Harmening, Mayor Betty Riscoe, Vice Mayor Ron Johnson, Councilman David Roberts~ Councilman Norman F. Strnad, Councilman Annette P. Tinker, Acting City Manager Tereesa Padgett, City Clerk James W. Vance~ City Attorney Mayor Harmening welcomed everyone and called the meeting to order at 7:30 P. M. He announced the invocation tonight will be a moment of s~Ient prayer followed by the Pledge of Allegiance to the Flag !ed by Councilma~ David Roberts. He requested everyone to please Stand. AGENDA APPROVAL Mr. Strnad requested an addition under Legal - Other of a proposed ordinance pertaining to occupational liCenSing. He added that he would also like to make some comments pertaining to s written statement on Page 21 of the February 6 minutes. Mayor Harmening requested the addition before Legal - Appoint- ment of City Manager, Mr. Denver Baxter. Mr. Johnson referred to New Business and requested the addition of Item E - Consideration for Adding Two Patrolmen to the Police Force and Four New Cruisers. Mr. Roberts moved adoption of the agenda as corrected, seconded by Mrs. Riscoe. Motion earried 5-0. ANNOUNCEMENTS Mayor Harmening read a Proclamation proclaiming the month of March, 1979, as Red Cross Month. tVLYNUTES Correction ~ Minutes of Regular City Council Meeting - January ~, 1979 Mr. Vance referred to there being some question whether a correction was needed and stated the actual verbatim excerpt indicates the motion was tabled and the matter was subsequently considered at the following meeting. This is just a matter of elarifieation and no correction is needed. Regular City Council Meeting - February 6~ 1979 Mr. Strnad announced that he just wanted to make additional cemmemts to Page 2!.AsAs a member of the Council on January 5, 1979~ he cer- tainly would have appreciated being knowledgeable to the fact that MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 20, 1979 the Mayor and Mr. Dave Roberts had sent a letter to the Governor's office asking for an investigation of various people including him~ self. He certainly would not have voted against an investigation, but would have we!eomed an investigation of this City by the Gov- ernor's office. Me does not know what the purpose was in not asking the entire Council to approve this along with the other two members. He would like to know why they were not apprised of this letter being sent to the Governor's office. Mr. Roberts informed him that this letter did not pertain to busi- ness handled by the new Couneil~ but was a follow-up to a letter wmitten by the old Council which contained some omissions. Also, actually the new Council could not vote on a matter in which they are involved as it would have been a conflict of interest. Mr. Strnad stated that as members of the City Council, they should have been informed and have been a part of it even though it per- tained to previous action. Mr. Roberts referred to this being Mr, Strnad~s opinion and stated he was entitled to have his own opinion. He elarified that the original letter was sent with omissions and this letter was a follow-up and had no bearing on the new Council. Mr. Strnad stated that he agrees 100% with Mrs. Riscoe~s feelings. If there does ~ri~e any litigation due to the contents of this letter, he doesn't believe our City Attorney should have to defend any people who sent this letter to the Governor. Mr. Johnson asked Mr. Vance if there was some way to possibly get this legally straightened out, so it won't come up again and Mr, Vance replied that he has never seen a copy of the letter referred to. He does not know if anything will occur further or not. Mr. Roberts added that he didn~ttthink Mr. Vance should be put on the spot on this matter, The Council should take the action the~ see fit and it should not be discussed further at this time. Mr. Robert~ moved the adoption of the minutes of February 6~ seconded by Mr. Johnson. Motion carried 4-0 with Mr. Strnad abstainingJ PUBLIC AUDIENCE Mayor Harmening requested~ anyone wishing to speak to please come forward. He added that anyone who wanted to speak on any item on the agenda to please give their name to the City Clerk and they will be recognized when that item comes up on the agenda. Mr. Ron Hall, 722 N. W. 8th Court~ questioned the reason for the ordinance against vans and pickup trueks parking at the public beach on the upper level. Mayor Harmening replied -2- MINUTES - REGHLAR CITY COUNCIL MEETING BOYNTON BEACH, FLOP~DA FEBRUARY 20~ 1979 that as he recalled, it was so the view would not be obstructed by a taller vehicle. Mr. Hall replied that going with that think- ing, he thinks it is necessary not to allow Cadillacs, station wagamss and any full sized family vehicle. He explained how a Cadillac had lar<3er dimensions than a van and pickup truck. Mr. Hall then asked what would be necessary to have this ordi- nance changed as he sees no logic in it. Mr. Roberts replied that he believes it was the thinking at the time the ordinance was adopted that'it was difficult to back vans in and out at this area as it is a hazard. Mr. Hall replied that if this was true, why weren't vans restricted from all the parking areas. They are allowed in any area in the City and there are no other restrictions except at the top level of the beach. Mr. Strnad stated at the particular time the ordinance was adopted, it resulted from two accidents involving vans because of the particular type of parking setup at the beaoh. Even with a car, it is diffinult to back up and see someone on the opposite side with the way the parking is arranged. Mr. Hall referred to diagonal parking being all over the City and Mayor Harmening replied that pedestrian traffic is much greater at the beach. Mr. Hall oontinued that this just did not make sense as vans are allowed everywhere else. He referred to many mothers hav- ing vans and explained how it was an inconvenience for them to unload their kids and belongings at the beach. Also, owners of vans and pickup trucks like to park along the beach to look out over the water like others. He thinks the