Mr. DeMarco the~ seconded the motion and the motion carried 4-0. ANNO~NCEF~NTS Mayor Zack referred to the agenda and announced if there was agenda anyone desires to speak on to please mame to MrS. Padgett and the City Clerk will ~all a~on them at the appropriate tims~ P~BLIC AUDIENCE Mr. Jehu Gonsman, 1320 S. W. 28th Avenue, appeared before the ¢~cil and referred to the meeting held em October 13 ~t City ~aI1 and stated he was under the impression it was for open discussion of the Recreational ~ehicle Ordinance. However, pictures of his home were passed among the public for public ri~icule~ He feels this was an invasionz of his privacy and personal rights. This has camsed his wife and himself much mental anguish. City .Manager Framk Kohl phoned him about ~he v~rious complaints and after ~scussion with Mr. Kohl, he felt ~he only solution was to come to the Council. For the past three years they have been constantly harassed, have bee~ through ~he courts and have had to pay a fine. He feels the ~ity hasbbeen very unfair because they were the only enos taken into court. He andhhis wife feel they must end this harassment. They feel they have taken all the~harassment they shomld from N~. K~zae~ikand M~. Gable. He thinks the Cit~ should take a stand whether his home is or is not a. pu~lic eyesor~ He thinks something should he done to re- stramn Mr. Kono~ik amd ~. Gable from further harassment. He is beginning to fear for ~he safety of his family. Mayor Zack replied that there is a moratorium on the parking of recreational vehicles and it may be some time before the ordinance is ~inal~zed. Mrs. Jackson referred to ~his one Situation being turned over to Mr. Kohl an~ stated she thinks it was wrong for us to have taken action at that meeting. She cannot see the consistency with taking action against one person with having a moratorium. Also, she does nos like to have a law on the books we don't enforce. Mayor Zack stated there was a question here regarding the court decision and how long it would hold ~p and Mr'. Moore £orme~ him that the court decisio~ was m~de approximately two years ago. He added that we have been in the Inter-local Agreement with the County for three years. Mrs. Jackson moved to have the proper authori~s sign the Inter-local Agreement, seconded ~y Mr. DeMarce. Mrs. Jackson stated that since this went into the minutes of last year, she thinks this letter should be read as part of the record. Mr. Joseph P. Eel]j, 700 Eorizens West, appeared before the Coumcil amd referred to accusations made im the press casting allegations on his good reputation. He told about a court hearing im October, 1976, when there was a conflict of imterest ~eussed with him being Chairman ef the Plaaaing & zoning Board amd an employee ef Walter Dutch. Jackson suggested reading the letter from Mr. Lawrence Gomzalez, Executive Director, Ethics Oemmission, amd Mayor Eack replied that he thought Mr. Moore,s letter was suffi- to the Plamni~ & Zoning Board. Mr. Strnad stated that this stir~ks rottem. He has never seem amythiag in his life like these people bringing all this ~age i~ the open at election tim~. Why was he not informed Mr. Moore was writing ~o the Ethics Commission? He is a men- her of the City Council and is entitled to receive this in- formatiom. If these people were homest and wan~ed te help someone, they w~uld net go behind his back, hut would go to Jge Kelly andccheck on it and not make statements to an inves- tigating body im Tallahassee. The letter written was taken omt of~ context. Our ~ice Mayor has done a great disservice ~y meddling in this pre jest. The citizens of Boyn%om Beac~ were entitled t~ this property for recreation. ~e could have gotten this property for ~300,~000. He them referred to Mrs. Jackson making a statement im the paper questiomiag the other $~0~000 and explai~ed how ~. Geldberg was held up for over tw~ years on the ~ale while the property deteriorated. He read a letter from Mr. ~. Schmidt, Building Depar~tmemt, to ~. Gold,erg motifying of the existing comditioms? require- me~ts and deadlines. M~s. Jackson asked the C~ty Attorney if the City Council voted to have him inves~i~&e how to get out of paying 2he $300,000 Mayor he is not co~cerne~ a~out a lawsuit. As far as negotiations, he was sure we could get it for less. With the Building Department condemning the cottages, we could have gotte~ the property for less. ¥~. Moore stated that the condition of the property and im- provements were the same as when contracted for $300,000. However, he feels some untrue and unfound accusations have been made against him regarding thisreport and the DeLeng papers. Bothwere dictated to him to be investigated by a unanimous vote of this Council. The letter from Mr. Dubbin clearly indicates they were threatening suit against the City. He took the necessary actions. He apologizes to Mr. Strnad for not being able to tell him every step he takes for the City. He does not have the time and questions whether ~. Strnad woul~ ~derstand. He did his job and feels he sa~ed the City $60,000. It was assessed for approximately $163,000. He gave his opinion regardiag getting out of the contrac~ which was substantiated by the Florida Board of Ethics. Mr. DeMarce asked when the deed was consmmmated and Mr. Moore replied that it was recorded September 15. Mayor Mack stated that according to the newspaper remarks from the ~ice M~yor that the man should be in ~ai~, etc., this if very distasteful to him and is sorry it was imtthe paper. Moore imformed him that a~ estimate was givem im excess of $14,~00 and he has been attempting ~o see if there is any w~y to get the editing done. Apparently the largest cost is the primting cost. We do have a bid from the Municipal Code Corporation for $~4,000. We have gotten a report about weedimg out the bad sections. Mayor Zack explaimed how he thought it was time that the ~eu~cil takes action and Mr. Moore replied that he had mot fimalized ~he search. There is the possibility they ca~ get someone who specializes in this. Mayor Zack referred to this being talked about many times and stated Whe~ he brought this up in J~mary or February, the City Attormey said he could complete it i~ two weeks. Mr. Moore clarified that the re~iew has been completed, but the ~uestion is whether they want to pay the ~umicipal Code Corporatio~ the $14,000 to print the book. The report has been furnished with what they feel should he edited out. I am sure real soul searching would have dictated you exami-e the Background and work from there, rather than listenimg te some o~ your friends and going by am unsigned memerandmm hidden awa~ in the parade folder. You say the fun~s should be used te pay expenses, from the cemetery fu~d and not the taxpayers. What about the tem- mis courts, swimmin~ peel, shuffleboard court, civic cemter dances, etc.? The people who use these pay a fee for the use, ye~ much of the money comes £rom taxes because none of these char~es ~re enough to he seti-sup~o~ting.
