MINUTES OF THE REGULAR CITY COUNCIL MEETING HELD AT CITY HALL~ BOYNTON BEACH, FLORIDA, TUESDAY, MARCH 20~ 1979 AT 7:30 P. M. PRESENT Edward'F. Harmening~ Mayor Betty Riseoe, Viee Mayor David Roberts~ Counoilman Norman F. Strnad, Councilman Annette P. Tinker, Acting City Manager Tereesa Padgett, City Clerk James W. Vanee, City Attorney Mayor Harmeninq welcomed everyone and called the meetin~ to order at 7:30 P. M. He announced the Invocation tonight will be by Father A1 Victor, St. Mark's Catholic Church and after the Invoca- tion, we will have the Pledge of Allegiance to the Flag led by Mr. James W, Vance, City Attorney. He requested evgryone to please rise. AGENDA APPROVAL Mayor Harmening ascertained there were no additions, deletions, or eorrections to the agenda. Mr. Roberts moved the aceeptanee of the agenda as prepared~ seconded by, Mr. Strnad. Motion car- ried 4-0, ANNOUNCEMENTS Mayor Harmening read a Proclamation pmoclaiming the week of April 1 through April ~, 1979~ as National Library Week. Mayor Harmening read a Proelamation proclaiming the month of April, 1979~ as Local History Month. MINUTES Regular City Council Meeting - March 6, 1979 Mr. Roberts stated he would like to clarify the next to last para- graph on Page 30 in referenee to appointing a "stranger'T into this office. First~ he was misquoted afterwards saying a stranger mn town~ which he didn't. Perhaps a stranger would not mean anyone eoming into Boynton. He is well acquainted with the nominee for the City CounCil and his baekground and possibly he should have said a newcomer to the political arena. He was a stranger in that he had not indicated his desire to run for Council. Mrs. Riscoe moved to accept the minutes as oorreeted, seconded by Mr. Strnad. No discussion. Motion carried 4-0. PUBLIC AUDIENCE Mayor Harmening announced that anyone who desires to address the Council on Rnything may do so at this time. He added that anyone who wanted to speak on any item on the agenda to please give their name to the City Clerk and they will be called upon when that item comes forward. MINUTES - REGULAR CITY COUNCIL MEETING MARCH 207 1979 BOYNTON BEACH, FLOP~DA Mr. Gene Moore, 640 East Ocean Avenue~ Attorney representing Melric~ Inc. came before the Council and referred to the appli- cation submitted by his client for PUD rezoning at the last Council meeting and explained that the items preceding it were lengthy and his applicant failed to bring to the City Council's attention the full scope of the application. He referred to the applicant having left out many material facts due to the time con- sumed for the other public hearings and he believes Mr. Strnad made a motion to deny the application based on a petition pre- sented with 25 names in opposition; however, a petition was handed to the City Clerk w~th 35 names in support of the peti- tion. The Planning $ Zoning Board and Technical Review Board recommended approval and it was not fully presented to the Coun- cil. The owner of the property was not given the opportunity to make concessions on the plan to meet the objectives. He ex- plained how the owner would be willing to consider concessions regarding the number of units and the location of a road. In regard to putting in a 12 lot subdivision, there was incomplete information presented to the Council. He requests that this matter be reconsidered. He requests the matter to be re-adver- tised and the applicant be given the opportunity to present the full facts on this ease. He would like the Council to be given the full opportunity to have the facts presented.. Mr. Vance advised that a motion to reconsider would have to be made by a member of the prevailing side. If a motion is made, then the next step would be to table it pending re-advertising. Mr. Strnad stated if the original objectors to this particular change would come forth and no longer have any objection, he would move~ but until the time he sees all these people who have objected have changed their minds~ he would not move. Mayor Harmening informed him that this would not be the time to bring forth any people in favor or against~ but the time for a motion to reconsider followed by re-advertising. Mr. Vance added that a motion to reconsider must be made at this meeting if at all. Mr. Strnad again referred to hearing fmom the people who objected and stated he did not want to go through this again if the people still object. Mayor Harmening stated if there were material facts that were not presented at the previous hearing, it might be equitable to allow another presentation. Mrs. Riscoe referred to attending the Planning L Zoning Board hearings with the people in the area objecting and stated the matters on the Council agenda at ~he ~ast meeting did not involve them and had no bearing on this matter. At this particular time, ~s one who rejected the plan, she still maintains the people want single family dwellings and she will not rescind the situation. Mayor Harmening stated that hearing no motion fmom the members of the prevailing side, we will proceed. -2- MINVlTES - REGULAR CITY COUNCIL MEETING MARCH 20, 1979 BOYNTON BEACH, FLORIDA Mr. Frank Kohl, 943 Isle Road, referred to this being the first time he has been up to this podium since January 2 and re~rets having to waste their valuable time. He had prepared his talk prior to the article in the Sun Sentinel this morning. After ~a~ding the article, he had to change it somewhat. Until read- ing Tim Tueker?s article in the Post last week regarding permits for his home~ he did not know what all this was regarding a hullabaloo regarding his home. Then, he saw the name Villa and recognized this as the name he bought his property from, He had this matter clarified in a couple minutes at the City Clerk's office. He explained that permits go from the Building Depart- ment to the City Clerk's office and if a change has not been received from the County Tax Office~ the owner's name is crossed out and the original name noted, He ~owed a' copy of this permit. He then thanked Mr, Robin Scott of the Sun Sentinel, an excellent journalist, who ealted him and did a thorough investigation. He did tell him that he planned to attend this meeting whether the story was written or not. At this time~ he would like to thank Councilman Norman Strnad for stating in the Sun Sentinel News~ paper that he is satisfied and nothing improper was done when a building permit was issued to Frank Kohl, Mr. Kohl then referred to the Mayor and City Council having sworn to support~ protect and defend the government of the City of Boynton Beach and explained that the public employees and Council are here to serve every citizen in Boynton Beach, The people are to be served equally. The Council and employees should be working together to serve the people equally. Personalities, likes and dislikes should not enter the picture. The undermining of depart- ment heads by disgruntled employees encouraged by the Council members and Interim City Manager should stop. The innuendoes about individuals that have been stated by Council members and the Interim City Manager~ Annette Tinker~ such as in the ease of Denver Baxter~ Frank Kohl, and Boynton Wrecker Service, should be dropped like a hot potato. The records should be checked before statements are made, gather the facts and .have everything substantiated. There has been nothing but bad reports for the City during the past few months. The residents and taxpayers are en~it!ed to something better than that, In line with this, The Post stated he said this is a lousy City and he apologizes as this is a good City. He meant to say the Cityadministration, but will even take that back and will not say anything, BIDS One (!) Reader/Printer (Library) Mrs. Tinker informed the Council that bids on the above were opened on Tuesday, March !3, 1979~ at 3:00 P. M. in the office of Mr. William H. Sullivan, our Purchasing Agent. The Tabula- tion Committee recommends acceptance of the low bid received -3- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MARCH 20, 1979 from Bell & Howell Company in the amount of $1,349.00. A copy of the Tabulation Sheet and Proposal signed by Mr, James P. Wade~ Salesman at Bell L Howell Company~ have been submitted. Also~ the affidavit was received and cop~es were distributed to the Counei!. She has eheeked all other requirements and finds everything to be in order. Funds for the above purchase are budgeted and available in the Library Department Account No. 001-711-57!