Minutes 11-21-79MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, WEDNESDAY, NOVEMBER 21, 1979 AT 7:30 P.M. PRESENT Edward F. Harmening, Mayor Betty Riscoe, Vice Mayor David Roberts, Councilman Norman F. Strnad, Councilman Walter "Marty'~ Trauger, Councilman Peter L. Cheney, City Manager Tereesa Padgett, City Clerk James W. Vance, City Attorney Mayor Harmening welcomed everyone and called the meeting to order at 7:30 P. M. He requested Councilman Trauger to give the Invocation in the absence of Reverend Edward Wollenweber, followed immediately by the Pledge of Allegiance to the Flag led by Councilman Norman Strnad. AGENDA APPROVAL Mr. Cheney requested the addition of Item X-S, a request for use of a public address system in the City which has to be approved by the Council. He requested the addition under Announcements for a report from the City Clerk on the results of the Primary Election. He stated he Would like to add first reading of an ordinance under Legal covering amendments to the Codes Enforcement Board Ordinance. He would like to remove from the agenda Item VI-B, a site plan, because it did not re- ceive approval from the Community Appearance Board this week. Mr. Roberts requested the addition under New Business - Discuss Lime Recalcination Process Mr. Vance stated he would like to delete Item VII-C-1. Mr. Roberts moved to adopt the agenda as corrected, seconded by Mr. Trauger. Motion carried 5-0. ANNOUNCEMENTS Mayor Harmening announced the next City Council meeting will be held on Wednesday, December 5, 1979, because of the General Election beinq held on Tuesday. Mayor Harmening then requested Mr. Perry Cessna to come forward and presented him with two awards. He read a plaque for the highest award in the State of Florida from the Water Pollution Control Association. He then presented a plaque from the Florida Water & Pollution Control Association for the best operation of a Class B Water Plant presented to the City for 1979. He added that the water plant is Class B because of the size. MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 Mrs. Padgett announced we had a 20.26% turnout for the Primary Election held on November 20, 1979, with a total of 4,277 votes cast. She then read the total votes cast for each candidate: Joe DeLong Robert "Bob" Feldman Bob Ferrell Edward F. Harmening Frank Kohl - 1,746 - 1,071 - 1,630 - 2,222 - 1,270 Mrs. Riscoe moved to accept the returns of the Primary Election for the City of Boynton Beach on November 20, 1979, seconded by Mr. Roberts. Motion carried 5-0. MINUTES Regular City Council Meeting - November 6, 1979 Mayor Harmening referred to Page 10, Payment to Delray Beach, and corrected this to be the pre-operating startup expenses. He referred to two corrections on Page 11, Report on Sanitary Sewer Problems - North End, and stated APA should be EPA; and Community~ De~e~©pment C~nsultant, and corrected: Russell & Axon "being" left off, etc. Mrs. Riscoe moved for approval of the minutes with these changes, seconded by Mr. Roberts. No discussion. Motion carried 5-0. PUBLIC AUDIENCE Mayor Harmening requested anyone wishing to address the Council on any item not on the agenda to please come forward at this time. He added if anyone wished to speak on an item on the agenda to please give their name to the City Clerk and they will be called upon when that item becomes the order of business. Mrs. Zibelli, North Boynton Community Improvement Association, referred to meeting with Mr. Frederick this week and told about improvements being made to the median on Ocean Parkway. She told about the City cooperating, but advised that two huge PVC pipes have been left going through the middle which should be underground as some children are going to run through and trip over the pipe and the City will be open for a suit. Mayor Harmening requested Mr. Cheney to please look into this. -2- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 BIDS One (1) 45 KW Portable Generator (Sewage Pumping Stations) Mr. Cheney referred to this being approved in this year's utility budget and advised that one bid was received. The bid was received from a central supplier and the price quoted is $9,990. $20,000 was included in the budget for this since we paid more than this several years ago for a similar gener- ator. He recommends approving this award as it meets our specifications. Mr. Trauger moved to accept the bid from R. B. Grove, Inc. for $9,990 for this generator, seconded by Mr. Roberts. No discussion. Motion carried 5-0. Annual Requirements for Zinc-Polyphos~hate (Water Plant) Mr. Cheney referred to receiving approximately six bids and recommended the bid be awarded to Shannon Chemical Corp. of Malvern, Pa., at the price of $46.46 per cwt in quantities of 600 lbs., since this is the lowest bid. Mrs. Riscoe moved to accept the bid from Shannon Chemical Corp. of Malvern, Pa., at the price of $46.46 per cwt. Mr. Roberts seconded the motion. No discussion. Motion carried 5-0. Four (4) Honda CTll0 Motorcycles Mr. Cheney referred to discussion at budget time to change the Police Department assignments to four ten hour days and stated part of this program was to purchase motorcycles to assist in