Minutes 09-18-79MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, SEPTEMBER 18, 1979 AT 7:30 P.M. PRESENT Edward P. Harmening, Mayor Betty Riscoe, Vice Mayor David Roberts~ Councilman Walter T'Marty" Trauger~ Councilman Peter L. Cheney, City Manager Betty Boroni, Deputy City Clerk James W. Vance, City Attorney Mayor Harmening welcomed everyone and called the meeting to order at 7:30 P. M. He announced the Invocation tonight will be given by Reverend Douglas H. Smith, First United Presbyterian Church of Boynton Beach. Immediately following, the P~edge of Allegiance to the Flag will be led by City Manager Peter L. Cheney. He requested everyone to please rise. AGENDA APPROVAL Mr. Cheney stated he thinks it might be appropriate to give some report on the trash colleotion efforts through~t the City during the past couple weeks and he would like this added under Administra- tive. Mr. Roberts moved adoption of the agenda as corrected, seconded by Mrs. Riscoe. Motion married 4-0. ANNOUNCEMENTS Mayor Harmening annoe~eed that Councilman Norman Strnad is ill and unable to attend thin,meting tonight. Mayor Harmening announced that City Hall will be closed on Monday, October 8~ 1979, in observance of Columbus Day. MINUTES Regular City Council Meeting - September 4, 1979 Mr. Trauger moved adoption of the minutes of the Regular Meeting ~f the City Council of September 4, 1979~ as presented~ seconded by Mr. Roberts. Motion carried 3-0 with Mayor Harmening abstain- ing. PUBLIC AUDIENCE Presentation by Representative of Area Planning Board: Areawide Housing Opportunity Plan for Palm Beach County, 1979 Mr. Frank Brutt, Executive Director of the Area Planninc Board of Palm Beach County, referred to asking for a similar type of commit- ment approximately five years ago and stated it was for the City -to join with other communities in Palm Beach County for the Commun- ity Development Block Grant Program. If this is adopted by half of the municipalities in the County, it will enable the various municipalities to apply f~r additional funding from the Federal Government to assist in mvercoming some of the housing, drainage problems~ etc. He presented a letter basioa!!y identifying to some degree what the program is involved with. He has worked with the City Planner and met with the City Manager regarding the program. They have gained approval ~f ap- proximately eight to nine communities for this program. He then read the last paragraph of the letter identifying the general Areawide Housing ©~portunity Program. By passing a resolution in conjunction with numerous other oommunities~ the Citywill be eligible for additional funding. Mr. Trauger questioned how drainage fits into this program and Mr. B~tt replied that under the Community Development Block Grants, the funds are provided to improve housing stock and if there are drainage problems preventing building satisfactory housing, funds can be used to alleviate these drainage problems. He told about streets, utility systems, etc. being built. Mr. Roberts stated he doesn't believe there should be any objec- t-ion to this particular program. He has not heard anything detri- mental and this is a routine proeedure. Mayor Harmening added that the resolution is on the agenda. Mayor Harmening asked if anyone in the audience wanted to address the Council and received no response. He announced if anyone in the audience wanted to speak on a specific item on the agenda, if they will give their name to the Deputy City Clerk, when that item becomes the order of business they will be allowed to speak. BIDS Sara Sims Park Walkways Mr. Cheney stated that some time ago, we received bids for this walkway and it was concluded the prices were too high. The City Council authorized him to attempt to have this done by County contractors. He then read a recommendation from the Deputy City Engineer~ Bill Flushing: ~'There was a bid opening for the subject 'project on August 14, 1979. The only bidder was Hardrives with a bid of 615,313.60. This was considered too high and Council authorized action that would allowaa County contractor to do the job at the County con- tracted price. The wa!kways are not located in street~rights-of- way and do not fully meet all the requirements to be constructed at County prioes. Attached is a proposal from Lot Servioe indicating that they will do the job for ~9.06 a square yard o~ $9,800.00. They did not bid the job originally because of their work load at that time. Lot Service has reoently (April, 1979) completed a similar walkway for the City[s Barton Memomial Park (I-95 Strip Park). Lot Service eu~ently has a contract with the City ($9,500.00) to pro- vide muck (top soil) for Sara Sims Park. The spreading of the muc~ and the oonstruction of the walkways must be coordinated. German Paving (a minority contractor) requested specifications for the walkways but'when I oontacted FLr. German today he said he regretted to advise that he does not have the equipment to do the job.'