Minutes 11-07-78YLIN-dTES OF %=HE SPECIAL CITY COUNCIL MEETING HELD AT CITY HALL~ BOYNTON BEACH, FLORIDA, TUESDAY~ NOVEMBER 7~ 1978 PRESENT Emily M. Jackson, Mayor Edward F. Harmening, Vice Mayor Richard D. Catdwe!l, Councilman Joseph DeMarco~ Councilman David Roberts, Councilman Prank Kohl, City Manager Tereesa Padgett, City Clerk Mayor Jackson welcomed everyone and called the meeting to order at 8:00 P. M. She announced it was a Special Meetin~ of the City Council in accordance with Section 56 of the City Charter of the City of Boynton Beach to consider the rezoning request of Faber g Kirsner pertaining to two pieces of land at the corner of Wool- bright Road and Congress Avenue. She explained that the special meeting was called to hear this request because it was advertised before it was remembered the regular City Council meeting would be postponed because of election day. Mr. Kohl then informed the Council of the following pertaining to this request: Parcel: Portions of Section 31~ Township 45 South~ Range 43 East (105.83 acres) Request: Rezone from Agriculture to PUD with LHI of 4.1 Location: Northwest corner of Golf Road $ Congress ~ve. Use: 509 Garden Apartments, 51 Tow~houses and Villas Applicant: Faber $ Kirsner, Attorneys at law for Frederick Zeiger, Trustee The Planning $ Zoning Board after conducting a Pub!is Heari~ at their regular meeting of October 24, 1978, recommended the r~.zon- ing request submitted by Harry Kirsner to rezone 105.83 acre tn?act from Agriculture to PUD with LILT of 4.!~ said project consist of 509 garden apartments, 51 townhouses and 80 villa gross density of 6 units to the acre and aet density of 13o6 units per acre, be approved subject to the comments submitted. The motion to approve was made by Mr. Lambert and seconded Mr. T~auger. The vote was 4-3 with Mr. Arena~ Mr. Winter and Mr. Ryder dissenting. Also submitted to the Council was the legal desoription~ sketch showing the location and excerpt from the Planning & Zoning Board meeting mi autes covering the above project. Mayor Jackson then requested the representative to give a presen- tation. Mr. Harry Kirsner came before the Council and advised that they are requesting rezoning of a 120 acre tract with two separate applica- tions, one for commercial and one for PHD. Most of the mumk has been mined and a large ~5 aero lake is left. He referred to dredging and filling being nemessary and advised that this brought the most per aore to $25,000 to $30~000. Also, this property is very diffimult because on the north boundary of the property, Woolbri~ht Road has to be dedicated and 7~ mares is lost and actually ~uins about 10~ mores. They are proposing not only to donate the right-of- way but construct the right-of-way. When in the County, this land was zoned at 6 units per acre; but when annexed into the City of Boynton Beamh, it was zoned 6 to 7.1 units per amre. They have been fighting the problem to get the allotted number of units on the land with the minimum amount of filling. About 56% of the property is taken up by parks, road right-of-way, and lake. He then read the Florida Statute regarding density of pro- perry when annexed by a city. Before annexing~ they were scheduled at 6 units per acre and they have been working on the plan to meet this for a year with Mr. Annunziato. The two plans shown are the plans approved by the ?!anninc & Zoning Board but some refinements have been made whioh Mr. Brad~haw will present. He then introduced their p!anr~ng and engineering team: Mr. Walter Taft Bradshaw, Mr. Charles Putman, Mr. Joe Rime, and Mr. Stanley Olesiewics. He requested Mr. P/me, the Traffim Engineer, to montinue with giving information about road improvements and traff~m signals. Mr. Joe Rice, 1800 Coral Way~ Miami~ stated that all developments such as this deserve a traffio impact study. He explained how this was done in two parts, commermial and residential, He pointed out the proposed roadways and explained how the traffic generation was determined. He told about the construction of Woolbriqht Road planned. He explained the amcess from Congress Avenue for-the present and future. He read the major traffim improvements agreed upon. Mr. Coldwell mlarified that there would be no access road from the front development along Congress Avenue to the bamk develop- ment and Mr. P/ce agreed. Mr. Coldwell asked how many units were planned ~or this small section of land and Mr. P/me replied 180 units. Mayor Jamkson questioned the acreage and Mr. P/ce informed her it was 9 amres. Mr. Taft Bradshaw, 4337 SeagraQe Drive, Lauderdale by the Sea, stated that this property is unique in