patrolling and give better protection and coverage. We re- ceived a bid from G & Z Enterprises, Inc. for the sum of $3,100 for four motorcycles. Since we only budgeted $2,800, we will buy only three motorcycles. He referred to other companies not bidding and recommended this one bid be approved. Mr. Trauger moved the acceptance of the bid from'G & Z Enter- prises, Inc. for three Honda CTll0 motorcycles, seconded by Mrs. Riscoe. No discussion. Motion carried 5-0. Pump and Discharge Pipe (Mango Heights) Mr. Cheney referred to approving this project some months ago and advised that one bid was received in the amount of $64,395. He added that $1,105 was deducted from the original bid for electrical and we will have a $1,500 expense for Florida Power and Light Company to put in a different electrical system. -3- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 Mr. Cheney then referred to the funding and advised the current budget provides for the Mango Heights project to be funded out of Revenue Sharing funds. It is his recommendation that we trans- fer the funding of that project to the General Fund so we can accept the current favorable bid for the project and will not be involved in complying with federal regulations applicable to the use of Revenue Sharing for construction projects. To offset this General Fund expenditure~ he proposes that $68,000 budgeted for sanitation equipment be purchased out of Revenue Sharing funds since there are no added federal regulations concerning the use of Federal Revenue Sharing funds for the purchase of capital equipment. Mr. Cheney then explained when we bid this project, we did forget to put in the bid documents indicating this was Revenue Sharing. After the bids were accepted, he realized this oversight. With realizing the problems we have had in getting contractors for small jobs, he concluded the better way would be to fund this out of the General Fund. If the Council approves this project and this funding, a motion will be needed to make the appropriate budget transfer. Mr. Roberts referred to a completion date and Mayor Harmening pointed out that 180 days was listed. Mr. Trauger moved to accept the bid as proposed for the Mango Heights drainage in the amount of $64,395 and transfer $68,000 as suggested in the memo of November 20 for the funding. Mrs. Riscoe seconded the motion. Mayor Harmening suggested this might be appropriate to take in two separate motions. Mr. Trauger then restated his motion to accept the bid for Mango Heights from R. J. Sullivan Corp. in the amount of $64,395 as stated on the bid sheet, seconded by Mrs. Riscoe. No dis- cussion. Motion carried 5-0. Mr. Trauger moved to make a budget transfer from where this was initially assigned for sanitation to Mango Heights for $68,000 and put the garbage packer under Revenue Sharing where this was originally established. Mrs. Riscoe seconded the motion. Mayor Harmening clarified that it was moved and seconded to authorize the appropriate transfer of funds. No discussion. Motion car- ried 5-0. Mayor Harmening suggested that thought be given to possibly deleting the pipe from this contract and having our other pipe laying contractors lay it as a lump sum of $6,600 is shown for this and some mon~may be saved. Mr. Cheney replied that he will investigate this. -4- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 One (1) Computer Output Reader and One (1) Continuous Computer Forms Console Mr. Cheney referred to not having final review and approval and explained this is for making the paper product from the computer to go directly into microfilming. It was approved in the budget this year. He then explained the bids received from Lanier and Eastman Kodak. A departmental transfer can be made and he recommends this bid be approved. Mr. Roberts moved to accept the bid for one computer output reader and one continuous computer forms console in the amount of $1,900 and $2,400. Mayor Harmening referred to having the amounts of $1,880 and $2,551 and Mr. Cheney clarified the recom- mendation is $2,551 and $1,880 as the other amounts were the amounts budgeted. Mr. Roberts moved acceptance of the bid of $2,551 for the reader and $1,880 for the continuous forms con- sole to Lanier, seconded by Mrs. Riscoe. No discussion Motion carried 5-0. ' Water Main Extension - Congress Avenue Mr. Cheney referred to Russell & Axon making a recommendation and advised that we approve this project. Basically it is the water line from the plant to the new water storage area in the Woolbright Plaza Area. He then read the following excerpts from the letter from Russell & Axon recommending the bid: "On November 13, 1979, at 2:00 P. M. pursuant to the pub- lished legal advertisement, bids on the subect Water Main Exten- tion to Congress Avenue were received in the office of the City Purchasing Agent. There were fifteen planholders and bids were received from nine contractors. This project was included in the $2..5 million dollar Water & Sewer Revenue Bond Issue, Series 1978 at a construction cost estimate of $380,000 plus a 15% allowance for Contingencies, Engineering and Resident Surveil- lance. There are therefore adequate funds available for this