? Mr. Cheney added that this price which we received from this contractor, who worked for us before, is below Hardrivets and the County bid. He recommends the contract be awarded to Lot Service. Mr. Trauger moved the City award the oontract for the Sara Sims Park wa!kways to Lot Service in the amount of $9~00. ~ Mrs. Risooe seconded the motion. No discussion. Motion carried 4-0. PUBLIC HEARING - 8:00 P. M. NONE SITE DEVELOPMENT PLANS Seaway Villas PUD - Construction of 21 Duplexes, Seacmest $ So E. 21st Avenue, Submitted by Felix Granados, Agent for Seaway Villas Mr. Felix Gran~dos, 315 S. E. 21st Avenue, requested approval of the site plan submitted and advised that it was approved by the Community Appearanoe Board last night. Mr. Annunziato displayed the plan and stated this is the last aotion needed bythe City Council. This was rezoned to PUD. It is located north of 21st Avenue and east of Seaorest Blvd. The plat has been approved and the bond posted. He explained the site plans for the oonstruotion of 21 units and recreation area. The Planning g Zoning Board and Community Appearance Board reviewed these plans and forwarded positive recommenda- tions. The Teoh~ioal Review Board made recommendation to ap- prove subject to the staff comments of Mr. Howell: 1. Show building setback dimensions from the propertylines, paved streets between buildings~ etc., for a check point when the Building Department reoeives tie-in ~urveys. 2. Must have approval from the Board of Health. 3. Water Management approval is essential. 4. Show elevations of a~aoent properties. 5. Show street elevations and proposed finish floor elevations. -3- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLOR/DA SEPTEMBER18, 1979 Mr. Annunziato continued that this information is on the plat and should be transferred to the site plan. This was on the agenda several wee~ ago and was deleted because it was not approved by the Community Appearance Board. The proper drawings were sub- mitted last night to the Community Appearance Board and approved. Mr. Roberts questioned the location of the entrance to this pro- ject and Mr. Annunziato pointed out it would be S. E. 1st Street extended. Mr. ~ance asked if the applicant was in agreement with the staff comments and Mr. Granados replied affirmatively.and stated he ~rill comply with them. Mr. Trauger made a motion that the Council approve the site plan for Seaway Villas PUD for 21 duplexes at Seacrest & S. E. 21st Avenue subject to the staff comments. Mr. Roberts seconded the motion. No discussion. Motion carried 4-0. HunterTs Run Golf & Racquet Club (Summit Associates) - Construction of Rail and Post Screen Wall at South Entrance Submitted by Paul Hyke!, Agent for Hunter's Run Mr. Annunziato showed the plan and pointed out that north of the entrance has been approved and this site plan is for the construe- tion of the rail fence lying south of the entrance road and west of Congress Avenue. It has been constructed. The staff did re- view this as did the Planning $ Zoning Board and Community Appear- ance Board with positive recommendations f~om all. Mayor Harmening commented that they have done an excellent job in landscaping and beautifying the south end of Congress Avenue. Mrs. Riscoe moved to accept the rail and post screen wall at the south entrance of Hunter's Run~ seconded by Mr. Roberts. No discussion. Motion carried 4-0. 1700 Development Corporation (Via Lago)- Construction of 66 Unit Condominium Complex~ including recreation facilities and dock, maximum height of 3 stories at 37 feet submitted by Tim Greene for the 1700 Development Corporation. Location: East of Bernard's Restaurant on Lake Street Mr. Annunziato advised this is a sensitive landscaped area consist- ing or,horticultural gardens behin~ Bernard~So The site plan pro- rides for an entrance off Lake Street and just east of Bernard's. He pointed out the loop road system. Every effort has been made to have the landscaping on the site memain~in~its o~iginal state. Attempts have been made to relocate trees in the way of the site plan to other sites. The applicant has provided for a decorative wall to be constr~ated for p~ivacy and it w-ill be landscaped on the inside of the wall. There was a slight problem regarding the termination of Lake Street and a vezs/ small amount of Lake Street -4- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLOP~IDA SEPTEMBER 18, 1979 will have to be extended and the south half of the right-of-way for Lake Street~wil! have to be dedicated. This will be p~ovided by.this site p!an inca plat to follow. He then explained the buildings varying inelevation not to exceed 37 feet. Mr. Tim Greene~ 466 N. E. 5th Avenue, Delray Beach, degeloper and agent for Via Lago, came before the Council. He referred to havinga four story 'plan drawn for 80 units, but advised it de- stroyed the site. Inre-eva!uating, they .cleared out vegetation choking out valuable vegetation. He explained how they~tried to carry,the theme of the restaurant throughout the whole project. He told about the various facilities planned. Mayor Harmening questioned if there was a projected price range and Mr. C~eene replied they would start around $1307000 to $140~000 with a size range from I~700 to 2~500 square feet with garage~ large decks and patios. Mr. Annunziato