Jackson, Vice M~yor Richard D. Caldwell, Councilman Joseph DeMarco, Councilman Norman F. Strnad, Councilman Frank Kohl, City .Manager Tereesa Padgett, ~City Clerk Gene Moore, City Attorney Mayor Zack called the meeting to order at 7:30 P. M. and re- ~u s~ed ever~yone to p±ease rlse at the sound of the gavel for the Invocation given by I~~. Frank Kohl, City Fmnager, followed by the Pledge of Allegiance to the Flag led by City Attorney Gene Moore. Announcements PROCLA~TION - Mayor Zack read a proclamation proclaim- ing the week of July 3rd thru 9th, 1977 as National Safe Boating Week. He then presented the proclamation to Commander Milt Meisner, Flotilla 54 of the U. S. Coast Guard Auxiliary. Comms_nder Meisner thanked Mayor Zack, City Manager Kohl, and the members of Lthe City Council. He stated he was indeed appreciative of this proclamation a~ud thanked Mayor Zack for his interest in this proclamation. He then referred to 50 million boaters te!~ing to the waterways and gave the figures for accidents and injuries occuring during 1976. He told about the free public safe boating classes conducted by the Coast Gus~d and their examinations of boats, He announced these classes ~d extenuations would be held at the Boynton Boat Ramp &nd he thanked Mayor Zack, City Manager Kohl and Recreation Director Frederick for their cooperation in giving this permission. Mayor Zack, on behalf of the City Council, thanked Commander Meisner for his facts and comments. Mr. Caldwell told about the Coast Guard's extreme courtesy and helpfulness in making examinations from his own experience. PUBLIC HE_%R~G - Mayor Zack announced that a public hes~- lng would be held by the South Central Regional Wastewaser Treatment and Disposal Board regarding the "201~' Facilities Plan on Wednesday, June 29th at 2 P. M. at the Boynton Beach City Hall. OT~R - Mayor Zack announced if there was any item on the agen---~anyone in the audience desired to speak on to please give their name to the City Clerk and ~s. MeetSn$ - June 7, 1977 When called upon by Mayor Zack, M~. DeMarCo, ~. Strnad and M~. Caldwell repl_ed that had nothing. ~[~s. Jackson referred to Page 2, second paragraph, and stated she believed this should be a hand "for" helping. She referred to Page 17, next to last paragraph, seven l~ues up, and stated she believed it should be a "larger" assessment. She referred to Page 18, second paragraph, first sentence should have the addition after paved "a_nd be assessed". She referred to PageE~8 and requested a clarification of the reference in the last paragraph to the Harbour Hall/Inlet Harbour Club mud stated she believed these were two separate places and M~. Moore re- plied this was correct. Mrs. Jackson clarified that it should just be Harbour Hall. She referred to Page 29 and advised that the fourth item should be Harbour Hall. M~. De~,L~rco moved to accept the minutes as corrected, seconded by Mr. Cald~ell. No discussion. Motion carried 5-0. PUBLIC AUDXE~¢CE Mayor Zack asked if anyone desired to address the Council and added that the purpose of the Public Audience was for those people who wish to speak on anything not appearing on the egenda, but he received no response. BIDS One (1) 20 Cubic Yard Rear-end Loader Garbage PackeE ~. Kohl informed the Council that bids on the above were opened on Tuesdey, June 14, 1977 at 3:00 P. M. in the Office of our Purchasing Agent, ~.~. William H. Sullivan. The Tabu- lation Committee reco~ends acceptance of the low bid from A1 Packer Ford of West Palm Beach in the amount of $23,090.76 less trade of $3,300.00; net price of $t9,790.76. A copy of the Tabulation Sheet, lh~oposal and Affidavit signed by Mr. Warren Garling, Truck Ma~uager of A1 Packer Ford a_~e on file. He has checked all other requirements and everything is in order. As indicated to you at the Reveler City Council Meet- ing of June 7, 1977, monies were not budgeted for this pu~- chase and Council gremted approval of the use of Anti-reces- sion funds. DeMarco asked if the specifications had been met and N~. Kohl replied: yes. ~. DeMarco referred to having mostly all Internationals and Mm. Kohl disagreed. ~. Sullivan informed him that right now, we have a variety of packers, both Inter- nationals ~ud Fords. He added that this particular Ford is the same as the previous one and we have had good luck with it. Mmyor Zack questioned the hlternate and Mm. Sullivan informed him it was not accepted. ~. Caldwell referred to the cost of $1.9,790.76 and questioned the budget transfer request for $23,504.00 and M~r. Kohl in- formed him that we have $23,504.00 under Special Contingency ~ad we will be needing it for the other packer. ~. Caldwell asked if it would be more advantageous to do one at a time and Mr. Kohl agreed it could be done that way. Mrs. Jackson questioned the differenc~ and Mr. Caldwell replied that there ~onld be better contrgl. Mrs. Jackson moved to accept the recommendation of the City Manager and Tabulation Committee and transfer the funds in the budget as recommended. M~yor Zack laid aside the gavel and seconded the motion. Under discussion, Mm. Caldwell stated that at this time, he believed they should allow S~9,790.76 inasmuch as it won't make much difference and they will have better control. Motion carried 5-0. LEGAL Ordinsmces - 2nd Reading - Public Hearing Proposed Ordinance No. 77-16 - Re: An Ordinance Amending Section 25B-8 Providing for Exception to Requirements of Erecting Safety Enclosures for Pools Moore read proposed Ormmna:~ce No. 77-16 by caption on secon~ ~ '' ~ ~ea~!no. Mayor Zack asked if anyone wished to speak in favor of this ordinance, N~. John Q. Ada.ms, appeared before the Council ~ad stated he was not speaking in favor of the ordinance, but in favor of the amendment. He referred to presenting his case previously with the support of members from Sterling Village ~d stated that he thinks condominiums, particularly with pools, have had. very good administration of these pools. There have been no ~nown accidents leading to suits. There have been no in- juries to speak of. He feels they are in a good position to protect the life and limb of children and/o~ adults. They certainly will continue to protect the lives and safety of people using the swimming pool and those coming near it. They are civic minded and have in mind