project. We hereby recommend award of the contract to the low bidder, E. N. Murray, Inc., P. O. Box 111, Highway 41 N., Buena Vista, Ga. 31803, in the amount of $379,209.92 with completion by 200 calendar days. There were no alternates to the bid, and only 1978 Bond Issue funds are involved. Should this recommen- dation be accepted, we will provide contract documents as usual." Mr. Cheney added that Mr. Cessna has recommended tha~ we award this bid. Mr. Roberts moved to accept the low bid from E. N. Murray, Inc., for the water main extension on Congress Avenue in the amount of $379,209.92. Mr. Trauger seconded the motion. No discus- sion. Motion carried 5-0. -5- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 PUBLIC HEARING Abandonment Request (Tabled) Applicant - Christian Development of Boynton Beach, Inc. Mr. Clyde Wor~ell, Agent Request - Abandonment of 30' Roadway Easement Between S.W. 19th Ave. and Commercial Property in Vicinity of Lindsley Lumber along Drainage Canal Mr. Vance informed the Council that he received a letter from the attorney representing Christian Development in which he outlines various reasons why he thinks a meeting would be appropriate and requests the opportunity to discuss it with him. He further stated he would be out of town this week and will give him a call on November 26. It appears it is his desire to let this matter stay on the table until he has the opportunity to discuss it with him. He suggests, based upon this letter, the appropriate manner would be to leave this on the table unless a representative from the company is present. Mayor Harmening ascertained no re- presentative was present and announced this.would be left on the table with no action required at this time. Abandonment Request from Riteco Development Corporation Submitted by William Pruitt, Attorney Request to Abandon 30' wide Road Right-of-Way running north from Boynton Canal to LWDD Canal 22, approximately 600' east of Congress Avenue Mr. Annunziato referred to this being a 30' road right-of-way platted many years ago and explained the location and advised there was ~ east/west right-of-way which was abandoned many years ago. The property owner on both sides is Riteco Develop- ment Corporation. This application was reviewed by the Planning and Zoning Board and evidence was presented by the staff and they recommend approval. Mr. Roberts referred to this being land being transferred to Motorola and Mr. Pruitt clarified that it is under contract to Motorola. Mr. Vance referred to this right-of-way running from canal to canal in a north/south direction and clarified that the applicant owns the property to the east and west of this easement and Mr. Pruitt agreed this was correct. Mr. Vance clarified there is no other owner who could be ser:ved by this easement and Mr. Pruitt agreed. Mayor Harmening asked if anyone in the audience wanted to speak in favor of this abandonment and received no response. Skylake Subdivision Approval of Variance for Road Right-of-Way Mr. Tom Clark referred to the request being for 50' rights-of- way as originally platted be approved for this plat only and advised the 50' right-of-way is our old standard and they are requesting a variance to comply with our old standard. He recommends we grant this variance. Mayor Harmening asked if anyone in the audience wished to speak in opposition to the granting of this variance and received no response. He asked if anyone in the audience wanted to speak in favor of the granti~ of this variance and received no re- sponse. Mr. Grover C. Herring stated he was present as counsel for this applicant. Mayor Harmening clarified this was originally approved, but was not platted and the regulations were changed for rights-of-way. Mr. Roberts added this refers to Plat 1 only. Mr. Roberts moved to grant approval of this variance for the road rights-of-way for Skylake Subdivision Plat 1 as requested and approved by the Planning & Zoning Board. Mr. Trauger seconded the motion. No discussion. Motion carried 5-0. SITE DEVELOPMENT PLANS Cranbrook Lake Estates, Submitted by Joseph Cogen, President Construction of Wall and Sign along Congress Avenue Mr. Annunziato informed the Council this application comes before them owing to the PUD nature of the application. He explained that a decorative concrete and wood wall is proposed to be located along the west side of Congress Avenue in the Cranbrook Lake Estates Development. It will lie on the east 4' of the utility easement. It has been checked by the Utility Department. Also included is a gate and wall around the lift f station site. The applicant is to coordinate with the Utility Director regarding the gate and lock. Also, a hold harmless agreement is required in case we have to repair and maintain the facilities. The height is to be 6' above the rear yard grade. This was unanimously recommended by the Planning & Zoning Board. -7- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 Mr. Vance asked if a representative of the applicant was present in the audience and Mr. Art May, Construction Manager, came before the Council. Mr. Vance asked if the applicant agrees to comply with the staff comments and Mr. May replied