stated the net densityon the buildable land is approximately 8 units per acre. Mr. Roberts questioned how the 5.578 acres fit into the ptan and Mr. Annunziato replied the owners have the d~ed to the submerged land~ but no credit was given for that. Mr. Trauger asked if the ownership of the development corporation was the same as Bernard's and Mr. Green replied negatively and explained the 1700 Development Corporation will be the owners which is separate from the restaurant. Mayor Ha~meningreferred to there being several stipulations attached to this approval from the Engineering Department, Build- ing Department~ Utility Department, Police Depa~tment~ General Services Department~ Planning Department and Recreation Depart- mentand asked if he was familiar with all the stipulations. Mr. Greerereplied affirmativelyand stated they have clarified them to the approval of all agencies and they will abide byall staff comments. Mr. Trauqer moved approval of the site development planfor the 1700 Development Corporation for construction of a 66 unit condo- minium complex located easter Bernard, s Restauranton Lake Street, subject to aoeeptance of staff comments. Mrs. kiscoe seconded the motion. No discussion. Motioncarried 4-0. LEGAL Ordinances - 2nd Reading - Public Hearing Proposed Ordinance No. 79-28 - Re: Creating Codes Enforcement Board Mr. Vance read proposed Ordinance No. 79-28 by title on second reading. -5- MINUTES - REGULAR CITY COUNCIL MEETING BOI?~TON BEACH~ FLORIDA SEPTEMBER 18, 1979 Mayor Harmening asked if anyone in the audience wished to speak in favor of this ordinance and received the response that this is a fantastic ordinance. He then asked if anyone wanted to speak in opposition to this ordinance and reeeived no response. Mr. Roberts moved the adoption of Ordinance No. 79-28 on second and final reading~ seconded by Mrs. Riscoe. No discussion. Mrs. Boroni took a moll call vote on the motion as follows: Vice Mayor Risooe - Yes Counoilman Roberts - Aye Councilman Trauqer - Aye Mayor Harmening - Aye Motion carried 4-0. Mr. Cheney asked if it would be acceptable to put this on the agenda for the next meeting to make appointments to this Board and Mayor Harmening replied affirmatively. Mr. Roberts suggested that we obtain resumes f~om people interested. Mr. Tmauger suggested that names be submitted now to see how they sit with the Council. He would assume anyone recommending some- one would have some knowledge of their background or the recommen- dation would not be made. Mayor Harmening added if the appoint- ments are made now, the Board could ozxganize and study the ordi- nance and state law and be ready to act sooner. Mrs. Ri scoe agreed that we should proceed now. Mr. Roberts stated he will go along with the majority of the Council~ but he cannot vote for anyone until he knows who he is voting for. It is not difficult to send in a little resume. Mr. Roberts made a motion to wait until the next meeting and in the meantime let it be known that we will accept resumes for the membership on this Board. Mayor Harmening ascertained there was no second to this motion. Mayor Harmening suggested making the appointments since the ordi- nance will go into effect on October 1. Mr. Vance informed the Council that an appointment could not be made to a Board which does not exist until the ordinance goes into effect. Mr. Tmauger asked if names could be suggested now so the Council, audience and City could look at'these people and if there are additional names, they can be acted upon. Mr. Vance replied the Council can certainly present for consideration, comment or evaluation names in an informal manner at this time if they desire. However~ to actually get to the appointing stage, we will have to wait until October 1 or immediately thereafter. Mayor Harmening suggested putting this on the agenda for the next meeting with the appointments to be made effective immed- iately. Mrs. Riseoe stated she is open for suggestions and would like to hear those which Mr. Trauger has in minds -6- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 18~ 1979 Mr. Trauger stated he was going to propose part of a panel of people in Boynton Beach who he thinks have outstanding qualifica- tions~ ability and experience in the City. We have a backlog of many,cases that have been ~gnored. He thenproposed the follow- ing: Mr. George Davis, an architeet who has semved on the Board of Adjustment. He has been supportive of the Boards and has assisted the Boards. He is a member of the Rotary. Mr. Riek Rossi, an engineer who has lived and worked in Boynton Beach. He was a member of the Planning g Zoning Board and Building Board of Adjustments g Appeals. He has done considerable work in development in many areas. Mr. Foy Ward, a qeneral contractor, who has great experience with codes, knowledge of codes, etc. He also served on the Board of Adjustment as Chairman far several years. Mr. Dick Lambert, a realtor, who has had experience with the Planning & Zoning Board, President of the Chamber of Commeree, and has worked long and hard for the City. Mr. Roberts stated that he has another list which he will present