the safety of their fellow citizens of any age. He hopes the Council will continue to vote on the second hearing as they did on the first hearing. Msyor Zack asked if anyone wished~to speak in opposition. Mrs. Alma Kohl, Snug Harbour Condominiums, appeared before the Council and referred to this being the first meeting she has attended ~ud advised that she wanted to speak in opposi- tion. There is a sign at the entrance to Snug Harbottr about 5 ft. from the City street statirg: '~Private Property - No ~respassin~,. There is also a sign at the swimming pool stating that ail children must be accompe~ied by an adult. She sees no reason why they should be forced to enclose the pool and m~ake an unsightly appearance of their swimming pool area. She referred to working ~0½ years at Bethesda Hospital and told about two dro~ings which happened to small children at private homes with enclosed pools. Also, the previous speaker referred to no k~uown drawnings or fatilities in condo- minium or co-op pools. Therefore, she opposes this amendment. Mayor Zack clarified that this was actually in favor of the amendment. Mr. De~rco moved to adopt Ordinance No. 77-16 on second reading, seconded by ~. Caldwell. Under discussion, Mayor Zack stated he was asked by two different condominiums what is me,mt by reasm~able surveillance, etc. as referred to in the ordinance and Mr. Moore informed him that it simply means there would be supervision in the vicinity of the pool to watch over it during the hours open under the rules and regu- lations. Mayor Zack referred to discussing previously havir~E the Building Dept. patrol this and also that a copy of the insurance will be necessary for the City. M~s. Jackson re- plied that she thought it would be logical to have a copy of the insurance for the City files and ~. DeMarco agreed. ~w~s. Jac~on asked if this was the procedure with businesses such as motels and M~s. Padgett replied that the ones that do have insurance do Eurnish the City with a copy. ~.yor Zack stated he still was concerned about health and general safety. Moore read proposed Ordinance No. 77-18 in its en~mrety. Mr. Kohl informed the Council that the rezoning request sub- mitted by M~. Robert Beane to zone from R-lA to C-2 at the Planning & Zoning Board meeting of June 14, 1977 was unani- mously reco~nended for approval after noting a petition signed oy adjoining property owners in favor of this application. The motion to approve was made by ~. Lambert and seconded by M~. Arena. Mayor Zack referred to this being discussed at the April 26 meeting of the Planning & Zoning Board ~ud it was passed 5-2, hut a public hearing was not held. Mmyor Zack ask~a if anyone wished to speak in favor of th_s zoning change and received no response. He then asked if anyone opposed it ~ud received no response. ~. LEGAL (Continued) Resolutions (Continued) Proposed Resolution No. 77-ii - Re: Declaring Need for a Housing Authority (Tabled) M~. DeMarco moved to t~ke from the table Resolution No. 77-II, seconded by M~. Caldwell. Motion carried 5-0. Mayor Zack requested input from the City Attorney and M~. Moore informed them that the information basically is that we are working with Boca Raton on the possibility of setting up an independent housing authority with the City designated as the agency for funding under Section 8. He hs~ received information from Boca Raton that their application has been approved by the authorities in Jacksonville, ~aere has been no funding as yet, but they are set up to handle it when funds are available. This is a possible alternative. M~. Kohl added that he talked to ~. Eric Williams and he informed him that they did make application to HUD and they do not ex- pect trouble in receiving funds and are working it ~hrough the administration. M~s. Jackson suggested putting this back on the table so the City Attorney and City Manager can do a little more inquiry and bring in the appropriate papers. Mayor Zack suggested discussing it from the table ~ud letting the City M~nager proceed. M~. Moore agreed that the aoplication should be investigated ~ad suggested appointing-a Housing Board as an advisory board. ~s. Jackson stated~that this resolution would not be apprspriate and they must get more information and Mr. Moore agreed. M~s. Jackson moved to strike this x~om the agenda ~ud have another one pre~ented to the Council. M~s. Padgett informed the Council that people had requested to speak. -6- MINUTES - P~GUL~M CITY COUNCIL MEETING BOTNTON BEACH, FLORIDA Jb~ 21, 1977 Mr. Charles Johnson, 25 Colonial Club Drive, appeared before the Council. He referred to being Chairman of the Community Relations Board and advised that after intent study and dis- cussion, the Board is in full agreement that there is dire need for a Housing Authority in Boynton Beach, so the people in Boynton Beach can receive the benefits the people of sur- rounding cities now have. Mamy conditions warrant a Housing Authority. The Council is talking about having their own Housing Authority, the same as other cities, which are having troubles. He thinks study should be given to the type of Housing Authority. Mx. Ron Johnson, 1205 N.. W. ~th Street, appeared before the Council. He advised that he was a member of the Community Relations Board and does not entirely agree with Mx. Charles · oh~uson that all the members agree a Housing Authority is needed. Something should be done, but he is not sure of the approach. Once it is formed, there is no way to abolish it. Possibly there should be a referendum for the people to decide which route to take. When the Federal Government gets in- volved, they have the tendency to push or pull different ways. A bigger slum may possibly be created~ Ten years ago, there Were ten blocks of slum area and then the Federal Govermment hull2 houses sponsored by HS~ and now there is a 25 block slum area. Me~or Zack replied that he believed if the City went on their own, it could always be abolished. Mx. Moore clarified that they were not talking about going according to Chapter 421, but were referring to an alternate route to have an advisory board appointed to give input. Mrs. Evelyn Ostrow, 1313 S. W. 21st Street, appeared before the Council and informed them that she works with the Delray Beach Housing Authority. She told about removing