-60-77. Mrs. Riseoe moved to accept the bid proposed by Mr. Sullivants office to Bell S Howell Company~ seconded by Mr. Strnad. No discussion. Motion carried 4-0. PUBLIC HEARING NONE SITE DEVELOPMENT PLANS Applicant: Location: Use: John Sheppard for Sage-N- Sand Motel, Ine. 1935 South Federal Highway Construction of 24 Additional Units at the Existing Motel Facility Mr. John Sheppard came before the Council and advised that he has 54 units presently and would like to add 24 additional units, shuffleboard courts and tennis courts. Mayor Harmeo-ing advised the Planninc $ Zoning Board at their regular meeting of March 1979, unanimously recommended the site plans submitted by John Sheppard for the Sa~geN-Sand Motel~ Inc. to construct 24 addi- tional motel ur~ts, subject to the recommendations from the Building Department and Engineering Department. Mr. Vance asked if the staff recommendations are acceptable and Mr. Sheppard replied affirmatively. Mr. Strnad ~ef~x~ad~lD bein~ in need of more rental rooms in the City and moved to grant ~his request subject to staff recommenda- tions~ seconded by Mr. Roberts. No discussion. Motion carried 4-0. Mr, Annunziato read the recommendations from the staff: Engineering Department requires details and ~awings rom paving and drainage struetures~ 3~? of rainfall to be contained on site, minimum parking lot grade to be .5%~ and parking !or he be eon- strueted witha minimum of 6" crushed rock and 1~ asphaltic concrete. -4- MIK~/TES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MARCH 207 1979 The Utility Department has requested that no trees be planted in the rear easement, The Building Department has determined that a 6" minimum slope on asphalt parking area is required to top of catch basins and if not permitted by March 15~ 1979, this must meet the energy code. The Police Department has noted that outside lighting is required. The Public Works Department has noted to substitute garbage cans for dumpster. The Planning Department has noted to dedicate the utility easements. Mayor Harmening asked Mrs. Galainena~ if this was satisfactory and Mrs. Galainena replied affirmatively. Mrs. Riscoe moved to accept this site development plan with the staff recommendations, seconded by Mr. Roberts. No discussion. Motion carried ~-0. Applicant: Cha~_Tes J. Simon Mrs. Padgett advised that Mr. Roy Simon informed her today that he has a meeting in De!ray Beach and may be a little late and asked if the Council could proceed with the next one and come back to this. Mayor Harmening replied affirmatively. Applicant: Location: Use: Cha~es L. Leemon~ III Southeast Corner of 1-95 and N.W. 2nd Avenue Construction of Holiday Inn Motel, Accessory Commercial Building~ Pool and Parking Area Mrs. Tinker advised that Mr. Annunziato informed her this morning that this applicant failed to appear at the Community Appearance Board meeting last night~ therefore~ it is not ready to go before the Council. Mr. Roberts replied that he did not know why the Planning $ Zoning Board reviewed this because it is in litigation. He does not think a vote or action would be proper while in liti- gation. Mr. Vance clarified that the City has' been sued by a grouppof neighbors in the a~ea contesting the ~alidTty of the zoning. No injunction was entered and Holiday Inn was not part of the suit. If Holiday Inn~ which has the appropriate zoning, desires to take the chance and go ahead and comply with City requirements and proceed~ that is their prerogative at their risk. Mr. Roberts asked if any action we may take will affect this case and Mr. Vance replied that we have no choice but to act on the basis of the existing zoDing since no injunction has been issued. Mr. Roberts stated in-view of this information~ he move~ to table this. Mro Vance informed him that actually the matter has not completed the administrative steps~ so really isntt before the Council. Mrs. Padgett took a rol! call vote on the motion as follows: Councilman Strnad - Aye ~ce Mayor Riscoe - Aye Councilman Roberts - Aye Mayor Harmen/ng - Aye Motion carried 4-0. -6- ~LINUTES - REGULAR CITY COUNCIL MEEI~ING BOYNTON BEACH, FLORIDA Ordinances - 1st Reading Pmoposed Ordinance No. 79-12 - Re: Amending Ordinance No. 78-34 Provide for an Amended Estimate of Revenue and Expenses for the Fiscal Year Ending September 30, 1979 MARCH 20~ 1979 to Mr. Vance referred to Section 3 of this proposed ordinance and amended the sentence to read: "That this Ordinance shall become effective immediately upon its passage." with the remainder of the sentence stricken. Mr. Roberts stated he would like to ask., some questions about a few items included with this ordinance. The top item notes some new help to be hired for the Occupational Lioense Depart- ment and he would like information on the action for this. Mrs. Tinker informed him that a CEE student was requested ~o the Occupational License Department could be covered during lunch hours and break. Also~ during the past few months, there ha~e been problems havin? someone relieve the switchboard and we do not have one person to train at the switchboard or assist down- stairs. Mr. Roberts clarified that this studer~would perform several duties and not just work in the License Department and Mrs. Tinker agreed. Mr. Roberts referred to the Fire Department and stated he read an article in the newspaper regarding some problem with emel~ geney vehicles and stated this is not included for the Fire Department. Mrs. Tinker replied this could not be included in the Anti-Recession Fund and explained that we must comply with the guidelines from the government and cannot ~nclude ~nless it is worn out within a year. Mr. Roberts referred to addi- tional help being needed for the Fire Department and Mrs. Tinker replied they asked for four firefighters last year and the train- ing officer will be a p~omotion. Mm. Roberts referred to the beach erosion control project and Mrs. Tinker replied that this is a recommendation from Mr. Frederick and the Parks Department and explained they will do the work and plant Hawaiian Seagrapes along the beach to pre- serve our beach, Mr. Vance read proposed Ordinanoe No. 79-12 by title on first reading. Mr. Roberts asked if this was an emergency ordinance and Mr. Vance replied negatively and there will be a second reading. Mr. Roberts moved the adoption of Ordinance No. 79-12 on first reading~ seconded by Mrs. Ri scoe. No discussion. Resolutions NONE Other NONE OLD BUSINESS Consider Nomination to Pill Declared Vacancy on City Council Vance read proposed Ordinance No. 79-13 by title on first 79-13 on first Mrs. Padgett Mr. Roberts refermed to suggesting it before that when a vacancy occurs so early in the season, possibly the next highest candi- date in line should be selected, but he does not knowthe feel- ing of the rest of the Council. Mayor Harmening asked if he was proposing this as a specific name or general idea and Mr. Roberts replied either way. He stated the next highest on the list i§ Col. Walter M. Trauger and he would place him in nomination. Mrs. Riscoe moved that nominations cease, seconded by Mr. Roberts~ Motion carried 4-0. Mayor Harmening then requested Mrs. Padgett to take a roll call vote on the nomination of Col. Walter M. Trauger: Councilman Strnad - No Vice Mayor Riscoe - No Councilman Roberts - Aye Mayor Harmening - Aye Vote tied 2-2. -8- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MARCH 20, 1979 Mayor Harmening asked Mr. Vance if it would be appropriate and in order for the Chair to declare an election in accordanee with the terms of the Charter and Mr. Vance replied the next step is to hold a special election under Section 51 of the code to fill the vacancy. The section is not clear with respect to what term this election would be for. The section is quite clear as to what happen~sif a replacement is appointed and he holds office until the next general election to provide the citizens the earliest opportunity to vote on the situation. However~ the code is not clear whether a special election should be for the remainder of the term or until the next general election. Because this is un- c!ear~ he has w~itten the Attorney General requesting an opinion at an early date. He anticipates receiving that opinion this week. Mr. Vance then referred to the election shhedule being in compli- ance with our code and the e/~mtion code and explained if the pro- clamation is read on March 29 and a second time by April 5', the filing period would be April 6 to 19 with a 20 day campaigning period through May 9. Assuming only two candidates file, the election would be on May 10; but if more than two candidates file, the runoff would be held on May 15. Mrs. Riscoe clarified that he was saying there is the possibility of having a primary and Mr. Vance replied if there are three candidates and no candi- date gets a majority of the vote, we would have to have a second election. Mayor Harmening asked if this point was included in the question to the Attorney