location, neighbors and design po~ntia!. They have tried to satisfy all the require- ments projeoted. This falls within the range projected in the master plan for the City as the gross density. As a PMD, the whole concept was to offer a variety of life styles, amehitec- tufa! character and physioal arrangements with having the least amount of adverse effect to the perimeters. He explained how the density was maximized adjament to the greatest amount of open space. As the application stands which was presented to the City and acted on by the Planning $ Zoning Board~ the projected density is 20 units per aere in the brown areas (apartments). Concern .was expressed about this together with the buildings being four stories and they have revised the eoneept plan after considering this. The pmojeet will have recreation spaces throughout with an internal pedestrian system. He explained the separation between the areas. He then referred to the pocket along Congress Avenue and explained that their revised reeommendation was to reduee the density in this particular pocket f~om 20 units per'acre to a maximum of 15 units with the height of the buildings not exceeding three stories. Also, they have recommended the other two apartment areas be limited to tlr0ee stories but be developed at 20 units per acre. They feel they have met the requirements. They have received majority approval of the Plan~ing & Zoning Board~ met the staff requirements and aoneerns of the City and County. They feel this is an exee!lent plan for this property. Mayor Jackson questioned the leg shown on the bottom of both plans and Mr. Bradshaw replied this was a townhouse area with a separate collector road in the front. Mayor Jackson asked what was to the right of this area and Mr. Bradshaw replied that it is the Quail Ridge Golf Course. Mr. Roberts referred to the remarks about this land being an unusual situation~ having di~eulties, etc. and asked if the present people have owned it sinee 1971 and Mr. B~adshaw plied affirmatively. Mr. Roberts commented that the character was the same in 1971 as it is today and Mr. Kirsner replied that they have been mining the muck out ofiit. Mr. Roberts referred to the same unusual characteristics existing in 1971 as they do today and Mr. Bradshaw agreed and told about meet- ing with Mr. Kirsner in 1972 to discuss plans and the muck excavation began. However~ in 1973~ there was an 'economie reeession and since then~ the land has been annexed i~to the City. It is eorrect that the eharacteristies of the property are the same. Mr. Roberts stated that between 1971 and now~ many changes have taken place in regard to zoning~ development~ etc. and he wonders why it was not developed in 1971 when there were no restl~iutions of any type. Mayor Jaekson referred to the area at Congress Avenue and Golf Road and Mr. Bradshaw explained there would be apartments on the eorner with villas down Golf Road. Mr. DeMarco a~ked if these would be three story units and Mr. Bradshaw replied that the villas are one story and the apartments are thi~ee st~ies. The other units will be one and two stories. Mr. Roberts questioned the total number of units in the entire project and Mm. Bradshaw informed him the total is 627 with the differenee oecuring with the reduetion of 20 units to 15 in the poeket on Congress Avenue. -3- MINUTES - SPECIAL CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 7, 1978 Mr. Caldwell referred to the Florida Statute read by Mr. Kirsner and Mr. Annunziato replied that it applies to gross un/ts, but the County plan is no longer in effect for this property and two years after annexation, the City ean rezone. Mr. DeMareo asked when it was annexed and Mr. Annunziato replied in Spring of 1976. Mr. Kirsner elarified that the original application was presented in April, 1978, but a lot of doeumentation has been required. His cheeks were dated April 21, 1978. They fell under two ordinances and had to hire engineers to do more e~neering study. Their first application was submitted within the two year date. Mr. Caldwell asked if the recreation problem had been resolved between the developer and the City and Mr. Annunziato replied that it has been resolved to the extent of the water tower site. The recommendation of the Planning & Zoning Board is that the water tower site be included in the divia dedication for parks and recreation. The application was still approximately ~ acre short and the app!ieant has expressed his desire to turn this into a dollar amount. Mm. Caldwell asked if the apartments were going to be rental and Mm. Kirsner replied negatively and explained they would