people from Boynton Beach to Delray Beach because we did not have housing. She requests they consider looking into a Housing Authority. M~. Caldwell asked if the proposed approach that Boca Raton was working on was similar to the Riviera Beach structure and ~. Moore replied: no, it was not under the stringent State structure. Mayor Zack referred to losing people on rent subsidy and re- quested the City Mmnager to act as quickly as oossible on this and ~. Kohl replied that he would call H~$ the first thing in the morning. M~. DeMarco then seconded the motion. Under discussion, M~s. Jackson referred to a newspaper article regard~ug Gov. Askew vetoing a certain bill mud stated she would give this to the City Manager to check. Caldwell moved the adoption of Resolution No. 77-II, seconded by M~s. Jackson. Under discussion, b~. DeMarco referred to the resolution stating the commercial bank should be located in the City of Boynton Beach and asked if these f~uds would draw interest and Mr. Kohl replied that he hoped so, but a checking account will not. ~. DeMarco asked if the funds would be in a checl~ing account and Mr. Kohl replied that they would be put where the Federal Government states. M~. Moore stated that ~e would just state ~'account" in the reso- lution. M~r. DeMarco asked if they would be limited to a bank in Boynton Beach if they possibly could get more interest else- where and ~. Caldwell replied that he believed we should keep the business in Boynton Beach. Mr. Kohl stated that he would try to stick in Boynton Beach within reason ~ad suggested taking out "checking in Boynton Beach". M~s. Other Authorization for the Mayor to Execute Stipulation to Termi- nate Beach Snack Bar Lease Between Mir. Donald Shelhamer & City ~. Moore referred to this having to do with the snack bar lease and advised there was an existing lease with two ye~s to run and the City Council entered into a new agreement with the purchaser of the old tenant. Mms. Jack~on referred to this being similar to the County Commissioners with their garbage situation and explained. She believes we are not doing the right thing by not putting it out for bid. We should have extended the lease with ~. Shelhamer or broken the lease with the consent of both parties and then have gone out for bid. M_~. Caldwell made a motion to authorize entering the lease, seconded by Mm. Strnad. Under discussion, ~@. Mrs. Jackson reolied that it is being extended beyond the period it was supposed to be and it should go out for bid without M~. Shelhamer deciding, ~. DeMarco agreed it should have been bid. ~Lr. Caldwell stated that he as yet had a name to come forward as being interested in this particular property° ~. DeMarco replied that people in the audience previously expressed intsrest. Motion carried 3-2, with Mrs. Jackson and M~. DeMa~co dissenting~ Consider Amendment to Board of Adjustment .Ordinance ~. Moore referred to the Board of Adjustment previously re- quiring four votes to take action with a five member Board. He explained how this was a relatively powerful Board and suggests with the increase in members, a vote of five should now be required. Moore read Ordinance No. 77-19. M~s. Jackson moved adoption of Ordinance No. 77-19 on first reading, seconded by Mr. Caldwell. Under discussion, Mayer Zack clarified that five members must be present and voting am_d Mr. Moore agreed that five would be a quorum. ~s. Jackson added that she thought it was a good idea to hs~e it, so it is not too easy to change the building and zoning codes. M~s. Jack~on asked if someone was supposed to take p~mt in the discussion by the Board if he had abstained from voting ~ud ~. Moore replied: no, he does not think they should participate at all until the issue is resol~zed. Fmcs. Jackson asked if she was correct that anyone abstaining should state their conflict am_d reason and Mm. Moore replied that he thought a simple statement would be enough. OLD BUSINESS Consider Appointments to Housing Authority - 5 Members (Tabled) M~s. DeMarco made a motion to remove this from the table, seconded by Mrs. Jack, On. Motion carried 5-0. ~. Kohl read the attached letter dated June 17, ~977 from Russell & Axon. M~or Zack stated he did not think this was the report they were looking for, but the information received from D.E.R. in regs~ds to the application. Mfs. JackSOn dis agreed and stated her motion was to obtai~ information from E~P.A. She advised that she had received & report from E.P.A. g~ read the part pertaining to hardness. She clarified that it still states the E.P.A. does not .know. A study was done'for the E.P.A. by the Natiomal Academy Of Sciences and they do not know and are doing further studies. She thinks we should go ahead with enle~gihg the water system ~ud wait until somebody comes up with a definite yes or no. She feels water hardness wou~ld be more advantageous than lime softening. 7/5/77 ~?yor Zack stated he thought we should get the report concern- mng the application. M~s. Jackson referred to the minutes stating we should wait until we hear from E.P.A. and we have not hes~d from E.P.A. She referred to .~. Hallman stating previously that there were two alternatives, and she referre~ to a third and that is we do nothing except go ahead e~d ~. Hallman agreed. She is opposed to doing something until we find out more about this. _Mr. DeMmrco added that he didn't believe we should go through lime softening until they make us. ~ney do not know the effects of lime softening until proven what they are. Mayor Zack suggested waiting for the response on the application. He asked if the application had been filed ~_d Mr. Kohl replied that it was. Mr. Strnad stated that time and time again, we have been told the proper course to follow by D.E.R. in the construction of the ~lant. The engineers proceeded in the way they thought was best. it is not a unique situation with the only City being told to use lime softening, but is used in over 80% of the cities of Florida. He does not see how we can turn our backs on D.E.R. They have told us. By not doing it, it is disobeying what they have told us. Mm. DeMmrco replied that they should definitely prove that we need lime softening. ~s. Jackson referred to the E.P.A. being over D.E.R. and stated she would be opposed to doing ~uything until