General and Mr. Vance replied nega- tively, Mr. Roberts referred to having four or five candidates and Mr. Vance replied that one must get the majority vote of 50% plus one of the people voting. Mr. Roberts asked if any ordinances or resolutions would have to be drawn for this and Mr. Vance replied that an election proclama- tion would have to be adopted. He added that two regular meet- ings had to be held to attempt to appoint a substitute Council member and now a special meeting could be held this week or by Monday if we get the Attorney GeneralTs opinion to meet the publication dates. Mrs. Riscoe clarified that this must be done by proclamation and Mr. Vance replied affirmatively. Mayor Harmening referred to having attempted at two regular meet- ings to make a nomination to fill the vacancy and asked if it would be in order to proc!aim the eteetion at this time or would it be preferable to wait until we have the full details and Mr. Vance requested waiting beoa~se we cannot tell what term the candidate is running for until we get the opinion from the Attorney General. Mrs. Padgett questioned whether there was just one week between the primary and general election as between the normal eleotions, there are two weeks and Mr. Vance replied this is a special elec- tion and he consulted the state election code and there is only one week. Mr. Vance consulted with Mr. Tanzy and advised that Mrs. Padgett is correct and the runoff would be held two weeks later. The ~irst election would be May ~ and the second election on May 24. May t0 would be the first date in order to give 20 days to cam- paign. However, if they wanted to stay with the traditional Tuesday voting day, the first election would be on May 15 with the runoff being May Mr. Roberts referred to May 15 being a Council meeting night and stated according to an ordinance if anelection falls on the same day~ it ca~e be moved one day and Mayor Harmening re- plied that the Council meeting date could be moved o~eday. Mr. Roberts asked when the books elose for registration and Mrs. Padgett replied that it is normally 30 days before the election. Mr. Vance stated that he will confer with Mrs. Padgett regarding this. Review and Discussion of Proposed Sign Ordinance (Tabled) Mr. Roberts referred to wanting to ask some questions and moved to take this item from the table~ seconded by Mrs. Riscoe. Motion carried 4-0. Mr. Roberts questioned where the changes came from and Mr. Howell informed him that the reason the ordinance was up- dated was because the present ordinance does not address C-3 and C-4 zoning at all. He told about working on this for over a year with Mr. Keehr~ Mr. Holland and Mr. Annunziato and explained that in some cases~ the size of the signs have become more restrietive and in some cases, such as corner lots, have beeome less restrictive. Also, the square footage has been considered and lessened in some eases. They have tried to cover all the zoning in the City. They have tried to be fair, but at the same time keep Boynton Beach from becoming a tin pan alley. Mr. Roberts asked if the areas marked in yellow were where changes had taken effect and Mr. Howell replied affirmatively. Mr. Roberts stated he wo~ld like to compare this ordinance with the present one f~rther and Mayor Harmening added that he would also like more time To study it. Mrs. Riscoe moved to put this back on the table until the next regular meeting, seconded by Mr. Roberts. Motion carried 4-0. -10- MINUTES - REGULAR CITY CGUNCIL MEETING BOYNTON BEACH, FLOt%!DA MARCH 20, 1979 Diseuss Wrecker Service Mayor Harmening referred to Mrs. Tinker probably having put this on the agenda and Mrs. Tinker replied that she did because she did not have the information needed from the last meeting. She stated ~t the last City Council meeting, the bids for the wrecker service were rejected due to a 2/2 vote. She has forwarded a legal opinion from Peter R. Tanzy as it pertains to the Boynton Wrecker Service. She had a meeting with Chief Noah Huddleston, Deputy Chief Bill Hand,ton, Captain John Gardner and Bill Sullivan, our Purchasing Agent~ in an effort to resolve this matter. It was the decision at this meeting that the contract for wrecker service should be given to an individual rather than a corporation. She submitted a memorandum from Chief Noah Huddleston who confirms this, as well as a new bid proposal for a vehicle towing service contract in the City of Boynton Beach. She respectfully requests that they be given permission to rebid this item as per the general specifications for Vehicle Towing Service Contract prepared by Chief Huddleston and his staff. Mr. Vance advised that the proposed general specifications appear to limit the bidders to individuals which is not proper. A bid can be submitted by any entity~ individual~ partnership or cor- poration. Mayor Harmening referred to being a little confused in regard to a mouple sentences in the memo and stated last year~ we had a conglomerate towing service and from all indications and ports, it worked out well. It was handled through one head with five participating individuals, Whether the strueture or frame- work is corporate or partnership or any form o~ legal entity that can be put down on paper~ he does not see much difference as long as the end result is satisfaetory with the Police Depart- ment receiving adequate service when calling upon the company. Certainly we have had performance f~om the group which has re- cently done the job. He has no objections to going out for bids; however, before doing so, the material Mm. Vance referred to should be incorporated into the bid speeifioations because he is certain there is no legal method whereby the City can discrim- inate against one type of legal entity over another] Mrs. Tinker clarified that in all areas where it says ?'individual~ it should be retyped and have inserted individual, partnership or corporation and Mr. Vance replied that he is not quite sure the way the Chief is using the word individual here~ He thir~ks the wording should be that the bid 'must be made by a towing service that is licensed or can obtain a license in the City of Boynton Beach. 'I!- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA MARCH 20, 1979 Mayor Harmening stated that he certainly believes the bid specifi- cations should be specific in one area and that is upon the effec- tive date of awarding the contract that the awardee is capable and has all the requipment required under the terms of the CDC opera- tions agreement and not somewhere downstream. Mr. Roberts added that ~ was still of the opinion that any bids should be limited to people in our City and not outside. The word individual says one individual to bid which would restrict others f~om getting into the act. Also, rotation does not have to be on a day to day basis but could be month to month which would eause no problems. Mr. Strnad stated he didn't know why we have to go out for bids again when we have received bids. A bid was received and just because he does not live in the City limit~ is no reason to dis- courage or discriminate. Many bids are sent out. Contractors, etc. come in from other parts of the state and county. It is discrimination to say someone must live in the City. Mr. Prank Kohl came before the Council and stated in regards to the Boynton Wrecker Service, he did nothing last year but carry out the orders of the City Council and the bid was given to Boynton Wrecker Service. This is in the minutes filed in Central Pile. Boynton Wrecker Servioe is a group of hard working individ- uals and some live in the City. They have given good service. They have joined together as one to give good service. They are a g~oup of people joined as one for the good of the City for fast efficient service. He agrees with Councilman Strnad about everybody being able to bid, but these people came in and the Council told him to negotiate. It was not by a handshake and he didn't get a hamburg. These people deserve it and the Coun- cil should get above this stuff and go onto other business. Mr. Ed DeVries, Treasurer of Boynton Wrecker Service, came before the Council and told about Mr. Davis coming to his office about two weeks ago and informing him that he was not interested in the towing service in Boynton Beach. He was asked by Mr. Davis iE%he was interested in taking over this par- ticular service with one or two corporation members. He told Mr. Davis that he would not be interested. Mr. DavisT main interest is the garage body shop. Mr. Davis has a body shop in Fort Lauderda!e and would like to take the care wrecked in Boynton Beach to his shop in Fort Lauderdale for painting and repairs. Mr. Davis has admitted personally to him that he is not