3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA
4 AMENDING LAND DEVELOPMENT REGULATIONS, CHAPTER 1,
5 ARTICLE V, SECTION 2, "WORKFORCE HOUSING PROGRAM ",
6 CREATING SUB - SECTION I, "SUSPENSION OF PROGRAM"
7 SUSPENDING APPLICATION OR ENFORCEMENT OF THE
8 WORKFORCE HOUSING PROGRAM FOR A PERIOD OF TWO
9 YEARS; PROVIDING FOR AUTOMATIC REIMPLEMENTATION OF
10 APPLICATION AND ENFORCEMENT UPON THE EXPIRATION OF
11 THE STATED TIME PERIOD; PROVIDING FOR CONFLICTS,
12 SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE.

14 WHEREAS, the Workforce Housing Program was adopted by the City Commission on
15 April 3, 2007; and
16 WHEREAS, staff believes that suspension of the application and enforcement of the
17 Workforce Housing Program will offer interim relief to stimulate development and is therefore
18 consistent with the Economic Development Implementation Initiative 15a.; and
19 WHEREAS, the City Commission has considered the recommendations and has
20 determined and finds that it is in the best interest of the citizens and residents of the City of
21 Boynton Beach, Florida to suspend the application and enforcement of the Workforce Housing
22 Program for a period of two years.
23 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
24 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
25 Section 1. The foregoing whereas clauses are true and correct and are now ratified
26 and confirmed by the City Commission.
27 Section 2. The Land Development Regulations of the City of Boynton Beach Code
28 of Ordinances, Chapter 1, Article V, Section 2, "Workforce Housing Program" is hereby
29 amended by adding sub - section I, "Suspension of Program" as follows:

1 I. Suspension of Program. Commencing December 15, 2011 and ending
2 December 14, 2013 application of the Workforce Housing Program is suspended
3 and parties to whom it may apply are relieved of any compliance requirements.
4 The Workforce Housing Program will automatically be re- implemented upon
5 expiration of the suspension of the application and enforcement of the Program.

7 Section 3. Each and every other provision of the Land Development Regulations
8 not herein specifically amended, shall remain in full force and effect as originally adopted.
9 Section 4. All laws and ordinances applying to the City of Boynton Beach in
10 conflict with any provisions of this ordinance are hereby repealed.
11 Section 5. Should any section or provision of this Ordinance or any portion thereof
12 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the
13 remainder of this Ordinance.
14 Section 6. Authority is hereby given to codify this Ordinance.
15 Section 7. This Ordinance shall become effective immediately.