somebody See Miu. o~ comes up with the ~uswer whether it does or doesn't cause 7/5/77 cardiac vascular disease. She referred to Dr. Rayborn saying GlenDyke~ our water ~as contaminated and when ~_w. Russell was here, she asked him three times if our water was conte~inated or had ever been and every time the reply was no. Strnad replied that this ½ million dollars will be far outweighed in the money saved in the maintenance of the lines and homes. In view of the deterioration of the pipes, it would be far more advantageous to have lime softened water. ME. Caldwell referred to ~. Russell pointing out that the deterioration of the pipes was not caused by the water, but by the types of lines in homes in the older area. If we continue to construct the plam. t waiting for EoP. A. to come up with a definitive study on the detrimental effects in the drinking water, it could take two to three years. What hap- pens to the plant ~uder construction? Wha~ are the contrac- tors going to do to the City for holding them up? What would the result be to the citizens in view of money and health considerations? If we can continue to construct a~ud circum- vent the problem of softening until E.P.A. ma/~es a final decision regarding the health question, he thin_ks we should continue with the plant c~cumventing this particular pro- blem. He refuses to swallow the fact that E.P.A. says we must do it which does not make it right for ali comm~uities. He can appreciate that 8C~ of the cities are being forced to go to lime treatment, but is this being done justly? ~Jor Zack asked who could give this information and Mr. DeMarco replied that nobody knows. Ma~or Zack continued that there was a directive to the previ- ous Council. He explained how there were two~i~es to be considered with regards to lime softening. Mrs. Jackson agreed and stated she thought we should wait since there are two sides. >~s. Jackson then stated that in regards to aesthetics, she does not care what it looks like as long as it is pure. She referred to M~. Russell quoting a figure of $76,000 if we do not go ahead with the plant, but it would cost ½ million dollars to change. Mayor Zack suggested they find out from the contractors and see ho~ much money will be involved. He added that he realizes health is important, but also equipment is supposed to be coming. M~s. Jackson made a motion to continue with enlarging our water plant a~ud leave this as it is until we have further word from E.P.A. Mm. DeMarco seconded the motion. Under discussion, ~. DeMarco commented that he thinks Boynton Beach has the finest water in Palm Beach County. ~s. Jackson added that ~. Hallman has said the main reason is for aesthetices ~ud anyone who wants beautiful water can vote for it. N2~s. M~s. Jackson asked how many units per acre and M~. Annunziato in- formed her that there are 84 units and he pl~us 40 more. }~s. Jackson stated this was way over the new zoning allowance. ~. DeMarco referred to the permits taken out and ~¢~. ~_unu~uz~ato informed him that permits were taken out for individual build- ings; each building had a separate permit and separate certifi- cate of occupancy. ~. DeMarco questioned whether the mora- torium had any bearing on this and ~s. Jackson told about being a member of the Planning & Zoning Board in 1974 and taking a tour of this e~ea s=ud Harbour Hall was in the pro- cess of being built then. Z4~. Arnold Stroshein, 710 N. E. 7th Street, Owner and Developer of this project, appeared before the Council. He stated that the project was started in 1968 and he has evidence in his file to substantiate this. In 1967, the property was set up for R-3 zoning. Construction was started in 1968-69. He was under continuous construction during that period of time and is still under construction. He has a copy of the site plan and the Building Official has noted in his memo that there is a site plan. These improvements give easements for water and sewer lines through his property. He had to bring in water and sewer lines to take care of con- struction for all the buildd~ugs on the site pls~. He had to go a step further and do all the engineering. This is the last building in the project. Apparently the reason for this total work ~uud expense to be done by him, which was many thousands of dollars, was for non-abatement. He never planned on abating it. All the improvements were installed to a point, which the City Council should consider when they vote tonight. To the best of his knowledge the only items which need doing ~ for the City are a thoroughfare for a fire route and also for the t2 and 18 ton sanitation trucks° This meatus if this last building is not built which has site plan approval, this could never happen because this sits directly in the center of the buildings there now. In the e~ent it does ~ot happen, we would be hampering the life, limb and welfare of all the people livir~ there. This was required by the Fire Marshall. If this building is not allowed, he would want to be relieved from doing this work. Mr. Stroshein continued that the permit was taken out for test piling in 197~. In 1974-75-76, he put in 5 ft. of fill in this property as it is located adjacent to the mari~ for the people living in the project and the intracoastal Waterway. He took out a perm~it for a seawall. He had other engineering studies made. He~is now to the point of going ~aead with the project. He does not feel it was~abandoned. There is a master plan. If it is not completed, there will not be access for fLre equipment and sanitation equipment and he explained the roumd- about way the trucks would have to travel. He plans to com- plete the project as approved by the City Council 6n the master p!e~. M~. Stroshein stated that in regards to the ownership, he would like to clam~ify that he and I~5~. R. Ke~hig purchased thm land in 1967 from Mrs. Yo~n~e~. At that aoproximat~time, he also purchased other properties, but nothing was aa~ed after that. At that time, the First Bank of Boynton Beach and Flagship Bank were the only partners. Everyone has been oaid off and only hi,elf and the First Bank of Boynton Beach ~ow hold interest in this property. -~. Stroshein then referred to the sewer moratorium financially hurting him very much ~_ud also many others. He referred to the certificate of occupancy