interested in the towing and w~ecker business and is only interested in the body shop. He then told about Mr. Davis going to his partner, President of the Corporation, Mr. Dave Franklin~ and asked Mr. Franklin the same thing and was informed he was not interested and we would st/ck together as a corpora- tion. Mr. Franklin asked Mr. Davis about his body shop in Fort Lauderdale and was told it was not his and he did not have the money to invest in=a body shop here. He does not understand what is going on. They have done a good job in the past and dontt understand what is happening here. -12- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA MARCH 20~ 1979 Mayor Harmening added that according to the newspaper, Mr. Davis~ who was the low bidder, aetua!ly was not interested in making a p~ofit on the towing service and this strikes him as unusual. Mr. Paul Davis, Route 441, came before the Council and advised that he has a license for a storage yard in this City. He has a body shop in Fort Lauderdale whieh belongs to him. In this City, he has applied for a storage yard for towing purposes. He did speak to Mr. DeVries about having other people joining him in the City if he should get the eontraet. He does have Mr. Bradden- b~rg, who operates a filling station, interested in towing with him. He is not here as an outsider. People in the other organi- zation are in the same predicament. He is here to perform a ser- viee for the people at a cost somewhat and signifieantly less than what these people will perform for. He referred to purchas- ing equipment and stated with Mm. Brandenburg, they can meet the requirements. He bid the price of g21 and if he doesn't make money, it is his fault. If he can save money for the people here when everything else is going up~ he thinks he should get the opportunity if he can provide the serviee. Mrs. Tinker stated that a gentleman did complRin about the rates of the Boynton Wrecker Service and in her pursuit to find out what happened~ she found they were unlicensed, loeated in an area where sereening is required and did not have it, and stated they were ineorporated but did not get the articles of corpora- tion until March 14 and submitted to Mr. Sullivan on Mareh 19. She wanted to get some of these things clarified. They also were functioning without a rate sehedule so no one knew the charges if they were towed. Simon Northeast Corner of Seacre~t Blvd. and Gulfstream Blvd. Construction of a Three Suite Medical Building Mayor Harmening stated the Planning & Zoning Board at their regu- lar meeting of March 13, 19797 was unable to make a recommendation on the site plans submitted by Charles J. Simon to construct a three suite Medical/0ffiee Building. The vote was $-5. There are staff recommendations submitted and a map of the location. Mr. Annunziato informed the Council that this was reviewed by the Planning $ Zoning Board at the last meeting. Several important issues were discussed. He thinks the 3-3 vote regarded the nature of the zoning at that location. This was submitted for rezoning within the past year and was denied by the Planning L Zoning Board and City Council~ but subsequently came back and was approved by the City Council. However, the zoning was given. Mr. Annunziato thenread the staff comments: The Engineering Department has noted the drain rock to be minimum of 1~6'~ in depth. The Building Department has noted that handioapped park- ing should be situated closer to the entrance, the roof overhang cannot encroach the setbaeks on the north and south sides~ the elevation on the eastern side of the building shall be equal to the elevation grade of the adjoining property, and if not per- mitred by March 15~ it mustmeet with the energy code. The Fire Department has requested the 6" water line be extended from S.E. 1st Street and construet a fire hydrant at the southeast corner of the property. The Police Department has noted there to be no view obstruction to the roadway. The Planning Depart- ment has noted that sidewalks are required and parking for 90© bays to be 65'. The vote was 3-3 by the Planning & Zoning Board and this plan was forwarded with no recommendation. Mayor Harmenin9 referred to the overhang being allowed and Mr. Annunziato informed him that an overhang was not allowed in a commereial zone. Mr. Roberts stated he does not tkink the Planning & Zoning Board should be concerned whether they like the zoning or not. It has been rezoned for a good reason since it does not interfere with the neighborhood. It is zoned C-1. He then asked if there was enough parking for the three medical suites and Dr. Simon re- plied affirmatively. Mr. Roberts stated if everything is in order with the setbacks met, the staff recommendations all met, and it will not create any hazard, the does not see how it can be denied. He asked if the ingress and egress is proper and Mr. Annunziato informed him that it is adequate and the parking is ample. Mayor Harmening referred to there being a question regarding Dr. Simon occupying the building and Dr. Simon explained that his original plans were to occupy the building, but with the prooeed- ings taking so long~ he had to make the decision to go into another building. He has not gone back on anything he said eon- corning the actual building. Depending on who occupies it, it could just be one suite or a maximum of three medieal suites. it will blend in with the residential area. The reasonfor the overhang is to keep the sun off the windows. There are 30~ set- backs on every side. It will look more like a home to blend in with the area. Mayor Har~ening asked if there is room on the site to aocommodate this square,footage and configuration and still keep the overhang and Mr. Ro~ Simon explained that the lot is 140 x !50~ 30t set- backs are required which !eave a bu~3dable area of 80 x 90' and he would have to reduce the bui~dable area another 4~ to accom- modate the overhang. There is an existing hedge along the east and they 'will extend tb/s along the north property line and put some fencing on the south side. They will meet the requirements. He advised that during- the review by the Planning & Zor~ng Board~ nobody objeoted to the building or gave any indication there was anything w~ong with the site plan. He wanted the Board to stipulate they were not talking about the site plan, but their decision had to do with the zoning. Mm. Roberts asked if the Community Appearance Board approved the plan and Mr. Simon replied affirmatively. Mrs. Risooe referred to attending the Planning & Zoning Board meeting and stated she understood the situation. Therefore~ she moves to accept the site development plans according to the staff recommendations. Mr. Vance asked if the staff recommenda- t-ions are agreeable and acceptable and the applicant will comply and ~m. Simon replied affirmatively, if they are in the code and demanded. He questions the overhang because of adding appearance to the building and Mayor Harmening replied the recourse for this would be to apply to the Board of Adjustment. Mr. Vance asked if he accepts and finds agreeable all the staff recommendations except the overhang and Dr. Simon replied affir- matively~ but he has one question about the fire hydrant. He was asked to put in a water line. He agrees with having to put in a water line to bis bui!ding~ but questions why he has to put in a fire hydrant for the community. Would this be required of a house? Mr. Annunziato replied that concerning the placement of one house, he would say it would not be required, but this is the development of commercial property and no fire protection is available. Mr. Vance added that if Dr. Simon wants to question this point~ it can be referred back to the Planning L Zoning Board for additional discussion. Mr. Roy Simon referred to the Fire Marshall requiring the water line and fire hydrant and stated nobody on that block is serviced by City water. This requirement is to extend the 6~ water line around the corner to afford fire protection to the block at his cost. Mr. Vance again referred to discussing this further with the Planning $ Zoning Board and Dr. Simon replied that he would rather accept the conditions than go back to the Planning $ ZoNing Board. Mr. Vance asked if hea~greed and would comply with all staff recommendations except the overhang and Mr. Simon replied affir- matively. Mm. Vance referred to the overhang and asked if he agreed to comply with that with reservation and he can appeal that matter to the Board of Adjustment and will comply with whatever decisionis made by the Board of Adjustment. Mr. Roy Simon advised that he has spoken to a member of the Building Departmentand was told overhangs are permitted in commercial zones. Mr. Vance