affirma- tively. Mr. Roberts moved to accept the site development plan from Cranbrook Lake Estates for a decorative and privacy wall and sign along Congress Avenue as recommended by the Planning & Zoning Board including staff recommendations. Mr. Trauger seconded the motion. No discussion. Motion carried 5-0. Preliminary Plat of C & H, Plat ~1 Submitted by Daniel Carnahan, Agent Construction of Total of 330 Units, Located North of LWDD Canal 20 and West of Congress Avenue, Constitutes Phase I of Meadows "300" PUD Mr. Annunziato referred to this being the first plat for the Meadows 300 PUD and explained the location and the housing tracts planned. The application is consistent with the approved master plan. The technical aspects regarding on-sight utilities and recreation have been pretty much worked out. One of the remaining things to be worked out is the off-sight utilities which should be presented to the City in the future. Mr. Daniel Carnahan explained how they tried to comply with everything in the PUD ordinance and have been working closely with the City staff. Mr. Annunziato then explained the proposed housing units, road system and entrances, recreation, etc. Discussion ensued re- garding the proposed housing mixture and price range. Mr. Roberts referred to the total acreage and number of units and Mr. Annunziato informed him the entire PUD was 290 acres and the unit count was approximately 1,400 units with a density of 4.8 units per acre. The recommendation is the plat be ap- proved subject to comments. Mr. Roberts moved the acceptance of the preliminary plat of C & H, Plat #1, as recommended by the Planning & Zoning Board with the staff recommendations listed. Mrs. Riscoe seconded the motion. Ordinance 'No, 79?35 - Re: Amending ordinance No. 79-28 Mr. Vance referred to the Codes Enforcement Board wanting some alternates and some other details clarified in this ordinance and advised this ordinance accomplishes these purposes. He then read proposed Ordinance No. 79-35 by title on first read- ing. Mr. Trauger moved the acceptance of Ordinance No. 79-35 on first reading, seconded by Mr. Roberts. Under discussion, Mrs. Riscoe suggested putting on th~ agenda for the next meeting names for alternates to be submitted and Mayor Harmening agreed. Mrs. Riscoe referred to a couple extras having submitted re- sumes and requested Mr. Cheney to bring these back to the Council's attention. Mr, Roberts asked if the classifications had to be the same as the original appointments and Mr. Vance replied that he thought any of the five categories would be appropriate. Resolutions Proposed Resolution No. 79- Re: Amending and Adding Job Description - Paramedic Positions Mr. Cheney referred to possibly holding this until after discuss- ing this suggestion and Mrs. Riscoe moved to suspend the regular order of business and discuss this resolution when we come to the other portion on the agenda. Mr. Trauger seconded the motion. No discussion. Motion carried 5-0. Other Review of Planning Board Recommendations - Re: Zoning Ordinance and Map Amendments (Comprehensive Plan Implementation) Mr. Annunziato informed the Council that the recommendation from the Planning & Zoning Board is based on his recommendation to the Board to implement the Comprehensive Plan by making zoning map and ordinance changes. He added that many were addressed in the Comprehensive Plan, others were alluded tobuy~ the map itself and some were provided for in the land use. He then explained that three new zoning categories were proposed with the creation of an AG Zone, Agriculture District; REC Zone, Recreation District; and, PO Zone, Public Ownership District. Mr. Roberts asked if this is part of the Comprehensive Planning Act and should this go before the Planning & Zoning Board and Mr. Annunziato informed him this is the package to implement the items brought about by the adoption of the plan and the Board is looking to the Council to go ahead with public hear- ings to implement these changes. Mr. Vance added that we recently received the attorney general's opinion in which he states once a Comprehensive Plan is adopted, that plan over- rides the existing zoning where the existing zoning conflicts with the new Comprehensive Plan. He clarified that Mr. Annun- ziato's suggestion is to make the zoning map and ordinance conform with the master plan. Mayor Harmening clarified that the Planning & Zoning Board must hold public hearings on these recommendations prior to the City Council taking any action. Mr. Roberts so moved, seconded by Mr. Trauger. Mayor Harmening clarified that it was moved and seconded to direct the Planning & Zoning Board to advertise public hearings on the full implementation of the Comprehensive Plan. No discussion. MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 Recommendations for Employing Appraisers - Re: EPA Projects Mr. Vance referred to having received two more after distribut- ing the packet and advised there will be estimates at the next meeting and requested this item to be tabled or postponed. Mrs. Riscoe moved to table this, seconded by Mr. Trauger. Motion carried 5-0. OLD BUSINESS Report on Community Devel©pment Consultant