issued in August, t974, and told about having to go through the State Legislature to force the City to let him hook up. He is finally to the point where fir~uucial studies have been completed e~d the building can he sold. When a building goes bankrupt, everyone loses. Mayor Zack replied that he found some disagreement with his statements and they also must consider setting a precedent as he heard a situation similar to this would like to continue. Mr. DeMarco replied that things have happened under different circumstances, hut he thinks we should help people and get additional revenue for the City. Mayor Zack replied that he did not think any member wanted to hurt anyone. He still feels we should abide by the rules mud regulations set up. ~s. Jackson asked how many units he has - 28 in Harbour Hall and Mr. Stroshein replied there are presently 56 units. ~. Annunziato clarified that in the Inlet Club there are E8 or a total of 84 completed and he wants to build 40 more on five acres. ~. Stroshein stated that he has done every- thing called for under Ordinance 62-9. He is only asking the City Council to let a businessman in Boynton Beach complete a project and there is only one more building s_nd they will get the fire protection and sanitation route. ~s. Jackson stated that this was 25 units per acre. M~~. Catdwell stated that the project was stopped through no fault of this gentleman but because of the sewer moratorium. If not because of the moratorium, possibly it would have con- tinued. ~s. Jackson replied that Mr. Stroshein did not come back. ~. Stroshein informed them that when he com- pleted 28 units, al! financial interests were~cancelled and there was no action for recourse. He had to sell the build- ings on a cash basis. He could not get commitments. Up until six months ago, he could not get another mortgage com- mitment. Today, it is impossible vo get a mortgage commlt- ment on large condominiu~ projects. M~. DeMarco stated that under the circumst~uces due to the moratorium, he moves to grant this permit. Mm. Caldwell seconded the motion. Under discussion, P~s. Kohl stated that he would be the first to help anyone in the City and was asked yesterd~j about another similar project like this. He thinks they should find another way to help out the Build- ing Official and City Planner. It puts the Building Official ~ud City Planner in a bad light. ~. NEW BUSII~SS Res?Eve Annexation Area - Councilman Richard D. Caldwel! Mr. Ca!dwe!l announced that he requested City Manager Kohl to put this on the agenda for discussion because he thinks Boynton Beach should take a closer look at the reserve annexation area. He thinks this Council should t~e initiative and plan now for annexing areas before we lose them permanently. He thinks an organizational study should be done. To his knowledge, a time table analysis has never been done in the past and he feels it should be done now. T~aken into consideratio~em~d ~ area~ such as Lime Tree, Quail Ridge, etc., thosa ~hich are already developed. While a couole are not in the annex reserve aa~ea, he thinks we should ~mk$ attempts to have these areas join our great City. ~e must gather the facts a~ad prepare them for these people in these other areas. Now we provide water to some s~eas and will be handling sewage in the future. We n~ed to know the cost. We need to compare police protection, fire protection, garbage service, etc. to what they have and what we can offer. If we can make it feasible for the City to annex~ we should expedite and exp~nd the City boundaries. if we cannot comvete with the services, we should re-assess our rates. We n~ed to bring communities into Boynton Beach before we are faced with the same problems as Boca Raton. We should avoid the fragmentation of this area such as in Lake Worth and West Palm Beach. We must mske it worthwhile for them to become annexed. ~. Caldwell made a motion to direct the ve~ious department heads to collect and prepare the necessary information to determine bhe feasibility of annexation of these various developments and proceed to study the necessary requirements needed for annexation and provide the Co~ncil with this infor- mation so we can tel~e the necessary steps in annexation. Mr. Caldwell continued that he thi~ there s~e certain develop- ments in this area which for some reason or another have not considered becoming a part©of Bo~nton Beach or sole entities. He calls on this Council to offer input to see if we can take the necessary steps for ~nnexation to the north and west of us, so we can make the City grow. Mayor Zack replied that he was concerned about this. There are two ways of annexing - voluntarily by the people who want to come in and the other is initiative by the ~ouncil. if we go out, we must get 51%. He feels some people moved to get out of Boynton Beach to have more acreage. He thinks th~ procedure suggested is correct, but he questions whether we should ask them, but they should be asking us. ~rs. Jackson stated that the Village of Golf is an incorpor- ated community and Quail Ridge ~ud Delray Dunes bonded with them. In 1973, this a~uexation came up quite often and the people were here in droves objecting, as they moved into the country purposely. ~. Strnad added that he has also sat through ~mny meetings when annexation was just mentioned and it was crowded with people telling us they wanted no part of Boynton Beach and chose to live in the County. He does not feel we can force our intentions upon those people. He thinks they should come to us and ~sk us to be a~uexed. M~s. Jackson referred to an editorial in 1971 in the Palm Beach Times pertaining to the bigger/better/cheaper myth and pointing out even though bigger, it does not mean better. She thinks we must remember the bigger the City gets, the more it costs to operate ~ud costs the ~eople in the City more. Mayor Zack stated he thinks Mr. Caldwell has a good thought and possibly it should be checked and get some re- actior~. Some people in Lime Tree have talked to him and he has told them it was up to them to come to us. ~ms. Jackson asked if it had to be contiguous to be annexed and ~ Moore replied: yes. ~s. Johnson, 4354 Redding Road, appeared before the Council and stated that as sure as June 21 comes along, so does annexation. Former l~yor DeLong