clarified that Dr. Simon is being given the opgortunity to reserve the right to take this to the Board of Adjustment and agrees to abide by the deci- sion of the Board of Adjustment. D~. Simon stated ~ith that reservation, he accepts it. Mrs. Riscoe moved to approve the site development plan for the applicant~ Dr. Charles Simon~ with the staff reeommendations to go before the Board of Adjustment and accept all the things they state at that particular time~ seconded by Mr. Roberts. Mayor Harmening clarified the motion was to approve this application ~ith all staff recommendations accepted with the exception of a possible appeal on the overhang to the Board of Adjustment and the applicant must abide by any decision if he desires to make this appeal. Motion carried 4-0. NEW BUSINESS Discuss Golf Course Petitions Mayor Edward F. Harmening Mayor Ha~vaening referred to receiving approximately 3~000 peti- t-ions to establish a muu/cipal golf course at the last meeting and stated the petitioners have property p~operly lined up at no charge to the City. In view of the large number signing the peti- tion~ it would be incumbent to put this out to referendum. In order to do a first class job in getting all the baekground~ financing~ and most needed, we need to have a feasibility study which will cost about $10~000. He would suggest and urge the Council to eonsider at the special etection~ which will be on May 15 or May 29~ that we include on the ballot as a straw vote, so the Council has the authority to proceed with a feasTbility study so we can present the voters in December a comprehensive picture which the golf course will oonsist of, pertinent data~ etc. for the voters to review prior to the December election. Mrs. t%iscoe referred to us acting as fiscal agents and questioned why it would ha~e to be a straw type thin~? She knows the people are anxious for this and we could get the vote on the special election. Mayor ~larmer~nq replied there was no way between now and the special election to get together and provide the backup materiat~ cost figures, the complete and total picture what it consists of in a positive way. Mr. Vance agreed that Mayor Harmening is correct. He advised that while these bonds will be paid out of revenues of the golf eourse, we will be issuing them. We must get together with the financial consultants and go through complicated work and mould not do it before the spec- ial election. Mayor Harmening clarified that if the straw refer- endum passes~ this work w-ill most a little money and we know the people have no objections to spending about $10,000 for it. On the other hand~ if the people do not desire to eontinue with it~ there is no reason to spend S10,000 to put it on the ballot in December. -16- MINUTES - REGULAR CiTY COUNCIL MEETING BOYNTON BEACH~ FLORIDA MA~CH 20, 1979 Mr. Roberts moved to go along with the suggestion of the Mayor and City Attorney and put this question on as a straw ballot at the special election. B man from the audience questioned how this would be worded and Mr. Vance replied that probably a little bit of time would have to be spent with the proponents of the golf eourse to give some information to the citizens. The man empha- sized that the important part is that it will be no expense to the City of Boynton Beach. If the people think the City is going to pay for this, it will make a lot of difference. Mr. Vance replied that he thinks the Council is interested in the proposal and any question on the straw ballot would incorporate informa- t-ion that the proposed bond issue would be an issue payable out of the proceeds of the golf course. To the best of his know!edge~ n~st of the municipal golf eourses make money, but the City would be the issuer of the bonds and in all f~rness~ this would have to be made clear. Mayor Harmening suggested that we meet with the proponents and work out the language so it can be clear and con- cise and the people will understand it. Mrs. Riscoe questioned whether this would entail more time through Mrs. Winehester?s office with including this on the ballot and Mrs. Padgett replied negatively, but it will require more time in our off-ice. Mrs. Riseoe then seconded the motion. Mayor Harmening clarified that it had been moved ~ad seconded to include on the speeia! election ballot~ a straw ~9ote type question to determine the peoples~ opinion whether we should proceed indepth to present the golf course question at the next general election. Motion carried 4-0. Mr. Vance clarified that he will meet with the City Clerk and with representatives of the people interested in the golf course and work out a draft form of the question. Mayor Harmening agreed and suggested that the leaders of the proposed golf coumse take this into consideration. In view of the people leaving, Mayor Harme~ing declared a two minute recess. He reconvened the meeting at 9:25 P. M. OLD BUSINESS (Continued) Discuss Wrecker Service (Continued) Mayor Harmening announced that it was brought to his attention that we did not take definitive action onthis item. ~e stated that it was Mrs. Tinker~s recommendation to go out for bids on the wrecker service. Mrs. Tinker agreed and stated no motion was made, Mayor Harmening apologized for being in error in not asking for a motion and stated he was under the impression it was taken care of. Mrs. Padgettadvised that two people had again requested to speak. -17- MINI1TES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MARCH 20, 1979 Mr. Gene DePaoe, Lantana and formerly of Boynton Beach, owner of ABCD Auto Center and part of the Boynton Wrecker Service, appeared before the Council and advised he wanted to state a few facts. The secret of this entire matter is service and the feasibility of what they have done in the past year and it has worked with the five gentlemen. He feels very hurt and sorry over the situa- tion taking place. They have been browbeaten, embarrassed, etc., but have continued picking up the cars and assisting the Police Department. They were appointed by the City Council last year. They came on February 22 when the bids were opened and complied with the ordinances in eonjunot~ion with bid performance with one disagreement with Mrs. Tinker regarding corporation. Mrs. Tinker has gone to every extent to knock them down. She has told them to leave the towing to Mr. Davis. They have still been doing the job even when under this pressure. He does notthink this is satisfactory business or politics. They have now obtained the corporation forced on them by Mrs. Tinker. Howevers now they are illegal because they are incorporated. He thinks the City is wasting time and they are wasting their effort. The problem is insulting their integrity. They have performed the service for the past year with a fee of $25 and $3 for storage. They found that was not satisfactory and increased it to $30 for tow- ing and $4 for storage. This is~ill below the County average of $35 to $40. However, they are still doing the towing under these circumstances. Mr. Roberts asked if people could call whatever company they wa~mted to if they were involved in a wreck and Mr. DePaoe plied affirmatively, but explained how they answer Police Dept. calls and have their trucks equipped with phones in compliance with CDC regulations and in accordance with the Police Dept. He ad4ed that they ascertain their rotation basis and it has been working successfully. Mr. Roberts referred to some accidents needing several trucks and Mr. DePace agreed and stated one time six trucks were needed and they do have 12 trucks. Mrs. Risooe stated the Council was not here to hurt him, but she wants to make sure all the rules and regulations are com- plied with. In her statement at the last meeting, she said she would only be for Davis if he could comply with the regula- tions by April 1. Ail the legality~ licenses, etc.