ordinance is discriminatory. Mrs. Riscoe referred tc him being a member of the Recreation Board and suggested that he discuss this matter with the Recrea- t-ion Director. She added that she owns a pickup truok and has children and does nor disagree with the ordinance nor find it diseriminatory. Mr. Hall replied that he did discuss it with the Recreation Direetor and was told to bring it to the Council. He would like to know what he has to do to get this ordinance changed. Is a petition required and Mayor Harmening replied that it might be helpful. Mr. Johnson stated he would like a legal opinion and asked if the ordinance is discriminatory? Mr. Vance replied that he has not read the ordinance in question. The gentleman's reoourse is to attempt to get the Council to modify the ordinance or sue the City. Mr. Roberts referred to this whole thing revolving around safety and explained how there was a hazamd with driving vans. He thinks the ordinance can be studied to see if T~ is illegal. Mr. Hall asked if he had ever driven a van and Mm. Mr. Hall told about having mirrors on his van enabling him to see down to the tires all around and the only place he eannot see is directly below the window which is the same in cars. Mr. Roberts stated with the parking arrangement at the beach, it is difficult to drive anything, there. Mr. Johnson stated he did not think this problem was going to be solved at the moment~ but he thinks it should be looked into. Mr. Hall replied that he would appreciate having it looked into be- oause he believes it is disoriminatory. He does not think there is any reason to keep vans from parking because of b!oeking the view. Mr. Theodore Blum, Village Royale on the Green~ referred to appearing before the Council at the last meeting and stated he tried to point out the importance of having a traffic light at 22nd Avenue and Seacrest Blvd. Unfortunately at that time, he did not have any statistics regarding what has tmanspired at that particular intersection. He has since spoken to Chief Huddteston and viewed the maps of aocidents at various places and the reports. Mayor Harmening advised that this item is listed on the agenda under New Business. Mr. Blum continued that he just wanted to give a few statistics. There have been quite a few accidents and one was a fatality. He would like this given some consideration. Mr. Jacob Bautz, 335 S. E. 36th Avenue, referred to being in- formed that he must hook up to the City sewage system and told about hiring a plumber and showing him the septic tank and conneotion locations. When the job was completed, the City inspector approved it. He then told about having a pool in- stalled and discovering at that time that only one bathroom was hooked up to the sewer. The inspeotor inspeoted it, the p~umber p~unbed it, and he had to finish the job. He spoke to Mrs. Tinker and was assured something would be done about this. The plumber did not do his job and the inspector did not com- plete his work. How would he have known this job was not done right if he did not have a pool put in? Mayor Harmening asked if a licensed reputable plumbing contractor performed the work and Mr. Bautz replied affirmatively. Mayor Harmening asked if Mrs. Tinker had looked into this and Mrs. Tinker replied affir- matively and advised she is waiting for a report f~rom the Htili- ties Director. It was discovered this entire street was not hooked up to the water system and she has requested a report on that also. Mr. Bautz told about going to the Water Department about a year ago for a job and being told the present personnel had to be given the opportunity first to apply for openings and he was informed at that time, there was no water on 2nd Court. Mrs. Tinker stated this was discovered after he made his complaint MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 20~ 1979 and she is expecting a complete report. Mr. Bautz referred to the City having a computer and stated this should Y~ve been discovered before now, Mrs, Tinker agreed and stated it is being investigated. As soon as she receives a report, she will forward it to the Coun- cil. She also must find out if the people in that area ~re being billed. Mr. Bautz asked if there were plans in the future to put City water in and Mayor Harmenin~ replied that he would think so. Mrs. Tinker added that there is no question it will be and she should have the report-within 24 hours and it is under investi- gation. Mayor Harmening asked Mr, Bautz when he first reported this and Mr. Bautz replied that he did last week when he could not get anywhere with the plumbing contractor. It seemed everyone was passing the buck.at the City. There are City codes to protect people and inspections should be enforced. Mrs. Tinker replied that she believed Mr. Bautz came in on Thursday and her off-ice was busy with the agenda and then there was the three day holi- day. Mr. Bautz referred to a plumber of this caliber being watched~ but told about mentioning this to an inspector and being told thatwould be discrimination~ Mr. Strnad requested that the Couneit members each receive an in-depth report regarding who was involved and exactly what took place, Mrs, Tinker replied she was waiting for this report and would forward it to the Couneil members as soon as she receives it. Mrs. Elizabeth Todd, 2003 S. W~ 18th Street, stated she was before the Council tonight to let them know that a number of people are very much concerned about Boynton West not complet- ing the widening of WoolbrightsRoad from 18th Street to Congress Avenue, She told about talking to Mr, Kahlert and being advised the County has nothing to do with this road~ but the City made an agreement with the contractor° She told about researching this matter and stated she has copies of letters pertaining to it. The widening of this street was supposed to be finished when the 30!st C/O'was issued in Section 10. As of last week, 555 residents were living in Section !0. If she missed two maintenance payments~ a lien would be plaoed on her property. She then read part