at the next meeting. ~&yor Harmening agreed this was a good cross section suggested by Mr. Trauger with most of these people having served on Boards previously. He suggests these be looked into and discussed at the next meeting. A gentleman from the audience referred to a lawyer being mentioned for this Board and Mr, Trauger replied this ordinanee provides for the service of an attorney for the Board. Ordinanees- 1st Reading Proposed Ordinance No. 79-29 - Re: Use of Fedgral keyenue Sha~ing Fund, 1978-79 Mr. Vance stated this is an emergency ordinanee sinee it relates to the use of Federal Revenue SharingsFunds prior to our next budget year. He then read proposed Ordinance No. 79-29 in its entirety. Mayor Harmen±nq asked if anyone would like to speak in opposition ~ this proposed ordinance and reeeived no response. Resolutions Proposed Resolution No. 79-JJ - Re: Approving Areawide Housing Opportunity Plan for Palm Beach County Mr. Vance read proposed Resolution No. 79-JJ by title. Mayor Harmening added that this implements and puts into effect the Areawide Housing Opportunity Plan which Mr. Brutt spoke about. Mr. Trauger moved to adopt Resolution No. 79-JJ, a resolution approving the Areawide Housing Opportunity Plan for Boynton Beach as a portion of Palm Beach County. Mr. Roberts seconded the motion. Hnder discussion, Mayor Harmening commented that these are the kind of things~ere tax monies go and the reason our Pederal Income Tax is as high as it is. It is more money for low cost housing. Mrs. Boroni then took a ~oll call vote on the motion as follows: Vice Mayor Riscoe - Aye Councilman Trauger - Aye Councilman Roberts - Aye Mayor Harmening - Aye Motion carried 4-0. Other City Attorney Report on Council Confirmation of Department Head Appointments Mr. Vance referred to submitting a memo whichis self-explanatory. Mr. Roberts referred to the suggestion to-repeal Sections 60 and 69 and questioned if the same would apply for Section 617 Mr. Vance replied that it would appear at the very least Section 61 should be revised and updated. Mr. Roberts stated he would like to see an ordinance to eliminate Sections 60 and 69 and to make a recommendation on Section 61 if necessary. He would also like discussion on Section 49. -8- MINUTES - REGHLAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 18, 1979 Mrs. Riscoe stated if we are going to start repealing and clarifi- cation, why don't we appoint a Charter Revision Board? If we start on one~ there is no stopping. Mr. Roberts replied that ~we have had a Charter Revision Board previously, but with Home Rule every time we run into something it is just as easy to remove or amend it. For a Board to read through all these documents is quite a shore. Mr. Vance added that he has been dealing in this area for 11 years and has seen several Charter Revision Boards come and go. He has also seen a couple situations where an individual is hired, retained and directed to redraft the Charter and thenmake a presentation to ~ Charter Revision Board. This appears to be helpful. Mr. Trauger stated that he agrees with Mr. Vance. As Chairman of the old Charter Revision Committee, he knows they spent six months to determinewhich ares to attack first. Many points of view entered into it ~and they were about a year coming up with the first part of the dodument and then changes had to be made. Then Home Rule came in and the City Couneil did not even piok up the good part !e~t. He agrees with Mr. Vance that we should appoint someone to weed this out and then have a Charter Review Committee sound it out v~th the publio. Mayor Harmeninc stated it seems like when you have a Charter Revision Committee, it takes a long time and then assuming they do come up with a ~inished product they are able to pre- sent to the City Counei!, the Council goes through the whole thing and may or may not agree with it. In the end, it still ~alts on the Council to make the changes. Ultimately the simptest~ quickest and most feasible way-is for the Council to revise portions of the Charter as they come to our atten- t-ion. If any member of Council finds a certain section to be particularly incongrmous to the present philosophy of govern- ment~ he sees no reason why that member of the City Council marmot put it on the agenda for discussion of that particular eeotion and if it is decided to ~mend it~ the attorney man be instructed to prepare the appropriate ordinance. Mayor Harmening then re~erred to the philosophy of government and explained how there were different shades of the City Manager form of government. Mr. Cheney stated that his main interest is clarity of what the existing Charter says. With our operation, a tremendous number of things by habit and procedure come to the City Counoil for the ultimate demision which he thinks is very proper~~' He ex- plained how many things in the day-to-day operation are handled administratively. However, the one question which came up is. the question of confirmation of department heads and what that means. Sections 60 and 69 have to do with the Police and Fire Departments and probably ean be removed. The City Council/ City Manager