always had this. How- ever, ~. Caldwell is the first person from the Council who has had an intelligent approach to the future of the areas west of Congress. He told about attending a civic meeting in Boynton Beach and then being politely informed that he and his wife weren't wanted because they live west of Con- gress. He told about talking to many people living in the County and they don't quite feel they are ready to be an- nexed. He explained how they thought the appearance of the ~hopping centers, downtown, etc. should be cleaned, land- scapsd, etc. They think Boynton Beach has gotten to the point where they a_we tax conacimms~ They will never get the sewers out to his house. He is for ¥~. Caldwell's idea though if they could all sit down and discuss it. There are too many fancy planners planning everything on paper, but they don't know how to do it. They must get the people in these spotted ~eas a~ad form a committee with some of the people from the City Council and look ten years down the road. He told about living in illinois and how the sewer was planned and installed to circle the city and if they wanted sewers, they had to annex~to the Cit~. There should have been a sewer district here. They can't look at Boynton Beach five years from now, but must consider 55 years from now. They ~ow they will come into Boynton Beach one day, but the City must be practical and plan for the sewers, water, fire, police, etc. and not just have it on paper. The minute the money comes into the City coffers, it will be spent east of Congress. If a committee can be formed for long term plans, he is all for it. EVery time, this is on the agenda, there are 750 to 800 signatures against it until they can see what good it will do. Msyor Zack stated he still felt ~. Ca!dwe!l's thoughts were good. M~. DeMarco agreed, but stated he does not think we have anything to offer these people at this time. When we can offer other protections such as police and fire, then it m~v be the proper time to make a move. He thinks this is premature. Mr.~ Caldwell replied that he was sorry he felt that w~. ~. Dennis Clark, 4376 Redding Road, appeared before the Council and advised he was the President of the Homeowners ASsociation in this area. He stated that the majority of the members e~e completely against any annexations>of the western section into Boynton Beach. The main reason would be the added taxes they would have to pe~ as opposed to County taxes. Also, there are laws and~ordinances which are unfair to the area where they live. He referred to particu- larly the recreation vehicle law. All services are being met except possibl~ the minor or major repairs to roads. However, he does not see where it would be resolved by the City. 'This evening, the City Council approved 25 units per acre and the County protects them from this high density. The majority of the people are satisfied drinking water from wells suud having septic tanks. It would cost the City quite a bit to get the ~es out to their houses. When they ha~e adequate water with a well, sewers would just be an additional tax. Some of the advantages would be having the roads completely resurfaced without having the individual property owners assessed for this particular service, a fi~e station, park or auditorium. M~s. Jackson informed him that their area will be brought in on the sewer because the regional plant will include the unin- corporated areas. Mr. Caldwell added that they would also have to pay higher user charge if not part of Boynton Beach because the City would have to pump it to the plant. This was not decided by the City of Boynton Beach, but was a de- cision of the Federal Government. He is sorry to hear that the people inlthe western parts do not desire to have any voice in the local government. He does not think the City of Boynton Beach cannot take oare of their desk-res mud needs. He thinks the Council is willing to hear out the recreation vehicle ordinance. The City does listen to various groups of people. He is sorry they feel so down on Boynton Beach. ~s. Jackson added that the s~nouncement made at the begin- ning of the meeting regarding a public hearing on June 29 at 2:00 P. M. has to do with the sewers in the~nincorporated area. Mr. Strnad stated he appreciated what M~. Johnson said about the decrepidated looking condition along north U. S. 1. Thome buildings are disgusting to see and also the gas station on the corner at U. S. ~ ~ud 2nd Avenue is a garbage dump and he explained. He thinks it is encumbent upon the Community Appearance Board to get these places cleaned up. M~s. Jackson agreed, but she thinks where the buildings were cut in half, the people cannot help the appearance. ~. She referred to the County asking us to contribute to a community school amd told about Mr. Frost, the City Msauager of Palm Beach, saying they could not contribute to anything outside of the City limits. She thin?~ the City Attorney should draw up 8m ordinance applicable to our City, since it will help us in the end and we should keep the mone~ here in the City. Mayor Mack agreed it was a good idea. Mayor Zack then referred to having quite a hassle about the drug abuse, but questioned what could be done about our local youngsters. He also asked about sending our violators to the Sherif~,s Department. Mms. Jackson replied that she thought a line could be drawn and the ordinance could be drawn up similar to the State Law. ~or Mack referred to have 40 to 50 youngsters in the commun- ity in drug abuse ~nd asked where we would send them saud ~s. Jackson replied that we should ask the County to take this over as it is a County problem. Mayor Mack stated that 49 people were from the City and he believes they should be tsi~en care of by the City. M~. Caldwell stated we are sitting here as the Council sand we cs~ determine where wes D end the money. An ordinance is not needed, but just a vote by the Council. ~-~s. Jackson referred to the community school asking us to help the media center. ~e have our own library and the County library and now they want media centers. She thin~ such an ordinance could eliminate a lot of pressure put on the Council. M~. Caldwell replied t~at% he did not think any pressure had been put on us. if we don,t want to go along with something, we don't. Mayor Zack