of a letter dated April 15, 1974, from Boynton West Development Co. to Mr, Frank Kohl regarding the traffic signalization being required as a result of the traffic impact analysis, She read part of a letter dated July 29 from the County requestieg the City to make known their comnrltment with the deve- loper regarding the paving of the two additional lan~e of S~W 15th Avenue. She read part-of a letter dated April 26~ 1976~ -5- MINUTES - REGHLAR CITY COUNCIL MEETING BOYNTON BEACH~ FLORIDA FEBRUARY 20, 1979 from Commissioner Medlin to Mayor Joe DeLong with the County again emphasizing the need to expedite the widening of this road. She continued with reading a letter dated May 3_l, !9Y6, from Mr. Frank Kohl to Boynton West advising the City expects them to comply with their commitments and complete this road through Leisureville. She then read a letter from a lawyer representing Boynton West acknowledging their obligation to complete the roads, but advising it will be done at a later date after a substantial number of additional homes are sold. She read another letter from the County Commissioners to Mr. Kohl reminding the City of the need for completing theroad. The next letter from the developer again acknowledges their commit- ment bu~ advises the plans will be prepared by their engineers upon the issuance of the 601s~ C/O or by November 4, 1979. The developer does not have enough money to widen the road~ but is able to start developments in other parts of the County. She then referred to the additional traffic on this road and stated she begs this City Council to get the developer to start working on this before he sweet talks them into getting out of here. Before they know it, the developer will be gone and the road will not be finished. Mayor Harmening stated he thinks an irrevocable letter of credit is in the file in the amount aocording to the County Engineer's estimate to widen this road to four lanes. Mrs. Todd replied that there is a performance bond for 1.2 million dollars. She thinks this developer should be forced to start immediately or the permits and C/O's should be withheld. ~r. Roberts referred to about three or four months ago when the County Metro Planning Organization met and told about the County Commission allowing the developer to extend the time and allowed him to continue to build because of the recession and some problems. They were given approval to continue build- ing until reaching the 600th C/O. He questioned the number of C/O's issued just a few weeks ago and was told the number was 500 plus by the Building Offie±aland he planned to ask .again at the end of this month. Possibly the City Manager can be asked to get a count. Mrs. Tinker stated that she has it. Mr. Roberts asked if it had reached 600 yet and Mrs. Tinker replied negatively. Mr. Roberts clarified that the contract as it stands now allows them to build until reaching the 600th unit or until Noven~er~ 1979. Mrs. Tinker added that~Mr. Howell did write to Boynton West on February 16 advising they had issued 525 C/O's and brought it to their attention the situation of widening 15th Avenue. Mr~ Clark also sent a follow-up letter regarding thesame and advis- ing that the road must be resurfaced also. -6- MINUTES - REGULAR CITY COUNCIL MEETING B©YNTON BEACH~ FLORIDA FEBRUARY 20, 19Y9 Mr. Lee Loveday, 4702 South Lake Drive, referred to writing a letter requesting permission to use a 37 acre tract of land at Charter World for a carnival and stated he did not see this item on the agenda. Mrs. Tinker informed him this would be on the agenda for the next meeting as she thought there would be enough time. She wrote a letter today requesting a eopy of the insurance coverage, Mr. Loveday asked if it was possible to get any infor- mation about it in order to proceed with advertising and Mayor Harmening replied that he didn't see anything standing in the way. Mrs. Tinker agreed and stated she just wanted to get a copy of the insurance before putting it on the agenda and thought there was time. BIDS Sara Sims Park Rest Room Building Mrs. Tinker advised the bids came in too high, She read a follow- up letter received from Mr. Bill Flushing recommending the bids to be tabled and telling about Mr. Doug Dawson volunteering to send a list of contractors who wish to bid on the project. He wishes to retract his approval of the bid and requests the City to again advertise for bids. He suggests the re-advertising to be delayed until the list of contractors is received, Mr. Roberts moved to table this at the request of the City Mana- ger. Mr. Vance clarified that the recommendation is these bids be rejected and the City advertise again upon receipt of names If tabled~ they could not re-advertise. Mr. Roberts rephrased his motion to reject these bids and instruct the City Manager to go out!at the appropriate time for new bids, seconded by Mrs. Riseoe. No discussion. Motioncarried 5-0. Approximately Twelve (12) To,ss of Scrap Metal Mrs. Tinker advised that bids for scrap metal (Water and Sewer Plants) were opened on Tuesday~ February 13, 1979, at 4:00 P,M. in the office of our Purchasing Agent~ Mr. William Sullivan. Two bids were received. One bid was received from Sam & Dee Antiques and they are interested in the scrap fire hydrants only (~pproximately 8 or !0). United Iron and Metal bid $50.00 per ton for all the scrap iron and m~al. The Tabulation Committee recommends selling the fire hydrants to Sam and Dee Antiques and the balance to United Iron and Metal Co. Monies received from this sate will be credited to the Utility General Fund Account~ A copy of the Tabulation Sheet and proposals from United Iron and Metal Co. and Sam and Dee Antiques are on file. Mr. Strnad questioned what was going to happen to the fire hy- drants which are broken and Mayor Harmening replied that he assumed they would be thrown in with the scrap metal. Mr. Strnad moved to accept the bids, seconded by Mrs. Ri scoe. No discussion. Motion carried 5-0. PUBLIC HEARING - 8:00 P. M. NON~ SITE DEVELOPMENT PLANS Description: Location: Use: Applicant: A Parcel of Land Located in Palm Beach Farms Co., Plat No. 8, and a Parcel of Land Located in Section 30, Township 45 South, Range 43 East (98 Acres) West of Congress Avenue and North of Lake Worth Drainage District No. 26 Canal Multiple Family Development and a 20 Acre Commercial Development (Meadow Lakes) Hank Skokowsk~ of Urban Design Studios Ms. Sally Benson, attorney representing the applieation, intro- duced the people working on this project: Mr. Hank Skokowski, Urban Design Studios, who will g~ve the presentation; Ms. Linda Davis, consultant to Mr. David Reed; Mr. David Reed, purchaser of the property. She referred to this plan being tabled two weeks ago because of some revisions which were made and told about it being reviewed since that time by Mr. Annunziato and the Planning $ Zoning Board and being unanimously approved with the changes. Tonight, Mr. Skokowski will make a presentation to briefly outline the changes made. Mr. Henry Skokowski, President of Urban Design Studios, stated the original site plan was developed at 10.79 units Der acre yielding 842 total units on the site of 78 acres~ He pointed out there was an error on the agenda in that the site consists of 78 acres for residential and does not include the 20 acre commercial parcel. They have revised thesite plan and accom- modated all the goals of the City. The revised site plan is for 542 units, a decrease of 500 units, a 35% reduction. The gross density is now 6.9 dwelling units per acre. The lake has been analyzed and if removed, the overall net density would only be 8.88 units per acre and the ~onin~ allows 10.8. As a result~ the buildinc coverage has been decreased by almost 10% to 6~%. The parking requirements dropped 600 spaces. Mr. Skokowski then stated he would like to point out some modifi- cations in the site plan. The original site plan called for a mixture of rental and owner occupied units primarily because of the density, but they do not feel with the reduced density they would be able to provide rental type housing, so all 542 units planned would be owner occupied. The site plan has been revised MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 20, 1979 to accommodate the Recreation Department's objectives and he pointed out t~t it was relocated to link with the civic recrea- tion area across the canal. The types of dwelling units have also been 'modified. Phase 1 is the only portion remaining with three story gamden apartments. The balance of the plan ~is two story garden condominiums on the lake and two story townhouses on either side of the recreation area. He then explained how this would be compatible to the surrounding areas. They are still willing to meet all the obligations of the City and County regarding funding of the school program~ road improvements, recreation requimements, utilities, etc. Mr. Johnson asked if the three story apartment buildings would have elevators and Mr. Skokowski replied affirmatively. Mr. Johnson refer~ed to there still being a question whether these would be compatible to the neighborhoods surrounding it and referred to Cranbrook Lakes with single family homes, Quail Ridge having single family homes, Leisureville with one story apartment buildings and single family homes. Looking at this development~ he does not feel it is compatible to the neighbor- hood. Mr. Skokowski showed an aerial photograph of the site and explained how there was a separation of the property to the east with a 450 ft. strip of commercial property~ Congress Ave., and an Australian Pine Hedge and the nearest distance to a Lei- sureville building is 600 to 700 feet which they feel is sub- stantial. He referred to the property to the south and pointed out the separation of an 80 ft. canal~ 200 ft. strip of land for civic use. Their program for the south propertyis two story townhouses which is the same as planned on the Kirsner- Cogen property. The property to the north is proposed for duplexes and their plans are to build duplexes mn the north. He then explained that they also had buffer provisions within their property. The property to the west is zoned R-3 and they do not know what is planned~ but their plans are to have duplexes inthat area on their property. The development fur- ther to the west is separated by the Quail Ridge Golf Course and the development is not single family detached units. Mr. Johnson disagreed and stated single family homes were located directly west. Mr. Skokowski pointed out the location of the single family development and stated it was separated with 300 feet of vacant property as well as the golf course and their plans in this area mall for single story development. He then explained how the relationship of their parcel just did not compare with the others with being bordered by commercial~ industrial anda school on Congress Avenue. They also do not have the identity of having access off Golf Road. It will also cot be a golf course community. Mr. Roberts asked how many three story units were planned and Mr. Skokowski informed him the only three story uhits left are located on the lake consisting of 192 dwelling units. Mr. Johnson asked how many buildings would be three stolies and -9- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, PLORIDA FEBRUARY 20~ 1979 Mr. Skokowski explained there would be seven buildings grouped in clusters of two and three modules. There will be about eight apartments per floor in'the three story buildings. Mr. Johnson referred to there being two story apartments on Woolbright Road and two story four-plexes on South Congress Avenue and stated that three story apartments do not conform to the neighborhood and he cannot accept the plan as it is. Mr. Roberts questioned how much it differed from the Comprehen- sive Plan~and Mr. Annunziato replied that the Local Planning Agency has held public hearings on the Comprehensive Plan and they will be meeting this Thursday night to prepare a recommen- dation to the Council. Adoption of the plan will occur in June. Mr. Roberts asked if he felt the reduction of 300 