Selection Mr. Cheney referred to a vote being taken at the last meeting and then being rescinded with the suggestion that he try to see what our options are. The options we have are to re-affirm the vote taken last week, hire CH2M and Hill, interview other con- sultants on the list, or interview other consultants involved. He added there was some question whether we could hire CH2M and Hill because they had another job in the County, but that has been resolved. They have entered an agreement with Lake Worth which does not affect us entering an agreement with them. Their assisting dollar amount of contracts in Palm Beach County does not exceed the minimum number set by the County. He explained how it was County policy to spread the jobs around among the consultants. He hopes this can be resolved and we can move on with the project. Mayor Harmening asked if he was recommending that we have a new series of interviews and Mr. Cheney replied that unless they want to consider a consultant they have not interviewed, they have the option to go ahead with one interviewed, but can pro- ceed with more interviews. He thinks there should be one the Council will support as a whole. Mr. Trauger referred to interviewing them all and knowing their positions and stated if we are going to hire a consultant, he thinks we should be in unanimous agreement to the firm we select or we will not be happy with the results. He presum~ from all the firms, CH2M and Hill had fairly large support. Mrs. Riscoe agreed and clarified that she only questioned why Russell & Axon was deleted. Mr. Roberts added that all were qualified. Mayor Harmening added that CH2M and Hill were able to answer more com- pletely several of the questions asked. Mrs. Riscoe moved to select CH2M and Hill, seconded by Mr. Trauger. Under discussion, Mr. Vance referred to selecting *Post, Buckley, Schuh & Jernigan at the last meeting and Mr. Cheney informed him ~his vote was rescinded. Motion carried 5-0. Mayor Harmening asked Mr. Cheney to inform Mr. Dawson the selection process is unanimous in the City of Boynton Beach. -12- *Correction - see minutes of 12/5/79 MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 NEW BUSINESS Discuss Lime Recalcination Process Mr. Roberts referred to discussing the recycling of lime at the Municipal League Meetings and stated we are spending around $6,700 per month for lime to treat our water, which runs about $80,000 per year. He found out there is a process known as re- calcination which has to be done through equipment. He has talked to Mr. Cessna and Mr. Swan and he is asking for approval from the Council to have Mr. Cessna give a report by the next meeting regarding this. There will be a savings. Mayor Harmening ascertained there were no comments from the Council members and stated no formal action is required. Mr. Roberts asked if they were in agreement to go ahead with this and Mayor Harmening replied affirmatively. ADMINISTRATIVE Consider Request of Robert E. Hamilton, President, Mariner Village Regarding Reduction of Bond Mr. Cheney stated the request is for Council to concur in the reduction of the bond from Mariner Village from the amount of $100,000 to $40,000. This amount is sufficient to cover the remaining improvements since the utility work has been finished. Mr. Trauger mowed to reduce the bond coverage for Mariner Village from $100,000 to $40,000 as recommended in the memo of November 9, seconded by Mr. Roberts. No discussion. Motion carried 4-0. Approval of Audit Engagement Letters Federal Revenue Sharing and Antirecession Fund EDA Funds Mr. Cheney referred to the Federal Revenue Sharing Funds and EDA Funds having to be audited and stated two letters have been sub- mitted from the auditors proposing to cover the cost of these projects. The cost will not exceed $1,200 for the audit of the Federal Revenue Sharing and Antirecession Funds and ~80 fQr the EDA Funds. He requests approval. Mr. Trauger moved acceptance of the proposals from Ernst & Whinney for audit of the Federal Revenue Sharing and Antireces- sion Funds in the amount of $1,200 per their letter of October 31 and for audit of the EDA Funds in the amount of $480 as established by their letter of October 31, 1979. (Mrs. Riscoe had not returned.) -13- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 RecommendatiOn that City Enter Into a Contract with Management Information Corporation of America (MICA) for Various Studies of City Programs Mr. Cheney stated he would like to invite Mr. Joe Safford to come forward who represents MICA. A proposal has been submitted to enter an agreement with an interesting concept with getting the services of this firm and then pay them only out of the savings of the project to a maximum amount. This would become an extension of his office with the ability to draw on many specialists throughout their firm. Mr. Joe Safford then told about the history of the company. He explained the organization comes into a city on a no risk guaran- teed policy. They do evaluations as stipulated by the city. They prepare productivity studies and make recommendations. After the recommendations are accepted, they implement them. They help with