be eondo- mir~ums due to the expense of preparing the land. He added that it will be a Rolls Royce type neighborhood with entranced features. T~ese will be expensive condominiums because of the site prepara- tion, donation of Woolbright Road and road impmovements. Mr. Harmening questioned the priee range and Mr. Kirsner replied the one bedrooms would start at g4Q,000~ but the villas will be g80, O00 to $100~000. Mayor Jackson asked how the lake would be kept from becoming stagnant and M~. Kirsner replied that the depth would prevent this whieh the engineer will explain. Mr. Stan Olesiewicz, Vice President with Sehwebke-Shiskin & Assoeiate~ informed the Council that they first beeame involved with this property over three years ago when they made a topo- graphical survey. They found the property contains a large irregular lake resulting from the farming of muekaand peat. Fill is required to conform to the proposed land use plan. The lake is very irregular ranging in depth from 6 ft. to 20 to 30 feet deep. With filling required for the land, it will cost approximately S20,000 to $30:000 per acre. They have complied with the requirements of the City~ County and South Florida Water Management District. Mr. Olesiewiez continued that they have agreed to dedicate and build Woolbright Road which comprises 7~ acres. He explained how an access road would serve the residential areas. Along Congress Avenue, they are dedicating an additional 10 ft. strip of might-of-way running the length of the propmty. He explained the street system planned with 60 ft. rights-of-way selected to provide good drainage and water munoff. The plan has received concep- tual approval from the Water Quality Management District. He explained the drainage sy stem thoroughly. He explained the con- tmol and outfall of the lake. Mr. Roberts referred to most developments having a lake ~or drain- age and asked if a 45 acre lake was required on this property and Mr. Olesiewicz replied negatively ~a[nd- it could have been smaller. Mr. PDberts stated that they sold t~e muck. Mm. Olesiewicz olari- lied that the existing lake is appmoximately 47 acres and it is p~oposed to be about 35 acres. He pointed out the areas to be filled. Also, thei~e will be 7-1 slopes as mequired by the South Florida Water Management District. Mr. DeMareo asked if they planned to get the fill from dredging and Mr. Olesiewiez replied affirmatively. Mr. DeMarco referred to the depth and Mm. Olesiew/cz replied from 35 to 45 feet since all the mcr has been removed. Mr. Ca!dwell asked if there would be any problem with weed eon- tro! in this lake and Mm. Olesiewicz replied negatively and ex- plained how the sloped area would extend into the water and at a depth of 40 feet~ there would be no problems with weed control. Mayor Jackson asked who would take care of the lake and Mr. Olesiewicz replied the homeowners association would and Mr. Kirsner added that the documents have been submitted to Mr. Moore. Mr. DeMarco referred to there being laws prohibiting the digging at certain depths and Mr. 0!esiewiez agreed there were in certain areas but explained that a study and report was made and the South Florida Water Management District stated not to exceed 50 feet. Mr. Harmening referred to the PUD embraoing the area and Mr. Kirsner explained with being required to build Woolbright Road, they requested to have an office park site on Woolbright Road but Mr. Annunziato would not agree. Also, 4.1 acres along Woolbright Road has been donated to the City and they will make up the other .4 acres. Mayor Jackson asked how far it was from Woolbright Road to the northern boundary and Mr. Kirsner replied approximately 150 feet. Mayor Jackson asked if anyone else in the audience wished to speak a~d a gentleman questioned the prices of the ufa%ts. Mr. Kirsner infommed h~m the one bedroom ur~ts would start at g35~000 and the lakefront villas would be in the $80,000 range. -5- MINUTES - SPECIAL CITY COUNCIL MEEI~ZNG BOYNTON BEACH, FLORIDA NOVEMBER 7~ 1978 Mr. Warren Griffith referred to 627 units being mentioned and questioned how the number of cars per unit Has predicted and Mr. Rice replied that it varies ~n generation between the townhouses and apartment units, but the average is about nine trips per dwelling unit. Mr. Harmening stated there would be 5~ 500 trips per project per day and Mm. Rice agreed, but not that many out onto the highway with having an internal system. Mayor Jackson asked if anyone else in the audier~e wished to speak in favor of this application and received no response. She asked if anyone wished to speak against this proj eot. Mm. John