~ must be intact by April 1. This is the only thing she is looking for. She does not think this is a case for embarrassment and it cer- tainly is not her intent. She believes Mrs. Tinker was trying to protect herself add the City. Mr. DePace replied that he would like to see her in his position and take this attitude. He has taken this situation personally. He has lived and built a business in this town. He has put a lot of effort getting this conglomerate together to work for the City. This is important because it serves the Cityts purpose. -18- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MARCH 20, 1979 They have conformed to everything required by the City. Now, another legality came about and they have gotten incorporated: but eaoh individual has always been licensed in the City and County. They stuek by their bid given to Mr. Frank Kohl and the Police Department of $25 and have never deviated. They have not overcharged. He would like to see the bills from the people saying they have been overcharged. They go out all hours of the night, holidays, etc. They must go to the accidents, the same as the police and ambulance. They are assisting mn emergency removal. It is getting so ridiculous, he has been trying to in- fluence his men to stop all towing and let the City do it on their own. He feels it would be fair after what they have been sub- jected to. Mrs. Tinker stated that Mr. DePaee met with her five times in the presence of Mr. Sullivan and Mr. DeVries and thought they were in complete agreement they were not licensed or did not have a contract. She is not nitpieking and has met with these gentlemen five times to discuss this matter. They agreed they were negligent in getting an occupational license as a conglom- erate, did not have the articles of corporation and did not have their area screened in. She has met with them and tried to get this problem resolved. Mr. DePace agreed they did meet~a~d clari- fied the matter of screening was a problem, but she did not men- tion this once to the City Council in their behalf. She has only been relaying one side of the situation to the City Council and he is a little bit distraught about this. Mayor Harmening stated that he personally feels when we have fi~e individuals who have fiv~ individual licenses that a sixth license as a conglomerate is certainly redundant in many respects. He does feel there has been considerable lack of rapport on the City ad- ministration's part insofar as the pursuit of this subject. He thinks the sooner we get it resolved, the less newspaper print will be used unneeessar~ly. Mr. DeVries came before the Council and requested to clarify some of Mr. Davis~ statements. He feels the bid given by Mr. Davis is very unrealistic and Mr. Davis admits it is below cost He does not see how the City will benefit~ It seems like it would jeopardize the emergency system of the City to run at low cost. The equipment could not be maintained proper- ly or the manpower paid sufficiently. Mr. DeVries then referred to Mr. Davis also mentioning about Mr. Brandenburg having a station and told about this station only being apen until 6:00 or 7:00 P. M. and his emergency vehicle being a pickup truck with a small electric boom on the baok. Also, he went into the lieense situation in great detail with Mrs. Tinker and thought it was resolved. The safety factor was explained to her. -19- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDK MARCH 20, 1979 Mayor Harmening s~ated that when this bid is awarded, the Police Department will be directed to inventory and cheek out any equip- ment available ~hieh the winning bidder proposes to use meets all the standards set forth in the CDC contract. If he has to take a day or two off fmom work to attend to it~ he will. Mr. Roberts added that if we have to depend on one man with or without equip- ment, he would eertainly favor the conglomerate. Mayor Harmening announced that the Chair entertains a motion to direct the City Manager to go out for bids for a wrecker towing serviee at the City Managerts request. Mrs. Riseoe so moved, seconded by Mr. Roberts. Under diseussion~ Mrs. Tinker requested Mr. Vance to change the specifications in the proper manner so all bidders will be eonsidered and not just an individual. Mr. Vance agreed and also suggested that the appropriate Citydepart- ment, probably the Poliee Department, be constituted to verify the types of equipment needed. Motion carried 4-0. NEW BUSINESS (Continued) Consider Re-Al!oeation of Federal Revenue Sharing Funds (Priority Requests from Department Heads) Vice Mayor Betty Riseoe Mrs. Riseoe referred to having approximately $228,000 in Federal Revenue Sharing Funds al!oeated for the 55 acres on Congress Avenue for the gym whieh is null and void and stated she under- stands we would possibly be eonsidering recreation for that site in phases. At this time, a suggested cost breakdown for these funds which could be diseussed further at the next meeting to be re-a!!oeated and have a public hearing regarding the use of Federal Revenue Sharing Funds in places where priorities are in demand. She then read the attaehed memorandum dated March 22, 1979, sug- gesting the re-allocation with public hearing of Revenue Sharing Funds. She added there is an approximate balance of $10,000 and she would like to see that added to the fund established for the 10th Avenue project. Mr. Vance stated an ordinance was adopted originally in 1973 which has been amended four times and we appear to be able to use these funds only for capital improvements. Therefore, every item the Vice Mayor mentioned would be appropriate ex- cept the salaries for patrolmen. Mr. Strnad stated that rather than leave the money in limbo, the departments should be given what they need. Mr. Roberts referred to some being duplieation and stated we just passed an omdinanee in the amount of $82~ 000 for Anti- Recession funds taking care of some of these items. The items mentioned ean actually go until budget time and immed- iate needs ean be taken care of with transfers and we will have a surplus at budget time. -20- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLOP, IDA 20, 1979 Mrs. Riscoe replied that other than the salaries for police offi- cers, she thinks everything mentioned certainly falls within the realm of necessity. She requests this list be given consideration for discussion at the next meeting. Mr. Roberts refer~ed to some items being taken out of Anti-Reces- sion Funds and Mrs. Tinker replied there were eemtain guidelines to follow and a large capital outlay cannot be taken out of Anti~ Recession Funds. We cannot go over $1,000 per unit for any one item. In the case of police cruisers~ we aah go over $1~000, if it is felt this item is worn out within the year. She checked with Chief Huddleston and he said they just about make one year. Some of the cruisers are junk. The oruisers are run 80,000 miles per year with ~unning 40,000 to 50~000 miles and idling 40,000 miles. Ail the other large items are not permitted from Anti- Recession Funds. Mr. Roberts questioned when the audit is to be completed and Mrs. Tinker replied within the next week. Mr. Roberts suggested waiting two weeks and possibly we will have the funds to do some of these things. Mrs. Riseoe moved to discuss this at the next speeia! meeting and at that time set a date for a public hearing to allot the necessi- ties for the departments as needed. Mr. Roberts questioned dis- cussing it at a special meeting and Mrs. Risooe replied that she understands there may be one this week. Mayor Harmening suggested that it eon ~e discussed in detail at the next meeting after we have more of an opportunity to survey the list of items that the Vice Hayom has proposed. Mrs. Ri scoe moved to bring this up at the next special or regular meeting whichever oomes first. Mr. Strnad replied that she could just put this on the agenda~ but seconded the motion. Motion earried 4-0. Discuss Capital Improvements Councilman David Roberts Mr. Roberts referred to having an Operating Capital Improvement Fund and stated he thinks it should be Pevitalized. The audit will show we have a substantial unappropriated surplus and also have S228,000 which is earmarked for the development of the 55 acres. That money should be used for that area even if not for a gym. He would expect that amount mill be carried over to com- plete the ~oads and parking in that area for the July 4 shootoff, and utilities and power. Some of the unappropriated ~urplus will no doubt go towards the budget and the items just mentioned. He would like to see the position of Assistant City Manager created. Most municipalities have one and he thinks it would prevent a repetition of our current problems. Many of the projects eom- pleted in 1978 were from EDA grants. Commissioner Gregory has offered to help through his liaison. He understands the Recreation Board is also working on plans. He hopes the Council will take eonstruetive action in this direction. He thinks the 6228, 000 should be carried over to the next year and the unappropriated surplus be used. Mayor Harmening stated that based on Ordinance No. 79-12, the Counoil oould go ahead and direot the City Manager to go out for bids for two police oruisers if it is the will of the Counoil. Mrs. Riseoe replied to Mr. Roberts that she ls aware we need reoreation~ but we also need the vital equipment to take oare of the services that all the people need. An ambulance is needed by young or old. They have higher priority on her list. This money is lying there and not doing anything. The 55 acres will be developed