units is fair and Mr. Annunziato meplied that it is substantial. He added that many'objections raised by the Planning g Zoning Board pre- vious!y had to do with buffering and they have gone a long way to address the specific issues which were raised. The land is zoned for 10.8 dwelling units under specific conditions. The last issue remaining evidently is the compatibility. The land is currently zoned R-S, but is recommended for low density in the Comprehensive Plan. Mr. Leo Feinstein, 1390 S.W. 17th Avenue, stated he is very much opposed to making any concessions for lowering this area and this project, to his way of thinking, lowers the area. Directly to the west is Quail Ridge which is one of the nicest projects in the area and to the east is Leisumeville which con- sists of nicely kept homes. This project will bring in a large influx of people with children and schools will have to be built. He does not see any reason why the City should make any allowances to lower the density when upgrading the City. Mr. Johnson made a motion to reject the planas submitted ahd turnback to the Planning $ Zoning Board. Mrs. Riscoe seconded the motion and stated it was based on one point. If itwas confirmed with two stories~ she would agree; but she does not agree to anything above two stories. Mayor Harmeni~g clarified that it was moved and seconded to deny this site plan because it is not in keeping with the area. Hnder discussion, Mr. Roberts stated he did not know how many times it could be sent back to the Planning S Zoning Board. Mrs. Riscoe commended the developer for taking away the rental units. The three levels should be brought down to two. She attended the meeting and saw the re- vised plans in detail. She thinks they can do a little more and come back with two floors. Ms. Benson asked the City Attorney if this could go back to the Planning & Zoning Board as she be- lieves if it is mejected by the Council tonight, it dies. -10- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLOPIDA~ 1979 Mr. Vance replied that he would have to study the mode and asked the City Planner if there was a time limit in the code on resub- mittal and Mr. Annunziato replied negatively. Mr. Strnad asked if we were on good legal grounds to reject this in view of the presentation and Mr. Vance replied that the existing zoning would permit 10.8 units per acre. The proposal is eonsiderably below the maximum which mould be obtained. The proposed Comprehensive Plan~ while in the proeess of being ~ormulated, is not in exist- ence at this point in time. Taking those factors into considera- tion, it ~would be problematical whether he mould defend the basis for the denial. Mr. Roberts referred to being mo~eerr~dqwith the projects planned, some which were not built after the land was rezoned but the-lend,was sold. In this ease, the whole thing depends on the western end of this project. This has been pro- perly buffered. As far as he is concerned, they have eut down to 542 units and the density is within the bounds. They have complied with all the requirements. He doesn't think it will affect Leisurevi!!e and there has been no opposition presented from Quail Ridge, Under the mireumstanmes~ he w~u!d be inclined to give them a fair shake. Mr. Strnad stated he would not vote on this at this particular time until he gets a concrete opinion from the attorney whether we can legally do this. If we can, he would vote nay. Mayor Harmening requested clarification from Mr. Vance. Mr. Vance stated that it is one of his duties to defend the actions of the City Council. Ne thought he answered the question previously the best that he could. In view of the fact he might end up litigating this item on behalf of the City, he doesn't think our mhances would be very good. Mr. Roberts referred to the question being whether we can vote on this and he says we man and it would be perfectly legal. He has given his reasons to vote against the motion as he is in favor of the projeet. Mayor Harmening added that the attorney's last statement was clear enough. He then requested Mrs. Padgett to take a roll call vote. A fourth gentleman was scheduled, but eould not make it because of the snow. We feel we have seleeted a man we can all work with and be proud of and his name is Denver Baxter. At this time, the Chair will entertain a motion to appoint Mm. Denver Baxter as City Manager. M~. Roberts stated in view of what happened at the workshop meeting, he nominates Mm. Denver Baxter to the office of City Manager~ semonded by Mr. Johnson. Under diseussion, Mrs. Riscoe stated she just wanted to take a few moments of time. We are talking about an advertised position with the figures of $25,000 to S30,000 for this partieular position. We have instructed our Personnel Director to advertise in several newspapers and maga- zines. She was misguided last night by some of our Council peo- ple with being told it was advertised in the Florida League Munieipal Book~ but actually it was in the Datagram and has not appeared yet in the Florida Municipal League Magazine which is to come out within a week. During our workshop meetings, the entire consensus was to get a Florida man. The feet is we have talked to just four individuals and out of the four~ we have not had any input from people within our own state. Due to weather conditions, one gentleman was unable to get here from South Carolina and she thinks we should go through with our obligations and interview him, She told how the policy followed by the com- pany she works for was to interview more than four applicants for a position. Then upon coming home from work tonight, she found out additional things, She will not vote for this gentle- .man until such time as we run a police cheek on this gentleman and do this on ~1 the applicants to make it equally fair. Mayor Harmening replied that in the 75 resumes received~ at least 15 were from Florida and Mrs. Riscoe stated this was thanks to the ad in the Miami Herald. Mrs. Riscoe continued that we advertised for someone with experience of a population of 