system works in a variety of ways. It must be clear whieh,way it works especially when it comes to department -9- MIbE1TES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 18, 1979 head appointment confirmation. The Planning Director was done by this method, but none have been appointed since that time. Mayor Harmening stated the Council actually has the final word 'hhrough a formal eor~irmationprocedure. However, if any City Manager appointed a Department Head, who the majority of the members of the Council felt was unqu~lified~ he thinks there would be enough expression that the City Manager would reconsider. There is a cheek and balance without formal proceedings. Mr. Cheney agreed and added there has to be abi!ity on the part'of the City Manager regarding the kind of person to appoint who will be sup- ported by the existing City Council. However~ there are problems and questions relative to the confirmation process. There is some common sense built in to p~otect us. His experience in the past hasbeen the Council did not~confirm~ but the Department Heads he appointed are still there and seem to be accepted by the City Council. It should be clarified some way. Mayor Harmening requested expressions on this and Mr. Roberts replied that he will go along with it if the City Manager feels it should be eliminated. However, the only restriction he would like to see is before anyone is appointed, the City Council be aware of it, so if they have any information, they could so state. Mr. Trauger questioned the difference between getting prior approval om approval after an appointment is made and Mr. Roberts replied that he did not say anything about approving or disapproving, but just for the name to be mentioned. If there is no objection, then the appointment can be made. It would not go formally before the Council. Mr. Cheney stated he could not imagine a City Manager appointing a local person w~thout checking him out very well as far as character, background, etc. Many people, including the Council, would be included to obtain that information. Mr. Roberts referred to not being prepared to move on this and suggested putting it on the table. Mr. Trauger suggested get- ting~clarification where Sections 60, 61 and 69 fit into the pattern. Mr. Vance informed him it would appear Sections 60, 61 and 69 were adopted in 1947 when the Charter was revised by special act.i£.When Section 49 was adopted by the City Commis- sion in 1976, it would appear it was adopted without being com- pared to the portions of the Charter already existing. Mr. Cheney clarified that two ordinances were passed the same night. One clearly identified the roles of the City Manager in a pre- cise way and the other put in Section 49. Two major conflict- ing ordinances were passed in October 1976. Mrs. Ris¢oe moved to have the City Attorney draw up an ordinance to repeal Sections 60, 61 and 69 of the existing Charter and table Section 49 for ~urther discussion. Mr. Trauger seconded the motion. Mr. Roberts referred to separating the two and Mr. Vance advised that it deals with a multiplicity of topics in his memo and it is proper to address all the items in the memo. Motion carried 4-0. -10- MINUTES - REGULAR CITY COt[~CIL MEETING BOYNTON BEACH: FLORIDA SEPTEMBER 18, 1979 OLD BUSINESS Report on Drainage Canals - Golfview Harbor Mr. Cheney referred to the last meeting when Mr. Edgar Lewis~ a resident of Go!fview Harbor, asked for information concerning the ownership and maintenance responsibilities of the canals through- out the City,and speeif/cal!y the canal to the rear of his house and advised all the oanals in Gotfview Harbor and probably most of the canals throughout-the City are dedicated ~to the perpetual use of the public for prgper purposes~'. This particular canal has a right-of-way of 80 feet and the plat indicates the width of water of 60 feet ~. The actual width of the water in the canal at this location is approximately 54 feet. Currently the Cityattempts to re~u!ar!y ~nspect canals for excess grgwth of vegetation~ and through a sp~ng operation.and the use of a speeial pellet material the City endeavors to curb the vegetation. The City does not maintain all canals withre~ard to removal of debris~ nor does the City carry outa dredging program. The City staff is ~orking with the Golfview Ha~h0r' subdivision deve- loper in regard to the head wall at the end of the canal at S. W. 14th Avenue and is hoping the developer will provide us with either an a~gine~ring certification relative to the present construction of the head wall or an acceptafole design for recon- struction of this facility. We have discussed this matter with the developer and his attorney~and hope we will be able to make some meaningful progress in this matter soon. Mr. Edgar Lewis thanked the City Manager for this report, but stated it does not answer some of his questions. He assumes when they say the canals are dedicated to public use~ this means they belong to the oitizens of Boynton Beach. Mayor Harmening replied that ~u~te a few of the canals in ~town are not dedicated to public use. Mr. Lewis referred to maintenance~and