comes on, to provide water and sewer to this development. Mr. Trauger referred to the ~pansion not materializing possi- bly and questioned how it could be decided who to cut off? We do not have the capacity assurance at this time for this development. Mayor Harmening added that we may have to re- project based on the County Land Use Plan densities some of the capacities for the reserve area. Mr. Moyle suggested that it be stated in the letter that these studies are being done and expansion is planned. The reasonable assurance the County is after is that something is happening by the person who is responsible for providing water and sewer and they will reasonably assure it will be available. The County can make their decision on the rezon- ing based on this. The letter can indicate an application is being made, etc. This would show the County Commission -21- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 that something is happening. To not give the letter and to delay it seems unfairly penalizing the developer. Mrs. Huckle stated on the basis of the meeting last night, a letter indicating lack of progress would indicate non- assurance. It would negate assurance because of uncertain plans for expansion. Mr. Trauger referred to Riteco coming in with plans about 3½ years ago and stated he does not see how we can honestly give assurance that we will have sewage on line when they are ready to go. Mr. Moyle asked if they could have a letter indicating water availability and Mr. Cheney replied there was no problem with that. He asked if the Council concurred and received an affir- mative response. Mayor Harmening stated the water letter will be forthcoming. Consider Application to Solicit - Florida Consumer Federation, Inc. Mr. deLong asked if this group was checked out and Mr. Cheney informed him this application was approved previously, but they have requested an extension of time. Several years ago, this group was questioned and the application was not approved. Mayor Harmening pointed out that the estimated cost of fund raising is 60% of the gross amount collected and stated that costs for most charitable organizations are almost non-existent. He is not in favor of this group. Mrs. Huckle added that the proceeds to be expended in Boynton Beach are only 10%. Mr. Wolf informed them that when getting into the area of solici- tations, the U. S. Supreme Court stated you cannot turn down an organization based upon the amount of funds spent in the City or administrative costs. According to the U. S. Supreme Court, basically all a City can do is make an organization identify themselves when soliciting. Our ordinance probably should'be revised. Any time the City Council turns down a solicitation request, they are subjected to a law suit that we probably cannot win. Mr. Cheney clarified that this application was approved for the period from 11/6 to 11/28. They indicated they would like to extend the date %O 12/5 which was done administratively. However, they are now asking for a significant period of time to the end of January. Mr. Nick Cassandra, 2554 S. W. 10th Court, told about his door- bell being rung by one 'of these people and being requested to write out a check for this organization. He is concerned about -22- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 this. The City Council has a certain responsibility to the citizens of Boynton Beach. This group is already out ring- ing doorbells. He would like the City Council or the appro- priate department head to advertise and tell citizens that if people do not have a permit, they do not have the right to solicit. The application should not be considered after the fact. He thinks this City Council should advertise once a month advising citizens that if someone rings their door- bell and do not have the proper permit from this City to please call the appropriate department to get rid of them. Applications seem to be considered after the fact. He would like them considered before the fact. Mrs. Huckle informed him this was considered before the fact and was granted previously, but now an extension is being requested. Mr. deLong questioned the time period granted previously to solicit and Mr. Cheney informed him it was 11/16 to 11/28. Mr. deLong clarified that they are soliciting now without authority and Mr. Cheney informed him the period was ex- tended to December 5. Mr. deLong questioned the reason for the extension. Mrs. Huckle asked whether the time extension could be denied legally and Mr. Wolf replied that we would be walking a thin line with denial. Mr. Wolf suggested that the ordinance be revised to require the people to wear badges, solicit within reasonable hours, etc. Any denial of a charitable organization is something where we could probably be subjected to a suit. He feels we would not have the chance to win such a suit. Mayor Harmening referred to granting the original request and giving an extension and asked if we would be on safe ground to deny this additional extension? Mr. Wolf stated this is a privilege which charitable groups already have. Mayor Harmening clarified that a permit is not needed to solicit. Mrs. Huckle asked if this could be tabled pending the adop- tion of the new ordinance and Mr. Wolf replied that he saw no reason why it couldn't. Mrs. Huckle moved to table this request, seconded by Mr. Trauger. Motion carried 4-0. Mr. deLong suggested that the City Attorney revise the pre- sent ordinance and Mayor Harmening agreed. Mr. Wolf re- quested some feeling on this from the Council such as whether there should be the requirements of identification badges, applications, etc. Mayor Harmening suggested that it be revised to be tight. -23- MINUTES - REGULAR CITY COUNCIL BOYNTON BEACH, FLORIDA DECEMBER 16, 1980 Mr. deLong moved to instruct the City Attorney to redraft the solicitation ordinance, seconded by Mr. Trauger. Consider Change Order for Wilson Pool - Lassiter Construction COntract Mr. Cheney explained how something happens like this with rehabilitations and there were not accurate plans of what was built twenty years ago. When getting into this project, they found some problems with the lights in the walls and safety problems with the electrical system. The whole system should be changed and the cost is $11,130. We can use $5,980 of Community Development money from the Sara Sims project. He recommends we do that and transfer $5,150 from Contingencies. Mr. deLong moved to accept this recommendation and make the transfer, seconded by Mr. Trauger. Under discussion, Mayor Harmening asked if there was any possibility for additional funds and Mr. Cheney replied negatively as he has tried. Mrs. Huckle questioned the amount in the Contingency Fund and Mr. Cheney informed her there is $75,000 and none has been used. Motion carried 4-0. No discussion. Motion car- ried 4-0. Removal of Political Signs Mr. Trauger requested the City Manager through work crews or the Police Department to be sure all the political signs are taken down. He suggests that the people having signs which are up to be notified to remove them within five days. Mr. Cheney replied that it would be easier for a City crew to do it as it takes more time to notify the people. Mrs. Huckle stated that she believes the candidates should be notified and have to take them down. Mr. Trauger and Mayor Harmening agreed. Mayor Harmening clarified that the City Manager is instructed to inform all candidates in the last election to remove their signs if they have any up post haste in the strongest possibl~ language. ~. Cheney replied that he will take care of this. Request for Permit %o Solicit for Salvation Army Mr. Trauger referred to volunteer time being spent for this and asked the City Council to grant the ~alvation Army a per- mit to solicit in front of grocery stores with buckets. He moved to grant this request, seconded by Mrs. Huckle. Under discussion, Mr. deLong asked if an application was submitted an~ Mr. Trauger replied negatively. Motion carried 4-0.