stated he was concerned about the Federal money we receive and hopes 100% will stay here. Mrs. Jackson moved to have the City Attorney research this and come back with the State law and see if we want to pat- tern an ordinance similar to it. M~. DeMarco seconded the motion. Mayor Zack replied that a 30 ft. right-of-way is in question at the north end and if they are going to condemn it, it skould be done within two weeks. M~s. Jackson stated that she did not think the D.O.T. had ar~y right to hold anyone up for ages like they did with 1-95. She does not think we can keep anyone from building on property owned by them until the D.O.T. takes it. Jackson referred to the Aqua Crest Pool having been planned for ma~- years and at times having been asked to contribute. She does not think it is right for us to be contributing. Lake Worth High School has a pool where half our children ge built by the County. She would like us to go on record with the County Commission asking them to fund this for Atl~atic High School. Mayor Zack replied that he was informed that the County was at one time willing to con- tribute $500,000, but were also concerned what Delray Beach and Boynton Beach would contribute. 5~s. Jack, on stated she would like a resolution drawn for the next meeting. Mm. DeMarco clarified that she wsmted the County to foot the bill and ~s. He informed them that at present, they are attempt- ing to show local support for a County project. It has been accepted by the County Commission to be included in the bud- get. There will be nothing finaluntil the budget is final. He would like local support from Boynton Beach and Delr~ Beach recognizing this as a worthwhile project. Mayor Zack asked if the figure was $500,000 and Dr. Carter replied that it jumps all the time. Mrs. Jackson suggested not put,lng in a figure. Mr. DeMarco clarified that they were recommending that the County handle it and we are in favor of it. ~r. Cen~ter informed them that he would be glad to work on the resolution with the City ~nd has made some for Delray Beach s_ud the Chamber of Commerce. ~. Kohl referred to this being brought to the Co~ucil's atten- tion from time to time and requested approval ~o do all the shell rock roads. ~. Caldwell moved to grant the City Manager permission. ~s. Padgett informed the City Council ~at Mr. Ron Johnson had requested to speak. ~. Caldwell then with- drew his motion. ~. Ron Johnson, 1205 N. W. 7th Street, appeared before the Council ~ud informed them that he lives in one of the areas with shell rock roads. He wholeheartedly agrees with Mr. Kohl ~ud this should be done. Large sums of money ~spent cleaning and repairing these roads. It could solve the pro- blem permanently this way. He referred to ~. Ca!dwell's statements in reference to annexation and stated that the City has been doing nothing to progress. He thinks they will progress by following the suggestions of ~. Kohl and ~. Caldwell. ~s. Jackson asked if he didn't think the City should ts~e car~ of itself first ~ud M~. Johnson re- plied that they should not be sitting here 10 to 15 years from now with the City collapsing. Mayor Zack referred to setting a precedent ~%d'advised that this was altogether different and Federal Revenue Sharing funds would be used ~ud not local taxes. ~s. Bud Howell, submitted regarding chamging the fees for various permits. We respectfully request the respective ordinances be amended to include these changes. These fees are uniform with the Palm Beach County Fee Schedule. They have been reviewed by the Co~uty Contractors Associatio~ as well as our Local Contractors Association who seem to feel it is fair. If Council approves, we ask the C_ty Attorney be directed to pre,are the s~endments to these ordinances for the ne×t meeting. ~s. Jackson replied that she thought it was a good idea to do this. M~jor Zack questioned the percentage of increase o~er the present rates and ~. Howell informed him it would be about a 35% increase and added that they were under 1967 rates now. M~s. Jackson asked if they were in line with what the other cities are charging and ~@. Howell replied: yes, 20 communities are on it. M~s. Jackson moved to accept the recommendation and instruct the City Attorney to draw up the proper amendments to the ordinances pertaining to permits. Mayor Zack ascertained there was no second sand laid aside the gavel to second the motion. Under discussion, M~. Caldwell remmrked that we can update our fees, but not planning. M~. DeMarco asked if any hardships would be created and Mayor Zack replied that if the majority of the municipalities are doing this, he does not think it will hurt anyone. ~. Howell informed them that now they are supporting about half the Build~_ng Department out of taxes and this will hopefully ~ke it me~e~ self-supporting. M~. De~co asked how much the average total permit for a house would cost and Mr. Howell ex~±axned how it was evaluated according taa schedule and the Southern St~udard Building Code and would cost approximately [~. DeMarco asked if the contractors have objected aud Howell replied: no, they had this and approved it and do not see any hardship. Msyor Zack clarified that all the suggestions have been discussed by the local cm~tractors and accepted mud Mr. Howell replied: yes and also by the County orgsnization. Mm~rk Wilenehik appeared before the Council and stated he would like to give background on solicitation and the legal presentation in the courts. Back in the 1940's, the Supreme Court ruled that solicitation is protected by the Constitution. Ne religious body can be withheld approval to solicit and proselytize. He then read the result of a court decision in 1943. He explained hew they must look at religious ~ersecu- tion. He explained how the First Amendment guaranteed the right of freedom of religion. He then advised that in the last years, there have been numeroua cases using these same precedents and he has never seen precedents reversed. Mr. Wilenchik then referred ye completing the application as required. He stated that the ordin~uce was written in 196h giving exemptions to local churches, but for some reason, all churches were not included. It is recognized very clearly that churches do not have to get permits to fund raise or F~oselytize. He does not think it was the