in steps. She has attended meetings of the Recrea- tion Board and there are mini-parks whioh can be developed. Service Should be given to the people. The money is laying there dormant and she does not see why it should not be re-allocated ~or praotioal purposes of the City. Mayor Harmening replied there is no problem re-allomating and it boils down to priorities. A new ambulanoe has been under consid- eration for some time~ but we mast have suffioient manpower to adequately staff it. There is a possibility something could happen to our existing one, but until having enough EMTs to staff it~ it would just collect dust. He thinks some of the sug- ges~ions are very essential as the budget was very tight this year and there are some shortages in certain areas of some departments. However, he mould not agree with the entire list as submitted by the Vice Mayor. When we have had the opportunity to sit down and have five members on the Council, it should not present too much of a problem to find out where the short comings lie and to what extent and address these things and rectify any problems which may exist. He saw the list oiroulated by the City Manager to the various department heads. The General Ser- vices Department requested $450,000 carte blanche and there are certainly other priorities equally as high as $450,000 for General Services. Only six or seven weeks ago, we allocated $130,000 to General Services for two new garbage trucks. There was a critical need and the need was met. It would be nice to have new garbage trucks, new trash trucks~ new everything in all areas. We could have, but he is not certain the residents of Boynton Beach are willing to cough up money to have new equipment running all over. There are so many different priorities and it takes thought by all the members to decide and settle the more serious ones first. Let the others hang fire until the £unQs are there to accommodate the needs or thmneeds are great enough to warrant the expenditure. The money is not lying fallow; but with the interest rates, it is accumulating a sizable sum. -22- MINUTES - REGULAR CITY CC~NCIL MEETING BOYNTON BEACH, FLORIDA MARCH 20, 1979 Mrs. Riscoe referred to Mayor Harmening using the term down- stream and stated we should go upstream and get the things we need. She is willing to give on some of the things. She does appreciate that he agreed there are some vital necessities. Mr. Roberts referred to the audit being completed in'a couple weeks and stated he thinks we can wait until that time. In the meantime, he thinks the acting City Manager should be instructed to go out for bid for the two items in that particular ordinance. As far as the other items, he thinks we should wait two weeks until the surplus is known. Mr. Strnad referred to talking about the money allocated for the 55 acres and explained that we should be tze~ted like other places in the County and ask the County to develop it. Mayor Harmening replied that the City Recreation Director is in communication with the County Recreation Director and they are attempting to prepare a proposal the County and City man agree to. He has been assured thereare chances there will be considerable County participation in some of this park development. However, being realistic~ he would like to wait and see to what extent it is. Consider 1-95 Suplus Right-of-Way Mayor Harmening stated the City Planner has been in contact with D.O.T. in regard to a small segment of surplus right-of-way bor- dered on the north by S.W. 15th Avenue, east by 1-95, south by the interseetion of the 1-95 right-of-way~ and the Seaboard Ossstline Railroad~ which has been the topic o~ ~veral letters. He believes they have asked for a resolution on the specific use of this land and he would like Mr. Annunziato to inform us where this stands. Would we receive priority over an individual and the railroad in the acquisition of this? Mr. Annunziato informed the Council that our proposed comprehen- sive plan indicates this area should remain in the conservation mode. Several months ago~ he decided to see if we could get this land for City purposes. They have reached the point where action from the Council is wanted. They want a resolution whether the City is really interested in becoming the owner of this land. Mr. Roberts referred to this being a good location for a well and Mr. Annunziato replied that the potential is there and it is directly across the railroad tracks from our well fields and this was an alternate site. Mayor Harmening asked if he had a recommendation for a specifie use which would eateh their attention and Mr. Annunziato rDplied that he does not know what that is. We are dealing with a money making decision as opposed Bo a grant. This could possibly be a well site or a recharge area to protect our wells. -25- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA MARCH 20, 1979 Mayor Harmening suggested approaching this with it being impera- tive that the City acquires this land for well fields. Mr. Milt Hallman~ Russell & Axon, came forward and stated they did not realize Mr. Annunziato was working with this and they have been working on this with D.O.T. However, they have dis- covered there is no access to the land. A road must be built across the railroad tracks and the railroad will not allow it. It is landlocked. Mr. Annunziato agreed this is a problem, but it will be rectified when the P.I.D. is platted. The railroad denies access for general public purposes~ but they may allow access for emergency. Mr. Hallman referred to maintenance being needed every day and stated the railroad would not allow this crossing. It is an excellent site for a well field. They discussed further the access and Mr. Roberts questioned the interest anyone else would have in this and Mr. Annunziato replied that the railroad is interested in this land with having an adjacent right-of-way. Mayoz Harmening suggested that it be pursued on the basis of a well field and the City Attorney be instructed to draft the neces- sary resolution to D.O.T. and stress the need for a well field with being adjacent to our existing well field. Mr. Roberts so moved, seconded by Mrs. Riscoe. No discussion. Motion carried 4-0. ADMINISTRATIVE Consider Approval of Preliminary Plat for Watersedge Subdivision Submitted by Tom Erling Mayor Harmening seated the Planning & Zoning Board, at their regu- lar meeting of March 13, 1979, unanimously recommended that the Preliminary Plat and Development Plans submitted by Mr. Tom Erling be approved. Further~ the Planning $ Zoning Board estab- lished the ~igure of S20~179.$9 as the dollar amount required by the subdivision regulation for parks and recreation dedication purposes. Mr. Roberts stated in view of the recommendations submitted and being familiar with the development, he moves we accept the prer liminary plat for Watersedge Subdivision, seconded by Mrs. Riseoe. No discussion. Motion carried 4-0. Consider Tree Ordinance Mayor Harmening questioned who put this on the agenda and Mrs. Tinker replied that she put this on the agenda at the request of Mr. Harold Blanchette, member of the Community Appearance Board. Mr. Blanchette came before the Council and stated two ordinances have been submitted for the CouneilTs review. -24- MINUTES - RBGULAR CITY COUNCIL MEETING BOYNTON BEACH: FLORIDA MARCH 20~ 1979 Mr. Blanehette explained that we do not have a tree ordinance and the present CAB Ordinance merely forms the Community Appear- ance Board and outlines the duties, but does not get into speci- fics. The proposed ordinance is a guide taken from the County ordinance and it is not that strict. The tree ordinance from Delray Beach was used as a gui~e for our suggested tree ordinance. He added thata forester would not be needed nor any additional help, but on-site inspection can be done by the help available. Mr. Roberts referred to reviewing a similar ordinance some time ago and stated there was some question whether it could be legally enforced regarding size of trees, ere, and Mr. Blanehette replied that the proposed ordinance includes sizing and specific spacing. He added that the tree ordinance is primarily for larger developments to the west where there are large trees and as many as possible should be saved. Mayor Harmening referred to considering the tree ordinance first and stated there is probably a need for something like this; how- ever, he feels there may be some problems in how it is administered. Mr. Roberts stated ~n view of just receiving this and it being quite lengthy, he moves to put this on the table to look at it closer, seconded by Mrs. Riscoe. Motion carried 4-0. Consider Amendment to Community Appearance Board Ordinance Mr. Blanchette stated that we do have a CAB