Dodge, President of Quail Ridge, referred to the newspaper article about this project noting four stories and stated they were very concerned about this. Four stories is out of character with what is happening west of :~ederal. He is pleased to hear the plans have been revised. The original proposal showed 640 units and now 627 are contemplated and this is only a reduction of t3 which is not significant. He recognizes six ur~ts per acre com- plies with the County plan, but in the County plan there are some indications of densities as to buildable areas. Fo!!e~ing the basis of this plan~ another could come with 100 acmes with a 90 acre lake and the units would be massed on the remaining 10 acres. Obviously there is some place in-between good for planning. He thinks 20 units to the acre is excessive. He would like to hear some expert planner speak on this. The density is 8 at Quail Ridge. He thinks 20 is excessive and 10 would be more in line with the kind of community being built. He would like some com- ments what~ is[the proper amount of ur~ts on buildabte acres and what is the proper amount on land area. Mr. Annunziato replied that in the County ordinance~ you cannot get all the density credit for the lakes~ but he doesn't know what the number is. He thinks the number on land is directly related to the config- uration~ location and community. There are areas with 100 per acre and others with 2 per acre. There is no magic to determine the right number but the community must be evaluated. Mayor Jackson akked what other developments have had ten units per acre and Mm. Annunziato replied the only development we have currently approved with ten units per acre are the townhouses of God, view Harbour. Mayor Jackson stated that this was under a court order. Mm. Annunziato continued that most do nor exceed 4.8. Mr. Roberts stated that this proposal is before the Council for rezoning and if we are unhappy with the density, we do not have to rezone it to PUD. This eou!d be developed as a subdivision under R-I or R-iA. The question is whether to grant the zoning. He thinks the project as proposed is good providing about 200 units are deducted. The owners put holes in the land by selling muek and created the lake. There is a total of 105 acres with a 45 acre lake~ 7~ acres for Woolbright Road and !1 acres for road rights-of-way which leaves 42 acres. He took exception with the statement made at the Planning $ Zoning Board meeting that we cannot keep telling people to reduce the density when it fits - just what does it fit? The City Council is accountable to the people of the City. We eannot stop people from eoming into Boynton Beach but it is in~mbent on the City Council to keep the density down. The plans are very good but he takes exception to the density. Taking the number of acres and dividing into 627~ the overall density is 15 units per acre. He does not agmee the lake should be taken into consideration. Also~ the water supply must be considered in addition to other problems with allowing extreme density. Mr. Lester Boese, Planner $ Architect from Quail Ridge~ stated he agrees with Mm. Dodgers statements regarding density and the four story buildings. The difference between net and gmoss density should be clarified. He explained how many PUDs did not give credit for the total amount of open space. The County does have restrictions on cmedits for the open spaee~ something to the extent on a body of water such as one made by man 50% is the maximum~ but others which are natural can go to 100%. The recreation areas ean be contributed to the building mass but only when accessible ~o the whole project. The majority of the communities borderin~ this property have established tow density counts. He knows by approving this plan, it does not necessarily establish a prece- dent, but that danger isaalways there. Quail Ridge is 1.5 gross and not more than 8 net units to the acme. If this PUD is approved, he eertainly requests it to be approved on a lower density or to consider a standard zoning category of lower den- sity. Mr. John Kopmeier~ Village of Golf, stated that he came do~ 1-95 today from Palm Beach and going off the ramp at Woo!bright Road~ he saw a Polls Royce pulling a U-Haul. He thinks this proposi- tion looks nice with having some Rolls Royce features, but he does not like the H-Haul parts. M~. No,man Strnad stated he cannot understand why the developers want to squeeze every available piece of building onto a certain piece of ground. There are beautiful developments like Quail Ridge~and ~elray Dunes with large open spaces between the houses and people are buying