25,000 or above and this man came from a city with 6~000 population. We advertised for five or more years experience~ but this man only has 4~ years. She believes we should give the people a better run for their money, Mm. Strnad stated as he stated last night, he eertainly has no objection to Mr. Baxter but thinks we-are doin~ a great disser- vice to the gentleman invited from South Carolina and due to weather conditions~ he could not'eome for an interview. Also~ in his mail tonight were more resumes. For a job with this pay scale, he does aot think it should be expedited to pick a man immediately. We have a very capable person ~unning the City right now and if she is doing anything wrong~ he would like to know and would remove her. As far as he knows~ everyone has been getting along. We should take 6ur time to pick a City Manager. Mayor Harmening referred to actually interviewing Mr. Baxter two times and stated the Council agreed last night that Mr. Baxter was what we are looking for and we could find nothing derogatory about his background or resume. He feels the City is in dire need of a City Manager. We have spent appmoximately two months in the search. It is his feeling some members of the Council are drag- ging their feet on this matter for reasons known to themselves. He explained how people from all over the United States woul~ be interested in a fmee trip to Florida for an interview. Mr. Baxter is certainly well qualified and is a C.P.A. Generally the C.P.A. exam is harder to pass than the bar exam. He has management background in industry, He has been a City Manager in Florida in two small towns. Mr. Baxter certainly-presented an excellent appearance. However~ from the indications tonight, it appears the vote is going to be 3-2 and he doubts the man would accept the job on those terms. Mr. Roberts agreed with Mayor Harmening~s statements and stated there was full agreement of the Council last night. He told how the City Manager was chosen six years ago by himself and Mr. DeLong. We have reviewed many applications and narmowed it dom~ to interviewing three. He does not think the City should spend money unnecessarily and g~ve people from the north a free ride down. The cost is approximately $300 to ~400 for each interview. As far as looking into the backgmound of Mr. Baxter, he would be glad to investigste his background. He told about doing this for another applicant. Mr. Strnad clarified that he was satisfied with Mr. Baxter based on the applicants interviewed, but we only interviewed four people and he says we have not screened enough. Mayor Harmening asked if 75 applications were not enough and Mr. Strnad replied it was not enough from Florida with the qualifications asked for regarding population, etc. Mr. Baxter is from a city of 6,000. Mr. Johnson referred to this being a touchy subject and stated it appears he will be voting against the two Council members he ran with, but must vote his conscience. As far as the gentleman from South Carolir~-~ he thinks in the discussion last night that we pretty we]] analyzed that with his qualifications we would mot vote for him. Assuming he would only get two votes, why pay his way down here? He thinks Mr. Baxter is qualified having been a City Manager and working for a large company ~efore going into city government. He thinks personally we should get down to taking care o~ the City's business and that is by himing a City Manager. MINUTES - REGHLAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA FEBRUARY 20, 1979 Mrs. Riseoe clarified that all she asked for was to wait until the publication~comes out either Friday or Monday and get input from Florida residents. She agrees Mr. Baxter was the best of those brought in~ but feels we should wait another week. Sometimes haste does make waste. Mayor Harmening replied that the Datagram goes to the same people as the Florida Municipal League publication and it was published in January. Mm. Roberts stated under these circumstances, he withdraws his mo~ion as he does not think we should have a man brought in with a ~plit vote as it would not be fair to him. He does not think it makes for good relations. He will have to withdraw his motion and we will have to suffer a little longer without a professional managem, but it may be in the best interest of the ~ity. SITE DEVELOPMENT PLANS (Continued) Applicant: Hank Skokowski of Urban Design Studios Mr. Strnad stated he has been .advised by the City Attorney if the Council reconsiders the motion to deny Mr. Skokowski the presentation he made, they would consent to building all ~wo story buildings. When they became aware of the ebfection by the Council~ they got together and have revised the site plan. Heexp!ained how this would merely establish a procedure which the Finance Department can use to apply to travel in any department. The department will not have any money to do any traveling unless submitting a request. He explained how when someone travels, the amounts received will be limited to the budgeted ~unds and per the terms and provisions of this res61ution. Mr. Roberts questioned if it would conf!iet with taking effect immediately and Mr. Vance re- plied that it merely establishes a standard uniform procedure and the Council will be able to fill in the amounts. Mayor Harmening remarked that this was barely adequate and stated that he studied this and suggests ~50.00 for that particular blank. Mr. Howell explained that the City must enforce the Housing Code and when buildings are found to be sub-standard, the owners are notified to bring them up to standard and if not complied with, they are demolished. In this particular case, the owner did not have the money. He told about there being problems with transients moving in, trash being dumped in them, windows broken~ etCo However~ the County Housing Authority is looking at eight buildings on that street to bring them up to standard. Mr. Johnson asked who would be paying for these demolitions and Mr. Howell replied that Com- munity Development would. Mr. Johnson asked if the owners