financing, purchasing of equipment, training of people, etc. until the savings are approved. Once the savings are approved, then they get paid. If savings are not generated, they do not get paid. This is stipulated in writing. He told about contracts with various municipalities and their experience with various cities. Mr. Roberts stated that he just received this information tonight and would like to review it more thoroughly, but he doesn't object to the rest of the Council moving ahead. He referred to a list of clients being submitted and Mr. Safford told about their clients including various cities with vary- ing populations. Mr. Strnad stated quite a few years ago, he tried to advocate having such a firm to find out what is costing our taxpayers unnecessary dollars. He believes this firm would answer the request he had at that particular time. He would be in favor of having something like this done. He believes it is a terri- fic burden for the City Manager to go into different depart- ments and try to sort out what is necessary and not necessary. He is in favor of something like this. Mr. Trauger referred to recommendations being made and the findings implemented with a monthly savings of $500 and ques- tioned what would happen then and Mr. Safford replied that the City Manager's office will determine the savings. The monthly figure would be included in the annual base. The one study would be combined with the rest of the studies and the savings calculated in each study. On an annual basis, the City Manager will rate them, measure their performance based on the savings they have generated. They can earn up to the maximum amount of the contract depending upon the savings generated. -14- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 Mr. Trauger referred to the maximum being $291400 and Mr. SaffOrd replied that they hope to at least double that amount. Mrs. Riscoe referred to this being like a check and balance system and Mr. Safford replied there is a diStinct difference. He explained that normally a consultant does a study and makes a report, draws his fee and leaves. They turn in the report, implement the report and prove the savings. They do not get paid just for a report. After they implement a system, then they get paid. Mrs. Riscoe referred to Mr. Cheney feeling this is necessary and Mr. Cheney stated there is no question that changes are needed in some areas. He referred to the vehicle maintenance program and explained that a program like this covering the entire City affects every household and is expensive equipment which should be looked at. The City is continuing to grow and the equipment should be looked at to see if it is as good as it should be. The number of manpower, crews, equipment, etc. must be studied. He is looking for expertise used throughout the country to come in and give us some advice. He thinks this is the quickest and hopefully the most effective way. Mr. Trauger asked if a study would give a cost analysis amount needed to operate a pickup truck and Mr. Cheney replied affir- matively and added that also out of this would come advice whether we should have a parts and maintenance inventory and how to handle the system. Our records would reflect the repair costs for every piece of equipment so we could have an accurate charge and understanding of c~sts. Also, a routine trade-in program can be considered. Mr. Cheney explained how experts would work with us for a year on projects we specify. Mr. Trauger referred to discussing this at budget time and asked how much was budgeted and Mr. Cheney replied that $15,000 was budgeted to do a separate study on the personnel. However, with starting with this program, there is no need for money. We will pay them accord- ing to what we have saved. The job classification study would be part of the total work. He explained how there was the possibility of some projects not proving cost effective. Mr. Strnad stated he thinks this would be $29,000 well spent. He is sure with people getting in there and ~digging in and finding out where money is being wasted, we will save much more than double $29,000. Mr. Strnad moved to accept this recommendation of the City Manager to engage this firm to do this job, seconded by Mr. Trauger. Under discussion, Mr. Roberts asked if Mr. Vance had reviewed this contract and Mr. Vance replied that he has reviewed it in general and will take another look at it when it is presented. Mr. Trauger commented that he does not see how we can lose in the savings. Motion carried 5-0. -15- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 Fire Department Personnel - Paramedic Program Mr. Cheney referred to having two paramedic vehicles and stated if we want to operate the two vehicles, we need to have additional positions - two EMT II or paramedics. With the current personnel situation, there is no way to guarantee operation of the two vehicles, one at each station. He sub- mitted information how we arrived at the number of men needed. He does have indication of the funding for the recommendation. He has submitted a report prepared by the Senior Paramedic Officer indicating the number of calls, number west of 1-95, number of times there