them. The houses sell for more when built on a decent piece of ground. He has spoken to many people in Leisureville and most have said they would have been willing to pay $~,000 to $~,000 more to have a larger piece of ground. Why not build a high class place and get more tax base from less population in the area! -7- MINUTES - SPECIAL CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 7~ 1978 Mr. George Fazell, Delray Dunes~ requested the Council not to permit three story buildings this close to Congress Avenue and across from Leisureville which consists of small properties but they are very attractive. He does no~think this ~il! do any- thing for Boynton Beach which has gained in stature during the past six years. He certainly hopes the Council will ~ot approve this p~oposition. He refezTed to coming to the meeting in the rain and stated fmom what he has learned about this plan, a lot of people will have to learn to walk on water. Mr. Warren Griffith questioned the highest density mentioned by Mm. Roberts and PLy. Roberts replied that he quoted the overall density for the project which is !5. Mr. Griffith questioned the average and highest in Boynton Beach and Mr. Roberts in- formed him that the last two or three developments have been approved between 4 and 5. He added that there were also set- backs to consider in a PUD since these are not stated in the ordinance. Mr. Griffith questioD~d how they'could go from the consideration of 5, 6 or 8 to suddenly considering 15 and Mr. Roberts replied that it has not been approved~ but is just being discussed. He explained how all applications must be considered by the Council. Mr. Harmehing added when an applicant pays a fee for rezoning applications, the Council must consider it but does not have to pass it. Even if the density is requested at 100 per acme, the Council must consider the application. Mayor Jackson asked if anyone else desired to speak and Mr. Taft ~adshaw replied that he would like to answer some of the questions or concerns brought up since their presentation and the Council replied affirmatively. Mr. Taft ~dshaw stated he thinks it would be nice if we all had the same thing in the point of physical things but unfor- tunately in a city everyone cannot have a ~illa, golf course, private club house, etc. He thinks we have to look at it from a whole broad base because everyone in the City of Boynton Beach lives a different life style. He cannot understand why everyone is so concerned about the lake. If it were just grass or a golf course~ it would be just open space also. The lake is the width of two fairways. He has seen beautiful projects developed at both high and low densities. He thinks they ame speaking of something other than just density but the total plan and eom- munity fitting into the corporate city limits of Boynton Beach. He thinks they established a good neighbor policy by-reducing the density to 13 units which was the result of their physical concern for the project. This is within the master plan density allowed. Obviously Quail R/dge and Delray Dunes are beautiful projects and are re~ated to golf and this project is related to water. Mayor Jackson then requested each member of the Council to comment. -8- MINHTES - SPECIAL CITY COIINCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 7 ~ 1978 Mr. DeMareo referred to the subdivisions in this area and stated he questions whether three story buildings would be eompatible in this area. The density is high and we have been establishing a precedent of keeping it 4.5 or 4.7. He questions if it could be cut down approximately 1/3 which would make it more compatible to the whole area with about 480 units. Mr. Harmening referred to many PUD applications being approved since the PUD ordinanee was passed and stated that none are very far along and before rushing into any more~ he thinks it might behoove us to see how they work out. He doubts he would be in favor of this one. ~Lr. Coldwell referred to some points needing elarifieation and stated there was a question regarding the time table as to when the aetual applieation was filed and whether the Council has the right to recommend higher or lower density according to the County land use plan. He asked if the application was completed when it was submitted ~o the Planning Dept. and Mr. Kirsner re- plied that they completed the app!ieation~ but there is a note inoluded that other documents may be requested. The application had everything required but after submitting~ additional engi- neering work and a traffic study we~erequested. Fir. Annunziato elarif%ed that the PUD takes the place of