would be billed and Mr. Howell replied that Community Development had not liened any properties to his knowledge. Mr. Johnson stated that this particular individual owns apartments in different cities and he cannot imagine HUD paying for it. Mr. Howell in- formed him that he did not have any control over this. Mayor Harmeninq stated that a lien could be filed and Mr. Howell agreed and this is the purpose of the resolution. He added that there is the possibility the County Housing Authority will purchase these properties and Mr. Johnson replied that even if they do, the owner should be forced to redo them. Mr. Howell told about the Building Department getting no results with hav- ing the owner refurbish these units. Mr. Vance explained how liens took a period of time to collect and according to the resolution, we have recommended that a lien be p!aeed, but we cannot make Community Development place a lien. Mr. Johnson stated it is hard to believe that tax dollars are spent when the individual has the money and he thinks it is totally unfair. He has been working with the Chief and what they would like to do is rescind Resolution No. 78-HH~ and reinstate the rules in effect since 1972 and in 60 to 90 days, al! pa~ties will work out a set of promotional procedures compatible in the depart- mont. Mr. Roberts referred to it not being the same as the previous rules and Mr. Sullivan replied that everything should be the same as it was prior. This is a temporary measure and he has talked to everyone concerned in the department. Mr. Roberts asked if the Civil Service Board was notified and Mr. Sullivan explained that the department submits a set of rules and it is forwarded to the Civil Service Board, City Manager and City Council. Chief Wright requested that during this period~ there would be no promotions within the department until this can be settled, with the exception of fire fighter and fire fighter driver. Coffey - Re: Access to City Landfill Area Mr. Vance stated he has not had the opportunity to review the lease, but gathers from correspondence this is essential for access to the land fill area and apparently renewal is simply a matter of mailing the check for the yearly lease payment of $~ 200. Mayor Harmer~ng added that actually-payment should be authorized to continue the lease in effect. Mr. Johnson referred to not using the present landfill area and Mrs. Tinker replied that we do use it for trash. She added she would also appreciate approval being included of the direct pay- ment requisition in the amount of $!,200. Mr. Vance referred to this involvinc a claim we have in bank- ruptcy against Village Royale Management Company, Inc. and stated apparently the owners in Village Royale on the G~een made the necessary payments to Village Royale, Inc.~ but the payments did not get to the City. We have filed a bankruptcy e!aim, but it is doubtful it will be paid. Village Royale on the Green has agreed to guamantee payment of the amount we are owed waiving interest. They also need to raise the money and have requested a year to make payment. Based upon our probability of collecting through the bankruptcy proceedings, he thinks this is a good agreement. He requests a motion to authorize this procedure and authorize the City Manager to sign the letter f~om Village Royale on the Green Owners League, inc. to himself dated February 8, 1979. NEW BUSINESS Discuss Plans for Fifty-five (55) Acme Tract and Prepame Specifi- cations for Submittal to Palm Beach County Commissioners for Funding Councilman Ronald Johnson Mr. Johnson recommended having Mr. Frederick prepare a plan for this 55 acres which will benefit all the City. He is sure Mr. Frederick is aware of the needs. He then moved to have Mr. Frederick prepare a plan~ seconded by Mr. Roberts. Under dis- eussion, Mr. Roberts referred to receiving a letter from the County Commission advising they have allocated ~250,000 to municipalities~ so there is money available. He added there were also the ~ederal Revenue Sharing Funds to be used and that amount was ~228~000. Mayor Hammening suggested that it may be adviaab!e to meet with Mc. John Dance since the County may be funding it.and he is the Director of County Recreation. Mr. Stmnad stated that he is not pmepared to vote on this because it involves matching funds from the City. He wants to find out what is entailed. He would like a feasibility study first of all before going into planning. Discuss the Future Widening of Seacrest Boulevard from Boynton Canal to North City Limits - Councilman Ronald Johnson Mr. Johnson stated in looking through information,, it appears that the City owns this street and should take legal action to turn it over to the County as soon as possible. We should make sure this is a County road so we will not be responsible for the cost of widening, Mayor Harmening and Mr. Roberts replied that this is a County road and Mr. Johnson stated that the legal action has not been taken to turn this over to the County and it should be done immediately, Mr. Vance advised that we are in the process deciding who gets what roads pursuant to the new legislation adopted by the D.O.T. He believes Seacrest Blvd. will be a County road and Mr. Clark ag-reed and stated it was subject to ratification of the agreements between the City and County, Mayor Harmening clarified that the City is contemplating no action to widen it and Mr. Vance meplied that he believes we are trying to assume the best negotiating stance to end up in the best position we can, The matter is currently under eon- sideration. Mr. Roberts told about there being litigation against D.O.T. because of their default in repairing sidewalks and highways and suggested we cheek into this. Mr. Vance replied that the City Manager has forwarded correspondence from the City of West Palm Beach regarding this lawsuit and he is taking a look at it and will make a recommendation at the next meeting. Consider Signalization Traffic Light at North Seacrest Blvd. and N. E. 22nd Avenue Councilman Ronald Johnson Mr. Johnson stated he