Mr. Cheney indicating a minimum maintenance program and showed pictures to the Council taken in 1977 and stated the situation is the same this year. Also~ is the developer going to res~re or ~eing asked to restore the end of the canal? If this is done, who takes care of main- tenance after that point? Mr. Cheney replied that he would as- sume maintenance of this canal after that point-would be similar with spraying and removal of debris. Mayor Harmening added that another ~actor affecting the canals is the amount of water and explained. Mr. Cheney explained how there had been a problem at this particular location due to construction and the water shortage. MINUTES -REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA SEPTEMBER 18, 1979 Mayor Harmening~ asked if the developer has made any commitment regarding restoring the head wall and Mr. Cheney replied that he has not made such a commitment but has employed an additional designer to work with the City. We do have a bond which we have discussed with the.attorney. At one point~ we were led to under- stand the engineer wrote a letter eertifTing construction, but we have not seen that letter. We have been pmomised there will be designs to restructure that head wall. Some of the material has been taken out by the developer. Mayor Harmening stated one reason in the past the Couneit has been reluctant to address canals is because of private canals. if we spend a lot of money on public canals, we would be expected to spend some on private eanats. In addition, there are certain covenants where the homeowners association has agreed to maintain the canals. Mr. Lewis asked if this was true in this ease and Mayor Ha~mening replied that he did not know. Mr. Vance added that he has not reviewed the plat or dacumentation .associated with it. Discussion ensued comparing the use of easements and canals by the public. Mr. Cheney then summarized that he will report when there is progress and will meet with Mr. Lewis. 55 Acre Recreational Area Access Road Mr. Cheney referred to having been in discussion with the deve- loper, but-advised there is no ~urther development on this to- night. NEW BUSINESS NONE ADMINISTRATIVE Report from City Manager Re: .TraSh Qglleq~%gn ~E~gMt~ Fo~0wing Storm Mr. Cheney referred to the trashbeing around the City during the past two weeks and stated that normallyina period of nine work- ing days, we would have picked up approximately 90 truck loads of trash. In the past nine working days plus two Saturdays and one Sunday, we have picked up 296loads of trash. Approximately 1,000 mardaours have been worked in that period of time which includes wor~kinglonger thanthe normal time each dayas well as the weekends. We are finally getting towards the end of the route and reached Golfview Harbor today. We have been workingand try- ing to get on top of this situation. -12- MINUTES - REGULAR CiTY COUNCIL MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 18, 1979 A woman told about no collection being made in the north end and Mr. Cheney-informed her on the day following the hurriaane~ 16 loads of trash were picked up in the north end and this is where the trucks started. After further discussion, Mayor Harmening assured everyone that all the trash will be shortly taken mare of. Replacement to Building Board of Adjustment S Appeals (Tabled) Mayor Hammening ascertained there were no nominations for this appointment ~and l~rs. Motion.carried 4-0, Status Report - Bass Creek Development Mr. Cheney referred to being asked by two members of the Council to indicate where the Bass Creek project stands and advised there has been some slowdown in this development because of financial reasons. He has been told by the developer that he has obtained additional financing and within two to three weeks, they will be workinc again. We do have a valid performance bond for the pro- jeer of over $400,000. Status Report - DRI Application, Motorola Mr. Cheney stated at the last Planning & Zoning Board meeting, a brief discussion was presented on two subjeets~ the DRi process~ development of regional impact mandated by the State~ and tied it into the possibi!ity of the first DRI project-which might be Motorola. The name of Motorola has been around the community for some time with not knowing what is going to happen. There is no application from Motorola. However, it was made clear two or three meetings ago that Motorola was making application to buy in the City because Riteeo requested an extension based on Motorola indicating purchase. He knows Motorola is making application for the DRI process and is working with the Treasure Coast Regional Planning Agency. He wanted a presentation made to point out where the Planning & Zoning Board and City agencies fit into the DRI process. Mr. Annunziato will explain the flow chart. We have tried to identify ~all the steps which have to be taken in the DRI process as to where the City agencies and staff fit into the operation~ so we know everystep is made and hopefully nobody ends up being forgotten and has to make a sudden decision. This chart suggests the number of steps involved and the responsibility. The