the master plan accord- ing to the subdivision regulation and drainage~ traffie~eteo are to be included in the master plan. He felt the applieation was not eompleted until all the information was submitted. Mr. Caldwell clarified that the original application submitted was not complete to the City Department people. Mr. Coldwell referred to this being in harmony with the surround- ing eommunities and told about most being single family homes with the townhouses at Golfview Harbour Being two story and stated he thinks this project will stick out like a sore thumb. He would be in favor of reduding the density of this land sub- stantial!y. He realizes the developer cannot do a whole lot with tb/s land but the overall impact must be considered at the small corner of Congress Avenue and Golf Road as well as the surrounding communities with regards to the traffic impact. Mayor Jaeksonsummarized that it seems everyone feels as she does that the densityi~s too high. If the Couneil turns this down~ it means the applicant ear~ot come back for ~8 months. The application ~an he withdrawn or a motion can b9 made to table it to have it revised to lower density. Mr. Hyman Kirsner eame before the Council and advised that he owns 60% of this development. He ularified that the consensus of opinion seems to he t~t they ~ like 480 units. He requests they be .allowed to revise the plan and come back next month. Mr. Roberts replied that he did not know who said 480 or how many,greed and Mr. DeMarco stated this was his sugges- tion~with cutting it down 1/3. -9- MINUTES - SPECIAL CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 7, 1978 Mr. Roberts referred to this being presented on the basis of !05 aeres and explained how this included the water which he did not agree to. He added that it has been said the County allows this, but we are not bu/lding this City on tke basis of what the County allows. Mayor Jackson suggested this be tabled and the applicant go back to the drawing board. Mr. HymanKirsner requested the Council to proceed with the next application. He agrees this applieation should be tabled as he ms sure they can please everybody and lower the Rensity. Theywil! put in more villas and towr~uses and bring down the unit count to please everybody. Mm. Annunziato recommended that both applications be tabled. He would hate for one land use to be set with not knowing wkat the other land use is going to be. Mr. DeMareo agreed that they both work together. Mr. DeMareo moved to table this until fumther notice when the applicant comes back With a more compatible plan for the-area~ seoonded by Mr. Coldwell. Mr. Harmening clarified that both applications are being tabled, theocommercial as well as the residential area and Mm. DeMarco agreed. Motion carried 5-0. Mr. Hyman K~rsner stated that they could be ready in two weeks and Mayor Jackson suggested that he meet With Mr. Annunziato. Mm. Y~rsner requested some guidelines f~om the Council. Mm. Harmening stated this would have to be re-advertised since it is a public hearing and Mayor Jackson agreed it would be adver- tised in the paper. Mr. DeMareo referred to guidelines and suggested reducing the present plan by 1/3. Mr. Caldwel! ex- p!ained how the number could be reduced by eutting down on the size of the units. He is concerned about the area between the buildinqs~ total number of buildings, and the number of stories abutting the streets and Quail Ridge. He would like to see the overall density brought down to what we are aeeustomed to seeing here in the City. He would like to squeeze the present density of !5 down to as close to 10 as possible. Mayor Jackson agreed the density should be brought down. Mr. Kirsner asked if they would entertain a pmofessiona!building since they are putting in Woolbright Road and Mm. Annunziato plied that a eommercial area not serving the PUD is not allowed within the PUD. Kirsner agmeed this could be done~ but questioned what it oould be used for. Mm. Kohl added that this would not be a sat-is- factory pareel for reereation and Mm. Roberts agreed. Mr. Annunziato stated that the PUD would have to be re-advertised. The land use or density could be altered, but in chan~ing cate- gories: it would have to be re-adver~cised. Mayor Jaokson asked if the recreation could be moved into another area and Mr. Annunziato replied affirmatively. Mayor Jaokson suggested t~t the applieant and Mm. Annunziato work together. Further discus- sion followed about the possibility of relocating the recreation area and adding eommereialamea. Mayor Jackson suggested t~mt the applicant discuss it fur~cker with Mr. Annunziato.