would like to make a motion to take the necessary funds to place a signal light at this intersection. He told about the dangerous eondition existing at this inter- section. Mrs, Tinker advised that she wrote a letter to Mr, Charles Walker~ Direetor of the County Traffic Division~ and made reference to the eonsiderable increase in traffic at this intersection and requested a study to be made to upgrade the existing blinking signal to a timed stop-go signal. Discuss State Requirements for City Pa~amedics - Councilman Johnson Mr. Johnson stated that we need immediate response from our param~c units, The indication he has received is that we are not up to par. He reaommends that the City Manager set everything in mo~ion to get a medical director and possibly the medical director of Delray Beach will be of some help. Mrs. Tinker infommed him that she has met with the paramedics and this is in the works. Mr. Vance stated that we have ascem- tained we do have advanced lif~ support situation under the Florida Statutes. !nthis event~ we are required to contract with ~ medical director to supervise and accept the responsibi- lity for the emergency medical technicians and paramedics func- tioning. He would suggest getting some prices. The biggest price we ame going to encounter is not obtaining the physician, but paying for his malpractice insurance because he is assuming the responsibility for the paramedies. Mrs. Tinker replied that she spoke to the paramedics and was advised that malpractice insurance would amOunt to about $2,000 rom the premium. Mr. Vanee replied that he preferred to get some quotes from insur- ance carriers. Mayor Harmening requested Mrs. Tinker to follow up on this matter. ~qqsideration .... for Adding Two Patrolmen to the Police Force. and Four New Cmuisers Mr, Johnson meferred to the Police Chief making a request for eight new cruisers and stated he thinks we should compromise and approve four. He then made a motion to hire two Bdditional patrolmen and purchase four new eruisers. Mr. Roberts asked if the funds were budgeted and Mr. Johnson included in his motion that the amount be taken fmom the Federal Revenue Sharing Fund. Mayor Harmen/ng replied this ~und was all commited and a public hearing would have to be held. Mr. Robemts referred to it being close to budget hearings and asked if this was an emez~3ency? Mms. Tinker replied that the police needed eight cruisers and did not get any last year. The cruisers are all in sad shape. She has been told the cruisers are in bad shape and cannot be repaired. Also, this morning~ she was informed that another was totalled in an accident over the weekend. Mayor Harmening suggested that the City Manager bring this back at the next meeting with the full backup material regarding the Chief's request. The Planning & Zoning Board, at their regular meeting of Feb- ruary 13, 1979~ unanimously recommended that the Preliminary Plat for Ridgewood Estates be approved subject to the provis6ss submitted. The motion to approve was made by Mr. Mauti and seconded by Mr. Hester. The Planning & Zoning Board minutes are not available at this time. Also submitted was a petition re- ceived pertaining to this area. Mrs. Tinker then read a letter from Mr. Charles Walker~ Director of Palm Beach County Traffic Division, advising they did make a traffic count on January 9 at S. Wo 6th Street and S. W. 23rd Terrace which indicated 27199 vehicles per day. While this is in excess considered to be desirable on a residential street, they do not feel either of the two alternatgves would eliminate the thru traffic problem being experienced. If 4th or 5th Street was connected to 23rd Avenue and the existing aecess was elimin- ated~ the problem would just be transferred. They have no objec- tions to the proposed plan for Ridgewood Estates and see no advan- tages in the two alternatives p~oposed. Mr. Rudy Blank, 702 S. W. 25th Place, informed the Council that the homeowners and taxpayers of this community, particularly those with young children, are disturbed the developers of Ridgewood Estates have not made plans for an entranee on 23rd Avenue. The County took a traffic count and it is stated that the amount is excessive for a residential area. They are not asking to close 6th Street, but to have another access road to 23rd Avenue to distribute the traffic and provide exit for an emergency. They request the Council to hold approval until the developer makes plans to provide a proper opening onto 23rd Avenue. Also~ it was discovered after the last meeting that Mr~ Mauti~ a member of the Planning g Zoning Board, has family 'living on 4th Street and this means a conflict of interest and he should have disqualified himself from voting on this matter. Mr. Johnson questioned the possibility of having a road coming out of this subdivision onto 6th Street next to 23rd Avenue, so there would not be another exit onto 23rd Avenue and Mr. Annun- ziato rDplled this was one of the possibilities mentioned~ but there is the safety factor to consider. -29- MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLOP/DA FEBRUARY 20, 1979 Mayor Harmening asked if the Police Department looked at this sit- uation and Mr. Annunziato replied affirmatively and they indieated if 5th Street is connected~ the people would not decrease their speed when turning because there would be no curve and also the stacking capacity down a decline is not the safest situation. Mr. Blank then explained a plan of the alternatives. Mr, Vance referred to the memo from the Recreation Director relat- ing to a p~oposal by the developer to construct facilities at an existing park rather than pay the normal fee as required and stated it is not~shownwhat the substitute proposal is. He has not com- pletely evaluated this~ but there is no procedure in the City Code to do this. The developer is either required to provide space or pay a fee. This should be ironed out before the City Council considers this plat. He would~ therefore, recommend this matter be tabled until the next meeting of the City Council.
