R12-026A1 RESOLUTION R12- Do' G A* 2 1 3 A RESOLUTION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, APPROVING THE 15 REINSTATEMENT OF AN INTERLOCAL 1 1 6 AGREEMENT BETWEEN THE CITY OF BOYNTON 7 BEACH AND PALM BEACH COUNTY TO RECEIVE 8 FUNDING TO SUPPORT THE YOUTH 0 EMPOWERMENT CENTER; EXTENDING THE TERM 1 p TO SEPTEMBER 30, 2012; INCREASING FUNDING 11 RECEIVED FROM 571,352 TO $91,352; AUTHORIZING 1 THE INTERIM CITY MANAGER TO EXECUTE 13 AGREEMENTS ASSOCIATED WITH THIS 14 REINSTATEMENT; AND PROVIDING AN 16 EFFECTIVE DATE. 164 17' 18 WHEREAS, in 2010, the Palm Beach County Criminal Justice Commission was 19 awarded a $324,901 Youth Gang Prevention and Intervention Grant through the U.S. 20 Department of Justice for an eighteen month period to enhance the County's existing 211, community -based comprehensive anti -gang strategy; and 22 WHEREAS, due to the length of time it took for the U.S. Department of Justice and 23, County to execute their agreement, the direct service to the youth was delayed 24 { !, approximately six (6) months; and 25 I WHEREAS, the County requested a six month time extension to continue service to 26 the targeted youth for a full 18 month period which was approved by the US Department of 27 i Justice; and 28 i WHEREAS, the City Commission of the City of Boynton Beach upon 29 I recommendation of staff, deems it to be in the best interest of the citizens of the City of 30 j Boynton Beach to approve the reinstatement of the Interlocal Agreement with Palm Beach 31 County to receive funding to support the Youth Empowerment Center, approve the Document in Windows Internet Explorer * Scrivener's error 1 extension of the term of the agreement to September 20, 2012 and to increase the funding 2 received to $91,352. 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF ,4 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. 8 Section 2. The City Commission does hereby approve the reinstatement of the 9i Interlocal Agreement with Palm Beach County to receive funding to support the Youth 1 0 1 Empowerment Center, a copy of the Interlocal Agreement is attached hereto as Exhibit "A ". 11 Section 3. The City Commission hereby approves the extension of the term of 12 the Agreement to September 30, 2012 and approves an increase in funding to $91,352. 13 Section 4. The Interim City Manager is authorized to execute the necessary 14 agreements associated with this reinstatement. { 15, ! Section 5. Prainito, MMC (- pocument in Windows Internet Explorer This Interlocal Agreement dated AUG 14 2012 reinstates the Interlocal Agreements of April 6, 2010 (R2010 -0531) and March 1, 2011 (R2011 -0324) (collectively "Original Agreements "), by and between the Board of County Commissioners, Palm Beach County, a political subdivision of the State of Florida (herein referred to as the COUNTY), and the City of Boynton Beach, a municipality located in Palm Beach County, Florida (herein referred to as the CITY), each one constituting a public agency as defined in Part 1 of Chapter 163, Florida Statutes. ITESSETH: WHEREAS, Section 163.01 of the Florida Statutes, known as the Florida Interlocal Cooperation Act of 1969, authorizes local governmental units to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will harmonize geographic, economic, population and other factors influencing the needs and development of local communities; and WHEREAS, Part I of Chapter 163 of the Florida Statutes permits public agencies as defined therein to enter into Interlocal Agreements with each other to exercise jointly any power, privilege, or authority which such agencies share in common and which each might exercise separately; and WHEREAS, the Criminal Justice Commission, upon direction from the Board of County Commissioners, continues the development of a Youth Violence Prevention Project which addresses the increase in violent firearms crimes; and WHEREAS, the COUNTY agreed to reimburse the CITY for expenses from a Department of Justice grant up to the amount of $71,352 as referenced in (R2011 -0324) from October 1, 2010 through March 31, 2012 for the Youth Violence Prevention Project and the CITY did not expend all funds prior to March 31, 2012; and WHEREAS, the COUNTY awarded the CITY a BYRNE (FDLE) grant of up to $279,900 (as referenced in R2010 -0531 as amended) for the Youth Violence Prevention Project and now wishes to add up to an additional $11,902; and WHEREAS, the parties mutually desire to reinstate the terms of the Original Agreements and extend the date of each to September 30, 2012; and NOW THEREFORE, in consideration of the mutual representations, terms, and covenants hereinafter set forth, the parties hereby agree as follows: :IL 4 9 3 4J I� .4 i.�W � \.I ! �`ri 1. The Original Agreements R2010 -0531 and R2011 -0324 are reinstated in their entirety. 2. The effective date of the Original Agreements shall be extended until September 30, 2012. 3. An amount of up to $11,902 BYRNE (FDLE) funding (R2010 -0531) shall be added to the underlying grant amount to be used for youth interest -based programming. All other provisions of said Original Agreements are hereby confirmed, and except as provided herein, are not otherwise altered or amended and shall remain in full force and effect. 2 In accordance with Palm Beach County Code, Chapter 2, Article III, Section 2.51, this Agreement shall not take effect until executed by the CITY and the COUNTY. This Agreement represents the entire understanding between the parties, and supersedes all other negotiations, representations, or agreement, written or oral, relating to this Agreement.