intent to keep out a ch~ch from Miami or Palm Beach. They az~e asking for their rights. He does mot think the Council has the right to with- hold approval and they are entitled to their First Amendment right. He asks for this consideration. Some cities have laws stating door to door solicitatior~ aresg~inst the law and they will abide by that. Mr. Nate Goldberg, 1317 S. W. 17th Street, appeared before the Council. Hereferred to some things coming to mind when they are asked for the right to proselytize emd solicit funds in Boynton Beach. ~ne first thing he asks is why Boynton Beach? There are richer communities nearby which means better pick- ings. Is it possible we are regarded as a more unsophisti- cated group of people and less likely to identify the Unifi- cation Church as the Moonies? How did the Unification Church gain their wealth in such a short time? In 1975, the cou~ts estimated Rev. Moon's income at $10,000,000. He told about them owni~ land in New York and California. He told how the money collected was filtered through the main office ~ud avoided the IRS. He referred to the Moonies application ad- ~tting they collected $550 in Boynton Beach, but will they deliver $550 into the welfare funds? Cs~ they show ~he money spent for the poor and needy? He told about the organizations they contribute to. Have they attempted to associate with the local ministerial association? They are under C.i.A. investigation. He then told how youngsters were brainwashed into joining Moonie organizations. .~ny thousands of dollars have been spent to de-program these people. The National Council of Churches has stated their religious teachings are faulty. Boynton Beach has 35 recognized churches and none have filed an application to do this type of solicitation. All the churches are battling to survive and use their funds in Boynton Beach. He then read a statement from Dr. Lloyd ~right stating it appears Rev. Moon plans to take over the U. S. ~overnment, etc. With these thoughts and understand- ings, now can they possibly permit this group to come in here and walk out with funds needed by our own people? ~s. Luanne Klein appeared before the City Council ~ud stated that she has been a resident of Boynton Beach for 18 years. First of all, she would like to applaud the remarks made by ~. Goldberg. She doesn,t know where he got his facts, but he obviously spent a lot of time. Over the last two to three years, she has been reading a lot of articles about this Unification Church in nationally known ~agazines. These maga- zines ~e known to orint the truth ~ud from what she h~ read about this gro~p~she would say we do not need nor want them in our town. Along with soliciting funds, who is to s~y that they might not also solicit new members. From what she has read about this group of people, they will take any- one they ce~ get but prefer young people from affluent homes. He read a quotation from a national publica- tion containing a statement made by Rev. Moon regarding his gain of the whole world. He is for religious freedom, but if this is religion~ his study did not include this. He would be glad to~have a lem~ oaesed that no church could solicit funds from door to doo~. Ar~y person who plans to worship God and must go out in this manner to get funds cheapens it and brings it to a low level. He would be glad to have these people come into Boynton Beach and set up a church smd do like the other churches have done. ~e records of his~urch are available to anyone showing the funds collected and spent. These people do not do that. This man is wealthy; he lives in a $600,000 mansion and drives in a chauffered limousine. This man is not God. He does not see why anybody should wor- ship him. He feels sor~7 for anyone mis!e~ to contribute to this organization. He feels sorry for this man here to- night. He told about these people being run out of an office in Delray Beach twice last week. He also told about friends having experience with them in St. Augustine. This man wants to be a dictator. He has no respect for them at all with making profit from suckers. ~. Fred Devin, appeared Before the Council and stated he could add nothing further as it has all b~en said by the previous speakers. ~. Mark Wilenchik appe8~ed before the Council again and stated he did not know what he could say to answer allega- tions which are supposed to be subst~tiated, but have ne,er been. If their church had been indicted for anything, they would know about it. These are allegations. If something was proven, it would have been all over the newspapers. ~. Many people have things to say, but they must be confined to the truth and facts. The quotations referred to were in reference to their word to Christ, which is their mission. Sub- ._sequently this item was placed on a City Council Agenda at the regular meeting of Ju-n'e 7, 1977. At the Council ~eeting this item was tabled ~wing to confusion over whether or not Council had ever approved a site development plan and the question of ownership of the remaining tract. As of this date, the staff is still unable to substant- iate that a site plan was ever approved by Council for this project. Various site~p!ans were submitted to the Building Department by M~. Stroshein over the years with different arrangements and sizes of buildings. These site plans were included in plans for permits for various buildings such as the one show~ attached ~to building permit number 6170 (attached). Concerning the question of ownership of the remaining tract, the situation has not changed although Mr. Kehrig may be involved with this project. Concerning the sewer moratorium, it went into effect on November 27, 1973, and it was lifted on August 14, !975. The last certificate of occupancy for a building was issued to Mr. Stroshein on August 30, 1974. In my opinion had F~. Stroshein succeeded in securing a building permit to continue his project within a reasonable time period after the sewer moratorium was lifted (say one year)~ he would have been able to complete his project as originally proposed. But, the zoning regulations changed in June Of 1975 and the site development criteria have changed; therefore, it is my reconu~endation that any new construction on the remaining parcel of land be in accordance with current zoning regulations.