Planning & Zoning Board and City Council will have animportant role. -13- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA SEPTEFiBER 18, 1979 Mr. Annunziato stated a development of this nature will be a development of regional impact because of certain thresholds a development of that size encounters with exceeding parking and square footage. Review i~ required by the Treasure Coast R~t gional Planning Council. They must eonduet a hearing on DRI and make recommendations to the local government prior to the City Council enacting any,kind of development order. He then f~mlty explained the potential classifications and procedures that a development of this nature would entail. He also explained the steps to be taken by the Planning g Zoning Board, City Council, Community Appearance Board~ Technical Review Boaz~ and T~easure Coast Regional Planning Council. He explained how if all the information 'was submitted as required, a development order eould be approved and issued by January 2, 1980. Mr. Vance added that Mr. Annunziato has cut all the excess time out of this flow chart. This is based upon the applicant f~r- nishing the materials within the time frame outlined. M~. Annunziato added this was a helpfn~l educational exerei~e for the staff. Mr. Cheney added that he thinks we will have here an interesting opportunity to see if the coneern of the environment and concerns about development can actually work together in this particular type of development. Mr. Trauger asked if a copy of this chart had been given to Motorola and Mr. Cheney replied that they are aware of this process. Mayor Harmening added that Motorola is working to meet various time frames. Consider Request of Metric Taxi for Adjustment of Rates Mr. Giocomo Mazze~, 435 So E. 1st Avenue, Delray Beaeh~ and owner of Metric Taxi came before the Council. He stated he was unable to attend the meeting two weeks ago beeause he was not notified. He believes the rates of $1o00 for ~ mile and 20¢ per % mi!e thereafter were approved. He requested $!.00 for 1/5 mile and 20¢ per 1/5 mile thereafter, which would be $1.00 per mile. Due to increased costs, he needs these extra revenues to stay in business. Also, Delray Beach deregulated them and they ean eharge whatever they want. They intend to stay within the requested rates. Mr. Trauger questioned the origin of the ordinance passed at the last meeting and Mr. Cheney replied that it was at the request of Mr. Mazzeo. Mr. Trauger stated since we just did this a couple weeks aqo~ he would like to ask M~. Mazzeo to test this rate and see how it does. Mr. Mazzeo stated he was not noti- fied when the original ordinance was adopted. Mr. Trauger informed him that it was his company which made this request. Mms. Riseoe stated sinee we just appmoved this ordinance, she thinks it should ride until given a fair chance. MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA SEPTEMBBR 18, 1979 Consider Request of Center for Group Counseling for Financial Support Mayor Harmening referred to this request being submitted by letter with backup mater~ia! and Mr. Roberts added that he also saw an artie!e in the paper in regard to this. Mrs. Mack, representing the Center for Group Counseling, came before the Council and stated she was present to answer any questions. Mayor Harmening stated the budget was passed at the last meeting and no money was ineluded for support of 'a group like this. Mrs. Mack replied that she understands budget problems, but also understands that there are some contingency funds. They have been serving Boynton Beach 1since they opened in 1973. They would like to eontinue servic~_~g people and expand with a new ward. They transport as well as come to homes. Mayor Harmening questioned the amount of their annual budget and Mrs. Mack replied that it was $52~ 000 last year and $707000 this year. Mayor Harmening referred to the request being for $4,000 from Boynton Beach and stated this seemed to be more than the 4% mentioned. Mrs. Mack replied that they hope to project into more numbers and service hours. Mayor Harmeoing asked if at the present time any of the cities to the south ~fund this and Mrs. Mack replied that Boca Raton is, but Delray Beach is not. Mr. Trauger questioned their source of funds and Mrs. Mack explained they have various fund raisings. Mr. Trauger asked if there was any part f~om the CETA p~oject and Mrs. Mack replied negatively and advised they have a volunteer force. Mr. Roberts asked if we had donated previously-and Mrs. Mack replied negatively. Mr. Roberts stated many organizations are funded by private sources or federal sources and when they run short of money, they approach the City Council. If all these groups came to the City Council and we funded them all, we would be broke in the first month. Also, we cut down on the drug program donation. He would like to see it funded~ but doesn't think we are in a posit-ion to. Mrs. Riscoe added-that we just recently rejected a request from the Y.M.C.A. Mr. Trauger recommended thanking this Center for their group counseling, the service they have done for Boynton Beach and the 14 patients