are overlapping calls or situations or accidents which would require more than one paramedic. He wants to make it clear just because we have identified the number 'of calls on the west side of 1-95, this does not mean 1-95 is the proper boundary of service. Travel time studies can be done to see where the zone should be with two vehicles. He is recommending $13,700 be approved to transfer from the Contingency account to the Fire Department account. The cost of the additional three Firefighters/Paramedics is estimated to be $32,000 including salaries, uniforms, insurance, etc. He has also assumed the recommendation of the position of Training Officer for a total cost of personnel changes of $43,700. $23,000 is currently available in the Fire Depart- ment budget and an additional $10,000 in the Personnel account resulting from the normal turnover. Mr. Cheney stated he has also recommended a change and ex- plained how the paramedic officers are responsible for the medical parts of the program and with two vehicles, these requirements are increased. He thinks it is time we desig- nated one Paramedic Officer as the Supervisor of the program. His recommendation is to create a position of one Paramedic Officer II and three Paramedic Officers I and he explained the responsibilities for each. He anticipates that this offi- cer will not always work on the same shift, but will alternate his hours from shift to shift so he is working with all the shifts and can coordinate all the programs. He thinks it is important to have only one person responsible. Mrs. Riscoe referred to the position of Training Officer and asked if it was going to be disregarded completely~and Mr. Cheney replied negatively and explained that he is hoping MICA will identify the responsibilities of this position and a detailed training program for our City. Mrs. Riscoe re- ferred to approving this position in the budget and Mr. Cheney replied that at the moment, this position is not in the budget. We did allocate $20,000 and indicated we would take a look at the personnel needs and .decide how to spend the $20,000 based on the needs of the department. -16- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1,979 Mr. Trauger moved to accept the City Manager's plan for hiring three Paramedics with the designation of Paramedics I and II with the cost not to exceed $43,700 with the amount coming from Personnel and the Fire Department and transfer $13,700 from the Contingency account. Mr. Strnad seconded the motion. Under discussion, Mr. St~nad commented that he thinks this is a form of insurance. He would rather see us have more than needed than not enough. The way the City is growing to the west, he feels we will be in need of extra personnel for this job. Establish Additional Maintenance Man II Position in Public Works Mr. Cheney stated during the time of preparation of the 1980. budget, he had planned to request an added Maintenance Man II position and he believes during the budget deliberations he discussed this possibility. However, he did not include the position in the list of authorized personnel that was adopted by the City Council, even though it was his intention to do so. He now requests that the Council authorize this added position. The position will have two important cost saving responsibili- ties as follows: Regular maintenance and painting of the dumpsters used throughout the City. This will be done as a part of a planned preventive maintenance program aimed at extend- ing the lift of this equipment and keeping the dumpsters looking as acceptable as possible. -17- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 21, 1979 e Special assistance in the vehicle maintenance program in relation to tire inventory and control programs for City vehicles. Because tire replacement is a major ~ expense in our vehicle maintenance budget(S35,000), it is necessary to assure that we have an effective inven- tory program for tires, that we increase our own repair activities for ~es, and that we have a control program for tire replacement. He believes that a person spending half of his time in each of these activities will be well worth the investment. He does not propose an increase in the budget for this person, since he is confident there are adequate funds to cover the expenditure of this new position in the Public Works Personnel Account, result- ing from personnel turnover in the Department. Mr. Strnad stated he thinks the City Manager is going in the right direction here because we certainly do need to maintain these dumpsters better than they have been maintained. He moves to accept the City Manager's recommendation for this Maintenance Man II in Public Works, seconded by Mrs. Riscoe. No discussion. Motion carried 5-0. Report on Fair Share Ordinance (~Road Impact Fee) Mr. Vance referred to finally getting all the paperwork from the County protecting us on the Road Impact Ordinance and stated that we do now have the necessary paperwork if we J enforce the ordinance. Also, the County indicated they have forwarded an affidavit and requested each builder to sign saying while the road impact fee is presently being held in abeyance, they may be liable for