Ordinance on the books, but it is very slight. He explained how the require- ments had to be improved. Mayor Harmening referred to the Community Appearance Board having done an excellent job and explained that it was usually the small businessman putting on an addition that objects to reeommendations from the Board. Mr. Blanehette agreed that the majority of people police their own and want their businesses to be attractive, but they would like to set a minimum guideline. Mayor Harmening stated he was against requiring a certain size and number and feels more latitdde is needed. He explained how locations had to be considered differently and flexibility was needed. Mayor Harmening suggested having the attorney review the ordinance and Mr. Tanzy replied that we must give people an idea what they are required to do, but not have rigid requirements Mr. Strnad stated he thinks the Community Appearanee Board has good guidelines and has enough intelligence and ability among the members to make determinations. He explained how usually the biggest problem was the maintenance. They discussed fur- ther how maintenance was a problem in various areas. -25- MINUTES - REGULAR CITY COUNCIL MEETINSG BOYNTON BEACH, FLORIDA MARCH 20, 1979 Mr. Roberts referred to getting bogged down with lengthy ordi- nances and stated he was not against them where necessary. He wonders if some ordinances now on the books have deficiencies and these should be pointed out and enforced. Mr. ~impe!mann, S. E 6th Avenue, told about an automobile repair shop looking like a junk yard on S. E. 10th Avenue. Mayor Harmening suggested that if he has a complaint that he diseuss it with our acting City Manager. Mr. Himpelmann further told about this site being an eyesore and Mayor Harmening rqquested Mrs. Tinker to look at the site and evaluate the situation and recommend whatever ~ective action is necessary. Mrs. Riscoe then moved to table the CAB Ordinance at this time~ seeodded by Mr. Roberts. Motion carried 4-0. Consider Ordinance for Local Comprehensive Planning Act Mayor Harmening referred to an ordinance being necessary aceording to The Datagram and suggested directing the City Attorney to pre- pare the necessary ordinance. Mr. Tanzy advised that he read the D~tagram and it does not require us to pass an ordinance saying we are going to abide by the law. He thinks what is being required is when we enact the comprehen- sive plan to pass an ordinance saying we are acting under Section 163.3171. Mayor Harmening asked if he had meviewed the case re- ferred to and Mr. Tanzy replied that it is a cireuit court case which is the lowest level. Mr. Roberts thanked Mr. Tanzy for this information and moved to strike this item from the agenda~ seconded by Mrs. Riseoeo No discussion. Motion carried 4-0. Request Approval of Proposal for Staking Easements for Regional Force Main Mrs. Tinker referzed to submitting the complete file on this which is self-explanatory and requested Council's approval to proceed with the staking of these easements with the Paul N. Howard Co.~ inasmuch as with negotiations with Mr. Tom Clark, this was the low bidder. Also submitted was a phone'message received from Tom Clark and his memorandum dated March 16. We' ~urther asked Tom to give us an approximate cost oftkhe side- walk and to determine where funds are available should Council approve this stipulation from the School Board. Due to the ur- gency of this matter, we respectfully request the City Council give their approval to proceed and designate Tom Clark to attend the School Board meeting on April 4 to indicate the wishes of Council. However, at this time, k & A is not sure an easement was ever ob- tained from Hy Kaplan or Joe Cogan. Since that time~ we have found out we do have Cogan~s easement and Tom Clark has talked to Norman Taplin, attorney for Hy Kaplan. Mr. Tom Clark eame before the Council and advised the problem with this easement oeeurred because there was a misunderstanding ginally. The plat was never recorded. The attorney had some' reservations about giving the easement. The pla~ may have to be re-approved. He explained that in any event~ Old Boynton Road is now City right-of-way and we can put pipe any place we want to. Mayor Harmening referred to the recommendation and Mr. Clark re- plied the reoommendation is to proceed with the staking of these easements with Richard L. Shephard$ Associates, Inc., the low bidder. Mayor Harmening entertained a motion to direct the City Manager to get with Richard L. Shepherd $ Associates regarding the timely staking of easements for the regional force main not to exceed $3~000. Mrs. Riscoe so moved, seeonded by Mr. Roberts. Motion carried 4-0. Mr. Clark added that the County Engineer told b/m today that often times the County does participate on sidewalks on a 50/50 basis. He was assured this would happen if the City elected to build a sidewalk for the School Board. The people fmom the Sehool Plant Planning said there was a good chance to get the easement if we promised them a sidewalk. Mayor Harmening ferred to this being approved last year and Mrs. Tinker agreed and read from the August~ 1978, minutes. She advised she did send this information to Tom Clark and he responded there was no written documentation between the City and School Board. The former City ~anager was handling ~nis with Dr. Hay. A telephone conversation disclosed the information that the School Board would not accept the agreement voted on by the Council on August 1. Persons in the area are interested in the sidewalk. Mr. Hallman has stated in telephone conversations the easements are needed so there will be no delay to the contraetor for the force main. On Mareh 167 Tom Clark wrote her another memo in- eluded with the agenda material stating the total footage and the approximate cost would be $87000 if done by a contractor. She checked with the Finance Department and funds are available in the Utility General Account. Mayor Harmening referred to the County cooperating up to 50% and referred to the sehool projects the City has contributed money towards. Mr. Clark replied that there is a question who has done the most favors. Mayor Harmening suggested re- -establishing equitable relations and have the Council authorize an agreement to go before the Board and get their approval. -27- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA MARCH 20, 1979 Mr. Clark clarified that we must commit ourselves that the side- walk will be built and Mayor Harmening replied that we have al- ready committed ourse~es to that and now we must get the County to participate. Mrs. Tinker e!arified that the Council does want Tom Clark to attend the School Board meeting and Mayor Harmening replied affirmatively. Mr. Hatlman requested that a letter be sent requesting this item to be on the agenda for the April 4th School Board meeting. He added that it oan cost money if we don't get this easement by April 4. Mayor Marmening requested Mrs. Tinker to send such a letter with a copy to Dr. Hay. Mr. Clark added that he doesn't know how the agenda is prepared~ but has been assured it Will be on the agenda. Mr. Ha!lman wants an affieial request from the City. Mrs. Tinker stated the letter would be sent tomorrow. Application for Permit to Solicit - Amara Temple, A.A.O.N.M.S. Under discussion, Mr. Strnad questioned how come these people lose money on these after holding for so many years and Mayor Harmening replied that a certain amount of administrative work is involved. Mr. Strnad stated that the cost has gone up and the price for a cemetery lot is not the same as 15 years ago. Mr. Roberts referred to this being put on the table to find out whether another cab was needed and stated from the reportessub- mitred, it seems those in existence are lacking in many instances and it seems we can use the service of an additional cab. Mayor Harmening stated that his interpretation of the backup material would intend to substantiate that more cabs are authorized than we are presently using. To establish another cab company on that basis would be contrary to the oz~inanee governing same. It is incumbent upon the Council to make the determination whether there is additional necessity before authorizing an additional franchise. The existing francises are being under- utilized and it would create a depression in the cab business by granting an additional cab franchise. Mr. Roberts asked if anyone in the audience had experience ~ith the cabs and a man replied that he does not use them because they are too expensive. Mayor Karmening asked if anyone was present in the audience representing the applicant and received no re- sponse. He asked if anyone was opposed to this application and received no response.