they have served, but we are not ~in a position at this time to grant any funds. They should consider making a request next year prior to budget time. He recommends that' we cannot fund it at this time. Mayor Harmening agreed. Mrs. Mack thanked the Council and advised they will be here next year at budget time. -15- MINUTES- REGULAR CITY COHNCIL MEETING BOyNTON BEACH, FLORIDA SEPTEMBER 18, 1979 Consider Change in Telephone System Mr. Cheney referred to there being some reluctance at budget time to proceed with an updated telephone system~ butstated as his memo indicates, we have received information that the Bell system has rate increases pending on this particular kind of equipment which may or may not go into effect by November 1. He thought it mandatory to bring this to the Counc±l~s attention before it hap- pens. If they want to give this system consideration, a presenta- tion aah be made by the telephone company~at the next 'meeting to explain the system and we will still have time to proceed before the Novenfoer 1 deadline. He still recommends we do it at ~some point, but the Coumei! may want to hear more ab, out it. Mr. Trauger made a motion to have the presentation and see what this is. Mrs. Riscoe referred to approving ~5C,000 for this~ but we did talk about trying to spread it over two years. Mr. T~augersmuggested that the presentation be made and consideration be given to spreading the cost over two fiseaI years. Mr. Cheney advised that he will arrange for the presentation at the next meeting. Authorizing Execution of Agreement - Riviera Beach Library Mayor Harmening referred to a proposed agreement being submitted to be executed between Boynton Beach and Riviera Beach which will provide for free public library services for library card holders between the two cities and stated this agreement is similar to others that the City has had. It is recommended the City Council approve the agreement. Sueh~approval is consistent with present City policy relative to cooperation between municipal librariesl He certainly is not in any way against this proposal~ but does not see how we would have much traffic between the Riviera Beach Library and our library.. He cannot see how it would be benefi- cial for either one. Mr. Cheney agreed but advised this is to have a working relationship between the libraries so they can share and work together. Mr, T~auger added that they might have vTa!umes in their library which we can use as reference. Mr. Cheney informed the Council that he received word today from the Assistant County Administrator that the Board of County Com- missioners directed the County staff to work on library funding, but he is not sure of the details. Motion car- ried 4-0. -16- MINI1TES -REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLOP~IDA SEPTEMBER 18, 1979 City ManagerTs Recommendation for Compensation for Classified City Employees, F/Y 1980 Mr. Cheney stated he had hoped to have all this packaged together for the Council tonight ~with a proposed resolution, proposed salary sea!es, etc., but he has a variety of reasons that it is not ready. He had also hoped to have the union contract, but that is not ready yet either although there is a speeia! meeting being called with the fire union this Friday evening. By the next meeting~ he is confident he will have the complete package for the CouncilTs review. He suggests considering this as a progress report with action being tabled until the next meeting. Mr. Trauger moved to table action on compensation for classified City employees until the next meeting~ seeonded by Mr. Roberts. Motion carried 4-0. Budget Transfer Requests Contingency Fund - Bus Benches Mr. Cheney referred to the City Council authorizing the purchase of twelve benches at the last meeting and stated this is the bud- get transfer to cover that purchase. Also he has had one or two requests from citizens for alternate locations which he is hold- ing until the benches come and he will come back with a list for the Council's review then. Mrs. Riscoe moved to authorize the budget transfer for the bus benches in the amount of $1,200 from the contingency fund. Mr. Trauger seconded the motion. No discussion. Motion carried 4-0. CityManager's 'Depar~me~ Mr. Cheneyadvised that this request includes a number of items and confirms action which the Council has previously takenand addresses those in a poht of view of transfer before the end of the fiscal year. Mr. Trauger stated this is a very interesting document. It shows inflation has takena heavy impact against the e~onomy and the amount of money it takes. We have grown and added more ser- vice but the cost of growth has been quite ~ pyramid going up. It is amazing to see what it is from 1971 to what it ±s today. Mr. Cheney.stated we must compare this with not only t±me and inflation, but we have doubled population. Mayor Harmening commented that he can tell from the licensing permits in the Building Department when construction has been up and down. Mr. Cheney pointed out also that even though property taxes have gone up~ they have still maintained a reasonable relationship to the total budget.