it at a later date. Mr. Simon Ryder came before the Council and told about a radio program interviewing Commissioner Koehler and there was the indication he may change his mind. He told about public input being requested and he responded in favor of collecting the road impact fee since the developers have cooperated in Boynton Beach. A meeting will be held on Dec- ember 6 and there may be a change. Mr. Roberts added that only about three municipalities are involved in this road impact fee since most of the smaller municipalities have rejected it. It seems we are getting our roads widened with each large project and ~this may result in some others having second thoughts. -18- MINUTES - CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA ' NOVEMBER 21, 1979 Newly Developed Administrative Structure for Park Division of the Department of Recreation and Park Mr. Cheney referred to submitting an outline as to what is happening and Mayor Harmening added that the Parks Division has been combined with the Recreation Department and the report covers the re-organization. Mr. Cheney continued that a precise work schedule for maintenance of areas has been designated and when complaints are received from an area, we will try to stick to the schedule. The complaint will be noted and the person informed of the date when we will be in that area. We are going to try to save time by not jumping all over the place to respond'to complaints. He hopes this will be more efficient. Also, he proposes to come back soon with a recommendation to change the procedure of mowing private lots. He plans to do it on an overtime basis and charge, so it does not interfere with the maintenance schedule. Report on Drainage Maintenance Mr. Cheney stated there was nothing new to report. He submitted a summary of the meeting. He would like comment whether the summary is accurate. He hopes to come back with a program like we talked about in about four to six weeks. Report on Study by D.O.T. - Re: Parking on U. S. ~] Mr. Cheney referred to the report not really saying much from the State and stated he had hoped they would have made some recommendations. He plans to meet with the man who wrote the report to find out what is going on. Mr. Trauger suggested that the side be designated as a bike path and this would eliminate the parking. Mr. Strnad asked if photographs of the parking conditions on U. S. ~1 were presented and Mr. Cheney replied negatively as we anticipated they would come in and make an independent study. Mr. Strnad referred to the newspaper reporting that D.O.T. was supposed to be here last week to make a study and Mr. Cheney informed him that they did not come, but submitted this two page letter as their report. Mayor Harmening commented that it has been our experience for a long time in dealing with D.O.T. that we have to be firm. Howard Company because of problems with finish- ing the project. They have begun to move, but there are still additional holdbacks. He assumes the Council members are get- ting some complaints on the restoration and he would like to know where they are, so the money can be held back until the job is done right. Mrs. Riscoe referred to the amount of $712.50 under Item #7 and stated she is very glad we have come to a conclusion with this situation and hopes her name is not linked with it in any way, shape or form. Mr. Strnad moved to pay the bills, seconded by Mrs. Riscoe. Under discussion, Mr. Strnad asked if anybody checked into the people getting meals at the boat ramp and Mr. Cheney replied that it is his understanding that certification is done by County personnel. Mr. Strnad told about a person obtaining meals for a relative, when he could well afford them and Mr. Cheney informed him that a relative does not have to support an indigent member of his family. Request for Use of Public Address System Mr. Cheney stated he received a request today asking the Council to give permission for the use of a public address system throughout the City for election purposes for the period between now and December 4. Mrs. Riscoe asked if an hour was specified and Mr. Cheney replied negatively, that the time was left open, but the Council can stipulate this. Mr. Roberts stated it should be restricted to reasonable hours and to public highways and not private streets. Mayor Harmening referred to the Jaycees doing this previously and stated a large number of complaints were received. Mr. Cheney clarified that a group was not making this request, but it was made by an in- dividual candidate. Mr. Roberts asked if it was for one day and Mr. Cheney informed him it is for the entire period from now until election day. Mr. Roberts stated he would not vote for this as it should be restricted to a number of days and hours. Mrs. Riscoe stated she is not sure which candidate made this request, but it does not make any difference. In this particu- lar case, she does not think it will benefit the candidate. If there was a specific date, possibly she would consider it, but she will not go 'along with it at large. Mr. Ferrell stated that he made the request and wanted to go to shopping centers and on the highway, but now withdraws the request.
