AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, RESCINDING, IN
ITS ENTIRETY, ORDINANCE NO. 097-40, WHICH
SUBMITTED TO REFERENDUM AN AMENDMENT OF THE
CHARTER TO DELETE IN ITS ENTIRETY ARTICLE IV-A
ENTITLED MERIT SYSTEM FOR PERSONNEL AND
WHICH WAS PASSED ON AUGUST 5, 1 997; PROVIDING
FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE
DATE.
WHEREAS, Ordinance No. 097-40 was passed on August 5, 1997, and
submitted tO referendum an amendment of the City Charter to delete in its entirety
Article IV-A entitled "Merit System for Personnel," thereby abolishing the civil
service system for all personnel; and
WHEREAS, the City Commission has determined that it is in the best interest
of the citizens of the City of Boynton Beach to rescind Ordinance No. 097-40, in
its entirety, thereby removing the proposed charter amendment stated in Ordinance
No. 097-40 from consideration at the March 1 0, 1998, general election.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The foregoing whereas clauses are true and correct, and are
now ratified and confirmed by the City Commission.
Section 2. Ordinance No. 097-40, passed on August 5, 1997, is hereby
rescinded in its entirety, thereby removing the proposed referendum question to
amend 'the charter as stated therein from consideration by the electorate at the
March 10, 1998, general election.
Section 3. All ordinances or parts of ordinances, resolutions or parts of
resolutions in conflict herewith be and the same are hereby repealed to the extent
of suc,h conflict.
Section 4. Should any section or provision of this ordinance or portion
hereof, any paragraph, sentence or word be declared by.a court of competent
jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part
shall be considered as eliminated and not affecting the validity of the remaining
portions of the Ordinance and its application shall remain in full force and effect.
Section 5. This ordinance shall become effective immediately' upon
